The right way to look at it is a deficit of 200sft = 1 full bedroom (13ftx10ft) with an attached bathroom of (10ftx7ft). That is the difference between 2 bhk and 3bhk. HUGE!!!

If after payment of 10% developer does not enter into an agreement, file a suit, keep everything in writing,once the matter is subjudice, he will have to give you the flat and in line with the act and not his crappy agreement. People are scared to take that step. There is no need of sending notice etc as is the myth, you can and should immediately move to the court once you even have a communication where he has not agreed to execute the agreement. It's a pretty straightforward case even for the judge then and he would ask to get the agreement executed, if the buyer says he wants to continue with the product. One should at least have a receipt with flat name and number, that's it. Acceptance of payment against a unit is an underlying agreement....people need to know that, it's a court that runs of facts first and then the evidences....

Never ever ever buy an under crunstruction flat.. only buy completed projects preferably 1 to 2 years old after rains so that you know exactly what you get and quality of construction. Saving grace is that she atleast got some flat..

Demanding money back is not suggestible. Because, even if they give your money back, you cannot purchase a new flat with the same price in the current market rates. So, demand for a flat of same size from their other ventures.
With a compensation, as the buyer has to adjust with small place, and will have to pay extra as per current market if they switch, with compensating their search efforts and expenses

No its mention in every documents of promoter whether small or big promoter to be on the safe side they never disclose full sqft in written..only after buying you will knwo generally they do give what they told but some might cheat.
Rather basically look for Home Inspection. These provide inspection of every aspect of the apartment that's important before getting possession of the flat... So you can go back to the builder can ask to repair faults. Check services like propcheckup.com

Best way to avoid this situation is to buy in Ready Possesion. You can measure the carpet area yourself. You can verify the materials used are as quoted. You can negotiate on pricing more commandingly because no builder provides what he claims to give. I did the same thing and builder didnt wasted his or mine time and came to the mutually agreed price which i offered him after his offer. Imp tip. Measure yourself with measure tape actual carpet area take ur sweet time while doing this. It makes the builder sales guy phychologically nervous even before you start negotiations.

That means Builder made a profit of approx 36% (Over and above Normal profit) by just decorating brochure and fooling people.
I don't think you know the effect you are causing to lodha and other finance companies indirectly. Lodha has more debt than it's assets and they were planning to go for an ipo to reduce it. You have literally stopped them from doing it. Since you are putting out these videos if people stop buying from them it causes a vicious cycle of them defaulting on their debts and declaring bankruptcy. The people who finance them like the Piramal group many other nbfcs and bond holders etc they all will take a big loss if lodha defaults. Thousands of crores will be lost. I am worried for u sir please be careful!
@James skorpio They're having problems now because of liquidity issues and bad credit lending. If big whales like Lodha default it will worsen the situation.
Everyday a huge number of Indians get looted off their life savings. They have already lost what they invested. I get your concern and it does worry me that others who have invested in Lodha projects also run the same risks as Lodha itself does. But how can we let this continue. These builders will never stop doing this. Today the risk stands in thousands of crores but if we keep supporting them losses are only going to pile up for a later date.

No builder is quoting carpet area as per rera in brochure. They quote built up and if we ask carpet they tell you usable carpet wherein they calculate balcony area also. This is how they mislead.
In builder quotation the show total carpet area including balcony and terrace which was 781. In agreement as per RERA act u have to show it separately hence if we calculate 678+ 75 terrace area it comes to 750 square ft.

Nowadays all builders are selling in this way, counting terrace and balcony as carpet. I bought a Pristine builders flat, they did same. May be they are playing with some loophole of RERA. Also builders show in plans as foot whereas in reality they count 30cm as 1 foot, which is not true. All builders are cheating customers in these ways.

I had booked property in pune in 2017 in which builder agreed to give possession by the end of 2017. However at the time of agreement he suddenly changed the possession date to 2020. Luckily I had stopped the booking cheque otherwise I would have been cheated.

I they don't allow to measure you by your own tape it clearly indicates that they are fooling you and you will be cheated. I will not pay a penny before that I will live in rented flat by the time I will invest in some assets so that I could buy and construct my own ditching those cheating builders I thank a lot to Krishna Raj Rao Sir for exposing the builders and their fraud so that many will be cautious before buying from them and if awareness spread then there will be lot of restrictions to the height of fraud the builders commit with the customers.

