Finding a tenant is easy aur kafi logo aise bhi hain jo sirf kiraye ki income se apna ghar chalaate hain.
Kafi baar aisa hota hai ki tenant property par kabja kar lete hain aur kiraya bhi nahi dete. Aise bhi case hai jahan kirayedaar kuch saal baad khud ko malik btane lag jate hain. Waise to makaan malik aur kirayedar ke dispute naye nahi hain par lockdown ne puri situation badal ka rakh di hai.
Lockdown ki wajah se kafi logo ki job chali gayi our kafi logo ke salary bhi kam ho gayi hai. Iska sabse bada impact un logo par pada hai jo kiraye ki income par dependent hain.
Kafi logo ne rent dena band kar diya hai, jisme se kuch geniune karano se rent nahi de paa rahe hain aur kafi log salary aane ke bawjood kiraya nahi de rahe hain. Aisa bhi dekhne ko mila hai ki kirayedaar property me apna samaan chhod kar tala laga kar apne ghar chale gaye hain, to jahir hai kiraya bhi nahi de rahe honge.
Genuine wajah se agar koi rent nahi de raha hai to landlord ko baith kar baat karni chahiye kyunki lockdown me hume ek dusre ka sath dene ki jarurat hai.
Lekin agar problem isliye hai tenant jaanbuj kar rent nahi de rahe hain to Aaj hum baat karte hain ki aisi situation me makaan malik ko kya karna chahiye.
Aisa bhi hota hai ki kirayedar kafi time tak na to kiraya dete hain aur nahi property khali karte hain, kuch cases me to ye bhi dekhne ko mila hai ki tenant khud ko malik btane lag jate hain. Sabse badi problem ye hai ki agar aap iski complaint police ko karte hain to police is situation me kuch nahi kar saktii kyunki kanon me aisa koi provision hi nahi hai ki police property kali karwa de ya kiraya dilwa sake.
Agar tenant kiraya nahi de rha hai to ya fir property khali nahi kar rha hai to landlord property khali karwane ke liye ya rent ke liye legal action liya ja sakta hai .
pehle jaan lete hain ki property khali ke kya grounds hain.
• tenant date ke 15 din tak kiraya na de.
• tenant bina permission sublet yani kisi aur ko property mirage par de de.
• Kirayedar koi unlawful activity kar rha ho jaise ki residential property ko illegal tareeke se commercial use karna.
• Tenant ki wajah se property ko loss ho jana.
• landlord has received a complaint from neighbours against the tenant.
• tenant khud ko property ka owner btane lage.
• landlord ko property khud ke use ke liye chahiye.
• landlord property repair karwane chahta ho par tenant ke rehte ye possible na ho.
• Property ko demolish karke nahi building bnane ke liye.
Do tarah ki situation ho sakti hai ek jab ape pass rent agreement hai aur dusri jab ape pass rent agreement nahi hai. Dono situation me legal process almost same hai to ghabrayen nahi.
How to Evict a Tenant in India?
After establishing the grounds for the eviction, the following procedure needs to be followed:
Stage I - Send a Notice to the Tenant to Vacate: The landlord must give a reasonable time to the tenant to vacate the rented property aur aap bkaya rent bhi claim karen . In the majority of cases, the tenants leave the rented premises after receiving a legal notice.
Stage II - File an Eviction Suit: The tenant may refuse to vacate the rented property after receiving the court’s eviction notice and contest the eviction.
Court pura kiraya dene ka order kar sakta hai.
Agar tenant koi illegal kaam kar rha hai to uski complaint police me bhi ki ja sakti hai.
Abhi court band hain to aap apne vakil ke dwara urgent basis par bhi case file kar sakte hain.
Aap is video ko apne family our friends ke bath share kare taki ye jankari unke kaam aa sake.

