Many states are using a cluse "distracted driver" regardless of the type radio or cellphone in a moving vehicle. If you read the law, it clearly says law enforcement is exempt in most cases.

I grew up in the Philly area. 10 mins from Broad street. I used to love walking the city and hopping from train to train seeing concerts and going places when I was younger. Seeking adventure if you will. I was in Philly 2 weeks ago near Kensington and it was absolutely disgusting. Homeless, drug addicts E V E R Y W H E R E ! Like picking my feet up to get out of the truck every where. WTF happened to Philadelphia? Like Sodom and Gamora I never thought I'd see the day.. Wow Brotherly Love on vacation... Other than the local town cops can't use radar guns for speed enforcement .and state cops can only use radar to time speed while stationary....these are good things. Also new cars have so many gadgets many people are distracted by.

My grandfather was a ham radio user for over 70 years. He owned one of the first cars ever. He always had a ham setup in his vehicles. Never a problem. Ham radio operators are responsible people. They have taken the time to learn and get licensed. They aren't a problem. Get a clue Pennsylvania and solve some real problems.

@@StarShipAdventures…and just like that, my FT-891 is a “CB”. I can program Channel 18 into the memory. I’m 75/100 towards Mobile DXCC and I’m not backing down. How would they even know we’re transmitting?! I’m not waving a big, chrome plated D-104 in front of my face. Are they going to equip cop cars with a frequency counter and a field strength meter? Doesn’t a Federal law supersede a state law?

The criteria our founding fathers used was life, liberty, property. Does use of my ham radio while driving cause people to die? Is my ham radio use resulting in crippling injury? Is my ham radio causing damage to property? Without a victim you don’t have a crime. If I am irresponsible taking my eyes off the road to enter a frequency via the microphone or I’m watching APRS data instead of the road and cause injury that is on me. No victim no crime. This bill is tyranny.

@@kd5you1 Sounds like common practice to me. They make laws and then look for victims to fit the crime. Remember when the seat belt laws came out? They swore they would not pull you over for a little seatbelt violation. Now, it’s the basis for them searching your car, while you are standing on the street in handcuffs looking like a criminal. Then, you risk having the cops plant something in your vehicle. To me, that sounds more like sovcit stuff.

From the ARRL: “The Pennsylvania House of Representatives Transportation Committee just passed a distracted driving bill that exempts amateur radio operators. That is, an FCC licensed Amateur Radio Operator using a push-to-talk mobile rig or an HT radio in his or her car, will be exempt from the restrictions that prohibit drivers from using handheld communications devices like cell phones.”

If I lived in PA and this bill is passed I would be telling all the served agencies I support, at no cost, I QUIT! Where does the ARRL, Red Cross, FEMA, CERTS, and EOCs in PA stand on this bill? Will PA be looking for amateurs from surrounding states to help out in emergencies?

Your point of them thinking that their job is to go make laws. That's exactly the problem.. How do they justify their full time positions in state houses, if not to sit around and try to legislate constantly? They pretty much need to constantly be looking for "things to fix".. In the original design, these weren't supposed to be full-time jobs. It was meant to be public service. Something more resembling jury duty.. Not whole career, things... This is basically the root of the problem..

Currently a number of states are using the cluse "distracted driver" in order to ticket a driver for using a microphone or radio in a moving vehicle regardless of the type of radio. This has been happening more and more. I received a ticket in Kansas a few years back. The officer said I was distracted driving while using my microphone on my ham radio. Even though I had a camera showing I was not using my radio the judge was not concerned, I ended up paying a $ 113.45 ticket regardless.

The problem is idiots on cell phones, not radio operators. Seldom if ever do you hear about an accident from using a radio, where as with cell phones it is prevalent. A cell phone requires you to look at it much longer and more frequently and perhaps even use both hands to hold phone and swipe, or click on something, where as a radio requires a quick glance to grab the mic, if even that. Radios with their knobs and buttons and switches are specifically designed to be used in vehicles and not cause much distraction. Transmissions with radios are short and to point, where as personal cell phone usage is not like that and they are not designed to be used in vehicles. This is just some lunatics, throwing a 2nd grade fit, who are mad they can not use their cell phones and decided to go after radio users. The next bill will no doubt be that you will not be able to talk to anyone sitting next to you in your car while driving. They are all ready trying to take your car, your house, your bank account and anything else you might own. The time is now to put a stop to this nonsense, call these people out, remove these tyrants from office along with those who fund them... IE Lobbyists.

A lot of hams use their radios during rush hour or drive time to work or home, and its never been a problem where I live. Not once has anyone here caused an accident or caused any other problems because they were talking on the radio. Today and yesterday the MS150 was taking place, and I was just thinking how SAGs would work in PA if they were not allowed to use their radio while mobile. Also, its better to have the engine running while talking on the radio because some radios will actually shut down if the voltage gets too low.

