Anyway, I can count on one hand how many times I've seen an officer actually hold another officer accountable without the public demanding it. Good on this lady cop. If they were all like her, we would NOT have the issues with American policing that we have.

The reason why they mentioned he was a disabled black man (and I'm not condoning this action, simply explaining) is because the officer is a white police officer. It shows that an already disenfranchised person who also has a disability is being assaulted by a person in a privileged class who is in a position of authority. It is a headline designed to shock people into realizing that every person of color is unsafe when cops like this are given authority. The implication is that the cop is racist. I have no idea if this is a true statement. I'm simply pointing out the implications of this headline, and why it was worded in such a way. All I know is that the violence needs to stop. These people who want to stay on the force need to be vetted yearly. Also, go back to the scene with the police sergeant handing over the card. The man taking the card from her (I'm soooo bad at names, I apologize) and the sergeant exchange a look that says, "I know that you know what's really going on here." That spoke volumes to me.

I also noticed that the police officer whose conduct is in question really spoke down to the female officer (blonde lady) before his supervisor and others arrived. Which is really in line with the rest of his behavior.

Audit the Audit is an amazing channel! You have to react to more! They find great videos and break down the applicable laws and cases extremely thoroughly. I love that he grades all the people involved in the encounter. Edit: The other awesome thing is that he does have videos where the suspect gets a bad grade, and the officer gets a good one. He seems very impartial.

2:22 That seems quite excessive to me too Kabir (retired PD), and its not the approach I would've used. As a matter of fact, I wouldn't even have had my sidearm out yet. I would've calmly approached the two men (keeping my distance) and asked, "gentlemen, what's going on here?" And yes, I would've asked just like that. In my experience, if you treat people civilly and with respect, they usually (though not always) will return the favor.😉 6:54 The lawsuit would most likely be against the entire township, its police department, the individual officer and any supervisors or assisting officers at the scene. In my 25+ years as a law enforcement officer, I had to resort to the use of force countless times (as you can imagine) but I was never accused of using excessive force or brutality throughout all of those years. I actually had to arrest another law enforcement officer (a sergeant) many, many, years ago. It's not a pleasant experience, to have to arrest one of our own, but it does happen on occasion. I've been present when others were arrested too, but I wasn't the arresting/investigating officer in those incidents.😕 13:01 Cards weren't a required piece of equipment and were a personal preference and expense for individual officers (unless the requirements changed since I retired) so the officer may not be lying about that. I didn't carry cards either though many of my colleagues did. The officer offered to give his name and badge number anyway, so I don't think that particular issue will lead to any legal consequences. 16:27 I agree completely Kabir. That's the news media for you.🤨 The news tends to separate, categorize and segregate everyone and everything, and in many cases it's merely to stoke the flames of resentment and distrust.😕

@@beesnestna9544 I couldn't help but notice the language you chose to use in your statement; "It's not a pleasant experience, to have to arrest one of our own." Your choice of words. It betrays the strength of the bond between LEOs. Even when an officer has, allegedly, committed an act that necessitates them being taken into custody, they're a member of your in group. Members of your community not carrying badges, know they are "them," in the us vs. them dynamic in effect.

If I have to arrest "one of our own", obviously one of our own has broken the law and committed an act that betrays the trust of all police officers. To most people who trust in someone/something, betrayal of that trust is never a "pleasant" experience, wouldn't you agree? Does that clarify things from a reasonable perspective? Think about it.😉

Internal investigation officers are held to a higher standard than the police they investigate in most cities. They also have a self policing system that has them looking over each other's shoulders to make sure nothing odd is going on. It's not perfect, but it does increase the chances of a clean investigation. Most people get frustrated with them because they will listen to witness complaints, but without evidence there's not much they can do. One of the reasons body camera footage is so important.

I absolutely believe there are plenty of good officers who would have immediately acted had they been on this scene, and they are out there doing great things to protect us. However, we place such a high level of trust in officers that 1 bad apple REALLY does spoil the bunch.

The officer stomping him to the ground is very excessive. The first thing is that the officer has no idea if those gentlemen are involved in the call or not.