Sir maine January 2021 me ek flat rent par liya tha. Makan malik na 11 mahine ka notary ka agreement banwaya tha. Makan malik humpar June 2021 se hi dabaw bana raha hai ki flat khali karo jab humne reason pucha to bolta hai ki mera chhota bhai flat me rahne ke liye aayega. june se hi humari aur uski arguments chal rahi hai, agreement pura ho chuka hai humne kaha ki kiraya badha lo aur 11 mahine ka agreement aur badha lo lekin nahi man raha 11 april ka last ultimatum diya hai makan khali karne ka nahi toh court me jane ki dhamki de raha hai. Sir kya koi aisa provision hai ki agreement ko aage badhaya ja sake please help sir 🙏

Mere Friend ke saath ek case hua tha Mera friend ek ko apna floor kiraye me diya tha wo starting me kiraya deta tha lekin fir 9 mahine se kiraya pending tha mere friend ka dimag kharab hua fir wo tenent 10vi mahine apne gaon gaya floor ko tala mar ke mera friend wo tala tod ke uska ek ek saman ko fek diya aur 3-4 items to bech me pure 9 mahine ka kiraya waslool lia aur wo 11 mahine ka agreement ko jala dia aur jab wo kirayedar wapas aya to mera friend usko pehchane se inkar kar dia 😂😂😂 aur ab wo kirayedar police station me chakkar kat rah hai aur uske pass koi saboot bhi bhi nhi hai 😂😂😂

Arbitration clause is a dispute resolution clause in any agreement wherein the parties decide not to go to court for dispute resolution.

Throw tenant out of the house if agreement has expired as there is no right of tenant to occupy the house after the agreement has expired. The owner can disconnect electric and water supply also as no court can issue order for restoring electric and water supply. The tenant himself should vaccate the house in case the agreement has expired.

Agar trust hai to thoda thoda karke rent le lijiye aur trust nahi hai to legal notice issue karke khali karne ke liye bol de.. bkaya rent bhi claim kar le.. naya kirayedaar ayega to rent time se mil jayega

Hi Sir, maine mera shop leave and license agreement pe diya hai. Lekin licensee fees nahi de raha hai. Maine use legal notice bhi bheja hai. To fees ki recovery ke liye kya provision hai? Agar court order agaya aur fir bhi licensee fees na de to licensee par legal action kya ho sakta hai?

Sir mere room me kiraydar rhta hai jiski wife government hospital me job krti hai aur husband security guard ka super wiser hai. Dear Sir, मेरी माता जी की ownership मे एक shop है जिसे हमने November 2019 मे Lease पर दिया था। ठीक 11 महीने बाद हमने Rent Agreement को 2 साल के लिए renew किया था ( जिसे आज 8 महीने हो गए है) लेकिन अब मेरी माता जी अपनी दुकान वापिस चाहती है क्योकि उनको उसे बेच कर अपने लिए एक Secure जीवन चहिए। और tenant ने 3 महीने का किराया भी नहीं दिया है जबकि वो रोज़ दुकान खोलकर अच्छा कमा रहा है। तो क्या हम उस दुकान को खाली करा सकते है agreement expire होने से पहले ??

नमस्कार सर में शुभम गौर मेरा एक छोटा प्रोपर्टी का काम है जो की मैंने 2 साल पहले सुरु किया अभी 6 माह पहले मैने एक लोकल किरायेदार को एक फ्लैट किराये पर दिलाया था जो कि वो अब खाली नही कर रहा में बहोत परेशान हूँ सर हर दिन मुझे मकान मालिक का फ़ोन आता है और हमें रोज फ्लैट खाली कराने को बोलते है पर वो मेरी बात भी नही सुन रहा और 2 माह का किराया भी नही दिया

Hello sir, mene apna ghar rent me diya tha delhi me and me khud rent me raha because office dur tha. Lockdown k time mene kaha aap dhire dhire rent dedo kyuki wo de nahi pa raha tha and parso Raat wo saara saman leke k Raat ko ghar chod kar bhaag gaya and 4 months rent and electricity bill chod gaya. Mere pass uski picture, uski ghadi ki picture , rent agreement, police verification and ek cheque he jo usne aaj ki tarik ko deposit k liye kaha tha and mene kar diya. What shall i do?? Can I trace him now??

