The name should be disclosed so that others cannot be cheated secondly he must hv cheated someone before maybe that person too can file the case and the case gets more stronger...
@@shaileshjoshi7912 you can always disclose the name if the person you have filled the petition against, he cannot do anything , first get your house back by putting up application under Order12 Rule 6 for possession . Within 3 months you will have your house back and then you May file suit for damages.
These things in a city like Mumbai would happen only if you the owner have been utterly careless in your deal. It's surprising that the tenant has shown such audacity in Mumbai.
This is the lesson to all owners, please hire a good real estate consultant in deals, especially when property value is as big. Consultants have a good role to play and their fees are not waste of money.

@@AbrahamZubin I just spent half a day at a govt office registering rental agreement with tenant. It was a tedious process but I did it. People always want to take short cuts and then blame the system. So you are the problem in my opinion.

Word of advise being a broker, always involve a broker.. paying a broker will really help you in a lot of things that will not occur to you ....you cannot knock on the door again and again but you need a local so nobody takes advantage.. being in Lokhandwala since 1987 have heard and seen a lot.. . I have heard of similar case of a Dubai owner.he then cut water connection electric meter and the tenant left forcibly... where was the agreement registered ? Does it have a proper Index II page ? What is the date of expiry of the agreement ? Does it have any additional clauses that people add like no door changing etc, terms of violation, etc . Interest penalty clauses ! Do you have payment receipt proof of rents to know from which date he stopped?
Got my lesson... As we never did anything wrong so thought nobody will do it with us .... But i was absolutely wrong... Yes registration was done.... Have all proof of payment he has done... For 20 months.... Which he used in civil court to prove that he gave me loan.... Of 90lakh rupees... Don't understand which stupid takes loan amount of 90 lakh in monthly instalment of 85000/-.... He made fun of our judiciary system... Because he was aware that he won't be punished.... I got judgement in my favor.... Waiting for lockdown to end.... Then will get the possession too... Thanks for all the support...
Giving property directly is dangerous without agent or any other responsibile local person Take lessons from this. Many one to one situation face daily
agent only takes the cut and they are not responsible for cheats. So a good agreement between tenant and owner and renewing that every year is the golden rule. nothing else.

Get a key made, and when tenant is out occupy the flat and change the door/ key. then let him go to police and prove he is rent paying tenant. This is what my friend did. He also managed to change the interiors and threw out all tenants belongings in parking area.
I've been staying as tenant in Mumbai since so many years, and even for a PG lease, the agreement and all are so foolproof that I can't imagine anyone not paying or even delaying their rents here. This case is so shocking. From where do these criminals and fraudsters find the audacity to cheat and claim someone else's property as their own in today's day and age? The only reason I can think of is that no proper legally bound agreement must have been made during the deal.

You should reveal the name so that someone else doesn't fall in his trap or gets conned by him. If you think you will be in trouble if you reveal his name directly since you mentioned he is a pretty well known personality, at least be indirect in your words and reveal it without really revealing it and let people guess. You should work with property consultant firms who do all due diligence and then deal with clients . Our firm has NRI clients who don't even have to come to see everything is update and company has to take care of everything and rent in your ac but we charge annual charges as per packages .
Just break the door and go inside. Then start fight. Bcz in india jiski Lathi uski bhaas. You are the owner. And the flat is empty. Just break the door put new lock and take the possession of property. And let the cheater do what he wants do. Nothing will happen.
I am wondering the same.. there is leave n license, police verification.. u have to submit documents to the society, there is a meeting conducted between the tenant and the committee members for their approval.. owner takes PDC.. dont know how she rented the apartment, wether she followed the proper procedure or not..

There are so many cases like this u should not leave that guy he will make all false documents and papers but at the end you will win because there is no place of false documentation in this case if u guys re right on ur path nothing will stop u to get ur house just keep all papers and documents clear to the court along with registration papers and this is why ppl shd not give tenants that much of liberty to even one drill at ur house and not more that one year at one place.

Lease n licence agreement have specific format, which is mostly in favour of the property owner, it should mention tht tenant will not do any alterations inside the flat ,no construction, no removing, no fixing anything, what type of contract u signed tht he did decoration in flat ? Catch ur estate agent, thru whom u kept this tenant

Much of the funds collected by the builders from Indian citizens are used for overseas projects, in the UK, USA, Middle East etc. As a result, these builders are delaying projects in India where the depositors have to wait longer to acquire possession of flat and/or constructing shoddy flats not worth the crores of rupees and handing them over to the buyers.

Omg! Ma'am recently my family also has been scanmed exactly in the same way by our tenant. The exact same nonsense he has been doing with us. He has changed the door of our house and we sent innumerable notices but no reply. When we went to ask for the keys and to terminate the agreement he told us to come and take it in court. He seems to be friends with a lot of police too. We have already filed a case agaisnt him. It wld be grt if u wld reveal the name coz wen i googled his name..i found he has been doing same with many others too! Plz disclose the name ma'am it wld really be helpful for ppl.