The area in agreement, cost sheet and plan seems same. It’s 781 sq ft in all. Where is the less area you talking about? The builder should have given a break up of the area in the cost sheet i.e. carpet and terrace area as shown in the agreement. Having said that I hope the floor plan was shared with the client when she paid the booking amount which should have the breakup of carpet and terrace. If the plan shared with the client did not have a terrace and showed area as 781 then this is a big problem. this seems a pre RERA transaction.

Enclosed Balcony, Dry Room & Adjoining Terrace aren't calculated as the Carpet Area? As i read somewhere that all of this are been included in the Carpet area according the RERA?
Yes - nothing of that is calculated as per the new rules from RERA. Carpet is only the area where a carpet can be laid out and nothing more , so even the walls are excluded from the calculations!
@@nishantthaccker1173 RERA clearly defined carpet area and the balconies. Carpet area per RERA is wall to wall and a nominal portion of the walls. So the glitch is see here is 1) Padmashree did not walk away from the agreement, she could have and then moved to consumer court, per RERA builder can't accept more than 10 percent without signing agreement. 2) If she had appealed in RERA, court would have asked for a RERA agreement and that would have made the flat right in numbers as per sq ft RERA calculations. 3) Balconies now if amounting to 100 sq ft Kalpataru managed to remain clean on paper and if he is not foolish, his actual provided flat, sanctioned plan and agreement will be in synch. 4) She could appeal for getting measurements done. However observation of mine says there is a definite less area given and Kalpataru would have silently added a 5% lesser area tolerance clause which though written in agreement is illegal....
I think covered balcony is counted as FSI as per rules. Hence technically builder has the base covered. Case has to fought on nitty gritties like offer document didn't disclose balcony/terrace area separately.
@Deepak - Balcony can't be considered as enclosed area hence the name 'balcony' - hope u get the point. Also there is something called a sanction plan from municipal corporation which the builder seems to have modified which is illegal
@@nishantthaccker1173 I have constructed by own house, hence know for sure that enclosed balcony is counted in FSI. By paying a premium you can convert a balcony into an enclosed balcony. As I said enclosed balcony is a properly sanctioned item which I have seen in my own case as well as the plan shown in the video. Also I think terrace balcony (not roof) is also counted in FSI, though only some percentage.

The thing is FSI is a matter of Plan passing authority and rera acknowledges any area enclosed by four walls in carpet area and rest comes in balcony and wash, but that doesn’t mean it is free in any way.
This is very common thing in India. I bought a house in chennai and I've been promised 978sq ft when I got delivered and I went and checked out it came only near 720 sq ft with all the Carpet area+ Plinth area + Balcony space. Real Estate sector in India is really doomed.
builders cheating on "carpet area" is known for years. I was explained- the area of entrance to the stairway, elevator are "proportionately" added to all flats. Builder says some one should pay for these common areas. Okay then say clearly- the area outside the flat is xxx sq ft. and cost for it Rs yyy. Silently adding area in flat and charging for it full money is criminal mentality.
Bro, talk to Akshar to buy a commercial, he still talks superbuilt up....you ask him he would say I have a 4000 sq feet office at 6900/-plus xyz etc and then you ask carpet, he would say 2000/-, so you say 100% loading to which he would say no it's 50%,that's technically 2000 to 4000 is like 2000 on 2000 that's 100% but if you consider 2000 minus from 4000 it would mean 50 percent of 4000, that's 50 percent less..lol...that's the regular way builders deal....so effectively you spend 3 cr for an office that you would hold for an year to put on rent to earn some 2 lacs max rent a month.....wow.....better don't invest....always negotiate on usable area and ask them to cut the crap....I still see Pune, Lonavala,Khandala,New Mumbai still talks about the stupid super built-up areas n it's bad
The video is misleading. Carpet area is always loaded with 35% loading and termed as salable area. It's a standard practice. If she has a point to prove she can appear for court trial and under Rera act she can get her money back plus builder has to pay penalty.
Yet another video i came across could co-relate. This is what I have also been duped for. I had a property in Palghar, the builder reduce the sq ft in agreement without our notice, stating the larger area the more we have to pay with so typically called as thook maar kaam. When the society contacted for unfinished work the builder is not giving Conveyance deed stating, that many people have pending amts. There are lot many glitches in the project.
I am not sure how it used to be back when this flat was purchased, but now they always quote the area like this in Pune. Balcony is always included in the carpet area and the builders are upfront about it. There is something called MahaRERA carpet area which excludes balconies which they should probably quote separately. The builder is spreading misinformation if they tried to convince you that the quoted area excludes the balconies. But just based on that cost sheet you do not have enough proof. In fact you might be in trouble if the builder sues you for defamation. It is always best to negotiate with an end user to buy ready to move properties because you see what you get.
After enactment of RERA also people are not getting justice in time...In Karnataka rera cases taking years to deliver a decision...in many of the cases where orders given for Refund, builders are not caring the orders ! So what hope is left for citizens, specifically senior citizens who have filed a case for refund, what will be their fate if a medical emergency comes and they die being depressed waiting to get back their hard earned money deposited in builder's pocket ??
When we blindly accept promotion offers or prelaunch offers etc, the results would be this.The builder will make sure the amount you offered will be adjusted against the area he gives you back..!
She is doing wrong ❌ calculations. She is getting promissed area as usable area. This includes carpet + enclosed balcony+ terrace. Builders get less fsi and they take advantage of adding enclosed balcony in bedroom. Plus she did not show actual calculations by measuring area. One thing is right fsi= carpet area. Ans builders must educate/mention usable area instead of carpet area. I would laugh with her expectations of having more 10*10 space to her existing bedroom. She is innocent....
In Maharashtra, politicians, builders, corporations, media are always hand in hand. Not a single open space is left in entire Mumbai, Thane, Navi Mumbai, Pune. Mangalprabhat Lodha has become the Vice President of BJP, Maharashtra. Sir, you are doing great work. You have complete people support but won't get any from political parties or government agencies. The dreadful episode that I went through in 2015 when I received my flat booked in 2012 in Pune. Promise : 625sq ft Received : 450 sqft The engineer kept argueinh that the area is there it's a technical thing. Please add the area of all rooms, washrooms passages and double check if it matghes the total. These builders are absolute cheaters in Pune. Bottomline: DO NOT BY AN UNDER-CONSTRUCTION FLAT EVER

