I wanted to ask how you hedge against an examiner's subjective judgment when you have a nonservice-connected condition that affects METs like obesity. Won't they say obesity is causing the heart failure symptoms and not the 50% & 70% blockages, and the CTO in my RCA? How effective will my log of angina events and nitro be? 3 MI's (1 in service) with stents.

I recently went from 10 percent to 100 percent after getting on a treadmill ( workload test ) and insisting on a cardiac catheterization. I did these two test in order to prove that I have ischemic heart disease related to agent orange. My symptoms were meaningless to the VA until I requested these two test from my cardiologist. Plain and simple. Thank you President Biden to signing The PACT Act

Retired reservist here. I'm at a 30% rating after multiple appeals. Am continuing to file claims to try and get to 50% so i can keep my disability compensation benefit instead of forfeiting it back to the VA. Since a military pension and disability benefits are compensation stream for two separate issues, i do not understand how retirees with a disability rating under 50% can legally be treated differently than retirees with a rating of 50% or greater. This is not equal or fair treatment of military retirees. What is the reasoning and legal basis for making retirees forfeit their disability compensation? Is there any proposed legislation to fix this inequality? If the government can give away our tax dollars to support millions of illegal aliens, it should be able to fully support military retirees that are entitled to receive disability compensation regardless of their disability rating.

I have consulted an attorney have parkinsons from camp lejeune treated by va on carbidopa levadopa about 2 yrs now and va claim has been deferred twice when even c&p said its parkinsons its presumptive and was a favorable c&p how do i get va to stop playing games and assign a rating

I’m retired military and have VA disability. 1 of my primary disabilities is migraines. I get enough on a monthly basis that I had been rated at 50% for migraines alone. But then after a few years I received a letter and it was reduced to 30%. It gave reasoning relating to the “Severe economic inadaptability” because I was still able to work around my migraines. I didn’t know much about the system so assumed that meant I wasn’t supposed to get 50% because I have a job and can work. But recently I spoke with a Vet that informed me that’s inaccurate and I should have fought it but still can. Any idea where I start? I have 5-10 migraines every month for about the last 20 years, documented, I see a neurologist every 6 months, and have a rizatripton prescription. My migraines require I stay home lay down and turn off the lights probably more than 1/2 those times each month. I’m starting to think the VA tried to ge rover on me by reducing me. I did appeal at the time showing nothing in my history had changed from when it was 50% but it was denied. Just doesn’t make sense to me

My combined rating is 80 percent. 10 percent for tinnitus, 40 percent for lower back, 70 percent for PTSD. Do I qualify for. TDIU.

There is one huge error with the testing of heart conditions. I have had heart issues for over 30 years. Started with a widow maker, have had many stents installed over the years, had open heart surgery with 4 bypasses placed, had one bypass fail 2 years ago. (Bypasses eventually fail resulting in more surgery or death.) Each intervention is like patching a leaking tire. A tire with a dozen or so patches on it will never be new again nor healed! After each intervention that I have had, I was sent to cardiac rehab, where you exercise to bring your heart up to a functional level. After that, I can temporarily reach the Mets level that will cause me to fail the disability test, because I was considered "healed". It is NOT healed and always more vulnerable than before, and like a tire with numerous patches, will fail again. I had my latest heart attack in January. If I had taken the test before cardiac rehab, I would have been at the 100% disability level. The Mets test is medically unsound and wrong for the reasons stated. Ignoring the extensive history and medical implications is wrong!! It's only a matter of time before another heart attack and or a bypass failure will take my life! The heart is NOT healed, only patched. Whoever came up with the Mets test, should be fired!

What if you were medically retired TDRL at 40% but eventually got rated 100%? Could you go back and claim CRDP or CRSC after the fact after you have already been discharged? Or is it that if you were separated under TDRL at a sub 50% rating and left with severance pay and VA only, that you basically don’t get any military retired pay at all?

Thank you, you have just discribt me completely! I've not brought myself to file for ptsd. Shame, things that I've gone through in life! & witnessed. I definitely need help. VA, has made me even more stress. For example "c&p exams" they are like a scam: ive brought fiscal evedence with me. It was just ignored. If this is the way you treat your solders after , laying your life on the line for 9 +yrs. ???

