Sadly, judges' decisions don't always reflect what is best for the children because parties haven't presented the information the judge needs to make the RIGHT decision. Hey there, I have a question. I live in California and I recently had my divorce finalized. I was also awarded sole legal and physical custody as a father. Im also awaiting my next court date for a contested hearing for a restraining order. During the last court hearing for the contested restraining order, the judge ordered us to go to tier 3 mediation. Why? Can the judge change their mind on a custody order that was already granted? The visitation order is reasonable visits so do you suppose that the mediation is simply for better visitation orders? I'm confused. I look forward to your reply.
I have 3 son's. My oldest sons father took me to court and won exactly one week after our sons 7th birthday. He literally took me to court because I rejected him. I left him in March of 2018. Few months later I started seeing someone I had grown up with and ended up getting pregnant by June 2018. I gave birth to my second son March 19th 2019. February 2020 my oldest sons father sent me a message saying that I should go back to him and let him adopt my middle son... He also stated that it would be him taking me back and not me taking him back. After I responded how I felt about that he flipped out on me and said he was going to take him away from me that he didn't want our son to have anything to do with me or my family. He used the living situation in which he had put me in on purpose making it so that I didn't have any other choice where I would have to go with our son when he was 3. He abandoned us when we had our own place. I had to go stay with my mom and not long after my brother and his teenage son at the time ended up getting evicted from his house and had nowhere else to go also him and my nephew were both very abusive towards me and my mom and my kids but nobody would help me get them out of the house. I had called the police many times but my mom kept letting them back inside. They both also had drugs and drinking addictions. He used all of that agents me to win placement. I feel that the court and the guardian ad litem and my sons father have violated my rights as his mother on many levels. My oldest son is almost 11 year old now and it has only been getting harder. My son tells me he hates me and wishes I was dead. I know he is suffering mentally and emotionally and his father thinks there's nothing wrong. He constantly puts me down. There are plenty of domestic violence records from the 6 years that I was with him. I kept every bit of paperwork every time someone called the cops on him. I also never deleted any of our messages from 2012-now. I live on my own my two youngest kids and I am supposed to have my oldest weekends during school and weekdays during the summer but his father keeps keeping him from me. I've tried so hard trying to talk to family, friends even strangers about everything. I've tried finding legal help from the very beginning. I live on low income housing. I've been on my own for a little over a year now and been struggling to get someone to actually listen to me and help me get my son back. I can't afford to pay for a lawyer. My son needs therapy but his father won't take him. He needs to be with me. He should have never been given placement in the first place. I just wish someone who knows what I know would find me and help me make this hard life right for my kids. Nobody besides me seems to worry or care how everything my oldest son's father has done how badly all 3 of my kids have been affected by his fathers actions.

So I served My ex's father with a DVTRO for attacking me at our sons school family function, on school grounds, on my parenting time. Two days after he was served she files and serves me with one. We go to prelim trial for the one I filed, she's a witness in that one and makes a statement and starts talking about the other case where she filed on me at the hearing where I filed on her dad. Basically incriminating herself. Also now the DA will not support me with anything because I'm stuck in the middle. In one I'm the Petitioner(which actually happened) and the other I am the Respondent(FALSE accusations), and the court is so backed up, the continued it until November 19th, so the stay away order is in affect until ruling on that day. I can not see my poor son for 5 months. I have submitted my response and formal written objection, the judge acknowledged it but didn't say if it was sustained or overruled and said, "To err on the side of caution" she's going to set it for trial. That does not meet qualifications of Preponderance of evidence or Burden of proof nor Prima Facia. I will file a motion to dissolve the case soon.
The judges get paid a percentage of every dollar of child support paid. So, they are incentivized to ignore PAS when it's operating in the custodial parent. Think. Greed. This is illegal. I just ordered the transcript of My wife who went into ex Parte to get a DVPO. With a bizarre story and no evidence. The commissioner told her it wasn’t enough for a dvpo and that is was a week petition. The judge then went on to coach my wife, allowed her to fabricate her story in the court room and then hand wrote the statement for her but in her own words. When she was satisfied, she said ok now I will grant you a DVPO. Is that legal?
I am trying to obtain custody of my grandson who's mother passed away recently and my son, (Grandson's Father) is no where to be found. How do I file a Witness and Exhibit list to all parties involved, GAL, DCS and the Judge? If the children are telling me how they have been coached or how the ex and her current boyfriend are fist fighting. How do I prove that in court with out the children out right saying it.

Isn’t the custody order itself already an enforceable document that states they have to let the parent see the child in itself?? Us men get sucked dry by the courts just to have a custody agreement that we’ve spent thousands on enforced then some have to spend more money filing these contempt motions just for the mother to get a slap on the wrist.. it’s so sad
Our judge did not let us speak, or present our evidence that we submitted per the judges rule of weeks prior, but rewarded the exhusband with 50 percent custody without any evidence presented to change the prior divorce decree. (The exhusband emptied the bank accounts and left the pregnant mother and oldest child with 1 week rent left on the apartment). The judge only allowed the court appointed therapist/exhusband to speak who is a family friend of the exhusbands family. He was already jailed for failure to pay child support. He also failed to show and drop off the children within the court ordered dates and left the state with the children without permission or notification to the mother whom had sole custody. Furthermore, the incumbent judge, (won the upcoming election), was the exhusbands lawyer who is also a family friend to the exhusband, brought only a water bottle to court. The evidence of child abuse, harassment, non support via monetary and visitation, by the exhusband was never brought out in court. Furthermore, the court reporter has yet to provide a transcript of how the session went. Insider jobs is the judicial system at this point find yourself a lawyer who is guaranteed to win the next election or friends with the sitting judges. Evidence, logic, written law, previous cases, and what is best for the children no longer apply the law is what the judges and their lawyer friends make it. Giant huge farce to make them money.
Hi Wendy , my sons mother told the Judge that she never did hard drugs and never smoked weed, but then when she talked to the court order attorney she told them that she used to use only around me , now I have it on paper , how would I use this .
Wants about " Status Quo" in these situations I'm a father and had Temporary custody of my son since Sept 2023 when my ex had mental breakdown .She is now back at home since Jan doing supervised visits with our daughter looking to do overnights by next hearing By the time we get to final hearing it will be September 2024 will they really move daughter back to hers after all this time if I can meet all the needs?