Very true. Rera was finally passed in a very diluted form compared to what was originally proposed. The real estate lobby must have influenced the politicians to make changes. For instance, in the beginning it was proposed that builders should not use the amounts received as initial payments, for their other projects.But later it was changed and the builder is allowed to use a portion of the amount for the same.
Most of the builder in Maharashtra... Not given carpet area which they coat on the paper... Even RERA olso... There is a department in Maharashtra gvt MRTP which given perfect carpet area certificate to customers.... If u buy any flat ask bulder reguard MRTP certificate..
I recently visited Kalpataru project and they clearly explained about Carpet Area and Terrace area are added in their cost. Even the sample flat is shown with details and without any interiors. This cost sheet is provided at the time of price discussions.. so I don't think it is a cheating in any case. As a buyer pls be educated and ask the details before buying. Don't blame builders if u don't understand things clearly.
Sorry to say but catpet area includes everything from your door . Terrace was earlier counted 30 percent now 100 percent . So plz check tue definition of carpet

This is getting so relevant in Thane. Talk about Puranik. I went to see a flat under construction. He showed me 620 sq ft RERA carpet area flat. I said to him it looks smaller. He is smiling and telling me "Daro mat Paper pe yahi aayega". The scam is from Day 1. Agreement value 78 lacs. But overall flat cost 1.09 Cr. They are selling parking lots as well.. When questioned, Why so high cost. " We are selling you lifestyle". He said it's not cluster living.. Which becomes so irrelevant because same place they are building 35 storey towers.. Amount of people is going to be same.
We also got such experience @ Dhayari Raykar Mala area. Builder Ganesh Raykar of ATM properties promised us the basic facilities like water society. But now almost 1 year after possession he still not giving the same. Please advise what can I do ?
I am a navi mumbai based builder , This is pure case of misunderstanding of sales person... Everything you said is saleable area but he/she quoted it as carpet .... we builder can add 35 to 40% depending on area and sell it as sellable area.... Its not a scam but an huge misunderstanding My architect usually add 38% as loading but we mention it correctly always.
Obviously those were not mentioned properly or why would they complain? And, I don't know what rule you are talking about. If a room is promised to be 206 sq ft, it should have that area inside. Isn't it?
Carpet area mentioned by Builders is always rera carpet area (which includes the inner wall area and excludes the balcony,terrace area) + Balcony/Terrace area. This is not fraud as much as disinforation. Customer s can always check the layout that builder provides and calculate the area. It will always be less area than what builder advertises. If confronted they will give the same explanation that i did.
