Why You Should Never Threaten a Lemon Law Claim or an Attorney if You Have a "Lemon" Vehicle

If you bought a new “Lemon” vehicle and are experiencing too many defect problems you might be wondering, “Should I Threaten to bring a Lemon Law Claim or to Hire an Attorney in order to get my vehicle Reacquired or to be Compensated?”
The short answer is, No! You should never, ever threaten to bring an Arizona Lemon Law claim or that you're hiring a Lemon Law attorney.
Here’s why. After dealing with numerous or repeated repair problems, most people reach a tipping point of being fed-up. If the dealer or manufacturer is unwilling to assist with getting you out of your Lemon vehicle, your first instinct may be to threaten to pursue a Lemon Law case or to hire an attorney. There are several reasons why you should NEVER do that:
1) Being a likeable claimant is important in Lemon law claims and being rude or making threats will actually hurt your ability to get you out of this problem.
2) Even if your vehicle has been in the repair shop a long time and/or numerous times, you will need a complete repair history and all of your vehicle repair records to pursue a Lemon Law claim. If you threaten an attorney or a Lemon Law claim, the dealer will go into defense-mode and could alter the records and minimize the repair issues or fail to document some of the problems.
3) Some typical ways they do this include: claiming that repairs were done for “goodwill” or not covered under warranty; claiming that the issues complained about “could not be duplicated”, there was “no problem found”, or the vehicle was “operating as designed”; or admitting there is an issue, but blaming you for it. All this greatly complicates proving a Lemon Law case as a he-said/she-said situation is much more challenging to prove compared to having repair records where the vehicle issues are well documented and admitted. Repair records are the number-one piece of evidence in Lemon Law cases and you don’t want the records tampered with before they are given to you.
4) Similarly, if you make threats to the actual manufacturer, they could flag your vehicle in their internal system, which may result in the same shenanigans with repair records or difficulty obtaining repairs.
The best course of action is to bite your tongue no matter how aggravated or upset you are with the situation and make sure you have complete records of everything that was done to diagnose and repair your vehicle under warranty.
Then you will have the ammunition you need to pursue a Lemon Law claim for a Refund or Repurchase, or a breach of warranty claim for Cash Compensation.
Don’t get mad, get even!

As Yoda said - do or do not Never threaten, find good legal advice and file the lawsuit - never let the dealer, manufacture, repair-shop know what is going to happen, let your lawyer and the courts do that for you!

Good informative video. I have a quick real life story for your "Lemon Law". I took a friend to a well known (Illinois) dealership to finalize his purchase of a used vehicle. He called ahead and when we got there, they had the vehicle in their repair bay. They said they were doing a final check on the vehicle. Papers were signed, They pulled the car out of the repair bay, parking it, engine off, at the side door where we were waiting. My friend got in, started the car, and I got in mine. He moved the car about 12 feet to the exit where the car engine quit. My friend attempted to start the engine but it failed to catch. The dealership claimed it was his fault, that he HAD to have done something. At first the dealership wouldn't do anything saying it wasn't their problem. That's when I threatened the Lemon Law! That the car hadn't even gotten off their lot! That seemed to light a fire under their - butts. They got very nice and pretty much kissed both of our butts after that. So, in this case, threatening the Lemon Law did help - outside of Arizona at least.

I have a 04 and 14 and i can not pay enough to get mechanics to fix my cars right and keep them running sooooo I went and bought my own tools and a scanner now I can track down my own mechanical problems and I have saved a lot of money doing it and most things are simple

I had a 2013 Altima V6 with technology package that had a slightly slipping auto transmission. Car purchased in early September 2013. Nissan bought it back full price under California lemon law in June 2014.

Keep all the records. Hand write any additional notes in a spiral bound notebook. If your state allows audio recordings use them when you can. Stay polite don't scream, don't use foul language. My Dad, with nothing more than the records, did not threaten the dealer. He contacted the manufacturer directly and received a full refund - no lawyer.

We had odyssey touring 2023 on May 14 in one month the transmission problems the honda dealership doesn't care they refused to give us while the car is in service after they resetting the car after we picked up in 24 hours it happened in Tow weeks now it is in service we don't have a car very bad dealership I will never advance to buy from them I don't feel safe driving with my kids I want return it it has 800 miles

What if the car is used, but still under the original manufacturer’s warranty? Who do you sue? The dealership you purchased from or the manufacturer?

