Too early to assume guilt but before 6am it's dark this time of year. If he was on the shoulder not much of an excuse but if he was in the traveled part of the road it may not be the fault of the driver. Before 6am on a sunday he might have been walking home drunk after partying as well.

NOT TO EXCUSE THE COP WHOM HIT THIS BOY , BUT , A SHIFT WORKER AT 6 am COULD FALL ASLERP AT THE WHEEL , OR BLANK OUT FOR MILLISECONDS ,, MIDNIGHT SHIFTS ARE DANGEROUS
