Paying someone not to say something bad about you or your company (NDA) is not a crime. NDAs are a standard business practice across this country. The prosecution called these an illegal practice, but never explained or supported this assertion. The defense also never challenged this, but they may be waiting until after the prosecution has rested to raise this issue to limit challenges and to off-balance the closing arguments.

No. They are saying that the payments did not amount to a campaign finance violation. They are also saying that the underlying charge is only relevant to NY state elections, not federal elections. In addition, the charge of falsifying business records is a misdemeanor for which the statute of limitations has expired. And finally, the FEC already looked at these claims and decided there was no evidence of a crime. Did that clear it up for you?
