@@geroldsloan9369Not a complete deprivation of food. Even the Army, which allows for major food deprivation, gives a few MREs a day. Hell Week, the Navy’s food deprivation, gives a little food every 2-3 hours

Tom was outstanding in this movie. He shows real ethic behind the whole scandal and made it so believable. That's what great actors do. Make you feel the moment/moments are very real.

Dawson disobeys an order to deprive someone of food, he gets a below average report and is denied a promotion. Dawson obeys an order to give a Code Red, he gets dishonorably discharged and if not for his CO's arrogance, would have gone to prison for life.

@@GizmoBeachthat’s essentially what happened anyway. The whole trial was about the junior Marines getting thrown under the bus. Jessup gave the order, Kendrick delegated the responsibility of carrying out the order to Dawson (as a test to see where Dawson’s loyalties lied after the Curtis Bell incident, sorta giving him a chance to redeem himself for that), Dawson probably brought Downey along to help with the code red, they give the code red, Santiago dies as a result. When Jessup finds out that Santiago is dead because of an illegal unlawful order he gave, that’s when the wheels started turning. He coerced the doctor to rule the cause of death as lactic acidosis by way of poisoning, got Markinson to draft up the phony transfer order, got the tower chiefs of both Gitmo and Andrews Air Force Base to change the logbooks, then arranged the plea deal so that Dawson and Downey would only do six months in prison before being dishonorably discharged. All so he could avoid accountability for what he caused. See in his famous speech he talks about honor, code and loyalty but he really doesn’t have any of those qualities. He violated the order of no more code reds from the secretary of the navy by ordering one anyway so he violated code. He orchestrated the punishment which led to the death of a Marine in his charge, and when it went awry he orchestrated a coverup of the whole thing to save his and Kendrick’s career and was very flippant about the death of Santiago as well as the two marinesa d perjured himself on the stand so he had no honor. And then he was gonna let two junior Marines who were trained to blindly follow orders without question or hesitation be the fall guys for something he started which could’ve been prevented so he could save his own skin and get his promotion to that next assignment he had lined up, so there’s the lack of loyalty. The two things that busted the case open was Markinson going UA and telling Kaffee what happened and Dawson refusing to take the plea deal and asking to go on trial. Had those two things not happened, they would’ve taken the fall and Jessup and Kendrick would’ve gotten off Scot free.

@@daetoris4473 I'm talking about the real world, not some fantasy movie where a jerkoff lawyer who didn't care about anything somehow pisses off a high ranking officer. UCMJ is just like all other courts. They have their protected favorites. Maybe Air Force or Navy in some case might be slightly more favorable to E 1-3 but not much.

Because there was never any charges or reprimands for that. Remember the officer in charge of him Col Jessup is essentially the same kind of guy as Kendrick, only with more rank and a lot more arrogance. I’m pretty sure he looked the other way on the Bell incident, which is even more believable considering it was Jessup himself who ordered the Code Red on Santiago. Clearly he condones this sort of thing.

Only question that I have is why on earth the prosecution's objection that the "Code Red" line of questioning be disregarded/abandoned simply due to Col. Kendrick's service record was sustained instead of overruled. Kendrick's service record has absolutely no bearing on the case and is not related to Kaffee's line of questioning. Furthermore, Kaffee's line of questioning may be aggressive, but it is hardly argumentative and is tying the culture of Gitmo to the case itself, which is VERY relevant to the case. The Judge's ruling in favor of the objection implies that a Marine Officer is incapable of lying or any other dishonourable actions, and that is very much not true. After all, the two men on trial are Marine officers with good service records too, so how can they be judged as dishonourable and untrustworthy while other Marine Officers are considered immune to criticism? This whole ruling would be grounds for a mistrial and the judge could easily be disbarred for such a decision

All of Kaffee's case was a spectacular magic show until Jessup finally spilled the beans. Yes, Kaffee was able to raise a few *suspicions* in the jury's minds that something else that's fishy *MIGHT* be going on, but at the end of the day, all he had was the word of two accused Marines who claimed they "just followed an order". Without any proof that this order was given, the judge cannot allow Kaffee insinuate or imply that Kendrick ordered the Code Red and slander his record. There's gotta be proof, and in the absence of proof, the judge has to accept Kendrick's rebuttal of "I never gave any such order to those men."

