Many decades ago, I had an incident where I saw a friend's custom car being broke into; I grabbed my 12ga. pump, and went out my back door to circle around the garage, to catch them in the act. Well, as I rounded the corner of the garage, it was really dark in that spot - they couldn't see me, but I could quite clearly see them. Instead of announcing myself and that I was armed, I simply racked the action, coughed, and watched them burn rubber off their shoes running down the street. It was in that moment that I realized they weren't armed with anything other than a crowbar, and the outcome would have been pretty ugly . . . for me, had I blew one of them up. This is just one of a number of "incidences" that I've lived through where I made the right decision to not discharge my firearm.

John for your next brief; in light of recent events, what would be the legal dance if in an active school incident, a parent with a child in that school breeches police perimeter and enters the school armed alone to rescue their kids?

Regardless of the morality of protecting property from someone already escaping, what's important is what the law IS, not what it SHOULD BE. And what the law often IS, is that you can't shoot fleeing people who do not present a threat to you

Need more of these. And can we add a further amendment to the Rules of Stupid including "is that worth it?" I'll leave it to others to better articulate the meaning but I confessed, I think yesterday or the day before, that 20s 'this guy' got into a violent encounter with an unknown adversary, of unknown capability, over a couple cans of beer at my friend's C-Store and I would appreciate any help is building the tools to instill a dose of 'less-stupid' into my boy, nephews and all of their friends so that they don't hold as many liabilities as I did. But, just to be clear, if it's time to go because the other outcome is unacceptable, go hard. Please, just don't increase your chances of having that kind of party.

Here’s the rub with using deadly force to protect property in Texas: Texas Penal Code Ch 9.42 stipulates that the actor (victim of theft) must reasonably believe that the property can not be recovered by any other means. First, in this example, there’s a history of the two sisters stealing the car from each other, so it’s easy to make the case that the property can be recovered by other means besides shooting up the neighborhood. Second, you have to ask yourself what the definition of “recovered by any other means” is. In my case, my insurance would replace anything that’s stolen, so I would argue that replacement by my insurance is another means of recovery, and further that I’m getting a *new* whatever it is, and that I didn’t shoot up my neighborhood while doing it.

To your 2nd point, you could argue this car has a large sentimental value seeing as it came from a deceased mother and that is irreplaceable. Still stupid tho.

Rare or antique cars or items are not easy to replace either. I have an 12 year old WRX outside and I am not sure if I would let it get stolen at night without a fight. Even if my insurance cut me a check for it, buying another one would not be that easy. Adding my mods backs on it ditto. I certainly don't want a new WRX too ugly and far too expensive, the insurance check would not cover that.

Also, I have a buddy who’s a retired lawyer, and he told me that, at least in Texas anyway, whether the item is insured, and thus “replaceable”(?), is not a consideration in court. So…I don’t know if I strengthened or weakened my position in the discussion, but I do know that there isn’t anything outside my house that I’m willing to kill somebody and then handle the consequences over.

It's not just an insurance deductible, it's probably going to be 2 or 3 weeks worth of spare time trying to replace your vehicle without losing your shirt, but also don't add to the problem with a murder or wrongful death trial that could drag on for a year.

I live in Texas and I am grateful for our common sense gun laws. If I am ever forced into DGU, I hope our freedoms are sufficient to at least partially protect me. Will do my best to avoid such an eventuality and to do so in most responsible manner possible - but even here in Texas display of a firearm can get you in trouble, much more so if you fire.

7.5 years on an Agg Assault charge with no injuries seems like a bit much (even with the additional charges which should have run concurrently). I suspect he this was not his first rodeo which enhanced the sentence. In my state, it would have been Felonious Assault (F2) with a 2-8 year potential sentence. With no priors or injuries, I could see probably 3 years, with 1 suspended. He would end up doing 6 months before a judicial release is filed and granted. Priors or injuries would be a game changer.

The first sister to buy and deploy The Club could have just kept the car, without anyone having to go to jail over it. But of course, this wasn't really about the car. It was about making the other person back down. I know you've said this many times, but nobody can say it often enough: your life and your freedom are too valuable to risk over petty stuff like this.

My personal take on killing over my property, and I say this as someone who doesn’t own many nice things, is that nothing I own costs more than a good lawyer. It’s a little irritating how some gun people will act like this means you’re pro stealing Even if the court case works out in my favor I’m still out way more than I would’ve been if I just had to buy a new Xbox. This is also why having good relationships and community so is important, especially in high crime neighborhoods. If any of my friend group gets something of value stolen, we pool up and raise funds to replace what they lost. Everybody sacrifices a little so nobody loses a lot. Losing possessions sucks, losing your freedom is much worse

Yes police need to be transparent, however they are struggling to gather information themselves. They need to be very careful to not give out incorrect information. Even if they say information is preliminary and uncertain they will receive infinite grief over any corrections.