The police no longer have a duty to serve and protect citizens so what do you think most will do? They police for profit taking money and possessions without proof of guilt and the person has to prove their innocence to get it back. In Memphis Tennessee police officers beat a man to death, emts did nothing to help him on the scene and he died in the hospital. All the officers were black as was the poor man they beat. All officers were in a "special unit" called the scorpion unit which was immediately disbanded when the officers were charged with his murder. The police in the United States have become nothing but thugs in uniform for the most part although some honest cops are still out there thankfully. This is a daily occurrence and your color doesn't matter since the police have qualified immunity and are well protected behind their blue line.

It has long been established by court cases that police in the US are 100% allowed to lie to people. They are also under 0 legal duty to actually help someone that is in distress. (that has been established by court cases as well)

I get what you mean with awarded but that has a weird feel to it, congrats you got beat up by the police. Also I dunno how a police officers pay is going to compensate for what he's owed. If you think that's alot of money then good cause it should be a deterrent not just for the police but how the community there within hold their police accountable. You're only upset enough to comment on a video, not any real change

Awarded has multiple meanings like compensate, payment, in consideration of, etc. As far as the community is concerned, you act like the people want unruly law enforcement officers outside their doors in their neighborhood. They don't, people started recording to hold the police accountable. What do you want them to do, arrest the police. That doesn't work. And secondly, you are on here also commenting on a video. You know nothing of me or wtf I'm doing or not doing. What real change have you enacted for the people? With all your big talking. And it's a rhetorical question, because I don't actually care what you're doing or saying. ✌️

Unfortunately in the US some people make an issue about someone's color. I prefer to look at it as good bad or natural no impact. It's so crazy how if someone is black or Hispanic or whatever how white some people can just rush to judgement. I'm sure it may be the same attitude with those groups toward whites as well but can't we just get over over it and see everyone as person first. Just trying to give an unbiased white guy comment. In my time I've seen plenty of good and bad from every origin of people

not gonna lie I would have issue with cop throwing anything on my vehicle. Just like I have issue with cops signaling dogs to alert and clawing the hell out of a car. this guy a pos. I hate that we got this, as there are way more good cops, but the ones like this make honest cops look bad. not just her, but the blond and the other guy behind her all had disgust in body language. They both knew.

The cop in question here was fired from his previous department for insubordination and harassment of a female cop. He is a bad seed. One of the major problems with American policing is the gypsy cop. This is a cop who moves from department to department as a result of being fired or resigning before he can be fired. Cops who are under investigation will resign in lieu of being fired because the investigation stops at that point, meaning there is no completed investigation to report on to his next department. Police departments in the U.S. are loathe to admit to another department that a prospect has had disciplinary problems. In some cases a department has been sued after firing a bad cop and have agreed to change the records to reflect that the fired cop resigned and was not fired as part of the settlement. Once the victim is on the ground and handcuffed you can see the cop going thru his pockets. If he is under arrest, the cop can do that. If he is not under arrest, the cop CANNOT do that. At most, he is allowed to perform what is known as a Terry search which is a pat down of his clothing to see if anything resembling a weapon is on his person. The conundrum for the cop is that if he says an arrest was made, he had no probable cause to make an arrest which means the arrest is illegal, as is the search. If he says he was not under arrest, the search of his pockets is illegal. We also have the concept of qualified immunity for government workers which was created out of thin air by our Supreme Court. In theory, it works just fine. It was meant to protect, in part, cops who had to make split second decisions in difficult situations from being sued in civil court. In practice, the police have used it to, literally, get away with murder. The way it works in the real world is that a cop can violate our rights so long as another cop has not violated those rights in the same exact way. The surprise that most people don't know about is that even if someone who is suing a cop manages to have their immunity stripped and exposing the cop to damages, the municipality that he works works for will still indemnify him and his damages will by paid for by the city or the city's insurance carrier. The cop never pays out of pocket for his actions.

