Right?? I was pretty disgusted she had her daughter lie for her… like come one you didn’t sign that promissory note for nothing 🤦🏻‍♀️ obv the judge is going to take that over family testimony.. I couldn’t ever imagine asking my kid to lie for me at any age ESP sense her daughter was there so she knows darn well her mom is asking her to flat out lie… it’s not like she wasn’t there and she takes her moms word for it, no she was there and her mom is asking her to straight lie for her 🤦🏻‍♀️🤦🏻‍♀️

The plaintiff is trying to dodge tax and regulations by selling a car his business purchased wholesale at a profit as a private sale. He is also using a second company to put a financial lien on the car to a avoid detection. The defendant thought because of all that he wouldn't be able to sue or wouldn't want to sue and it became a battle of the scammers.

The defendant strikes me as manipulative, and the type who plays dumb or helpless to get away with little things. I believe the plaintiff that he gave her the benefit of the doubt because she gave him a sob story (that she was disabled and financially struggling). She did the same thing with the judge by claiming she was "stuck on stupid that day". And I bet she did some version of this with her husband - who she admits she lied to about the price of the car.

However I also think there's something fishy about the plaintiff claiming it as his 'personal car' but the title was in the dealership name... I think he was doing something underhanded, too. ...That lady knows DAMN-WELL that she didn't give a stranger $8,000.00 and not get a receipt. She just doesn't want to have to admit to the judge that she had him to write out a receipt that she'd paid a lot less to submit to the Motor Vehicles for a break on the taxes.

If you get the car and the paperwork with it, that paperwork is pretty much your receipt that you paid for the car in full. If you didn't pay in full, you'd sign some kind of note to say how much you still owe or you don't get to take the car.

They are both shady though, because the plaintif is a car dealer, meaning that he should know that even if she doesn't ask for a receipt that he would furnish all the appropriate paperwork for both parties.

She got a receipt, but the receipt was for some very small amount so that she could cheat on her taxes. That's why the dealer, even though he's selling privately, also forgot to give both parties a copy of all the relevant paperwork that he deals with on a daily basis selling cars. They were both shady and breaking the law.

I always get a receipt for any cash i give anyone otherwise i pay with a check, cashiers check, money order, debit/credit card or some form of payment that will generate a receipt and money trail .. and there is gonna be some type of contract/paperwork showing how much i owe, payments , length of time i have to pay and the receipt will show amount paid and amount left owing on said debt..

I don't care if you're selling a vehicle to Mother Theresa or the Pope, the purchaser doesn't get posession of the vehicle or the title until it's paid in full. Giving someone the benefit of the doubt or trusting people generally gets you screwed over. A person's word and a handshake used to mean something. Today, you're exemplified for how well you can con someone. It's sad!!!

I think it was the defendant who was the one trying to con the salesman, not the other way around. This is why: Her daughter accompanied her when she counted out the money. Even if the defendant had forgotten to obtain a receipt, the daughter should have caught it and said something about it. People are usually careful about retaining their receipts for ordinary store purchases in case they decide to return items so would this woman be letting a receipt for thousands of dollars go? I don't think so. Also, the fact that the defendant could not (or willingly chose not to more than likely) provide the other receipts the judge asked her for. She had no documentation, just her say so. How can this woman consistently forget so many things that are important, not bringing them to Court? It's because providing the receipts would work against her, that's why. I am glad that the judge ruled in favor of the plaintiff because I believe him when he said that this woman was trying to portray herself as a disabled person and took forever paying him for what she owed him because she just didn't want to.

If the the defendant was stuck on stupid that day why enter into a contract to purchase a car and not have sufficient funds to pay for it then throw manipulative tantrums when she couldn’t pay? She acts like she was under duress. The defendant didn’t get a receipt to prove what the bill of sale actually said. Not getting receipts makes no sense. Signing a promissory note and then saying she doesn’t know why she signed is problematic. This entire transaction was problematic and messy from the start. Defendant couldn’t keep her story straight. No punitive damages in breach of contracts case those damages are only awarded for tort claims.This is one of those nightmare cases that could appear on a bar exam as an essay question.

So the 675 was for additional work on the vehicle? One of two things with the defendant, she either believes her story or she is really good at manipulation. She maintained eye contact while telling her side of the story.

Defendant changed her mind afterwards not to pay the rest of the money she agreed to. Figured she was set because she had the title and registration and everything was finalized and done ; but then she got sued. Figured she only had to pay the listed price of $8200 , and forget about the $675 extra she agreed to pay. Plaintiff already “shammed” her to pay the extra $675 ; why not try to get extra $9325 in filing the lawsuit. The kindness disappeared from the litigants afterwards when it came down to the money.

Intelligence takes a whole new level of low here. Knowing you paid the car in full. Yeah let me sign a note saying I still owe money. WHY? Because you knew you still owed the money. Proof is in the paperwork showing the full agreed upon price was not paid in full. When you come to court just to prove up the Plaintiff's case for him. Stuck on stupid Will try to argue it was paid in full like the signed note did not exist.

A car dealer who put's a car in an other name is avoiding taxes. That's also why no receipt.

I was thinking the same thing but not many people picked that up. That's also why he put the smaller amount on the bill of sale. He knew exactly how much to put down for it to be less taxes and he can say he didn't make as much

When you buy a car, you don't need a 'receipt'. A real dealer knows to give you a bill of sale so you can get the tags and all at the DMV! She had her registration in an envelope, showed it to the judge. She could've easily proven what she told them she paid. First she said I gave him $100 the day I "purchased" the car, then later she said I gave him $525, which would be wrong because the $8200 minus the $7665 he said he got would be $535. Ignorance is not a defense because she still came to court without any evidence... This was crazy, and at times, hard to follow.

My decades of watching PC has often made me feel like the world's smartest. Giving cash for a (big) purchase or as a loan for which i wanted repayment I have never failed to get a receipt. I know i have "trust issues", but that just seems like common sense. 🤔
