We want to help as many people as possible, but for us to be able to assist in a Lemon Law or breach of warranty claim the vehicle must have an unreasonable repair history (typically at leas 3 repairs for the same substantial defect or 25 or more days out of service for warranty repairs) for repairs covered by the original manufacturer's warranty. That is the standards set by statutes and courts.
Unfortunately the Lemon Law and breach or warranty laws typically do not apply unless the original manufacturer's warranty is still in effect and there is an unreasonable repair history under warranty.
What if your past the Mercedes warranty but had the problem first under warranty and purchased an extended warranty and it just happened for the 4th time. They had my car 49 days on the 3rd time under Mercedes warranty
There would need to be at least 3 repairs for the same substantial problem or 30 days out of service under the original manufacturer's warranty. Extended warranties do not have the reasonableness requirements under the law of manufacturer warranties. State and Federal Lemon Laws are manufacturer warranty enforcement statutes. Hope that helps!
Are you a lawyer?then,at least as someone debating the law, I hope you show basic courtesy. And do you know how the Lemon Law, which is now half a month old in 2024, will change, and the current Lemon Law, which is changing little by little for each car company and the other Lemon Law for electric vehicles, leased cars, and used cars? Please learn more about the current lemon law and basic etiquette and advertise on RU-vid.
The loan is still in effect. In a cash and keep resolution you receive a check as compensation for your vehicle's defect and repair history. You are then free to use the check to help you trade out or whatever else you want, but you are still responsible for the loan on the vehicle.
I’ve got a Ford Eco sport motor knocking undriveable since mid January of 24 Ford has a recall on this car 1.0 liter turbo engine rubber oil pump drive belt going into hot engine oil comes apart clogging up oil pump intake no oil pressure Ford says unable to get parts I have already bought another car but need to get out from under this one still making payments how do I proceed
Unfurtunally attorneys like you!!! Talk good game but at the end of the day you guys are also part of the issue they see you everyday (manufacturers reps) so now you guys have become friends and most of the time are looking for a career advancement, you will likely love to be seen (from the powers that be) as a good help for your career advancement and personal interests. Lots of us rather be screwed by just the dealer/manufacturer and not be double screwed by attorneys as well that all they are looking for is for their career advancement and in the future to be offered an advisory position.
We have helped thousands of consumers get compensated over the years with a 95% out-of-court settlement rate so the attorneys you're referring to are not us.
I bought a car about 10 days ago with only 43k miles and it already has had 3 check engine lights just wondering do the damages have to be major or can it be any 3 problems
@@5.0twoSLOW 3 substantial problems (if they are the same) are usually sufficient to qualify if the repairs are under the original manufacturer's warranty. Lemon Laws are warranty enforcement statutes. You should definitely request copies of your repair records.
They have to be major but I consider the engine to be major. The repairs also have to be covered under the original manufacturer's warranty for state or federal lemon laws to apply.
Nice video! To be honest people hate the look of the law guy infront of the golf course/lake and will tend to not listen. A prospective at your desk or in public would be a nice look.
Hi, Good video. In my case: 1) There was 3 attempts to repair this vehicle (that was purchased new). 2) A Lemon Law claim was sent to the manufacturer notifying them that the Lemon Law allows a FINAL (4th) attempt to fix the car within 7 days. 3) The FINAL attempt has not fixed the car so far, but the dealer has gone beyond the 7 allowed days and supposedly is continuing to try things (ie: replacing parts); the dealer acknowledges the issue but can't find the source. I don't have confidence that this issue will be fixed or won't come back again (after Lemon Law runs out) . At this point, should we ask the dealer to give us the car back, put it in our driveway, and wait for the Lemon Law case to proceed? Or should we let the dealer continue making attempts to fix it. The manufacturer is proceeding with the case and said that they take about 60 days. Thanks
Neither can do anything about it, do or do not tell them. It will make know difference in the end, if you do in fact intend to pursue a lemon with an atty.
Hello, I’m in California and going to start documenting on my new vehicle. 2022 Silverado with electrical problems. Do you recommend a lawyer in San Diego California?
What about arbitration? With my manufacture it states that to do arbitration first but I contacted a few attorneys, one told me I do not have enough at this point but to keep bringing the car in, then another attorney stated I have enough for them to file a claim. I am not sure what to do at this point.
yeah but in ordre to get a buyback or your attorney fees under mag moss and state lemon lemon statues you have to go thru the process. how are getting your clients thru it efficiently?
YES - NO WAY - SORRY - YOU WANT TO WIN A LEMON LAW CASE !! THIS IS HOW I DID IT AND THIS IS HOW ITS DONE ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-EODew6J6AcA.html
These companies sell useless broken vehicles that cost the average consumer thousands of dollars. There's little recourse to be had. None of them care about the consumer. And they usually get away with it. I don't know why people even buy from a dealer when they're just going to end up paying the price. It's all a huge scam. All dealers are scams. They are not legitimate businesses.
