In today's video we have a cow stuck in the ditch!
This is a complete nightmare, by chance i was just driving past in the evening and just saw her back in there.... Not everything can go perfectly!

As a legal person, I can tell you tom that you must bill the owner of the dike for your loss and time. When you have a figure I would gladly take the case on free of charge with just expenses, nothing more nothing less, Without your loss, there's really nothing much I can do. Because they own the dike it's their responsibility to maintain the fencing under the law Duty of Care. IMO they are just laughing at you when you had your meeting. they know that you are a nice person and a soft touch. You must make a stance NOW.

Excellent piece of kit to clamp on to the hips, years ago we would have cattle in the river and a hell of a job trying to get a sling around the gut, this made it look eas(ier)

Good luck. Used to work in Haz chem industry and it was up to me to "educate" the customer according to the EA. Guess how well that went over 4 years as a technical assessor. Bit like the NPS or national probation service.. waste of space and time

@@Gareth-pi4sp small claims court is quick and simple, citizens advice is helpful there too. The stress may have effected the cows next few milking's. As a farmer you should know, the small things soon add up. It's also about sending a message to the EA.

@@Hill_Walker the stress may affect her milk yields for a short period of time yes but so can many different circumstances. When that happens a cow you dont think about the 20 litres you have lost because milk yields fluctuate between each milking. His cows could give 2000 litres one milking and only give 1700 the next. 20 litres is nothing to worry about. Checking the fence and checking all the cows where in from the field was the farmer’s and farm worker’s responsibility not the rivers agency.

Sue them for the land youre losing to the slippage . At the very least, the threat of legal action and paying out for the land 'might' , jump start them into maintaining it properly

They should not "sell" the land.. No! They need those people to just do their fucking work. If Tom and his dad start selling land, they wont expand.. Did you hit your head? The ditch is already 3 times bigger than it should be! Sometimes its alright to use your head dude xD

@@MrPete81 - Yep. Probably wondering where the Hoof GP was! Dairy cows spend a lot of time being penned, shut behind gates, pushed into stalls, squeezed between rails, and so on, so she knew something was going to happen. Outdoor milking, maybe? On a more sombre note, cows that are used to being moved and poked and prodded are also less stressed when they wind up at the slaughterhouse (and they all do). Different smells but similar handling, so they stay fairly quiet right up until the final 💥.

@@EleanorPeterson While your "sombre note" is sombre, it's also a peaceful thought. As a carnivore who loves cheese (can't drink milk), I feel a level of responsibility for the animals whose lives are sacrificed for mine. All anyone who understands life and death can wish for is a happy life and a swift end when that time comes. But to an animal, life is more in the "now" than it is for human beings. Are they happy, now? And the best life we can give livestock is to provide for their needs, keep them happy and content, and when that end date comes, if they are peaceful and unstressed they will have had a most ideal life. I know a lot of folks think that the way livestock is kept is horrific because it's "not natural" and they call it abusive, but really, in the end, I think animals adapt to domestication because they don't have to deal with the stressors that your average prey animal has to put up with. They aren't hunted by a pack of carnivores, they don't watch their companions crying while a wolf is literally gnawing on their innards, they don't have to put with parasites and disease and difficulty calving without help. They don't face privation when there is a drought.

She probably was a bit tired and had given up on getting back to pasture. Cows that trust their farmers know that they are helping and she is used to being handled so she didn't even have any reason not to fight back either. You can see from those animals that they are well kept and cared for.

Work out your costs in time and diesel, add additional costs for rebuilding the fence and for loss of the embankment land, and send it immediately to the EA, asking for reimbursement within 14 days. If no reply, send it again, and if they still don't refund you, go to a solicitor. Do you have evidence that they told you it would be sorted out? If so, you should get compensated.

Common sense you know the fence is trash run a hot wire along the ditch so they don't jump until its fixed.....

How easy would it be to register each cow as it came in for milking and alert you to say it was missing... are cows electroniclly tagged? Send me a PM I may be able to design something for you... I work with electronics and software.

@@samueldeakin2902 Systems already exist - rfid tag and a reader around the doors (Yes, there's readers that will work over this distance). It's just the cost and maintenance. Probably outweigh the benefits.