A C&P EXAMINER cannot check you out and cannot treated you at all and their decisions could be way off without properly checking you out like ordering a MRI or CT scans and looking at a DBQ that was file from the private Doctor for this reason it's a waste of time and causing the Government Millions of dollars like a VA EXAMINER said if they can't send for any exam it limits they finding .

Got out military 25 years ago. Never went on sick call for sleep problems. Last week got diagnosed at VA hospital for severe obstructive sleep apnea and issues CPAP machine. How can I service connect sleep apnea? Or can I do secondary to mild concussion or to rhinitis??

I have been at 80% for a few years. I just got denied for 100% tdiu/ptsd increase. I made 40000 last year and just found I got denied, but this year it's getting worse, I no longer work at all, caves are falling in on me. I am about to contest this decision. How should I feel about this. Ty.

We who went to combat do not have PTSD. Combat Veterans carry two crosses NO ONE ELSE CARRIES! We who go to combat, FROM THE WEST; Non-Christians DON'T SUFFER PTSD because their religion or government rewards their murders; they don't go to Sunday School where King David is King because GOD REWARDED HIM FOR KILLING GOLIATH and the father of King Solomon -- I don't believe in any religion and didn't go to Sunday School nor Church, but I studied religions: Comparative Mythology. What makes the Combat Veteran Unique is that we MURDERED people and WE SURVIVED. A, what is now known as "first responder, may see many horrible things, and crash and mangled bodies and such like, but the "first responder" is going to someplace to HELP someone. We who go to combat go to put a bullet into someone, kill someone. We are there to save one groups way of life and end the others. Our "job" is one of destruction. The "first responder" didn't cause the crash, the building to fall, the heart attack; "they" get to do good in the eyes of ordinary people but us in uniform are not seen as saviours, we are the destroyers in the eyes of the civilianry. When I came back from Vietnam, all of us were told NEVER TELL ANYONE YOU WERE IN VIETNAM. The VFW REFUSED us entry into their brotherhood of beer drinking old men. THEY DID, but, of course they deny that. The VFW was our grandfathers, Fathers, Uncles, all from World Wars. The VFW saw us all as drug users. Of course, to them, pot was a drug but alcohol wasn't...And now I am not receiving anything from the VA but RESENTMENT AND HARASSMENT. Our VA instillations/hospitals are to be over-run by the ANTI-AMERICAN putz president, Biden has opened the VA to people who NEVER SERVED and their only attachment to the military is THEY HATE US AND OUR WESTERN WAY OF LIFE, for health care; abortions, Genital Harvesting -- or the euphemistic LIE of Sex Change surgery (et al) -- and not to forget those trash people who have crossed our "borders" and now live in five star hotels and get to jump in line before a Veteran at a VA instillation. I don't even have a primary anymore, and no one at my facility knows when I will get one...if anyone else in our world were to have a suicide rate like those of us Veterans, especially if the person or people where illegal, or Black, or ... if anyone BUT Veterans were to have 22 commit suicide EVERYDAY those Biden-ites, who are destroying our peaceful world, there would be a billion dollars given to them and cover them all in cotton. 22 Veterans commit suicide daily, every day, and that means nothing. 24hrs in a day. 22 Veterans put a bullet in their ear in that 24hrs. That means EVERY HOUR AND FIVE-MINUTES, OF EVERYDAY A VETERAN, LIKE ME, PUTS A BULLET IN THEIR EAR BECAUSE THIS COUNTRY AND THESE DEMS HATE ME AND MY BROTHERS-IN-ARMS! I can't find anyone who cares enough to do something. I"ve been without teeth for going on five years because of the lies and road-blocks the VA throws at me. I've been given appointments at the local VA and when I get there either I was suppose to be there an hour earlier -- even though my appointment letter states that I AM ONE TIME, or the front desk doesn't show an appointment for me...the list is long and I have no hope I will ever have a life. AND NO ONE F-ING CARES. THANKS A LOT AMERICA.