Yes you’re right. I just dropped off my car to dealer on Monday. They was found my 2020 Honda odyssey have a Malfunction VSA code and written down on the paperwork and verbally told to talk to honda because the transmission needed to replace But Honda have parts shortage issues and the transmission was made by European company. I should need to wait for months. Due to this was a 4th times to visit the honda dealer in past two years. At the same day, my lemon Law attorney told me to ask for buy back due to the issue. And I did. But on the next day American Honda’s technicians refused the dealership’s technical request and they said the dealerships must been duplicate and recorded the issue before repair. Today, the dealership’s service manager told me that due to their technicians unable to duplicate the issue, I could pickup my car or leave the vehicle for them because they will let the technician to drive my car home 150 miles a day and everyday with a computer connected to my odyssey until the issue is able to duplicate. If you don’t want to wait please call American Honda and ask for a goodwill. Due to my car already over 37000miles the dealership and American Honda refuse to give me a rental car. I need to pay for it. The dealer stepped back and told me different story. And they told me the malfunction was wrong. I asked for buy back too early. I feel sad because too late to see your video.

Are you a lawyer?then,at least as someone debating the law, I hope you show basic courtesy. And do you know how the Lemon Law, which is now half a month old in 2024, will change, and the current Lemon Law, which is changing little by little for each car company and the other Lemon Law for electric vehicles, leased cars, and used cars? If you want something done and done right you better do it yourself because mechanics will keep you coming back over and over again at a price on RU-vid they show you how to fix every thing. I found out how to put a timer on a washing machine and then bought one and put it on cost 75 dollars for a timer or 700 dollars for a new washing machine

Speak softly and carry a big stick. I have found that making legal claims, no matter how valid, pro se, simply tells the other party "I am very concerned about legal fees". You need to send the message "I can afford a lawyer and will spend ten times what you own me just to make you pay". Once they see you have paid an attorney (be sure not to use one with the same last name as you) to fire the opening salvo they will know you are not just shooting with blanks.

Long shot but I own a 2016 Hyundai Elantra. Purchased it from a dealer in Illinois and have taken my car to that dealer for all repairs pertaining to my transmission. I have been covered under warranty and thankfully haven’t had to pay anything out of pocket but tomorrow will be the 3rd time taking my car in for transmission issues. When do I have a case around this? I don’t feel safe driving long distance anymore and it’s frustrating.

You may have a possible breach of warranty claim under the Magnuson-Moss Warranty Act. We don't practice in Illinois so I suggest doing a Google search for an Illinois Firm that has the best reviews and that you feel the most comfortable with.

Does Lemon law in Arkansas cover ATV’s? I bought a 2021 Honda Rancher that is electric shift. So far it has 130 miles and 18 hours on it. Since my first time riding it the ATV will randomly not go into gear. It has been at the dealership twice, but the previous time they said it was fixed and would not go into gear while trying to pull it out of the shop. It only had a 1 year warranty that is up but I purchased the extended.

Per the Arkansas attorney general the Arkansas’s Lemon Law does not cover mopeds, motorcycles, the living quarters of motor homes or most vehicles weighing more than 13,000 pounds. So it appears that your ATV is probably not covered by the State Lemon Law. However, there is also a federal Lemon Law called The Magnuson-Moss Warranty Act that may apply. I suggest looking into that.

FL law is 3 repairs within 24 months. I'm going in for my 6th time today l within 24 months for a suspension issue that's not resolved for a 2021 Toyota camry that I leased in June 2021. I don't know what else to do other than get another car due to the defects. Update finished arbitration and they're buying my car

I'm glad to hear you got a buyback. Unfortunately most companies do not accept responsibility like they did in your case without a lawyer being involved. Also, it is helpful to have a lawyer to make sure that you get all of the compensation you're entitled to under the law.

What about arbitration? With my manufacture it states that to do arbitration first but I contacted a few attorneys, one told me I do not have enough at this point but to keep bringing the car in, then another attorney stated I have enough for them to file a claim. I am not sure what to do at this point.

You can typically seek help from an attorney prior to looking at arbitration to see if your case can be resolved without it.

I bouht a 2023 Acura Tlx type S and after owning the car for only 2 months the navigation system went blank. They fixed the problem. Then a new issue came out after a month the steering wheel makes a loud humming noise during start up when you put the car on reverse and steer the wheel to left and right. They changed a cable wire the noise was fixed only for 2 weeks and came back louder. It's in the dealership right now for repair and they told me me that they put lubrication to the problem thtat making noise . My mistaked was I told the service advisor that I think my car is a Lempn and I even asked him how can a file a claim. Lol😂 . but he told me previously they had a customer who has issues with his new car but they cannot fixed and bought the car back and gave the customer a new one. I'm from California I'm not sure what the Lemon law here but what the adviso rtold me if they can't fixed the problemi in 2 attemps the third time it happens again they will buy it back or give a new car. But as you said it migh change there mind .if they know what planning to do. Please advise. Thank you in advance for your reply.

