Watch this video if you are interested in learning what the 7 common mistakes are and how to avoid them while testifying in a debt collection trial.
1. Guessing instead of testifying based on personal knowledge.
2. Answering a question without fullying hearing it.
3. Answering a question without understanding the question as a whole or individual words in the question.
4. Answering a question without first taking a moment to think about the truthful answer.
5. Answering more than is asked -- instead only answer the question actually asked.
6. Trying to outsmart the collection lawyer.
7. Having the wrong courtroom appearance including dress, showing up late, not being respectful, etc.
Thanks for watching!

Your video Sir was a blessing. I had a family member that I had to help out . A debt collections Attorney took them to Court . I took your advice and took notes .... Long Story Short . The Collections Attorney requested the court for a motion to dismiss... Key word folks "Purchase Agreement". Never saw one never. Was not even aware that they sold something. To a debt collector.... Keep up the good fight folks just have to go in with some positive thinking.... Don't let them push you around show respect and look them in the eyes and ask them where is your "Purchase Agreement". and where is it that I have signed and seen this so called Purchase Agreement and have agreed to any terms .... These collection sharks are betting that you won't show up for court so they can name their price .... Follow this man's advice and your odds will be good at winning your case .

@@allenpruitt8650 so you got sued by LVNV and Resurgent Capitol Services? I'm going thru a similar situation with LVNV right now. They bought a charged off account of mine that the original creditor refused to let me pay off. I sent Resurgent Capitol Services/ LVNV a "debt validation " letter, asking that they send me proper documentation to verify the debt. All I got in the mail was a letter from PayPal saying Resurgent bought the debt, and all Resurgent sent me was a two year old billing statement. After they recieved the debt validation letter, they continued to contact me for almost a week, and they just recently reported to the credit bureau's this charged off account is a new account, yet its been on my credit report as a charge off for the past two years. I am currently in the process of mailing them a "notice to cease and desist" letter.

I was advised by my attorney just to file an appearance & say deny to everything in my answer to the courts. But in the meantime just offer a settlement to resolve the matter. I did just that, but he was adamant that i not send them any money without a settlement offer/letter in writing. So now they are playing games giving me a written letter with the amount they wanted me to pay. The problem is i suppose im not dumb enough to give them my bank account info & prefer to send a cashiers check for the exact amount they offered. This way i can expedite the payment, keep a paper trail & protect my personal assets. So now they are coming up with every excuse in the book not to put it in writing. Well they sure as hell can take me to court for $700 because im not giving them anything until they send me something credible in writing that once i pay the settlement amount the debt is satisfied "paid in full"

Now they are trying to ask me questions about owing the debt, do I answer those the same way I would in person? Just "I don't know", they don't even have my full account number. I requested the documents from them, privacy notice, and chain of command because they tried collecting payments from me, they never sent me an agreement in writing they're just trying to get a judgment against me - they're very aggressive. They have not sent me those documents and have put 28 days for me to give them information and bank statements- any advice?

It would appear that I'm the newest/latest to comment herein. Damn good advice you've offered up here and you know that old saying that, One who represents them self has a fool for a client. That holds true in most cases simply because most people want to argue their case when they should except and or acknowledge the allegations address them and do not dishonor the court by arguing with or allowing your emotions to control your mouth for if you do then you loose so don't argue the case just state the facts of the mater, truth and logic usually triumph. Or that's my belief.

We got a letter brought by sheriffs office from a debt collector lawyer. It’s a lawyer. They said they were hired by Citibank and they didn’t buy the debt. My husband got scared and called the lawyer and they talked him into a crazy high deal of $375 a month for 4 years. I told him not to make that deal coz we can’t afford it. But we do own a house(not paid off) and my husband makes $75,000 a year but I’m sick and don’t work. We are truly barely making it. Hubby is afraid they will garnish his wage to such a high amount that he won’t be able to pay the mortgage and bills and we will lose the house. The debt is $22,000. How do we find out if this lawyer bought the debt or is really hired by Citibank. Is there any way to make a lower deal with Citibank.

If the Debt Collector or buyer tells you and the Court (or admits) they purchased the debt and now owns it, what legal right does this debt collector/buyer have to collect a third party debt without a legal binding contract with the debtor?
@johngwatts
@johngwatts 2 года назад
If a debt collector *actually* buys the debt, then they normally can collect. They step into the shoes of the original creditor in terms of the contract with the consumer. The problem is often they don't prove they actually bought the debt when it comes to court.... John

My friend sued a collector company under the FDCPA because the collector tried to collect a false debt, they accused him of a false transaction, however the federal court says that even though they were in default they cannot issue a judgment against that company because he is a not a consumer and is not a collection and there is not a transaction. I read in case law however, that my friend was involved under a non consensual transaction and he is protected under de FDCPA

This has been very helpful. I am being sued by a debt collector. Thjs happened once before several years ago. I didn't answer but showed up for court. At that time, i had a payment plan of $50 a month. I had a little extra money for a couple of months and paid $75 and the company took me to court to permanently change my payment to $75 a month. When i got to court the lawyer headed me off before we went in and convinced me to sign a paper to change my payment so i could avoid going into court. It also tacked on court fees to my balance. It was probably a mistake but i felt really intimidated by him because i had no idea what to expect. This time i am going to make a response to the petition. Does the court usually require the defendant to pay the court fees?

