the man on foot was completely at fault- he entered a zone that had a machine doing operations and it was his responsibility to either stay out ofthe way or make contact with the operator of the machine to let it be known where he would be and only after he and the operator are in agreement can he be in the area of operation- he was not simply passing through so he has to respect machines operating inan area also he was clearly not paying attention and all this stuff about the height ofthe bucket- its as low as its going to get before spilling the top of the load
