Five things you NEED to know before you step foot into a meeting with a Voc Rehab counselor so you're not tricked out of your benefits.
They will try to use these definition to trick you or deny you but if you understand their true M28R (since October 2020 called M28C) meanings you can defend your entitlement.

These definitions are so helpful. Especially since the VA has their own definitions, which are not the same as what we commonly know them as.

You are a blessing!!! I watched pretty much all the videos and used the criteria from one of your videos to get an SEH with the 9 points you made. I was deemed entitled 45 minutes into my meeting. Thanks for all the information and assistance!!

I was denied the first time but i definitely didn’t have the wording needed to combat what they said. Everything she says in this video the VA told me were the reasons I wasn’t going to be approved for the program I wanted. In fact, she even said “you’re just applying to the wrong jobs, you need to apply to these jobs because that’s well here your experience lies.” All good though, I have the ammo now and a new program that does make my experience shine. Feeling confident!

You are a queen! Thank you! I just had my initial evaluation and got entitled. I scrambled around looking for information then found your page. Literally just watched your videos and got entitled after a 30 minute virtual meeting. I was a bit worried your information could be a bit dated since the program rebranded, but not at all! Mine wasn't really a simple case either. I already had a bachelor's degree in economics from an Ivy League, had a high-paying job in Investment Banking, and decided to quit to pursue law enforcement given everything going on (hoping to try and make some positive change from inside). In case helpful to anyone else: I explained how my SCD was exacerbated by the job and harped on the lack of interest in the job and fields related to economics. I mentioned that I quickly realized econ wasn't for me, but had to just keep pushing through it because military taught me to complete the mission and because I was already in too deep. One tip: don't overplay disabilities that could get in the way of your desired career field. E.g. I had a physically disability listed at 10%. She got a tad hung up on being able to be a cop with physical ailments like that (I just explained that it gives me pain and issues here and there, but that it is totally manageable and that I still work out, do MMA, and run several miles a week).

If your 10% and I am a 100% does that mean i would not be able to get a career in ultrasound technician, Radiology, Health Information Management. I do a virtual meeting on June 20th 🙏🏻

I'm so grateful for you! I mentioned to a friend when I submitted the initial application and he said "you won't get approved; they told me that I needed to be homeless or have a narcotics problem." Well, one of your videos came up as suggested when I had to watch the VA's orientation video. I finished their required watch then started clicking through yours. I had my initial meeting today and was approved. Bless you!

Thank you! I just finished my orientation/assesment. Within 20 mins of the appointment the counselor told me that I made her job 1000% easier and that I was found entitled! Your information is very informative and to the point. I felt prepared and ready for this appointment

From day 1 all of this has been hurdle after hurdle. Say the right thing or they deny you, etc… Exhausting. I work with a fellow vet that won’t even start the process. Can’t convince at all because he doesn’t want the headache. I told him that’s what they want…for us to not even try.

It can be very stressful to go through this process, but not every VRC is horrible. A small percentage of them are very fair and won't take you through this kind of hassle. Your friend could try and just quit if it got too frustrating. He has nothing to lose 🤷‍♂

Thank you for your great content. You helped me get entitled and approved for a Bachelors, even though I am a GS11. Your advice on what gainful vs Suitable employment actually means helped me prepare for my initial and whats next appointments. I was feeling backed in a corner and trapped not wanting to lose my family’s quality of life. You have opened a door for me. And at a perfect time of me needing dental as well. Omg Nic this is great information ❤🎉😊 Thank you so so much!!! I am 100% P/T since 2003. I served in the Army from 1990 to 1995. My apt is June 20th and looking forward to it. I found a job in a hospital as a Inventory Analyst. I have been working this job for the past 5 months and the only reason I went back to work is the inflation affecting everyone 😢 and all i have been doing for years is be in pain and not doing anuthing. Ita the only thing i can go back to is Inventory Management. Here is why i signed up for the V R & E. The position i have is to aggressive to my body. I cant do it anymore. Trust me it pays 21.00 an hour but i just cant. Standing for more than an hour kills my feet., knees and back. I would love to work for the VA and that is my goal. Thanks again Nic for all this valuable information ❤

I am in the same boat. The first time around I had to pick 5 careers and I did. They would not let me do any of them. On June 20th i have a virtual apt with a VA counselor. I am scafed they will deny me 😢

Please be aware that they trick most vets by concentrating on and rejecting your desired track/path/education goals instead of addressing your entitlement. Stay focused on why you're entitled. Tell them you're open to a different track after being found entitled but you want to be found entitled based on your EH/SEH first.

