The issue isn't the removal of the documents. It's the return of the documents. The indictment was filed long after this which is why they couldn't do it in DC. And the DC court is a rubber stamp for the DoJ so they would give anything to have tried him there.

It is an appealable issue. 139 years of precedent is a hard thing for an informed Judge to get around. 1885 a Special Council was used. Charges can be refiled under other legal grounds. it is not a case that a throw away.
Sometimes the judge is with you sometimes they are not. It’s better to actually win an election based on your policies and not depend on little tricks.

They will appeal, then the 11th circuit will overturn it, then the defense will appeal and it'll go to the supreme Court where they'll overturn it once again and they'll most likely have to start the entire process over and none of it will really matter because the election will have to decide things.
i really dont think the supreme court is going to say that Watergate, The Waco/FBI investigation, Plame, and Hunter Bidens investigations were illegal...just to name a few.

Trump didn’t just take 340 documents, he attempted to hide and keep them even after getting a subpoena and even after he and his lawyers falsley claimed in an afidavit that they no more documents whenit turn out that they did. Trump knew it and even tried to have the security footage destroyed. Plus lets not forget the tape of him showing top secret documents and admitting that he had not declassified them while president and couldn’t now. The theft and dissemination of top secret classified information is plenty of reason. It will be overturned on appeal and Cannon will be dismissed from the case.

Every year, thousands upon thousands of federal cases are prosecuted without the appointment of a Special Counsel. The DOJ can go forward with this prosecution without Jack Smith. Get it done, Merrick Garland!!

Just move the prosecution to New Jersey where Trump moved many of the documents and was heard showing them to people without clearances. He admits at the time he should not be showing them the documents.

Clarence Thomas was one single and corrupt justice who wrote some nonsense attacking the use of special counsel. You folks need to do some research. Before Judge Roberts received his appointment to the Supreme Court he served on a five-person panel that the guidelines for appointment of a Special Council. The guidelines as written are the ones being used by the DoJ. Out of curiosity does Congress approve every lawyer hired by the DoJ?
