The insurance system is strange - the US companies insure the Americans, the London insurers cover UK and Australia /NZ residents and the EU cover only EU residents as I have been led to believe. The main Australian companies only sure in Australian waters...This would lead to wide variations in cover provided.

Being a lawyer, I would naturally advise contacting a good attorney knowledgeable in the field and have a discussion regarding the policy and coverage at the time of purchase; and, needless to say, I would also further advise immediately contacting a lawyer to represent you when claim time comes about. The cost, percentage wise, may be the most beneficial investment you can make.

Great video and great advise, tks so much. You did not talk much about liability and this part is what I was thinking first, special as there is another boat involved and this can end up much higher than the value of the boat and end up going after your other assests. Looks like you are well covered and I am really happy to see that you put a lot of thought into this, but just curious if there are already talks about liability and if the coverage is sufficient and what would happen if not?

@@friedrichplankensteiner5626 Dear Friedrich, the liability is likely to passed away from our insurer to others so my liability will not need to cover the L45, I understand. As I said in the video, my 3rd party liability is only $500K that would not cover the value of a L45 so next time, I will increase that amount. I presume if the cover was not sufficient, then the innocent party would probably need to sue the liable one personally if the insurance does not cover it....

Hello John! Your advise is spot on with insurance. The time to read your documents is before you need it and not after as I’m sure there are many people that have benefited from your experience. I have read that some boaters can not get insurance coverage during hurricane season if they make the decision to stay in a country during their hurricane season. It appears that boating is more about destinations chosen by insurance companies and not your own agenda.

In the US, varying by state, auto insurers are generally required to pay a claim within 30 days. It is their problem to get an adjuster out in a timely manner. Of course no one learns about that unless they ask the insurance regulators. But are there any similar time constraints under your state laws for boats in Oz? There are also games with insured, agreed, or market value. Market value must be in accord with state regulatory procedures, limited by sales of extremely similar type within a timeframe and geography. Agreed value often carries a smal footnote "or market value whichever is less". A really good broker (like IMIS in the US) will point out the fine points and catches when comparing policies.

There do not seem to be any time constraints in the US for boats and there are not in Australia that I am aware. Given that before this year I had not claimed I don’t have past experience in that aspect but there seems to be no rush for them to pay us or the salvors as that often takes months... Hence their demand on us to pay up front

Thanks Ray. These insurance tips are also very important when dealing with travel insurance and possibly house insurance... Once we had valuables stolen from a locked car while on holiday and there was a clause that read that unattended cars are not covered so they paid us nothing! Thanks for your kind words!

I would also suggest keeping copies of documents in a secure place, perhaps with a competant shore contact and also in the cloud. This should include everything from receipts, photos, logs, maintenance work.

Yes that is absolutely true. For our next boat, I think I need to find a good program that can store receipts as you get them, photo or scan them and file them in a document that can be accessed in the future. Mostly the paper receipts go into our pocket or wallet until there are so many the wallet won't close and then they and store somewhere that can never be easily accessed...

@@barefootdoctorssailing8567 Yes .... invaluable to have documents readily available on one's computer and backed up both locally and to "the cloud". Here is what works for me. I have a simple file system on my computer, creating folders and sub folders, as necessary, for each category. I find it important to either scan the document or use a supplied pdf format of the file if available, within a day of receipt. It is not good to have documents pile up to be scanned, because then it becomes a real chore to go after a pileup of them. I back up all the folders. Once a week I backup all the folders to a removal drive, temporarily connected to the computer though its USB port. A quick process. I am a bit paranoid about hackers getting into my computer and stealing or corrupting my files. A last step, which is automatically executed is to back up my files to "Dropbox" in the cloud. My approach is a cost effective, easily managed, and can be scaled up as required.

Thank you so much for sharing all your learnings from the awful demise of Ultra Dash. My heart goes out to you both. Just glad no-one was injured or worse. This episode about insurance reminds me to get more sailing experience before purchasing a cat, or I may not even be able to get insurance at all. I am chartering a FP Elba 45 in 5 weeks time in Croatia, so that I get some experience - try before I buy! Thanks again for inspiring us to get out on the ocean and explore this beautiful planet. I read a quote recently that considering the coverage of oceans on our planet, we should not call her Planet Earth, but it would be more accurate to call her Planet Ocean or Planet Water! I think if we were visiting from another star system, the oceans would be the biggest draw of this amazing blue planet. Much love to you both. Rob from the UK. PS. I am told they are very slow - possibly another month or even two! The investigation could not be started till the attorney was appointed so now the steps to START the investigation can occur. One concerning thing for me is that the assessor stated that often the insurers do not even release the findings, no-one accepts fault and the insurance companies just sort out the liability payments behind closed doors. However, it will be clear where the fault lies if my insurance passes the costs to the other parties and the verbal events of the day are reasonably clear and simple (from where we sit).

