It's not a Legal Capacity to contract marriage. It's still an affidavit of capacity to contract marriage. These are two different things. An affidavit is a sworn statement, the former is a legal document where the embassy is affirming. The US does not keep a database of marriages. Due to this they can't give a document such as the Legal capacity to contract marriage.They do offer templates online for you to print and fill out on the embassy website of the affidavit. This is what you will be getting to have notarized. Ask the local LGU/PSA what notary accept (local or embassy) before proceeding.

Yes you will need an apostilled birth certificate. If an American like me you can get it from the state you were born in. Let us know if you have any other questions.

@@ZechsMarquize Hello, I am trying to get everything together for a philippino marriage next month. These items you mentioned (American Birth Cert, Id's, decrees, ect)... do they ALL need appostilled? These get presented to the American Embassy so shouldn't they recognize official state certifications?

In that case po,mas ok po Kung punta na lang kayo or mag walk in kayo ask nyo mismo doon sa embassy ,sabihin nyo sa guard Yung situation nyo na ganyan .. TAKE NOTE:malayo pa lang dapat po ang inyong kasal ay set nyo na agad ang appointment dahil nga po nag kakaubusan ng slots😊

PSA OFFICE is place where you can get your cenomar certificate. Cenomar is proof that you are not married to anyone,means your single.CE NO MAR CErtificate of NO MARRIED