Yes any person can be traced.. if you have deposited the cheque, your next course of action is to send a legal notice under section 138 NI act in case the cheque bounces. Then you may file a complaint in criminal court. Iske alawa aap civil money recovery case bhi file kar sakte hain.

Bina rent agreement sign kiye. Ya bina police verification ke kirayedaar ko makaan nahi dena chahiye.. pehle ye batayen ki police ne koi action liya ya nahi? yes you can get the property evicted on the basis of bonafide personal need in case the rent control act is applicable.. otherwise apko simple eviction suit file karna padega

Hello Sir ..My grand mother rented shop long back(40yrs) and later after family property division my father got the ownership right to the same shop(15 yrs). Tentant never paid any amount to my father(except to grand mother for 2 or 3 yrs) and he did construction work also to the 1st floor of the shop. Tenant who stayed, there is no more and now his son started running the shop(2 floor). My father has sent legal notice with the help of local lawyer but we did not receive any response. Appreciate your guidance on the same.

@mangesh ji ye situation kafi logo ke sath hai..aap sabse pehle to police station me tenant verification ka form fill kijiye taki police verification ho jaye.. uske baad 7 days ka legal notice issue kare.. agar for bhi tenant rent na de ya property khali na kare to urgent basis par civil court me eviction suit file kar sakte hain jisme aap bkaya kiraya aur electricity bill bhi claim kar sakte hain.. Kisi ko rent par property dete time legally thoda secure rehna chahiye.. agar police verification me koi problem aati hai to fir hum kuch aur legal tareeke bhi apna sakte hain.. Dhyan rakhe ki police property khali nahi karwa sakti kyunki police ke pass ye power hi nahi hai

relative can be allowed to use the property for residential purpose on lease/licence basis based on love and affection also. Agar rent agreement nahi hai.. to rent cash ata hai ya account me, ye dekhna padega.. aur agar rent nahi hai to rent free lease can also be terminated and possession can be claimed...

Aap uske liye property ki photography karwaye.. thik karwane ka ek estimated amount pata kare agar koi electricity ya water charges pending hain to uske bill bhi calculate kar le.. fir ek legal notic issue kare aur usme sara amount claim kar sakte hain.. agar paise na mile to aap uske baad civil court me recovery suit file kar sakte hain ...

Sir notarized rent agreement 5 sal ka bana hai valid hoga court me sab mera makan ka paper original hai

any rent agreement of more than 11 months is compulsorily registrable instrument.

Sir tenant ki death ho gai.siblings sath Nahi rehte the.wife Taala laga k chali gayi.6 mahine ho Gaye na kiraya dya na Saman uthaya.taal rahi h.pati se saat Saal s alag reh rahi thi.

Apko tenancy termination notice issue karna chahiye then you need to file a suit for eviction wherein you can claim arrears of rent.. for more whatsapp call 9999010507

Apne tenant verification karwai hai ya nahi? Agar nahi to pehle verification karwa le.. iske liye local police station me jakar ek form bharna padta hai.. Agar rent agreement nahi hai to bhi aap kanooni karwahi kar sakti hain..

bhai mera kirayedar to sala 1 Sal se kiraya bhi nahin diya hai ( 3 years agreement Tha Jo last year Khatam Hua aur tab se lekar ab tak kiraya nahin diya hai) aur na hi dukaan Khali kar raha hai bhosdi wala... ab to kuch din pehle Court mein case Kiye Hain abhi shuru nhi hua h..pata nahin Kitna Din chalega😢😢😢... Aise Aise kirayedar nark ki sabse garm Aag Mein sade sale... Khoon Pasine ki kamai se ek Makan banate hain Salon Tak aur fir use kabza kar lete hain chutiye.