Thanks a lot for these informations. It is difficult to imagine what you are passing through. I am very interested to know the cause of the fire, if once it is known. Your boat was new, at the dock and it is a bit surprising such a fire. Normally all is done on this type of boat to obtain a switch-off of electricity before an overheating of the cables. It mean that the overheating wasn't detected, as a consequence that the overloading of the circuit wasn't enough strong to switch off the circuit. I don't know if you had "charger" like "iPad-Phone-Computer-portableVHF" one connected, but when failing these "charger" can create this sort of fire. It is even recommended to disconnect them when you are not at home. Second track could be the connection of your boat if connected to the dock. (?) Last track, is a brutal short circuit on a very high power circuit like the chain motor. Normally when docking you cut off this circuit to avoid bad surprise. If not, the intensity can be so high before an automatic switch off of the circuit, then it can create a fire. Good luck and Bon courage.

Thanks Ed, This fire was seen and heard starting by several people and without crossing boundaries, the speed that it went up was not electrical and there have been several reports in the news and RU-vid videos that point to a specific cause but we are trying to wait for the investigation to be done to make those "stories" public and spread only when they are known to be the truth. So rest assured, it was NOT ELECTRICAL!

Yes, but they haven’t actually taken all the plastic apart yet and done the inspection.

Thank you for the advice on insurance coverage, perhaps local sailors could also warn us of the pitfalls in boat insurance. I said last week the story of Mangrove Charlie that the boat looked a lot like the boat you built. The proper title is; How to build a sailing catamaran from nothing Mangrove Charlie. If we knew the timezone you are in, and you turned your computer on at 9:00am , or 9:00pm your local time. Also film your screen with a go- pro starting at the top of that hour for 15minutes. Nothing is faster than your camera so if our comment is deleated by censors it takes them 2 to 5 minutes to react sorry they missed the bus. Fair Winds!

Hi Rick, Yes I had seen the Mangrove Charley story before and the boat is similar to the one I built but is is a different design with significant shoulders (the wider areas of side deck to give more buoyancy and inside space) and mine is built of western red cedar strip planked and that one is marine ply, it seemed. But very similar with high bridge decks and daggerboards and they both would sail very nicely! I was not aware that RU-vid censors content - I know I have posted things and often they don't go up or disappear so I think that it is glitches in the internet system and not censoring as the content is unlikely to be strong enough to warrant being cut and stuff that should be cut (offensive and rude comments) and porn links seem to just sit there! @@barefootdoctorssailing8567 I also felt as you do about overlords they just protected us, but I have commented many times to you and watched it be taken down. Then the break through came when I felt sorry for a couple who were sick in their catamaran in Aruba. I made a statement the source of their illness. In a few minutes it was taken down. So I commented back that I guess we have lost our freedom of speech in America. Darren, and Krystal replied back ; We were watching our screen when they took it down. If I didn't post my disappointment they would not be able to find me. You are on a continent with the largest dumb in the world. This is an acronym to find out why. Considering the cost of the vessel and the damage they can do spending the money for for a lawyer to review the policy would be money well spent.

Two questions come to mind. 1. Are there countries that require a boat owner to have insurance, before they are able to enter their waters? 2. Can a boat owner put a sum in an escrow account, and virtually be self- insured?

1. Countries do not require you to have insurance but marinas will not let you in unless you have it. Many people sail without insurance and this why there are many abandend boats that are wrecked and the owners do a runner as they can’t afford the salvage costs. 2. If you can afford to put the value of your boat + $1 million for pollution clean up in an escrow acct, you are better to just pay the insurance! Hope that helps

Bottom line is don't be cheap when it come to insurance saving a couple of dollars on your payment would cost you dearly

Where does the babysitting service you hired to 'keep an eye' on your boat fit in all of this? What is their liability in all of this? Did they have insurance for such an occurrence?

We were having work done by professionals while we were away so they were in the boat probably every day so its not really "baby sitting".... The investigation will be looking into the events and what happened but all quality contractors have insurance with 3rd party liability so wherever the cause is found to be, that insurance will pay up... (as I understand it and trust the system works). Thanks for your support.

Now, with the introduction of working onboard contractors has introduced a whole new layer of complexity to the investigation. This has been a humongous learning experience for me and I thank you for sharing. I have asked about this since day 1 and the owners must know the answer but have avoided answering that question. That issue seems to be important. Would you agree?

Well, that was very informative, but now I have a headache! LOL Insurance is government forced gambling, you're putting up a giant wager that you will basically wreck your boat/vehicle and the insurers are taking that bet and putting in so many requirements and fine print clauses that stack the deck against you recovering your bet and ending up with some major losses no matter what you do. I've been paying for car insurance for 53 years, give or take a month or two when I didn't own a car, I've never had a claim except for one time when a mahogany nut fell out of a tree onto my windshield and cracked it, they denied the claim and said it was an act of God! I had to pay to have it fixed or get a ticket because driving with a cracked windshield is actually against the law! LOL The insurance that really cracks me up is life insurance, where the only way to win is to die!