Have had a fib since 88 spent 6 months at lejune exposed to toxins in 79-80 for 36 years in and out of emergency rooms cardioversions multiple ablations medications and the va gives me 10% rating for tinnitus? Have to go back for 2 more visits with clinics that va contracts with to establish service connection? Am i missing something here?

I'm a Vietnam Vet with a severe heart condition, triple by-pass and pacemaker....I have my C&P and I found out very quickly that the VA and their Doctor's who give the exams are not our friends. They'll shoot you down in a heartbeat.

Yah I can see that will happen to my case. I’m still using cane cause of my hip’s surgery and knee pain which not services connected. I applied for TDIU for my mental health issues, migraine and IBS. I hope they don’t do that dirty work on me.

Hi I have some questions regarding TDIU. so I spent hours on Reddit on this topic and most opined that you can’t go to school if you are on TDIU since if you are able to go to full time school, you should be able to work. That was their argument and that the VA will terminate your TDIU. I also saw most people saying you can’t get on vr&e if you are on TDIU because TDIU says you are unemployable and Vr&e is assisting you to achieve employment through education or other trainings. So they contradict each other. Some said vr&e reps refused accept the application because somebody was on TDIU. That was their argument. My argument is that I believe if a person with 100% p&t can go to college, anyone should be able to go to school. If you can’t go to college while on TDIU, it implies nobody with let’s say combined disability rating over 80% should be able to go to school because they all do have severe disabilities. Some said you can’t go school if you are 90% disabled because the VA will assume you have improved and Lower your ratings by scheduling c&p exams. Please tell me all of this is false. If you could make a video on this topic, it would be so helpful. I have found nothing on Google on this topic. This is useful for young veterans like me who want to go to school. There is not a single video on this topic on RU-vid as well. Thanks.

If you are TDIU, they had to go through a process that pretty much says you are unemployable. TDIU provides benefits at the 100% disability rate to veterans who are unable to maintain substantially gainful employment due to service-connected disabilities, even if their combined disability rating is less than 100%. -Attending School: Veterans can attend school while receiving TDIU benefits. The VA does not automatically assume that attending school equates to the ability to work. However, the type and intensity of schooling may come under review if it indicates potential employability. -VR&E and TDIU: Usually, VR&E can be used to assist veterans in becoming more independent or potentially preparing for future employment, which might involve removing the TDIU status. While on TDIU, you can apply for VR&E, but there is a risk of re-evaluation if your activities suggest you might be employable. -Requesting Removal of TDIU: You can ask to have the TDIU status removed, and they will re-examine you. Then, you can apply for VR&E with the goal of achieving employment through education or other training. -100% P&T: This is different from TDIU. A 100% P&T rating means a veteran's disabilities are rated at 100% permanently and totally, often due to a combination of disabilities. It does not preclude the veteran from working or attending school. The criteria for TDIU are different and focused explicitly on unemployability. So, in summary, you can attend school and even use VR&E while on TDIU, but if your educational pursuits suggest you might be employable, it could lead to a re-evaluation of your TDIU status. The key is to understand that TDIU is specifically about unemployability, while 100% P&T is about the severity of disabilities. Also as long as you are scheduler 100%,90,50, or whatever you shouldn't ever be told you can't go to school. I worked with many individuals that were 100% P&T or with other ratings, and they also went to school at the same time. I hope that this helps you some. Was diagnose in the military with Sleep apnea in the service had the surgery. Did a sleep study and provide a nexus letter. Still denied. Took it a HlR won waiting on the VA

Hello, when I was 40 I went in for an MRI because of coordination issues. The Neurologist said I had Mild Cerebral Palsy which I obtained at birth. I had no idea when I joined and passed all the medical tests. I have VA benefits will this diagnosis affect them negatively or does the presumption of soundness?

I'm currently at 70% for PTSD. I'm still working at the moment but due to my PTSD I miss work often. I make myself go to work, so I have enough money to pay my bills. How do I go about getting TDIU? Can I file for an increase and maybe use my work history as evidence?

I am rated at 90% disability. I also receive 100% for TDIU. I am 76 yrs. old, and have been getting this for about 3 yrs. Can they because of my age, reduce me back to 90%?