A few weeks ago here in Colorado we had flash flooding. Our daughter and her husband are ranchers. Her milk cow went too close to the bank after the flooding and it caved off with her. The cow survived for almost a week afterwards but she wouldn’t stay standing or get up herself and between them and the vet they had exhausted all of the things they could do and had to put her down. 😪💔

I thought this had been resolved with your meeting with the Council. Get the local media / TV involved - those photo of a cow being hoisted from a ditch will be a big embarrassment for the Environmental Agency - Can you sue the EA for failing to maintain the drain? What if that cow has suffered from the incident and requires veterinary attention who is liable for the costs

Glad to see the lady got out ok, just had a moment where I thought she was going to jump back over the fence! Unfortunately the phrase 'prevention is better than cure' doesn't ring out as loud as it used to. Not just agriculture, I see it elsewhere rather react to something rather than prevent it. Long term short sightedness, spend to save??

That ditch looks very fishable!! The EA just are not bothered, still waiting after 20yrs for them to dredge the local drain in hull.

I don't want to be too critical Tom, but it's 100% your responsibility to have your cows properly fenced in. EA have nothing to do with that. The fence looked a bit shook in a few spots. Now, about losing land to an ever widening waterway due to lack of upkeep of the ditch, that's an argument I would be on your side in.

I hope that the EA read these comments. Its disgusting how they don't maintain what's they are obligated to do. It's also terrible how they think it's fine for a inch, foot or metre of your land can be lost per year and they find that acceptable. You wouldn't allow your neighbour to take a few inches of your back garden each year so how is this acceptable. Keep soldiering on team Pemberton you guys are ace!

Its not a good look to go around spreading blame on others when you are at least a share of the reason the problem happened in the first place. If you had been on top of fence maint. the cow wouldnt have gone over.

Lining the stream with gabions would likely be the real solution. Costly for them. But, a long lasting fix. If you have any left over big hardcore, you can even offer to fill some of the gabions for them which is the expensive bit.

I always heard with those cow lifts comes with pain, did she get anything for her pain? She was walking though a little stiff. Can you do an update on her please and thank you! Not a cattleman just repeating what I heard. I’m from the confused USA.

I'm sure it wasn't the most comfortable procedure for her but better than dying in a ditch. I'd imagine her stiffness is mostly from the exhaustion and being trapped . Poor girl.

I'm so glad your cow was okay! I have to admit, I was truly afraid she had been hurt going into the ditch, and that she had died. When I saw her kick... the whole doctor's office (where I'm watching this while waiting, lol) saw me gasp and clutch my imaginary pearls! Yay for yon wee cow! Give her a special pat when you see her at milking, Tom. She's an adventurous cow, but also, she's a tough old girl, and she made me very, very happy today. 🥰🤪

Amazing the you can lift a cow up with just that clamp around her hipbones. I’m so glad she was okay and walked off on her own. Cute how all the other cows came over to check her out. You should use your social media to bring attention to the ditch problem again. Government will just ignore you if you don’t keep in them. “The squeaky wheel gets the grease.”

Somebody's probably read that a ditch is also a 'dee why kay eee' (can't write the word in full because the Censorship Algorithm deletes the Comment) and got scared. "Ooh, can't touch that, mate. More than my job's worth..." Huh? Well, 'dee why kay eee' is slang for a le- Er... Look, the ditch identifies as a Person of Depth, and you can't perform surgery unless she/he/it/they gives his, her, its, or their consent. So the ditch/'dee why kay eee' cannot be touched. Hands off. Big Brother is watching you. Have you committed any other hate-crimes recently? 🤪

So happy that you saw the cow in time. The way she looked in the air - the face was priceless. The ditches should be maintained better. I know in the US at least where we are - there is a drainage ditch that snakes through the land around us. The farmer who rents the fields maintains the ditches and went through a year or two ago and cleared it out very well to help the new drainage tile going in. The county government is responsible for some of the clearing and you can tell who keeps ups with their part of the land. Tell us who to contact and we can can make voices heard. Farmers and friends of farmers need to stick together

Start sending them land rent bills for the land lost by having to re fence along it. Sounds like a typical government or council job thou. We are having a battle for similar things here in New Zealand

I think you're forgetting folks that get petitions, get them signed, by those of us Not afraid to speak up, while having our points heard and fixed for the better. Let's see, some laws that are in affect are based upon them🤔 Just because you're afraid to speak up does not mean the rest of us are. In case you missed it, they literally said who was responsible for maintaining that ditch. So here's how it works. We can easily research them and contact them. This whole thread proves some are not capable of that. So by making is easier for some of you, simply putting that contact information out there makes it easier, again, for those of us not afraid to speak up for others. A tragic trait today's society has lost. I'll stand true to who I am and defend anyone I care for. I care very much for Tom, his family, and their way of life. Cool, that you can judge what a kind of person I am from 2 comments without even knowing me... I would be open to sign a petition, but im not giving these people a ring since im not even living in britain. I think Tom, his father and the other farmers in that area can speak up for themselfes and form some kind of organisation to get some pressure to the right people. And in case u didnt know, i would indeed help someone who has a problem and speak up if necessary. In the past there were already some situations where I had to do so.

