Great subject thx for bringing it up. One note 1300 gal. is not a lot of water, that's 2 minutes on my farm, don't let them limit you. Agree with your moral delima on registration was faced with same issue. Did not comply. My fence line is the last line in the sand to be crossed

I remember when they first started talking about metering private wells around here. It's stand your ground time...I told a fella from the department of lands if he came on my property and tried to meter my private well I would shoot him in the face. That was about fifteen years ago and the people in the restaurant though I was bit unreasonable with the lad...today those same people don't think I was that unreasonable Get possession of your mineral rights as well as your water rights and then DEFEND THEM!

Yup, they used this tactic in CA. A large reservoir was diverted to the Pacific Ocean to protect a small "endangered" fish and remove irrigation from farmers for food production. Take action now!

Thank God in Oklahoma our water rights belong to the Indians and they encourages us all to collect water and dig wells.. Our state tried to sell the water here years ago and the Indians fought them and won.

This same thing happened in Idaho over 35 years ago. I don't know about Bonner and Boundary Counties, but it was still through the Dept. of Water Resources. It was called The Snake River Adjudication. All water that was watershed in the area of the Snake River, (I was in Adams County), needed permits for water rights. It was reversed shortly after. I still have water rights in the Little Salmon River area. I would look into this deeper and not let this information scare you. If you're concerned, it's easy to get water rights. It will cost, but it might put your mind at ease. I'm no realtor, but I think when you purchase your property, you also will own the mineral and water rights under your property if you make sure to. If an aquifer dries up or changes course (as our family well did after an earthquake) the amount of your water from your well might diminish. It will be interesting in the years to come regarding water. I don't know if this is true or not, but I have heard how China has been buying up large tracts of land, farms and ranches, just for the water. Look at the Nestle company and how they have taken over water resources to sell their bottled water.

In some states you do not necessarily own mineral rights under property you purchase or own. I'm an Idaho native but I own 3 mineral deeds in Oklahoma that I inherited from my father who is from Oklahoma. My deeds cover all minerals found under the private properties they apply to but I can not extract any minerals without the property owners permission. They have use the water but nothing else.

Yah, as long as water rights are written in when buying the property, you own it. Filing for water rights in states like idaho is also not very hard.

Please everyone. This is not about meters. This is about claiming your water rights. If you have a well that was drilled by a licensed well driller, the IDWR knows you have the well because there was a permit and it is all recorded. This is just claiming the water you are using. Idaho is a first in time, first in right state. That is Common Law. This also only about the Clark Fork-Pend Oreille Basin in most of Bonner County and a small part of Boundary county. Some of Bonner County was already adjudicated in the Coeur d'Alene Basin adjudication where the USFS and the CDA tribe were trying to control all the flowing water. The state of Washington was trying to get their dirty paws on our water too. The rest of the state has already been adjudicated in different basins since the 1980's,

this would be my take. This is an opportunity for those who have not previously received state acknowldgement of their water use to file it and make a claim. If you do not file you are taking the risk you may be denied the use some day. If you don't want to file, and continue to use the water good luck, hope the registered downstream users dont coming checking on your use someday.

@@jeffreymerkeley4526 i think you're missing the point. folks that have drilled/dug wells on their property shouldn't need to file any claim to water access. the result of not doing so possibly resulting in the state denying access to the water beneath the property is the issue. they'll start w/ "it's just the large swaths of acreage (usually farms) that we're looking at," but everyone knows it's only a matter of time before it hits the folks w/ any acreage at all. your comment of "registered users" coming to check on the "unregistered" shows which side you'd take. good luck telling someone who's been on the land for decades they shouldn't have access to their water because they aren't "registered." you won't be around long.

Even if you register your water rights, the next step the government will take will be to separate your water rights from your property when it is sold or transferred. Of course, it will be done for the sake of the "collective common good". It is simply taking your rights, one drink at a time, and people feel helpless: creeping socialism.

@@raysova7666 Yes. Most of Missouri has no building restrictions or laws on water collection. Very good aquifers and the strongest gun laws in the nation since SAPA (second amendment protection act) was passed. Missouri is what Texas THINKS it is.

I would write an affidavit and a Declaration of my rights to my property and all natural resources in or off of my property. I would also take notice that I don't consent to any gov officials or public servants trespassing upon my property would be in complete violation of my rights and could be met with reasonable force.