Trading out of or selling the vehicle is still an option if you settle a Lemon Law or breach of warranty claim for cash compensation, although I would still recommend doing your best to get the vehicle repaired prior to trading out. That way you are at least compensated for your inconvenience and for overpaying for the product.

If the repairs have been under the manufacturer's warranty you may have a valid breach of warranty claim. I recommend conferring with a Lemon Law attorney who has good (real) reviews. Most provide free evaluations.

Yes. Many State Lemon Laws apply to leased vehicles but even the ones that don't have the federal Magnuson-Moss Warranty Act as a backup.

But what if you just bought a vehicle on Monday, find an issue on Tuesday take it in Thursday and they keep it for over 2 weeks making repairs. And then try to charge you a portion of the repair cost.

Right!!!!! I bought a used truck 4 weeks ago yesterday. That was a Monday. Tuesday I told them it’s shifting hard. Took it back Thursday. Got brand new 2021 loaner, which I appreciate, but it’ll be 4 weeks this Thursday and they still have my truck. On the plus side they’re not charging me, but I got a truck for a reason. Need it for work and other personal stuff.

@@TrollinOn22s it’ll be 6 weeks tomorrow. I’ve had a loaner the entire time and now they’re not charging me for the repairs. Clock spring and rear differential. The differential is what’s taking so long it’s on backorder and they don’t know when they’ll get it.

in FL you need to submit a 15 day right to repair notice, meaning after 15 days out of service. you must notify the manufacturer that they need to repair in 15 days.

The vehicle had the lights on vehicle came on for the transmission. dealership. 36,000 miles or 3 yrs . Its the transmission. I do not have the car. Its been a week. They said it started as soon as signed the papers and matter of fact the lights turned out on the dash at their front door

Thing is, they charge usage and mileage. You may get about a third back of what you paid. You "did" use the car so. Sucks, but thats what we went through on a 2012 Focus (known transmission probs that Ford hid). Luckily we got a ton back because of a very large down, and transmission replacements at 500 1200 2700 and 4000 miles.

Currently trying to find info on my vehicle and came across this vid.. my brand new yukon denali blew the motor traveling down a major interstate approximately 400 miles away from home (luckily my family is safe could have been really bad).. GM towed the vehicle 4 miles to the nearest dealership and was told on the initial check in that will need a new motor and it wont be replaced for 4 months due to availability for the motor.. do i have a case here? Car was 91k dollars they want to give me trade in value of 70k "due to current state and time for repairs" if i chose to move into a new vehicle.. i feel like im getting the run around here.. 800 for a rental out of pocket and approximately 2k to get the vehicle towed to my home dealership.. i have no idea what to do to not lose loads of money in my situation, any help or advice would be much appreciated

You might be able to sue if you know who did it, but the Lemon Law only applies to vehicle manufacturer defects.

@@5.0twoSLOW 3 substantial problems (if they are the same) are usually sufficient to qualify if the repairs are under the original manufacturer's warranty. Lemon Laws are warranty enforcement statutes. You should definitely request copies of your repair records.

You have the right to fire your attorney. The thing to look out for is language in your representation agreement stating ways you could be charged if you end the representation.

So, none of those items listed in the description are true. Or at least, it totally depends on the state you start the lemon law process in. For example, I'm going through the lemon law process in Washington State. It doesn't matter which repairs were done or not done, all that matters is that the dealership/manufacturer took longer than 30 days to fix a problem. If it took more than 30 days then it qualifies as a lemon. The dealership can falsify all the documents they want, can say they fixed or didn't fix whatever they want and it has no bearing on whether the vehicle qualifies for the lemon law. The law is very clear on what qualifies for a lemon and what the manufacturer needs to do in that case.

You are technically correct as far as what qualifies under the Lemon Law. The challenge is that dealers and manufacturer reps can lie. The consumer has the burden of proof so tie goes to them if the arbitrator, judge, or jury doesn't know who to believe. We are dealing in probabilities so you could still technically win without the records properly documenting what happened, but you have a much better chance of prevailing with confirmed and documented defect warranty repairs.

@@amarlawgroup9163 Again, at least for the state I'm in (WA State), it doesn't matter what service records exist aside from checking the vehicle into service. If 30 days pass, no matter what the dealership/service does or does not do, the vehicle then qualifies for the lemon-law. The dealership could write they didn't even look at the vehicle to diagnose anything during those 30 days and it would still qualify for lemon-law, simply because the vehicle was dropped off for diagnoses and/or repair and stayed there for more than 30 days. Even if the dealership lie, it won't matter. If the there's a record of the vehicle being dropped off with complaints, and nothing is done within 30 days, it qualifies. There's no burden of proof other than proving you checked in your vehicle at service.

