I think you have misunderstood the charges against Trump. This is an accounting fraud case. Had he just paid the money, then there would be no crime and no one would care. However, he decided to falsify business records in an attempt hide the payments (§ 175.05 Falsifying business records in the second degree) and to write the payments off as business expenses for a tax purposes. Trump already has admitted to repaying Cohen for the Daniels payment as a "...reimbursement of a private contract between two parties, known as a non-disclosure agreement, or NDA.".. ---tweeted by Trump on May 3, 2018.

Ok little Ricky here goes. See a jury hears the evidence and decides if an indictment is warranted, then the prosecutor decides whether to indict or not . Still with me, ok. Then a judge hears the indictment and decides if they have enough to let it go to trial. Pretty remedial actually. Also a citizen can't bring a criminal case, in civil court yes, criminal no. A citizen can call the authorities but it's up to the authorities to actually bring the case to court.

However, the judge could not have dismissed the case based on that argument yet because there have been no motions made to dismiss this case filed by the Trump team. That process happens later. Proving this was politically motivated would be tough since Bragg was not the DA when the investigation on this case began. However, even if true, it wouldn't change the fact that Bragg was required to show actual evidence of a crime to a grand jury to get the probable cause indictment.

As far as Bragg not being in office when the investigation began, he ran his political campaign on going after Trump, even after other DAs said they wouldn't touch the case. It should, but Trump's defense has not provided any exculpatory evidence or claims about any of the charges against him. Think it would be different if he went on the record and said specifically 'I never made any payments to anyone.' 'The district attorney is lying' etc. But he isn't. They aren't refuting any of the claims or charges. And I suppose he doesn't have to, the burden is on the State of New York, not the defendant.

How could you possibly know what evidence Bragg has obtained or used in his presentation to the grand jury? The case was just charged and the discovery procedure has not happened yet. And Bragg gave Trump the opportunity to testify in front of the grand jury. Trump declined.

In my country if a prosecutor would announce that he/she "is going after somebody" this would form a legal base to get him/her off the case on the (legal) grounds that the prosecutor is prejudiced.

Also, even if the prosecutor was prejudiced it wouldn't matter. He still would have to present evidence that supported a 'probable cause' to arrest. And he would still have to convince all members of a jury that Trump was guilty of the crimes. I imagine most prosecutors hate or are biased against child molesters and gangsters. Yet, they are still allowed to charge them with crimes.

It's why we have to stop believing a grand jury is such a respectable thing. It's nothing more than a few like minded people, hand picked by a prosecutor on a mission to get someone.
