I understand it's your right to film you weren't doing anything wrong but it's not your right to be a total a****** so next time just answer the question and quit being a douchebag. I personally know that cop and he is a really good guy so he was just checking in on those women to make sure they were okay because they felt unsafe. So next time yes you can exercise your amendment rights but quit acting like a total douche
That was pure art. You shut him down with absolute style. You remained calm, but assertive and used nothing but law, and facts. A small note for the cop; glad he took the whooping and walked away. Many more wouldn’t have been able to resist their own ego. An awesome audit.
Erik Williams I didn’t say the cop acted perfectly. There were a great many things he did wrong. However the only compliment I gave was that he didn’t let his ego ride over his choices. He walked away with his tail between his legs where many other cops wouldn’t have done.

That's why I enjoy watching these audits - those educational turning points like the one at 3:04 where the cop realizes that you know your rights and that his spiel to get your ID (which works on most citizens) will not work on you. You can see it in his face. He was put in check but was nice about it.
Extremely well-done. Outstanding on many fronts and a true example of how to properly do these types of audits. Indiana News never lets viewers down. A crucial element, which Indiana News displays with pinpoint accuracy each time, is standing ground and remaining firm in the face of police confrontation. This is easier said than done for many of us that do these audits nationwide and is of paramount importance each and every time. Having a "rights" card is always helpful in setting the tone for the encounter since it "stifles" them almost immediately and lets them know, that as the auditor, you know what is going on and will not be screwed around with. Not even for a minute.
Great as usual.. Thank you for your service. More often we're seeing the term 'feelings' come into play in all aspects of our society. Laws are being proposed and passed about personal feelings and being offended. The work you and other auditors do is greatly understood and underated by the public at large, but incredibly necessary.

I always carry a notepad because I forget things. Recently I bought a fanny pack too - I carry my notepad in my fanny pack... these things are awesome.

You did an outstanding job of interacting with that officer. Certainly far better than I ever could. It would have been nice to get him to say his name and badge number. Also, pursue having allow you to inspect his law enforcement identification card. Another possibility is to assert your civil right of Free Association and choose not to associate with him.

Don't you just love it how their vehicles say Public Safety and yet a vehicle had to go into the left hand lane on to oncoming traffic if there have been any to get around them while he was double-parked talking to his Thug buddy. Excellent vid thank you very much

Should have demanded his license, registration and proof of insurance. He was illegally parked across a driveway without his emergency lights - that is an illegal act and he is not above the law

Officer when you show up or just passed by you make me feel uncomfortable . Because I know you're not held accountable for your actions and you follow no traffic laws .
This auditor handled the fifth amendment protections perfectly. After a little fishing, the officer realized he was in a checkmate situation and disengaged. The fifth amendment gives you the right to remain silent and not answer any questions during a police encounter. However, first you MUST verbally announce you are invoking your right to remain silent; THEN you can legally refuse to answer questions. NOTE: There is case law that says total and complete silence (not verbally invoking your fifth amendment rights) can be cause for an obstruction arrest.
leef_me and Slim News - I may have mis-spoke using the term “case law”. Remember, the police can and will do anything they feel like doing, legal basis be damned. There are RU-vid videos of a traffic stop in New Jersey where a lawyer did remain totally silent and the officer arrested her for obstruction. While the case was dismissed, a wise auditor should always exercise strong CYA behavior unless they are prepared to be arrested. Search RU-vid for “lawyer arrested for remaining silent.”
Slim News - good to know. 👍 however I believe there are many other cases where such silence did not have such a happy outcome. Always best to CYA when dealing with police.
CHC Cops Hate Cameras ...FL Statute 901.151 is the Stop & Frisk (Terry Stop) guidelines. 856.021 is the Loitering statute, nothing to do with Failure to Identify...901.151 is the applicable statute that Akron Ohio needs...aka “Terry Stop.”
Two Black Labs COPS in FL will often pair the two. 901.151 says "a violation of the criminal laws of this state" and applying 856.021 can make that happen. If you are loitering, you are in violation and must ID. Of course, you and I know that won't fly, but many persons who may know the Stop and Frisk law might not be as familiar with the Loitering and Prowling law, thus will ID to the COP.

The application of the Texas statute to detain appellant and require him to identify himself VIOLATED THE FOURTH AMENDMENT because the officers lacked any reasonable suspicion to believe that appellant was engaged or had engaged in criminal conduct. The Supreme Court has interpreted the Fourth Amendment use of the word “seizure” to mean both the seizure of evidence and, as in an arrest, the seizure of a person. The Court also applied probable cause to searches, seizures, and arrests conducted without a warrant.