*If* the only thing the officer did wrong was the act itself, and immediately admitted his actual actions to his Sergeant, etc. I'd be more understanding of his aggressive actions when going to a call of someone aggravated with a gun. Would that have made it alright? No, but I think it would have been a different outcome of internal discipline vs possible prison. Was everything he did wrong? Yes, of course, but knowing you f__ked up and then trying to hide it when you're a public official? That really looks bad.

They said he was disabled. He may not be able to easily get all of the way down, he may be hard of hearing, he may have dementia, etc. I saw this before and was filled with rage. I regularly watch Audit the Audit. You learn a lot about your rights.The man did nothing wrong. He had a tool in his pocket. He complied within reason for being disabled. They never interviewed anyone and it's all hearsay. I honestly believe there was racial profiling big time. The subject is elderly and disabled and a fellow officer witnessed him being kicked in the back of the head. The offending officer is a liar, and is guilty of unnecessary use of force. He better be fired! (Bravo! He was!) For the record, the department or officer doesn't pay out after losing lawsuits. That's covered by taxpayer money. So WE pay for his misconduct. Can you see where some of that defunding of the police is supported? That term doesn't mean get rid of the police force. It means to divert funds for things that don't require the police, to the correct agencies (e.g. mental health services, child protected services, chemical dependency counseling, etc.). ONE THING that ppl need to understand is that dispatchers many times will tell cops something different then what's going on. I had this occur ,I called in realizing that someone had stolen some of my belongings when they were packed to move.. the cop was dispatched to a domestic violence call.. so she came ready for the fight that was not occurring .. her mindset was on a dangerous domestic fight occurring when it was nothing at all but that I needed a police report and only myself and my toddlers were at home.

Lawsuits in the USA are typically contracted on contingency. Customarily the Lawyer (Solicitor in Brit Speak) elects to take the case and pursues the offending , liable party with a goal of extracting justice in the form of a cash settlement for which the lawyer in exchange for their time, expenses and legal actions receives 1/3 of the amount agreed to in the settlement or court award.

Something always bothered me about this video. In the very beginning someone else is seen walking away. It could very well be a teenager but if there is suspicion of a gun, why not check him too? Was the man described on the call? The black cop reminds me so much of my sister with her facial expressions! “We have cards!” 😂

On the note of identifying the victim as black, it was probably done because there is probable cause that this police officer might still be charged with a hate crime which is still a big issue of our police problems.

You asked why is it remarked in the headline that he was a black man. I, perhaps like you cannot wait for the day when race is not remarkable. When it does not "need" to be mentioned. The fact that in this country it is often used to color (pardon the turn of phrase) the reaction or feelings about the reporting without thought to the fact that it automatically prejudices the reader. No wonder people still take sides in the race issues here. We force it with every article every news program because in this country it still matters to a lot of people. I just hope I see the day when a persons race is not remarkable for either good or bad. I hope I was able to get the point across the way I mean it. When will we just not feel the need to make notice?

I know that South Park has made a big joke of it but some cops do have the "RESPECT MY AUTHORITY!!!" attitude. Reference: I worked as an X-Ray tech for 30+ years in hospitals. There some very nice cops but some were major jerks. Some walked 'the cock of the walk strut'. That is with their chests puffed out taking slow measured steps with hands resting on top of their gun holsters. We, the hospital employees would mimic them behind their backs. I know, not the most mature thing but when you are faced with death, dismemberment and heightened emotions on a daily, almost hourly basis you need a pressure valve release once in a while.

The reason why the newspaper mentions he is a black man is because this is something that would not happen to the white people of South Carolina, unless you were a very poor white person. It is mentioned in the newspaper like that to remind the community that this is happening to Black people only. Our police departments need to be updated, right now, our police go after the poorest, the most uneducated, disabled, and minorities harder than your average middle-class white person. They assume if you’re poor, you’re more likely to be a criminal. If you’re black, it’s the same..

So it’s actually the taxpayers that pay out when it comes to lawsuits against police in the US. The police department does not have to pay a dime, it all comes from taxpayer money. It is something that needs to be addressed because when the money for lawsuits comes out the of the police department funds they may be more likely to get rid of bad cops and do a better job policing.