Ronald Lewis If your job is exacerbating a service-connected disability then you can be found entitled but it’ll be a lot harder for you because of your degree and good job. With a masters degree and a good job, what they would likely want to do (if they find you entitled) is work with your employer to give you better working conditions so your service connected disability’s are not exacerbated.

I just met with my rep today. I didn’t have the paperwork finished but he wanted to interview me and he said that can make a case either way. In my case I have a job and I have a degree. He said on one side he can say I need the program because my employment record shows I move jobs a lot and that can be due to my SCDs and the other point t can be made that I don’t need assistance because I am employed. He also said that every job can increase my SCDs and since I work from home I have more opportunities to take breaks as needed to destress. He said for me to write up a good reason in my paperwork. I’ll keep the group posted.

I want you to understand something. It is the VRC and the VRC ALONE who makes the decision to find you entitled. He doesn't have to justify it to anyone, he doesn't have to get anyone's permission, he doesn't have to get anyone's approval. The fact that he's even pretending that he has to do that, or suggesting that he's doing some type of stressful preparation behind the scenes, suggests one of two things; either he enjoys the power and wants to make you think that a lot more is happening so that you are super appreciative when he approved you or he's just a liar who's using that as a made up extra work as a foundation to deny you later by saying "they said no". So let him play his little game, but you need to understand that if he comes back and tells you that some other entity said no or pulls some other made up crap, that you need to be prepared to fight for your benefits. There is NO requirement that says you need to write up a good reason to be found entitled. ITS THEIR JOB TO FIND ENTITLEMENT not yours. -If you have service connected disabilities that are exacerbated by your job or line of work and you do not have the education and or training to obtain different work that will not exacerbate your SCDs then you should be approved PERIOD. DON'T be moved by their made up stress or pretend challenges approving you, it's all an act.

1 year and got fuck all out of voc rehab. Was literally just the same job searching I did before but with extra pointless steps and being told I need a therapist when no one with friends pays $100+ a week just to talk to anyone outside of work.

Denied after a 15 min interview by phone because I had a real estate license regardless of the fact of not having a single sale in over a year and not steady employment nor interest or military training, explained how it aggravated my SCD and that any job in Law Enforcement of which I did for 20 years in the military I was unable to qualify for. (100% P&T). I was told regardless, the mere fact I had a license was proof I overcame. Was told the reason for denial was based on The Rehabilitation Needs Inventory, labor market research,.

My counselor said I had to be working at the time of application in order to be entitled to more benefits. So since I hadn’t found work In so long I was basically not entitled.

If they give you anxiety, don’t watch them. You can just go in and try your best to do it on your own and if you don’t get approved then you can come back and look at the videos then reapply. Maybe you’ll get approved without them 🤷🏽‍♀️

What happens if we left a job due to our disability ( couldn't focus, couldn't remember the rules, migranes, depression) for a new job and they throw that in my face and say "if you felt all of those things there what makes you think you wont feel all those things here once you get your degree?"

The degree is not the issue it's the job. Take a look at videos # 16 and 25 and also #36, and that should answer all these questions.

Anybody can have a serious employment handicap, but if you’re under 12 years since your first SCD rating, you don’t need a serious employment handicap in order to be found entitled. If it’s past 12 years since your first rating, then you cannot be approved unless you have a serious employment handicap.

Thank you so much for the information. Unfortunately I only have 10 percent from SCD and a handful of non-SCD I applied for and didn't get. If i worked in a physically demanding atmosphere in Deck dept. would that be any factor in considering if I have a SEH? I regret not going to medical more but I everyone was always so shamed for being sick I was always too worried to.