In California, they have a program where if water is scarce, they can limit the amount of water a municipal household is allowed to use per month. If the municipal government declares you to have used an excess of water, they can shut off not only water, but electrical and gas service as well. What I have been told is they can remove the meters and cap them off. You, the resident of the home will have to either apply for new service or the city/county can declare the building illegal to occupy and evict you from your home. You will still have your mortgage to pay, and if the mortgage holder finds out the house is not able to be occupied, they can change the price of the monthly mortgage insurance. Don't think Boise is not going to look at what they can do to their own subjects. It is time to work to revoke that legislation, by the use of a citizen initiative, if Idaho had that. If not, or even if they do. Find out who voted for this disaster and work to remove them from office. Even if they are not in your county, support candidates in any county that will agree to void this legislation completely. Country folk and city folk alike are in danger

I think we’ll see more of these resource grabs in the future, especially in areas surrounding large populated urban centers. There is no resource of greater importance than fresh, potable water. I’m fortunate that Texas still had reasonable groundwater capture regulations BUT we have enormous growth in our major urban hubs that already demand fresh water from outlying areas (e.g DFW, Austin). Thanks for providing this video. It’s a good reminder for the rest of us.

I have a grandfathered well in Canada . My local community all draw from the same aquifer . My new local municipality has responsibly restricted any new dwellings for lack of water to sustain them. I originally came from a community that grew and grew and grew with not enough water to go around. No lake source or river only aquifer the entire community’s rely on. Extremely irresponsible planning and all about more tax revenues and not about the quality of life for the life time residents like me. I left that community because the growth over the years drove the housing markets far beyond my affordability and the policy makers had no concerns about that. The higher the markets go the higher property taxes they make. And none of it went back into infrastructure . Still no good post secondary school and not enough water to go around . The watering restriction start before the kids are out of school for summer vacation and you are fined if your caught watering on you non watering day. Your not even allowed to wash your car. They drilled another well in order to get more development underway but the dumb dumb residents don’t realize the new city well is drawing from the same aquifer only in a different area. It was a million dollar scam to me in order to approve more high end subdivisions my children will never afford. My point here is if your state is taking census on water it may be for good reason and responsible planning so you don’t run dry like my old town that is fully metered. My new property dwelling has run dry a few years ago and I’ve paid big bucks to fill the cistern yet I live in a rain forest on Vancouver island. When you understand how aquifers work you understand they are not forever. California has run dry and many 100 + years farmers have gone belly up. Look at the population growth there. Consumption far far exceeds the aquifer replenishment. I’m going to invest in rainwater harvesting and have studied aquifers and water scarcity ( world wide ) for this reason. I also want to build another home for my children on my property in the near future and the municipality will only approve it if it is subsidized on potable rain water. ( responsible and fair policy ) The best way to be active on this is to promote water conservation. Low flow showers and toilets . Underground irrigation systems save 50% consumption from evaporation. fight tooth and nail against large scale developments. Demand transparency regarding this letter in the mail and the truth behind it? We all need farmers ! water scarcity is a world wide issue even in a rainforest like Vancouver island and my old town Gibsons BC. And thank you Idaho I was raised on your potatoes all my life.

Idaho code concerning domestic wells “Rights to ground water for such domestic purposes may be acquired by withdrawal and use.” Domestic wells are excepted from these registration requirements, withdrawal and use serves as your acquired water right.

I have lived in Idaho my entire life of 72 years but my father is from Oklahoma. He left me 3 subsurface mineral deeds in 2 different counties in Oklahoma. I had to refile the deeds with the state of Okkahoma in order to retain rights for anything found under those deeds whether it be geothermal or oil or gas or gold or any other minerals. The private property owners where my deeds exist do not own access to any elements under the ground but they can dictate whether or not I can extract anything under their ground.

What happens when you buy a property? Do the claimed water rights of the prior owner transfer over to the new owner? What if you buy a property from someone who did not claim their rights? If they don't transfer upon sale, is this just a way for the state to own it all as time goes by until all land has eventually transfered over time? This is terrible.

water rights when they have been perfected are appurtenant to the land. As long as your deed doesn't withhold the water rights, the water goes with the sale of the land.

