You mentioned the 4 key factors (Financial, Social, Commitment and Cohabitation). Is it still possible to apply and be granted the 309 if you are married but do not live together (say for instance in two separate countries) with a view to moving together in the near future? We can prove the the other three but cohabitation will be difficult. Is this one more for defacto? Thanks
Hi Kanzzz - in situations where couples are applying as a 'Spouse' (i.e. married) the law requires that they be able to show they either live together, or do not live separately on a permanent basis. If you can demonstrate that you have lived together previously (i.e. when visiting each other and living with each other during those periods) and have strong intention to live together in future, then this may satisfy THAT requirement. Separate to this however, is the need to show that the four aspects of your relationship demonstrate you are living like a married couple. Given that the 'nature of household/cohabitation' aspect is going to be weak, this would mean the remaining three aspects (financial, social, commitment) would need to be STRONG so that, overall, the four aspects show you are a in a committed married relationship. Does Sponsor also need to fill up the application from his immi account or only applicant's (Partner who is outside of Australia) application is enough?
Is it a must to live together for some time before applying for a partner visa?? And to have joint bank accounts and house bills?:/😥 I find it a must in some websites and some others say it isn't necessary😐😐 Which is correct 😑🤦🏻♀️