Having an SEH is not based on one specific thing so your job in and of itself would not be a major factor in determining your SEH status.Take a look at video #8, I go through each category of an SEH and how you can meet it. If you do actually have a serious employment handicap, then you can still be found entitled even with a 10% rating.

I’m watching this trying to get ready for the interview but I’m 90% and I’ve been unemployed due to scd for like 2 years now. I have no work experience other than military and working at a medical marijuana store less than 90 days. There’s no way they’re denying me. It would be a crime 😭💀💀💀

You’d be surprised, if working at the medical marijuana store does not exacerbate your service connected disability, is that it’s not a slam dunk. Make sure you look at video #25 before that meeting

@@iamnicthevet yeah it did exacerbate my disability. easily. that’s why i’m not working. i can’t stand longer than 15 minutes without my knees throbbing like splintering pain because patellafemoral pain syndrome 😜 i’d rather not have it but whatever lmao can’t go back now thanks to PT. 👍🏻😎 i have max for knees and max for tension headaches -caused by stress and exacerbated by the fast faced and LOUD customer service environment such as the place i worked. and then major depression / chronic fatigue for 70%. working somewhere i don’t enjoy or that motivates me is definitely going to exacerbate my major depression (it would anyone) and standing for 9 hours straight at a cash register isn’t good for any of them.

After being stone walled in Feb. & denied by some random supervisor for my entitlement of VR&E benefits. You have equipped me with the knowledge to fight BACK like a champ. I have a visit at the Vr&e building near me 2mrw to go over my disdain of being denied. I will update here 2mrw of what happened & what results I took away from this visit & etc.of me fighting for mines which I know I’m eligible for fully! ✊🏾💯 Thank you!

@iamnicthevet Okay, so it really hasn't gone yet. I went to the office & requested to go over my situation as I said I'd do. Yet, a VRC came out & we sat & discussed the matter. He told me after sitting & listening to file an HLR & also, to submit an internal E-va system inquiry abt everythiny that happened. And that would go directly into Vr&e. I didn't do any of that Friday. What I did do is call into Vr&e & left a vmail with the Vr&e coordinator of AtL office explaining most of the issue. If he doesn't call me back by Wednesday, I will file the HLR. The E-va sys. route will likely go directly to that supervisor who denied me in Feb. & the way I'm doing it now is going over her head from jump street. Whatever results that come from that detailed vmail I left, the coordinator guy will tell me which move I need to make next. The coordinator of the office should have the power to make a decision without an HLR I'd guess. If I can avoid submitting an HLR, which I believe goes straight to that supervisor anyway that blocked in 1st place, right? I want to avoid it. We will see...

@@RynAmelli84 I didn’t realize you were denied in February and I didn’t realize your meeting was an impromptu one. I think you should just reapply. I’d be shocked if anybody called you back. You’ve got a much better chance of just trying again plus HLR’s will take months.

@iamnicthevet The advice is noted for sure. I will make my decision on the next steps to evthing this week by close of business Wednesday. If I haven't heard from him, I'll just re-apply. Also, when I spk to a V.a. call center rep Friday, he told me that in the system, it's still an active file. From the counselor I dealt with in Feb. so, he said he couldn't understand why that would be if I were denied back then. I had no answers for that one, like lol. I have that counselors contacts, yet I haven't heard from her at all since she told me via text/& Eva system the supervisor denied me. Lastly, I understand abt the HLR yet, I tght a Vr&e HLR was diff. process than like a disability claim HLR & more internal to Vr&e & wouldn't go all da way to D.C.!?🤔

Should a vocational specialist have access to your personal link? I know that your supposed to send them each job you apply for , should they have access to your personal link. Such as indeed, monster so on?

“Personal link“ is a bit vague but I wish my VRC would ask me for a link to my social media or God forbid a password. You do what you feel you need to do but I wouldn’t give them that. They are free to look online at whatever they want just like any other person with Internet access but if my vrc asked me for something like that I would question their intentions to the nth degree. Their duty to assist is to find entitlement not find reasons to deny you. Then, once you are entitled, your LinkedIn is irrelevant.