The government already owns all the water. If you buy a place with a previously filed water right, you can transfer that right with the original file date. If you have water that doesn’t have a water right, you can file for one but your date only applies for when it was filed. So if your neighbor is drawing from the same water source and has an older water right and he uses all the water leaving you none, you won’t have a legal recouse to get your neighbor to give you water. If, your right predates theirs though, then you have a legal right to that amount of water and they have can be forced to reduce their use so you have the water you have a right to. If this video is what I think it’s about, it is a system that is allowing you to prove the use of your water so you can back date your water right so you have more protections from others drawing from the same source. And if that is what it is, it doesn’t apply to boundary county as he claims. Of course he never mentions WTF he’s even talking about so it’s hard to know. But that’s what I expect it is and he’s just as full of S as the mainstream media reporting on the Kenosha kid.

Adjudication of water rights is something most states in the west update every so often because of a principle called “Doctrine of Prior Appropriation” and it’s a BIG DEAL for large ranches, agricultural farms, or multi-generational homestead estates. You’re absolutely correct we have an abundance of water here in Bonner County and have thus far never ran into an issue to my knowledge where mines, livestock, or property owners have yet run dry (minus some private wells) in the Panhandle, however if you read the press release IDWR put out last year, the Clark Fork-Pend Oreille River Basin is the last of the 3 major basins in our state Idaho Dept. of Water wants to figure out the ‘hierarchy of water rights’ to. Where the adjudication of your water rights is important however is one day there could actually be a day when there’s enough people who’ve moved in, and dry enough consecutive seasons that the creek or river that feeds your particular parcel is no longer viable to supply everyone living in the area. Or let’s say a new resident moves in, and re-channels the river onto their property upstream thereby depriving you and your livestock of the quantity of water you need to recharges your wells. You would obviously take him/her to court and say “hey, this is my water I’ve used for X number of years and I’m entitled to it.” Water isn’t always a renewable enough resource to go around in a circumstance like this, a court is going to say, who is first on the list of ‘Prior Appropriation’? If you go to the Bonner County assessor’s office and look at individual title reports, water rights are separated from general land ownership because it affects everyone in the radius of your property. A nearby orchard might have higher priority to water from 80 years ago than someone who’s just bought a piece of property to raise sheep etc. Property rights are a “bundle” of rights for this very reason. No one lives in a vacuum and it’s no secret that Bonner County’s snowpack isn’t what it once was. The northern end of Pend Oreille used to freeze to where you could walk right over to Warren Island. Now all that being said, if you’re concerned about the state knowing where all your water comes from, just list the wells that you would want the court to rule in your favor should a neighbor sue for the water you need. If there’s an abundance of water which there is right now, you can pull from all over without anyone knowing or caring like you mentioned in this video. It helps to understand that in the days before Teddy Roosevelt helped establish the U.S. Bureau of Reclamation, water rights wars were a serious point of contention and deadly conflict between cattlemen and farmers ALL OVER THE WESTERN U.S. This is why there is a ‘doctrine of prior appropriation’. Just south over in Kootenai County/Eastern Wa. for example, the farms on the Rathdrum Prarie prior to the 1950’s didn’t always have enough water for all the old apple orchards that used to be fed via ‘canals’ drained from the falls on the Spokane River over by Exit 5. It was through federal government grants that all those checkerboard water towers were put up with pumps to tap into the aquaifer underneath that solved the issue. The Bureau of Reclamation is who funded the Albani Dam west of Priest River to prevent flooding, Bonneville, and of course those east of us on the Clark Fork river like Cabinet Gorge and Thompson Falls over in Sanders County generating clean and cheap renewable electricity for the PNW. Now all of that being said, you could be right there’s some corruption here as mining companies like Heckla have had there eyes on areas like Rock Creek and a silica mine is trying to gain approval on the southern end of Pend Oreille at the base of Green Mountain under the public’s radar because if the Forest Service grants them a lease, they could potentially have a 60-70 period where that area is now off-access to hunters, anglers, and off-road enthusiasts, and they (the mine owners) have approval to DRAW ALOT OF WATER that otherwise should be going toward either local land-owners of the general health and welfare of the lake and wildlife habitats. To strip land down and level it for the silica underneath requires a huge amount of water.

They tried it in Arizona by putting meters on our wells. We fought it in the Supreme Court and won. They even tried to out law catching rain water. It fell through also. Take it to the Supreme Court.

Avoiding claiming your water right will just make you more vulnerable when water is scarce. If you don't make a claim, you'll have very limited legal recourse if a neighbor is taking more than their fair share. This isn't about taxing anything.