@johngwatts

Broadly speaking there are two things they have to prove -- if they fail on either one, they lose. 1. That they own the debt. This is a huge struggle for debt buyers. 2. That you owe the debt the claim you owe -- they have to prove the amount. These are two big hurdles. If they prove both of these, and you have no valid defense (statute of limitations etc), then you lose. The court costs are normally a few hundred bucks. So anytime you try a case, someone is going to lose. You have to weigh the odds and then make your decision. Hope that helps John

Great video!! If you file an answer and realize you should have selected the box that deny that you are responsible instead of “I admit that I owe some money but not the total claimed” what should you do?
@johngwatts
@johngwatts 3 года назад
I would file an "amended" answer where you change (amend) it to what you want to say. Most courts allow you to do this. If I get a moment between meetings I'll do a quick video on this.... John

@@johngwatts i think i need to do this. I had a credit card debt- unpaid for awhile cause of the covid loss of money and I failed to contact them so they sold my debt to midland credit. I called them cause they said in a letter if I didn't pay they'd take me to court and they asked my some questions and I said yes. But looking back i don't believe I owe them anything and they bought my debt to my original credit account so it seems I owe them nothing. How do I make an amends letter? What's it called so I can learn how to do it?

What about when they sue under the guise of the original creditor?
@johngwatts
@johngwatts 4 года назад
Jimmy, If the original creditor sues you, then much different situation. But your question suggests it is a debt buyer suing but they are pretending to be the original creditor. That would be a HUGE problem for them in Alabama to lie about who is actually suing. I would press them on this and see who is suing and who claims to own the debt. Do be careful that sometimes the lawsuit will say, "Midland Funding as assignee of Synchrony Bank" -- that's Midland suing not Synchrony Bank. Keep me posted what you find out thanks! John

A friend's situation. Owes over $100k in credit cards from 8 credit cards. One of them is Capital 1. A law firm sues on behalf of capital one. A balance that he cannot pay back. Then they submit a copy of last statement showing balance. Then they submit information that the debt has been discharged. So, if they have discharged the debt, can they still sue for that? Also, if he cannot make payments because the amount is too high, what should he say? Besides, he is planning to file for Chapter 7 or Chapter 13. Should he tell the lawyer at trial that he cannot pay or settle because he will file for bankruptcy after this trial? Besides, the other balances he owe are with collection agencies calling and harassing but no other has sued. Just this law firm claiming they represent capital one. Plaintiff is Capital 1. Can you advise how to tackle this in court? I feel the lawyer will automatically win. But friend plans to file for bankruptcy after trial, if he loses. Please, advice.

My apologies for the multiple questions I'm very inquisitive and nervous. I do respect your time and if you can please answer I'd appreciate it. What if the JDB provides the full purchase agreement including that bill of sale. Will the stance of personal knowledge still stand? I also have a notarized affidavit included in my summons. At what point can I file a motion to strike that information from the case as hearsay? Due to it being an affidavit from the JDB.

Hi John, I went and watched a case and noticed the judge ask if you want to talk before talking to him. Is it a good idea to talk or just go straight to my case. I’m being sued by midland.

Is there this same video when its the ACTUAL creditor suing you? Everything was going good until 4:04. I'm being sued and need help with the original creditor and their lawyers.

called the original creditor and ask if they sue you and they will answer yes or no. also ask if your account is in good standing they will say that your account was giving to a debt collection some of them say are law firm but they are debt collectors. and ask if your account was charge off , if it was the means the original creditor gave up on getting the money you owe them and they had called there insurance and the insurance company had paid for what ever you owe them.
@RemoteCamper

@@YarevAguilarMusic I went to the Law Firm's own web page. They do collections for clients. In their own description they say they like to negotiate. I called them today and told them I want to negotiate ASAP. I got almost $3k removed, which was vey close to what I wanted to get removed in the first place. I set up the pay duration and they came up with an affordable monthly bill. I was SO happy to NOT have to go to COURT. I had only 10 days left to file my Answer. I'm happy with the outcome, and just want to get rid of it with no court. Quick story. The Wife was using a card I forgot I had (never had it in my possession nor ever made a purchase) and racked up over $11K before it was Charged-off for non payment. We broke up and she moved out (Still married) and she even had the billing address changed. I had no idea what had happened and thought I was CC free since about 2005, until I was served last Monday with a bill over $11K. So like I told the lawyer, I'm on damage control now. She is going to be paying for it, but this time I have full control.

That's simply not true that's what people think they are legally required to charge off an account that has not been paid for I think it's $180 days that does not mean you don't owe the money anymore you still owe the money and they can still sue you for it it's sold that means it'll be sold with third party and then you know it's harder for them to prove it but an original creditor is required to charge it off after 180 days it means nothing it's an accounting thing for them

What happens when the debt buyer has the purchase agreement showing my name and the bin number along with the creditor’s info and the previous account? Is it still worth it to not admit the debt and continue to repeat yourself stating you didn’t agree to contract with this debt collector?