You don't trigger the lemon law until a certain number of failed repair attempts and/or time out of service.

I was scared when I started to watch this video because just 15 days ago we (attorney and I) sent the demand letter to the dealer because of Rollback and Lemon law, but I have all my records that the gave to meb(with date, etc) and all evidence for all claims that we made I am pretty sure that I have 100% evidence in documents and documents signed by them as a evidence so I think I will be okay, it been 15 days since we sent it, and they haven't answer, 15 more days to go and see what's go on with the case thanks for the video sir.

What if my vehicle has only 2000 miles total and the manufacturer keeps sending defective replacement parts to the dealership? Today is 3 weeks now without my truck (RAM 3500 6.7Turbo Diesel Cab Chassis). I'm in Colorado, truck is 100 miles away in Durango.

I have a 2019 with 32801 miles in shop in a different state been in numerous times. Dealer that it’s at is having to wait 3 months for a transmission to be delivered from ford . I’m from Texas car is in Ga they only paid for 10 day rental. I have 60 month 100000 mile warranty. It had hoses for transmission tighten back up at 30000 miles which that dealer charged me out of pocket and ford because at 17800 miles the dealership didn’t put motor back together when they replaced motor. Don’t buy ford they can’t make a solid product and they don’t care about customers. They are also deleting service records

If the vehicle is still under the original manufacturer's warranty then the federal Lemon Law called The Magnuson-Moss Warranty Act would apply.

Lemon laws don't cover breakdowns. Only cover if not repaired under warranty within a certain number of attempts.

No they cannot at all. There is no limit on how long you need to own the vehicle in order to get the tax credit, as long as you have enough tax liability to cover the amount you got back. The manufacturer and/or dealerships have ZERO say in this. The money comes from the federal government, it should not (and does not) touch the pockets of the manufacturer or dealership.

A Lemon Law is basically a manufacturer's warranty enforcement statute. There are both state and federal Lemon Laws. If a substantial new vehicle defect cannot be repaired within a reasonable number of attempts or time within the warranty period then state and or federal Lemon Laws may be pursued.

I am filing in small claims court on a dealer right now--first time ever.I just do not get why these multimillion dollar companies do not just take a car back or fix it right.They get parts at wholesale which can average a third or a tenth the price of retail--so a 1k repair they charge you and i actually can be fixed for much less--instead almost all of them BS.Even high end cars dealers do this.

How about this one took my car in for repairs got ithere's got a loner car they were too busy to mess with my car had it for over a month told me I had to owe them storage fees Or I could not get my car back so they ended up turning turning loner car that they provided me for each othey provided me free of charge and perstolen to the police and said it was a rental and then kept my car for 2 weeks after that until finally I had the CO signer on the vehicle come get it out for me which they did not charge her any storage fees However they were many many cops show up immediately after we did to pick up my car I was talking with this car company and was in communication within the whole time every day and I have all the phone calls recordedI mentioned a lawyer because this guy was this guy was being just stupid about this loner car and I and I was dealing with the family merge seat at the time with my daughterIn the hospital with potentially life threatening situation going on why this guy is blowing my phone up on up for the 2 days we're in the hospital I need a pebble to leave my daughter in the hospital because I was being threatened for criminal action being taken and turning the car in stolen so I agreed that I would come back to Colorado and return the car upon reach turning to Colorado there is a bad hailstorm so therefore if you make it for that night I was in contact with them and even talked to the owner I wake up in my hotel room the next day at the Marriott and Westminster with police going through my loner car and then taking a Wilder car That's what the workers said at hotel as they gave me my stuff as they were kicking me out because I had please contact supposedlyThe Marriott's policy is a view please contact your band from all Marriott's from then on However Because of covid and my 4 public defenders that failed me this case is still going on and it happened in 2017 the end of 2017 I've tried to get over the car out of bore association I've tried to get ahold of on contingency lawyers big law firms for stuff like this And obviously arguments are public defenders and they failed me I mean I've gotten hold Of Colorado legal services but it just sent me some website for telemarketing type of soliciting for lawyers I'm pretty Educated and have dealt with many family law situations and can represent myself and they're just fine any suggestions or pointers or do process of motions or entries I need to file 1st

There are defenses to a Lemon Law claim when it's a driver's fault e.g., abusing the vehicle, not getting maintenance, or making unauthorized modifications to the vehicle. Some cars are defective Lemons because they were not manufactured properly and can't be repaired within a reasonable opportunity. That is not the driver's fault at all.