The title report and guarantee grants property rights based on recorded information, liens, easements and water rights are included in there just like mineral and mining rights. You all need to take this seriously. My lands water was taken from my in laws and the county closed the springs and redirected the pipes to flow from their water source, the James, and started billing them in Henrico Va. They also had to pay for the new system's installation and lost in court when they went. Of course they did. The government thinks it owns everything, including you. You are sold on the stock market if you have a birth certificate so you are nothing but property that can perform a task. It's unbelievable. I don't think they even had the opportunity to register anything.

I wonder how they could know if you had a well . I’m in Missouri and they didn’t start requiring wells to be registered until 1988 . So any one before that is unregistered. My well was not finished when I bought my land . So I finished it but ain’t claiming it . Good luck with it .

I lived in Athol for 15 years and saw these things coming. Gov policies and regulations changing, increasing strict building codes and permits and inspections required for every little thing. Water wells drying up. I left.

Look into the Nettleton/Lowery case. The State of Idaho was happily allowing the Fed's to take the water rights from cattlemen. The two families petitioned the state to protect the water rights. The State ignored them so they sued the feds and won. They then sued the state for doing their job, and won the right to be reimbursed from the state. The State has refused to pay a penny for decades. The interest on the lawyer fees has devastated the families. Idaho Governor's and state Congress work for their self interest, not the people. It's a corrupt state masquerading as conservative

When you bought your land you have title. Go back and check what your title says. In California title gives you rights to so many feet underneath your land already when you buy the land. Does that make sense. Check your title papers when you bought the land. In your title papers it says you own So many feet under your land, that is binding. And then from there you will probably would have to have title attorney or lobby with other landowners there to fight this. You’re doing a great job and thank you for bringing this to California residents. JUST SO WRONG!

This has been threatened in TX as well - the rural area HOAs are informing their community residents that the county has informed them their water may be diverted to the city and they will no longer have access. It isn’t just in 1 or 2 states. This is something “specific” counties are pursuing all over the US.

I've fought for water rights for decades. It is essential, that when you file, you protest, in writing, that you have grandfather rights,established prior to the legislation, and you intend to contest said legislation- in court as it applies to your situation. Then you must organize, find a good water rights law firm and file a class action law suite , paid for by your organization, if you do this, you will win. Copy everything, always # correspondence with return receipt. Make sure to tie your protest to your filing.These devils will throw out the protest, keep all records.DR and carry on.

If it is left to you what you register, then register your entire property as a watershed. All low lying areas are reservoirs of the rain that falls and traverses your property are thereby claimed for the use of the owner of the watershed. This would include all percolation to underground reservoirs and would be reserved for the use of the property owner.

We are currently selling our home in California , we have two wells that currently do not have meters. Once the house sell the new owner will be required to meter and pay for the water in addition to the cost of pumping the water. Thank you for sharing this information...

I live in North Idaho. We have tons of water on my hill (Kootenai County). I have a spring under my house that we have to pump to keep it from flooding and when you walk around my neighborhood in the spring and summer, you can hear the water running through the soil and sometimes it just bursts and gushes out like a geyser. Sometimes a seasonal creek even appears. My water bill last month was $1.69.

I own 40 acres in Latah county. It clearly states in the purchase agreement that I own all water rights that flow under the boundaries of the land. I filled out the "permit" part at the ID department of water resources, not the "claim" part. If you fill out the claim part, you are admitting that you do not currently own the water rights on the property. This will supersede any sales contract you paid for and signed. Be careful. I spoke to a guy at the ID Water Resources, he says the State of Idaho has no interest in limiting or taking anyones water rights. They are trying to get a handle on dwindling resources.

A company called Sac a storm water company based out of Texas! We are being charged in Pennsylvania $20 per month for storm water ! So they build storm water drain systems! Ok that's great ! We started paying for this every month before Sac built the system. This past summer 2021 they built the storm water system on my street! So just how long will they change We the people $$$ for storm water??? It's crazy our government has made a business out of storm water in America!

@North Country Off Grid we've got 20 acres (undeveloped) in Bonner county; we don't have any water sources on the property, we plan on drilling a well in a few years. We'll start building in the Spring, primarily catching rain water and snow melt. We do have an area that behaves like a small creek with the Spring thaw. It dries up within a few weeks of warmer weather. Since we don't currently have a permanent water resource, do you know if can we register now for future access (well)?