@@CheerfullyCynical829 Except Kaffee has every right to ask pointed questions of Kendrick, and the judge cannot throw out an entire line of questioning simply due to Kendrick's record. Remember: Dawson and Downey are presumed INNOCENT until proven otherwise (And no, that is still the case in a military court). Furthermore, while Kendrick cannot state what all 400+ Marines were thinking, Kaffee can easily call forward those Marines to testify to the Curtis Bell incident. Remember, the other Marine who testified stated that he was given a Code Red simply for dropping his rifle, meaning that Code Red's likely happened to many others on the base, and that Kendrick HAD ordered them in the past. Kendrick's reputation/credibility wouldn't stand up against the testimony of dozens of Marines who had witnessed Kendrick ordering Code Reds on a regular basis. And if Code Red's were common, then Dawson and Downey would be able to legally claim that they believed a Code Red to be a lawful order and that they could not therefore be held responsible for Santiago's death beyond conduct unbecoming and possible manslaughter.

@@kylewilson2819 It's also worth noting that the prosecution had demonstrated beyond doubt that Downey was definitely acting upon Dawson's orders and Downey was under the impression that the order had come direct from Kendrick. Dawson's much harder until Jessup confessed. Kendrick and Jessup both maintained that it was bunk and by everyone's admission, Dawson was the only one to receive the order and Dawson had a credible motive of retaliation. Yes, Dawson could've received a private discussion but without something corroborating it, the jury would've likely believed it was as close to certain as anyone reasonably could've gotten that Dawson was acting upon his own initiative. Though if they had been able to prove the doctored flight logs, the mere act of doctoring the flight logs likely would've been enough to let reasonable doubt back in. Apparently in the play, the flight logs from the destination airbase were not doctored and it's a bit of an oddity that, in the movie, Jessup could've gotten that done and made the men on duty that night have amnesia. Overall, though, the defense did an excellent job showing the unreasonable constraints that Dawson had been put in with the question of obeying and disobeying Code Reds. They demonstrated that the crime committed was, at worst, manslaughter, likely aggravated by a medical condition. They also demonstrated that Colonel Jessup and Lieutenant Kendrick had no respect for the rules against hazing and that the culture ran deep. And the prosecution put no energy into asking what the alternatives were for Dawson other than performing the Code Red. So they built both ends of the bridge, they just needed the middle piece that does anything to suggest that a Code Red had been ordered. They filled it with Jessup.

This scene is part of why I don't like the final verdict. Kendrick ordered them to perform the code red, and the last time Dawson didn't cooperate fully with something that could in all likelihood be considered a code red he was punished. So, bearing in mind that Kendrick orders the code red at 16:20, and the code red gets performed at midnight. So Dawson has 5.5 hours to try and get in touch with somebody that is one of the 4 officer ranks above the Kendrick, only two of which we know for sure are on base, Markinson and Jessup. Now we can only speculate what Markinson would have said, but we know for a fact what Jessup would have said. So at that point who was he supposed to try and get in contact in the interim? So Dawnson's options are basically to either refuse the order and get punished like before or follow the order. Now, the other problem I have is that after they saw the blood they immediately took the tape off, and when they saw more blood, they called the ambulance. He gets to the ER at 00:12, about as fast as you could expect. They weren't trying to kill him, and when they saw he was in danger they called for help, but they still get the conduct unbecoming and dishonorable discharge...

You might be interested with the real life story The 3 (out of 10; other 7 went with plea bargain and got dishonorably discharged) were cleared from murder and conspiracy charges. Although one of them (David Cox) got charged with "Simple Assault" since he was using a shear to shave William Alvarado's (basis for William Santiago) head. David Cox was able to be honorably dischaged. Though, there was added drama in comparison to the real life case. As William Alvarado survived and recovered from his ordeal, while the fictional William Santiago did not.

They got dishonorable discharges because they lacked the judgement to know that this was an unlawful order and even if it came from higher, it doesn’t change the fact that they caused the death of another marine. Doesn’t matter whether they intended to or not, it happened. So they still have to be reprimanded for that. I mean do you think Santiago’s parents care if there was intent to kill or not?? Bottom line is their son is dead and these two Marines are still responsible because they carried out the actions that led to his death. Doesn’t matter who gave the order, they followed it and Santiago died as a result.

