The recent stand-off between the judiciary and the executive on judicial appointments and the law minister's public advice to the Supreme Court not to hear bail matters and frivolous public interest litigations are issues that raise critical questions on the attitude of present ruling dispensation to the core philosophy of the Indian Constitution. Earlier, the same regime publicly called for dropping the words like secular from the Constitution stating that it is a later day addition. This is despite the fact that the Supreme Court in the famous SR Bommai case clearly stated that secularism is implicit to the constitution and the addition of the word in the text has only made it explicit. Series of policy measures in the name of 'One nation' trample upon the federal character of Indian democracy. Secularism, federalism, and separation of powers between the three organs of the state- Judiciary, Executive and Legislature form part of unamendable basic structure of the constitution, which is under a challenge from the current union government.
