In America it's different. The people are Sovereign and are not property of the political party (ie the state). So there is no contradiction and no legal body able to undermine the rule of law.
Technically that’s true. However the Supreme Court in the US is a constitutional court. This means they can uphold the constitution against the government.
@@SWBIL there is no contradiction. The government in the USA is not a group of first class citizens. The government is we the people. If people act outside of the law they are criminals. The people of America are the sovereign not the government.
@@SWBIL Government is not the force or entity that gives the rule of law. The rule of law comes from a public law which all are accountable to. Making all people equal. Any other way would not be the law ruling. This is what the name republic means. The public thing rules ie the rule of law. It's a Constitution which is supreme. My Constitution guarantees me the rule of law in my country. My Constitution states that my government will always be Republican. Fyi that guaranteed has nothing to do with the political parties and GOPs.