The new law exempts police fire Ems emergency vehicles commercial vehicles. It does not include the use of CBGMRS or ham radio in private vehicles

I come from a small village in Slovakia randomly watching this video. I want to tell you that many of your ancestors from this village (Vysoká nad Kysucou, also known as Vyszoka or Vrchrieka) moved directly to Pennsylvania during the immigration. Of course not only from this village but from all over Europe, but this is known to me from stories. These old people (now only a few are alive) and their children (maybe your parents) helped build Pennsylvania into a beautiful state, until you elected stupid officials who start making your life harder. You elected people there who never built your country, but they have new stupid ideologies that make your life more difficult, and not only your life, but their tentacles reach as far as Europe, where we also feel their senseless ideas. Wow! Allowed to text at traffic lights? In Georgia who is very proud to start this hands-free money grab, you must be in a parking space in a parking lot engine off to touch the phone. Engine off even on side of the road it's still illegal first day it was enacted Cherokee County Georgia look like an Arnold Schwarzenegger movie with what seemed like 100 police overlooking the highway trying to pick off as many motorists as they could. HAM radio operators self learn how to multitask, and we identify as being /M (mobile) so our contacts know not to start saying "where did you go?" helping the driver/s. I wonder how the law will effect operators, operating cw while moving with paddle in front of the center arm rest. Ron W4BIN

I would expect the truckers to be fighting this. CB radio is still common in large trucks. This would ban the CD use in the state. This is what happens when government has no fear of the people.

There is an exemption for Commercial Vehicles. So Ham Radio and CB in Privately Owned Cars would be illegal.

A lot on new 10 meter radios like Radioditty , Anytone now have VOX, so you can talk hands free with an ear mounted mike so the police will not see you with a mike in your hand. It is one way around it if this goes through.

Federal law overrides state law when it comes to licenses from the FCC. No state can restrict a FEDERALLY issued license in any way. This would also apply to garbage trucks, DOT, state, county, and city official vehicles as well as any businesses with radios in their vehicles. They also have FCC licenses, so they are able to carry on as well.

They have exempted Commercial Vehicles. So Guy driving Gas Tanker can use radio, guy in private car can not! This has nothing to do with safety!

I don't know how much of that law will be actually enforced. in California we have a lot of law, but many are not enforced such as 55 MPH limit , right two lanes only while towing. or even normal speed limits are rarely enforced.

We have had such a law in Texas for years. This is NOTHING that hams here worry much about because it's nonsense; I don't know of anyone who has ever been ticketed. The law requires that two-way radios can only be used in hands free mode if you can figure a way to do that. I don't remember all of details because like I said, it's nonsense. That said, IF THE LAW IS PASSED in PA and you are worried about being ticketed, maybe use a headset and put a PTT button on the steering wheel. Instead of watching for some driver holding a mic, the police could spend every minute of every day just going after people texting and driving which is also illegal and so much more dangerous than holding a mic that you don't even have to be looking at to use. I have and will probably continue to ignore this law and use a hand mic while driving if I want. This is certainly no more dangerous than eating and driving which is still legal. My guess is that I MIGHT be cited under this law if I cause an accident and the police somehow figure out that holding my mic was the cause.

Can't even have a scanner / radio in the vehicle to begin with unless you're a ham in a handful of states thanks to an ancient 1934 law

The Scanner Law that is still on the books in Florida says it can't be "Mounted" in a car. We had them sitting on the seat plugged into a lighter plug for years.

more run away government. here in ca it is a crime to use a cell phone. but i see so many using while driving. the law is not in-forced. and one night i can up on a county sheriff with his car in a ditch. i bet he was on his phone and speeding . as many cars spin out on this corner.

"Drivers" are the only ones required to buy an annual plate registration sticker and insurance ... Fact ... only those involved in Commerce like a Taxi or Delivery vehicle can be legally enforced to do so. Call Yourself ...a ..."TRAVELIER"... not a ... "DRIVER".

What about the truckers or police? They aren't any better than the rest of us. In fact, IMHO they are worse and more distracted than a typical operator. Then you have the utility workers as well..... they don't THINK at all!!

My new Kenwood TH-D75 HT has Bluetooth and a earbud you can order that has a PTT button on it. Only trouble is you have to order it from Japan. I live in Utah and don't have to worry about this but it still sounds handy to have anyway. Wonder how long it will take to get that from Japan?

Yes they can. A cop can type on the laptop with one hand, hold the phone with his head and shoulder and talk on the palm mic at the same time while a drive of a Gas Tanker can talk on the CB... BUT If you do any of it your fined!

How will this law affect Law Enforcement, Public Works, Emergency services and using their radios. Amateur radio is a vital means of communications in time of need. This is Bull Schiff. If it passes Hams should withdraw their support for emergency comms (ARES, RACES, et.) in the state Pennsylvania.

As usual the Government made an Exemption for themselves. A man driving a huge fire truck lights and siren, or a commercial driver of a Gas Tanker, or a cop using his computer, mic and phone at the same time are ALL EXEMPT! You on the other hand. NO GO!

What's the problem? As hams we can pretty easily add VOX switches on our mic lines. I'm sure there are circuits in old copies of the ARRL Handbook, or QDX, or all over the web for those hams who don't know how to design one. That's the sort of thing that ham radio is all about. BTW, even $20 Chinese Baofeng's have VOX built in.

The FCC has already ruled : Declaratory Rulling, on federal preemption in a case in NY where a police officer attempted to confiscate equipment from a mobile licensed ham based on the wide band coverage (before LE went digital)of the transceiver. States and municipalities cannot trample on federal jurisdiction.