That was the most efficient rescue operation i have ever seen! Bravo!!!! It's horrible that you had to do it though for lack of someone else not doing their job! Bring this video to the council and light a fire under their asses!

Parden my ignorance. When you say "it's their responsibility" and other references to "they" who are you talking about? Whose responsibility is it to maintain the ditches? Who gets upset if you try to do any maintenance yourself. Who is THEY?

@Richard Bennett I guess every country has efficient (as far as govmt goes) agencies and others that are just mired in red tape and useless. And unfortunately, all rules are aimed at the lowest common denominator: that 1% that F's it up for everyone else.

I can still freshly remember our neighbour neglecting putting up safety obstacles while driving manure from his basement pit. He had his cows walking freely around the pump well hole and one fell in it. That paniced dumbass put a nuce around her neck and JCB´d her out ending up in a young half gallowed cow in need of an emergency slaughter... That corset bone grappel gadget of yours worked way better then I expected. What is it called, do you have a link to a shop ...and have you had any noteable mishaps with it ?

I’ve had to used clamps similar to yours many times to get cows on their feet. Most of the time we had to use a hand winch though. Good job

Loved the rescue, curious cow friends, the pack greeting, and cow chorus celebration of a job well done! Interesting vlog though and good to get a clue on how that government 'meeting' awhile back went. Reading between the lines, sounds like the government gave you a threat to 'cease & desist' with threats of interference in all the farm improvements and licensing. Pemberton's have been very compliant to their credit! The government showing progress--to be expected, nothing. Looks like Great Britain is dealing with the same problem we are in the US. INFRASTRUCTURE! Time to remodel and save the land!

So far none of my colleagues have the super sick, critical neonates I specialise in trying to keep alive so I get a few weeks break.

OK Tom that caused me stress seeing that cow in distress then You and your Dad, stressed. Great video, but not a fun situation; especially when you know it shouldn't be happening. Hope the delayed milking didn't hurt her and all is well. My heart rate is back down again!

We always count the cows in the last round of milking, so we always know is we miss one ore not. Maybe an idea for the future

I commented when you did the pumping station vid.The EA people are brain dead,first criteria to get a job with them!!!!Spent 20hrs ignoring them,doing what was required,retired now,nowt ever changes however.Hope the cow is ok.

Two experienced farmers doing what they do best. Get in with it no panic! Can you imagine what would have happened had somebody called the emergency services😮😂. Never thought one of those hip clamps could be used to fully lift a cow like that.! Might have to invest in one for emergencies

Not first, or last, just late... Manitou on the mooooove so to speak..🤭 Government Department living up to it's tick boxing behaviour. Always looking behind in the rear view mirror, not through the wide vista of the windscreen looking forward. I had to cope as a local Hotel Maintenance Manager where the financial year started in October, and 3 times it was 'yes you can do the roof work now', instead of long dry days in summer. 🙄👍😎🇬🇧

There is nothing but harm done!! Against your farm. The powers to be are ignoring the back bone of the world. The farmer (any crop or livestock,) are the absolute foundation cornerstone of any productive society. That is ridiculously angering. Tom id send this to local media and government parliament representative. Threaten to take legal action. Embarrass these government agencies in the media. I'd become such a thorn I third side they'd ditch my property so fast just to get some peace and quiet. Or look at getting a local business involved in ditching. Find a business arrangement with them for livestock out of the farm shop for their labour?...

Cannot believe the local environment agency hasnt jumped all over the opportunities you have offered up to them in the past! Even if just to attempt to justify the desisons made at the pump station, or at weir and ditches on your land. Farmers feed the nation and why can't you be given the rights to dredge the system, while protecting the ecosystem of the water ways and your pastures at the same time? How many animals are impacted when your under water in the winter! maybe contact IEMA? Glad to see she was back all four quickly Thanks for the video Tom and the Ginger Warrior!

Thats crazy...isnt the ditch a health hazard...Health and safety issue...How can any council stand by that..its an accident waiting to happen...Id be sending that video to their engineers ...You were lucky the water was low or youd be at the loss of an animal...Time for Serious action
