న్యూఢిల్లీ అనేది జాతీయ రాజధాని ప్రాంతం. దేశ పరిపాలన విభాగాలు, రాష్ట్రాల కార్యాలయాలు, పార్లమెంటు, సుప్రీంకోర్టు వంటి అత్యున్నత సంస్థలు వాటి ఉద్యోగులు,దేశ విదేశ రాయబార కార్యాలయాలు, రాయబారులు వివిధ పరిశోధన సంస్తలు మొదలగు కీలకమైన కార్యాలయాలు ఉంటాయి. దేశ రక్షణ దృష్ట ఇవి చాలా కీలకమైన ప్రాంతం,నిత్యం డేగ కళ్ళ పరిరక్షణలో ఉంటాయి,ఉండాలి కూడా.కాబట్టి అక్కడ రక్షణ, పరిపాలనా పరమైన అధికారాలు కేంద్రానికి వాటి అధీనంలోని సంస్థలకే ఉండాలి ఉండడమే ఉత్తమం. ఢిల్లీలో ప్రభుత్వానికి ప్రస్తుతం ఉన్న సాధారణ పాలనా అధికారాలు సరిపోతాయి. కేజ్రీవాల్ వాళ్ళ టీమ్ ఏదో ఆందోళన చేసి రాజకీయ లబ్ది పొందాలనే దురాశ తప్ప ఆ ప్రాంత విశిష్టత దృష్ట్యా వాళ్ళకి విచక్షణా అధికారాలు అనవసరం. ఇప్పుడు ఈ కేజ్రీవాల్ కి కొందరు ప్రతిపక్షాలు రాజకీయ వత్తాసు పలుకుతున్నారు కానీ రేపు అదే రాష్ట్ర నాయకులు ఢిల్లీలో స్థానిక ప్రభుత్వ ఉన్న అధికారల్ని చూపిస్తూ తమకు వేరే ప్రాంతీయ రాష్ట్రాలు కావాలి, రాజధానులు కావాలి అని అంటారు. ఉదాహరణకు గమనించండి ఒక GHMC వారు హైదరాబాద్ చాలా పెద్ద జనాభా ఉన్న ప్రాంతం కాబట్టి ఈ ప్రాంతంలో పూర్తి అధికారాలు తమకే ఇవ్వాలంటే రాష్ట్ర ప్రభుత్వం ఇస్తుందా, తెలంగాణా ప్రజలు ఊరుకుంటారా. ఒక వాస్తవాన్ని గమనించండి ఇప్పటివరకు ఢిల్లీలో ఏ ముఖ్యమంత్రి కోరని ఏ విచక్షణా అధికారాలు కేజ్రివాల్ అడుగుతున్నారు. అది అనవసరం రాజధాని ప్రాంతంలో రాజకీయం చేయడం సరికాదు.

మీరు పొరబడ్డారు. రక్షణాధికారాలు, లేదా కేంద్ర ప్రభుత్వ పరిపాలనాధికారాలు డిల్లీ ప్రభుత్వం కోరలేదు. కేవలం రాజ్యాంగ పరంగా సంక్రమించిన అధికారాలనే అడుగుతోంది (మూడు విషయాలపై మినహా- లా అండ్ ఆర్డర్, పోలీసు, భూమి) కాబట్టే సుప్రీం తీర్పు డిల్లీ ప్రభుత్వానికి ఫేవర్గా వచ్చింది. ఆ తీర్పును పక్కన పెట్టడానికి మొదట ఆర్డినెన్సు, తర్వాత బిల్లు ప్రవేశ పెట్టారు. రాజ్యాంగం ప్రకారం రక్షణ , కేంద్ర ప్రభుత్వ వ్యవహారాలు కేంద్ర జాబితా లో ఉంటే దానిపైనా డిల్లీ ప్రభుత్వం ఎలా అజమాయిషీ చేస్తుంది. ? ప్రజలెన్నుకున్న ప్రభుత్వానికి వారి పరిధిలో అధికారాలుంటాయి. డిల్లీ కి రాష్ట్ర హోదా లేకపోవచ్చు,కానీ ప్రజల ద్వారా ఎన్నికైన శాసనసభ , పనిచేయాల్సిన పరిమితిని నిర్వచించారు. కానీ ఇక్కడ వ్యవస్థలు పట్టించుకోకుండా మెజారిటీ ఉందని ఏదైనా చేస్తామంటే ఇందిరా గాంధీ కి పట్టిన గతే పడుతుంది. ఆమె కూడా సుప్రీం తీర్పు లను కాలదన్ని ఎన్నో ఆర్డినెన్సు, బిల్లులను ప్రవేశ పెట్టింది.

*Background* 1) Delhi is not a complete UT nor a state.....Its a capital territory with Legislative Assembly 2) Population migration is high in Delhi so the central government cannot look into the issues of Delhi people, so in 1991 69th constitution amendment was brought & made Delhi as a territory with a legislative assembly to address the issues of the people, while also keeping in mind that it's a capital of the country so that's why 3 subject are expected from Delhi legislative assembly that is LAND, POLICE & PUBLIC ORDER and given powers to center *Political reasons for this bill* 1) Delhi Vigilance and Anti Corruption Bureau comes under Delhi govt. When kejriwal became CM of Delhi in 2015 he lodged a corruption case against Mukesh Ambani in the Delhi ACB, a few days later PM Modi sent Para Military force and occupied the ACB department and Home Ministry passed an ordinance in 2015 by overriding the powers of CM regarding the tranfer posting of Delhi and given to Lieutenant governor. From there on the case went to the Supreme court and recently the constitution bench gave a 5-0 judgement in the favor of Kejriwal led Delhi govt. *Jurisdiction rules of Delhi* Though Delhi is a NCT, *as per the IPC, number 1 and 2 of the concurrent list* Delhi ACB & vigilance has powers to raid the Central govt Group A, B,C & D officers because the central govt is the subset of the Delhi territory *So the centre doesn't like to give control the ACB and vigilance to kejriwal and centre cannot remove the two departments separately with any law* *So central govt wants to take completely the Services department from him*
