That’s not how hate crimes work. This was child abuse not a hate crime. There was nothing to indicate this child was targeted because of race. She is just the victim of a random assault.

It should be a 3rd degree felony imo, but since it was her first offense and the child wasn’t severely injured she got a lesser punishment. well we don't know anything about thewoman who did it really besides the fact this incident occurred. it's highly unlikely but she could have been dosed with a drug and had a reaction to it.... not likely, but then we can't just say she's less mature than this kid because she did something insane. more information is needed. but yes, in general i might agree if the cops are right - if she did it to impress people around her and decided to attack a child... she's probably not less mature than a 10 year old, but something is definitely severely wrong with her decision making abilities, if she wasn't intoxicated or in some other way compromised greatly.

I get what you're saying but there is nothing (again, unless I am not presented with more information not in this video) that suggests she did it simply because the kid was white. Sure, there might be issues if it were reversed but that doesn't make it valid (two wrongs don't make a right). To me, many of their mental age never seems to go past the 8-12yo mark, it tends to peak at 12yo at best in most cases. Giggling and smiling as they break things and people. They physically develop faster, but also peak sooner. I think the girl was facing to the show window and didn’t even know there was the woman behind, so maybe only battery, but I think it should be aggravated battery since she use the glass window to attack her. Depending on the state. But I think we use assault when it’s clearly intentional attack not accidental injuring in casual talk.