Now a days people who steal vehicles are often stealing the vehicle for other crimes. A lot of them could of been prevented by not leaving the car running unattended in the drive during the winter. In the past year and half I remember two different homicides of people confronting car thief's. Both of them were people getting ready for work with their remote start on while they were in their house. The fact of the matter in a lot of places the most plausible out come of that situation is the thief gets a signature bond or you get dead or worse you harm a neighbor sleeping in their bed. If you own an older truck or van put a hidden gps on it and let the police track it down. Lately one of the most common vehicles stolen for other crimes are the F-250 and F-350's. They can be stolen with a screwdriver in less than a minute.

I would argue that the case where the man set his 45 on the dash of his car did not commit aggravated assault though he was right up against the fence of it. What he did however do was brandishing a firearm. Which means to present or show a weapon in a manner consistent with instilling fear. Such as to brandish a sword. You do not have to draw the sword to brandish it you merely have to take your coat off the hilt of it, like I've seen people do with firearms, just to show it off that you may be willing to use it. Just because somebody can see it doesn't make it brandishing. The definition is quite clear that it has to have a mechanism of instilling fear into the mechanism of somebody seeing it.

Still has a force discrepancy issue. You typically cannot use deadly force against someone who has no weapon nor has multiple attackers coming to hurt you. Even if you live in a state that is friendly to brandishing, the force level is unequal. If you a an elderly person then it might be OK.

While I don't think killing thieves is immoral in principle, it would be almost impossible to legally sanction. Should a store clerk be allowed to shoot a kid who shoplifts a pack of gum? Certainly not. So then where does the line get drawn? And wherever that line is, we'd then be asking people to exercise their own judgement over when it's been crossed, which, from the stories Tim and John shared in this video, would be bad times. At best, we could apply the death penalty to thieves as a matter of judicial due process (as it has been done for much of the world's history, incidentally), but doesn't present any personal self-defense implications.

So you recommend not shooting at a fleeing car thief unless they have your children in the car you are going to be shooting at? Or do you mean you should shoot them as they are running toward the car, presuming that they will get in it and drive off. I don't think there is any power on earth that would make me shoot at the car containing my kids.

"Case dismissed." In reality, there probably would not even be a case. Not sure just placing your firearm on the dashboard would really justify an Agg Assault charge given the road rage drives actions (cutting you off, getting out of his car and approaching yours). Pretty sure Mr. Road Rage actions led to a fear of great bodily harm by the student. While not wise, it does not sound criminal.

@@ASPextra The standard is objectively reasonable. Is it reasonable to expect someone who's road raging, getting out of their car and approaching you might mean you harm? 100%. Would I shoot the person or even point it at them at that point? No.

I'm surprised you guys didn't mention the possibility of the sister winding up dead... over a car. There is no car on the planet worth the life of one of my siblings. And I don't even like them very much. And what kind of person, in the calm, sane light of day, would be okay with their boyfriend murdering their sister over a car?

I was on Jury duty in Phx AZ. The reason a felon grabbed his girlfriend's .45 went to the club with his friends. After wards he noticed someone stealing his rental car and went to try and remove the person. He couldn't so decided to empty the magazine in the ground. Over a rental car lmao. Great videos keep em coming.

I have watched every single one of your videos multiple times. I'm more pro cop than anyone. You NEED to do a livestream or video about what we know in Uvalde. The timeline and videos available are horrifying. The cops were on scene BEFORE he went in the school and they WAITED for BORTAC. Please, I can't even watch your badge cam videos right now I'm so steaming mad. We need respected people like you demanding answers. Please, John, speak up. There are enough details out to start forming an opinion. You don't need to wait 2 months for all of this to come out.

So you can't use a gun to stop anyone from stealing your property if they don't present any great bodily injury to you or others. Well please inform you local criminals and hope you have replacement insurance after they nickel and dime your bank account to empty. Not everyone has full coverage and many have high deductibles.

watched my neighbor set his pistol on the dash of his car following him home from the gas station one day. Difference is the guy stepped out of his truck with a metal bat. I think this was a legit display. Funny thing is I still see the idiot in his truck and his driving has gotten a lot nicer....