Great video! I will be contacting you soon, you literally described my exact circumstance. I’ve had engine work, strut assembly work done wrong 2 times and currently in the shop replacing the transmission. I’m getting all my records together now I’ll be in contact within a week. SO GLADE I CAME ACROSS YOUR VIDEO!!
I have a 2009 Mercedes ML , it's been for more than 30 days at the dealer for emission modification for which there's a recall but now that they put all the new parts the car is refusing to start and they can't seem to figure it out, sometimes they don't even answer the phone for 5 days. I understand that's an used car but what would the solution be in this case, just leave the car at the dealership forever??? Since it doesn't fall under lemon law because it's old
I would think that since they put the parts that are causing the car not to start, they need to fix it. Or put the car back to how it was. You brought it in running and operating correctly. I assume.
@@bunzaroo yes running perfectly it was just for the emissions upgrade since they issued a recall... Still today they haven't fixed it, but at least I got a courtesy car from them finally
I need an attorney! One group wants my case but I’m not sure about them. I live here in AZ but bought the car in Cali. I have a very strong case and Nissan is reconsidering buying it back because my new car keeps breaking down. Never buy a new Nissan!
I have a question, if had my roof repaired 3 different times since the A pillar keeps leaking. I haven’t even owned the car for longer than an month. I’m going to contact since I thought it was fixed but it started to rain and I can see a wet spot starting to grow again. The dealership people are super nice and friendly. Just don’t feel like paying 40k for a car to grow mold in and worse to possibly have electrical issues.
Currently trying to find info on my vehicle and came across this vid.. my brand new yukon denali blew the motor traveling down a major interstate approximately 400 miles away from home (luckily my family is safe could have been really bad).. GM towed the vehicle 4 miles to the nearest dealership and was told on the initial check in that will need a new motor and it wont be replaced for 4 months due to availability for the motor.. do i have a case here? Car was 91k dollars they want to give me trade in value of 70k "due to current state and time for repairs" if i chose to move into a new vehicle.. i feel like im getting the run around here.. 800 for a rental out of pocket and approximately 2k to get the vehicle towed to my home dealership.. i have no idea what to do to not lose loads of money in my situation, any help or advice would be much appreciated
The car has to be under factory warranty. So if you buy a used car with 6,000 miles and it’s still under the factory warranty the lemon law applies. This does not include used cars with extended or other warranties not from the factory.
They never put heated seats or heated steering wheel and warranty expired. They told me they would inform me when they got them Soni can take it in but they never did. Do I have a case
Need help asap So I found a truck at a used car lot and it was $9995. I don’t have the best credit so I asked the salesman what would be the best way to go about this if I wanted to purchase his car he asked his boss and the boss says if you get $4000 down we can finance the vehicle so a couple weeks go by and I bring in $4000. I sign all the paperwork and they said they don’t have any finance yet but shouldn’t be a problem with the $4000 down so I signed the contract and nothing happens a week goes by and they give me a call and asked me about my insurance information and said OK great so about three weeks go by and I haven’t received any paperwork from the finance institute or the dealership stating that they’ve got me financing so I sit there and wait another few months go by and still nothing so basically the dealership didn’t give me finance and they have the title of the vehicle still I there name ! None of my phone numbers haven’t changed my address hasn’t changed and nothing changed and it’s been about a year and a half now I’ve registered the vehicle twice because I had to get my handicap plates on there and also pay for registration now it’s been about a year and a half still and I want to trade the vehicle in but their name of the dealership is still on the title. Well I called Dealwrship and told them that I need to get the title and they said that thee mgr wasn’t in but please bring the vehicle and so they can confirm it and it sounded kind of shady so before I bring the vehicle and I wanna get someone’s advice on this because I did everything I was supposed to do I didn’t receive any literature or MIL via finance Institute of phone calls and don’t you think the vehicle been Repo if I didn’t pay the finance company, so I’m not sure what to do with the legal restrains are and I don’t want to drive in his dealership in heaven say or we only vehicle when I get my money or anything like that what should I do I do again they said they only get financing and it looks like they never did my theory is they took the vehicle in for about 3500 bucks and then get in the 4000 in cash and let it be a swipe but now that I’ve called him I’m kind of worried about it
I bouht a 2023 Acura Tlx type S and after owning the car for only 2 months the navigation system went blank. They fixed the problem. Then a new issue came out after a month the steering wheel makes a loud humming noise during start up when you put the car on reverse and steer the wheel to left and right. They changed a cable wire the noise was fixed only for 2 weeks and came back louder. It's in the dealership right now for repair and they told me me that they put lubrication to the problem thtat making noise . My mistaked was I told the service advisor that I think my car is a Lempn and I even asked him how can a file a claim. Lol😂 . but he told me previously they had a customer who has issues with his new car but they cannot fixed and bought the car back and gave the customer a new one. I'm from California I'm not sure what the Lemon law here but what the adviso rtold me if they can't fixed the problemi in 2 attemps the third time it happens again they will buy it back or give a new car. But as you said it migh change there mind .if they know what planning to do. Please advise. Thank you in advance for your reply.