Please explain this to me. I watched your videos for the first meeting. I took my notes . Got approved. Now I am being threatened with having my case closed because I have to apply to the masters program, which requires the GRE. I have never done this test before and the case manager gave me 30 days to apply to the program or my case is going to get closed. I am trying to do things right, it’s a competitive program and my GPA is short by 2 cs and a D. Why the F*** didn’t they tell me to have my GRE taken before all of this. They made it seem like don’t apply to the program at all because if it’s not approved to exacerbate your disability then we will not cover it. Wtf? I’m so irritated because now I have to reapply to the program and submit this dumb ***again if I can’t get the test results done within a few days. I don’t even think I can schedule for the GRE and get the test results within the time frame they have given me. Please help? What should I do. I need to get a stipend now. My rent went up, my moms rent went up and my car is gonna break down any time now. I gotta bust a move and get that box rehab and I am tryna put my best foot foward but they wanna rush and stall me. This *** is so annoying. All they had to do was be clear about what I need to do in the first place. You should def do video on this because many veterans are wasting their time and it’s not even their fault. They should told us this in first place but they rather make it some secret. Please do a video on how to use the program to get a masters with a background in a useless degree.

Video #37 covers how to use the program to get a masters with a background in a useless. A GRE is not a vr&e requirement, it's a degree or school specific requirement. My masters in film didn't require a GRE, many universities don't require a GRE at all. I don't know your situation but some vrc's will lie and say it's required just to deter you or remove you from their caseload. As it relates to your late bills, they don't care about your late bills, it's a COMPLETE non factor. Your options are to find out if your school/degree actually requires a GRE. If it doesn't, escalate your concern about the vrc making up this requirement and ask the they allow you to proceed and start school without it. If it IS required, get it - or switch majors.

I have a 40% service connected disability, and I am preparing for my initial Voc rehab meeting. I want to know how best to present my current work scenario. My wife is a 100 percent disabled veteran and I "work" as her home caregiver through the VA. Do you think I should list this as employment, or that I'm not employed but enrolled in the VA caregiver support program?

The primary argument is generally that you need more income to support your family, that you need more training/education in order to find suitable work but I dont have enough info to give a real opinion. It depends on your tier. If you’re compensated on middle or high tier, that means you’re paid for 25-40 hours of care for your wife so it may be tough to justify your getting trained to go to work full time when you’re already being paid to “work“ 25 to 40 hours a week for your wife (theres only so many hours in a day). It also depends on the path you’re interested in taking and whether or not you have an employment handicap versus whether or not you need an employment handicap or a serious employment handicap. If you want to email me I can help you figure all that out but I would first need you to address the issues above. If you want that help, look at video number 16 before you email me and then let me know whether or not you need/have an employment handicap or serious employment handicap and we can go from there. As for telling them or not telling them that you “work” taking care of your wife, they already know that when you come in because they can see all of your VA related records/payments etc.

No service connected disability can be explained as an employment handicap. Please watch video # seven in its entirety and then, if you are still not sure, you can follow up with video #16. An employment handicap consists of a three part criteria.

Since the Chapter 31 description is so short and vague on what they pay for, is there anyplace I can go to, to get more in depth info ? example - says you get a housing allowance, next paragraph says they don't pay dorm cost ! says it pays for supplies but my coach starts rattling off supplies it doesn't pay for.

I don't know what a coach is and I don't know where you're looking to suggest the chapter 31 description is short and vague because it most certainly is not. Video # 40 goes over how to ask or what you need and video #36 goes over what to do if they say still say no. The VA is not going to lay out the red carpet to give you everything you want and they're certainly not gonna make a list of "all the things you can have" If it's not on the list that says you can't have it, then you can have it. If your counselor says you can't have it, he's lying.

@@iamnicthevet Anxiety disorders/panic attack. I have a written generalized anxiety disorder diagnosis from my doctor and I am currently in a Masters in Nursing program. My undergrad is in corporate communications.