I agree that it's wrong to keep labelling people "Black" "White". But while the media keep doing it then there's always going be a divide. There's a really good Star Trek episode. For some reason they go back in time and pick up Abe Lincoln. He calls Lt. Uhura "A Charming Negress". She doesn't even know that she's supposed to be offended. Society as moved on so much that racism was forgotten centuries ago... If only that was case today.

This same officer was fired from the Calhoun County police a year earlier. Mr. Gaillard received a 650,000 settlement, most of which, no doubt will go to the lawyers. Orangeburg has made several changes to its internal and public relations policies, and hopefully to their hiring practices, since this guy already had form. Dukes was arrested and made bail. I couldn't find anything after that, I assume the case is still pending.

That's one of the most infuriating things about policing in America; some truly criminal behavior is committed by LEOs and after being fired they go on to the next community to get hired there. If there would be nationwide regulations regarding these loopholes eventually (maybe) we would have actual public servants, instead of the largest criminal gang in the US.

@KabirConsiders this video does justice to what seriously hinders law enforcement in the United States. Appreciating the U.S. constitution and the division between Federal and States rule, to me it seems wrong how each state adjudicates crimes and the ever present of subjectivity of what should be objective. Fortunately, in this case, the law officer was 'found' wrong...

The video conveniently stops with the officers foot in the air. Did he actually make contact, did the detainees head actually hit the ground. As well a metal rod can be a lethal weapon. There is a reason officers may not identify themselves, they may also work as UC officers or are trying to prevent be doxxed and harassed. Also why no information on Guillards record. We're the police ever called to his location before? Does he have a history of violence? It rare that in calls for service such as this that there has been interaction between police and the subject before. Which would explain the felony stop of the police coming into the scene code 3 and with guns drawn.

and one problem with suing cops over misconduct and abuses is that when there is an actual settlement that comes from it, it's the taxpayers who foot the bill and the cops often never actually suffer any reprecussions

This cop is a prime example of why I'm absolutely convinced that the hiring practices for police officers to mandatory required to go through the academy for a total of 8 years, in addition to be mandatory required to have a minimum of 2 college degrees that specifically applies to law enforcement prior to admission to become a police academy recruit

You could probably fix it easier than that. Just make it so that every court settlement or payout for improper behavior comes NOT from public funds, but from police pensions. Stomp a head and somebody gets a million bucks? That comes from the collective retirement of the police department. I guarantee all of a sudden that "thin blue line" will vanish and the good cops will start tossing bad cops out immediately. New cadet with an anger issue? That 20 year veteran is not about to have that moron ruin his approaching retirement. He'll get rid of him before he finishes his probationary period.

The evidence is tainted because the officer had no gloves on and who said the (disabled) guy had it in his hands. It jas the cops fingerprints all over it. A good lawyer would eat this up. A judge would award the civilian a big pay day.

they mention he's black in the title of the news article because of a belief that racism played a part in the interaction, though i agree not referring to skin color would also be appropriate. an elderly disabled white man in the exact same situation can still be the victim of undo violence from law enforcement, but it certainly seems to happen less.

Why is everything about race. Blacks in America create over 50% of all crimes and 80% of the most violent crimes despite being only 13 to 15% of the population. So, a predisposition to Black people has nothing to do with being racist but merely the people committing the crime. The color of the skin is secondary. No different than the predisposition to illegal immigrants and their color. We don't single out blacks or white's at the border. Black people are really good at playing the race card instead of fixing a cultural problem.

Law in the United States protects individual police officers from being sued. Any settlements are paid by the Departments and their communities. I give police officers a lot of credit for doing one of the most difficult jobs imaginable, but wish there was accountability when necessary.

A big fan of the ATA channel. Have friends in law enforcement and it is interesting trying to talk with them about situations like this. There are so many videos of police questionable conduct that we can’t afford to keep “letting the police police themselves” a.k.a. The thin blue line. If the brotherhood can’t keep the bad apples off the force, then there needs to be civilian review and oversight.