2:50 This is why I don't understand why people say that Dawson and Downey were guilty of involuntary manslaughter. As I understand it (I'm not a military person so bear with me) Kendrick punished Curtis Bell under his own authority using a Non-Judicial Punishment and placed him on Barracks Restriction limiting how much food he can have. But someone pointed out that apparently, not only does that punishment only happen on Naval Vessels, you can't deprive someone of food for more than three days, no matter the circumstances. Therefore, Kendrick's order was unlawful because he did it for SEVEN days. Dawson was entitled to, and as it happens, expected, to disobey an order that is considered unlawful (Which comes from whole Nuremburg "I was just following orders" precedent) And was punished for it. Surely, something like that would mitigate him of responsibility for the manslaughter charge because he's tried to exercise his duty to disobey unlawful order before and his commanders punished him for it. That puts the rep squarely on Kendrick's shoulders and by default Jessup's. At best, he shouldn't have got a Dishonourable Discharge but an Honourable One

That is a pretty good point as Kafee would have stated the facts of the case based on the way Kendrick was stating it. But if Kafee did ask this question, we would expect that Kendrick being a "hard to crack" witness that his character was written to be, would have calmly said: "Obviously, he did". Which, as it is written, gets the story to whether he should put Jessup on the stand.

Kafee has to watch what he said. Judge Randolph has to agree with Captain Ross. The objection is sustained. Kafee will be careful during tbe questioning for the witness Lieutenant Kendrick during a cross exam at Judge Advocate General. The question is relevant or not relevant.

@@joshbarclay1769 They don't go into details what is a lawful or unlawful order in basic training since military law is different than civilian law and they don't teach you to be a military lawyer in basic. Giving you bread and water for a week was normal Non-Judicial punishment in the military for decades until recently.

Wiped that smug smile off his face after the judge mentioned his “impeccable service record.” Kendrick no doubt had committed other immoral, questionable acts in his time, considering he knew two innocent Marines might go to prison for an order he gave, but pretended he didn’t.

You can feel the Raw Unadulterated Hatred between these Two 😠😠😠😠😡😡😡😡 Many of Danny’s Questions and Remarks are Dripping with Sarcasm, Hostility and Disgust at Kendrick due to His Abrasive and Bullish Personality while Kendrick is clearly Infuriated and Appalled that Danny isn’t Treating with the Respect and Admiration that He thinks He Deserves and Usually gets and He clearly wants to jump over the stand and Kick Danny’s Ass but is barley holding on Restraining Himself from Doing So.

I've never watched this movie in it's entirety and maybe there is some context missing. But when I was in the Army, the only Code Red I saw was in Basic. It was after lights out, and a few a the guys jumped another private because he was a fuck up. It lasted about 45 seconds. I never heard of a Code Red ordered by an Officer and I never heard of one, that was starving someone for several days. Anyone else have this experience?

I haven't been in the military so can't answer your question but just wanted to let you know that you should 100% watch the film in its entirety. I won't spoil anything but the alleged Code Red in the film was to gag, tie up and beat an unfit Marine. The unfit Marine died during this and the whole movie is about who should be blamed. It's one of the few films I would give a 10/10.

I was at AIT at Ft Sill in 2006. We had this DI (drill instructor) who took 2 muscular dudes out of my platoon and beat up this other guy in his office. He watched over the whole thing and gave them a thumbs up afterwards. The two guys didn’t get in any trouble, but the DI was handed down some UCMJ after we left. I haven’t heard of starving anybody as an punishment. The only food punishment was when you didn’t like someone, when you were passing around MRE, you would give them the veggie omelet lol.

That’s kind of the point, though. I can’t vouch for the accuracy of the movie, but it’s all centered around the fact that the code red in question was an illegal order and the officers who ordered it tried to cover it up at the expense of the enlisted men they they ordered to carry it out.

From what I understand, what defines a Code Red is that it's the practice of enlisted men initiating discipline upon other enlisted men. What an officer does is called something else. Is that right?