I am on 100% P&T, is an EH helpful to have? I don't seem too interested in it if it doesn't do much. I don't want to annoy the counselor. I had voc rehab before for a professor route but I dropped it temporarily to stay on GI Bill because her case load was huge and communication via email was every 3 months.. But they called and told me to come back and apply. Since they hired 12 new counselors. I haven't held a job since medically retiring 5 years ago.

honestly, all 3 of your statements are really confusing to me but an EH is not just beneficial, it’s the only relevant factor in your entitlement. You might want to look at video #16 to see if you’re entitled and video # 10 to see if you’re even interested in this program.

I don't know what to do. My voc rehab counselor has already qualified me for VR&E, and I am about to start school. Me and my husband don't make enough just getting VA disability, and the BAH would help, but I'm still worried. If I get a job, will the VA not pay for my education?

Not knowing all the details of your situation I don’t feel comfortable telling you what they will definitively do but I’ll give you a general answer. If you’re going to school using Voc Rehab and you have to get a job in order to support yourself, that will not get you kicked out of the program. You should be good all things considered. If I were in your shoes, I would not be too concerned with it.

Good day, Ms. Nic. I am a veteran who exited in 1992. At that time, a lot wasn't known or we were not as informed as the veteran post 9/11. I have been drastically suffering since since getting out but I can honestly say, the signs were there before I got out. I just didn't know what it was. In 2013, I filed for my first disability. At that time, I didn't remember any of my medical issues but I filed any how. My mental claim was denied but I have since received documentation from my two sisters attesting to the difference of the person that went in versus the person that returned. I have been homeless many times and closed off from family since returning from the military. I have my first VR&E appointment tomorrow. Since I haven't received recognition for my mental disability, do you have any advice for me as it continues to be a major hinderance and has been?

If it shows up twice, forgive me for that too😉. if you currently have no rating then you would not be eligible for vr&e services, I don’t really know what to tell you as it relates to getting your health issue recognized as service-connected except to say keep appealing and try not to claim a new file, try to keep the old file open so that way once you’re actually approved you’ll get all the backpay from the original date. Maybe check with DAV or another VSO for help, They helped me a lot in the past when I was hitting brick walls. Sounds like you’ve really been through the ringer. Hang in there👍🏽

I have read the Voc Rehab handbook and I believe those counselors pick veterans based on favoritism. I do not believe these counselors are intelligent enough to have read the handbook and know veteran affairs definition, policy and terminology. I do not believe these counselors even hold a degree and/or certifications. They are low level GS employees who make poor decisions on eligibility screwing veterans over applying for VRE. All those counselors need to be fired and need counselors with Masters level degree, who have background in government policy to properly assess veterans for eligibility for Voc Rehab.

Just for the record, about half of the VRC's do have masters degrees in vocational rehabilitation and it is now a requirement for new counselors. Not all of the counselors pig people based on favoritism. About 20% of them are honest and do the right thing. That's why as a veteran, you need to understand the rules and the guidelines so that you can get what you want from the program.

Had the interview today. I have a law license asking for help getting a masters in law (advanced degree). Was told I don't need help. I have a bachelors and a jd. What I really need is help with my resume. What a joke.

The law masters (llm) is a degree higher than the JD. It is a degree employers will substitute for experience in a field of law. So, if you have no experience in the law and can't get hired to get the experience, the llm is a way to sub education for experience. If I am missing something, point me to the video I need to watch. When the M28R put in bullets like this, the vet need to show that he/she cannot meet ONLY 1 item (not all 4) to be determined NOT Suitable, correct? I'm just not sure it's an AND or OR requirement. "Suitable Employment • Employment which is consistent with the Veteran’s expressed interests, aptitudes and abilities that can be measured and/or demonstrated. • Does not aggravate the Veteran or Servicemember’s disability(ies). • Is stable and continuing. • Requires reasonably developed skills."

Congrats on your entitlement 🎉🥳🎊. As for the major change, I can't really tell you how to explain to her that this is best for you. This change is specific to you, your SCDs, your abilities, your wants and needs, etc. Just spell it out and explain your interest lies there, you have experience there you'll be successful there, that degree won't exacerbate SCDs because of XYZ. You can do it, you got this👍🏽
