Angry New York ATC argues with Aer Lingus pilot [ATC Audio]

On July 22nd 2018 flight EI104 (A333 Reg: EI-FNG) from JFK-DUB was departing at 5:15pm local time from New York's JFK airport.
Following relatively severe weather in the New York area many aircraft on departure from the New York were requesting deviations from their routes due to the storms. This was a time of very high workload for pilots and controllers alike, as random weather deviations from planned routings can quickly throw a controller's airspace into a mess.
The crew told ATC they could not turn to the east/southeast due to a weather build-up. ATC responded by remarking that he can see only the lightest category of weather there (ATC has a weather radar in NY Tracon) and that no other aircraft had deviated from there. The Aer Lingus pilot remarks that he is just going by the equipment he has onboard. The flight, after 3 holding patterns, continued to Dublin, landing an hour late.

indeed, because last year southwest was STRUCK BY LIGHNTNING in light rain weather conditions, from cloudy NH en route to Orlando, so might be in everyones best interest to listen to the pilot, yes indeed. JFK do us all a favor-and terminate that employee control tower attendant/ who cannot handle the pressure of that job, he's better off in another career. Aer Lingus pilot, you were grace under pressure, mate bless you.

I’ve been a commercial airline pilot for almost 30 yrs, I was based out of JFK for years and I can say this much : first, that controller was way out of line. It doesn’t matter what clearance Aer Lingus accepted originally it’s the responsibility of those pilots to maintain a safe distance from weather. That’s precisely what they tried to do. The ATC controller is on the ground- he’s not flying the airplane. All he did was attempt to convince Aer Lingus to do something unsafe and after his attempt was refuted he attempted to punish the Lingus pilots. If that scenario happened to me I’d absolutely be talking to that controllers boss and ensuring he be trained not to do that again. Being a controller is a tough job and I respect what they do, but this guy needs to be re trained. Period. No debate.

I am a commercial pilot too. You are absolutely right…often in New York I have the impression they take this things personally. A weather situation can, once you airborne look completely different than when your are scanning it on the ground. On top it doesn’t mean if all the other traffic before did the turn to the left, that you can still do it… we know how fast it can close up. We are sitting with our butts in the plane deviating from weather trying to bring people and material safe home. And this particular situation he can be sure that the pilots would to turn left if they could, in direction of their route and not waste precious fuel turning to the right. This controller definitely needs to be back in training…not to punish him but to bring up some forgotten basics that have been lost in years of stress and experience

I’ve been a controller for 23 years. (Military,DOD and FAA) I do agree with what the other pilots are saying. But so many times I’ve seen pilots get into a worse situation because they don’t have the big picture!

You could tell by his response after “my boss will call your boss”, this wasn’t the first complaint he’s gotten. Downplaying serious weather and putting pressure on a pilot to approach despite what his instruments are telling him is unacceptable to say the least. Should be suspended and fired if it continues.

@James C.E.S. I'm an ex cab office owner, controller... I've had to tell drivers NOT to drive thru water that will drown and ruin an engine... I want all my pieces available, had his bullying been adhered to, say a younger less experienced crew, and decided to give it a go, crash, and where does THAT put all your pieces?? Hours of backlogs and cancellations, MILLIONS lost, they're not paid enough... and they're not staffed sufficiently. But they need to do something about that, in house, not hate your job conditions and take it out on people who are literally at the mercy of the weather. I love listening to a good controller.. I miss it, only cars, but, knowing where you're sending them, 3 stops in advance, I was great at that one thing I miss it. Wish I'd had the guts to go for atc. I'm thinking of volunteering for emergency helplines... But yes. Unless these people are told, they get away with worse. And they never learn. And it WILL end in fatalities one day. Yet that man will leave his supervisor's office, cursing the pilot.

Brendan Y it’s like trusting a mother or a girlfriend, the mother being the pilot and the atc the bitch girlfriend. 1000% I would trust the mother cause it’s always right. Hope you understand what imma trying to say. Not offending you or any shit like that but, atc controllers in New York have a bad reputation. Trust me when I tell you this. I live in New York and have travel many times overseas and in the states.

@@brendany8229 weather changes. aircrafts following a route in the past does NOT inicate that this route is still safe! props to the pilot for not obeying to atc insisting to put himself at risks. the atc has no idea what going on in the plane, so a pilot has ALWAYS the option of calling unable. your comment is really not thought through....

They do, its one controller in particular that seems to have this problem. And with the shortages on controllers and the FAA not really hiring any new controllers because they don't have the budget for it at the moment this controller isn't going anywhere. He's in A LOT of NYC videos on ATC forums/channels

ATC in the New York area is the second busiest in the world. There’s Newark, La guardia, jfk, west Chester, islip and private airports all together.

I get that the pilots accepted the departure clearance but clearly after takeoff they encountered something which made them uneasy, and safety has to always come first. I know that ATC is a very stressful job, especially somewhere like NY, but it was extremely unprofessional to speak to the pilot that way, and even potentially dangerous because there are crashes that have happened because of bad decisions made by angry pilots. The controller handled this horribly and the pilots did the right thing when they felt that the situation was not safe.

The pilot is much close to the immediate weather and ATC should listen instead of trying to force thsir will on the pilots in these circumstances. This was caused by the weather And the ATC made it worse for this aircraft especially with a his jibber jabbering.

Everyone is arrogant to some degree about where they live. New Yorkers are not unique in this regard. DC, LA, or small towns in the middle of nowhere - people associate their own ego with the place they live. This whole conversation is predicated on the belief that where you live now is better than NYC.

At the end of the day the pilot is responsible for the safety of his aircraft. he did the right thing, by not being bullied into a flight path he did not want to take , for safety reasons ( weather )

True. But I get the distinct impression Shamrock was a big puss. That's probably why he's flying the heavies... because he is overly-cautious and those things are not cheap. But the controller did have a point, in that he accepted the clearance on the runway... THAT would have been a fine time to raise objections, not while you are ascending.

You get used to it in at least two ways. First, in each phase of flight there are fairly standard things you're going to hear from ATC - heading changes, altitude changes. So you're preconditioned to hear what's coming next. Secondly, there's a sort of "chunking" going on where you perceive and filter information in larger chunks at once rather than word-by-word. I did my initial flight training in the Washington-NYC corridor; and you learn very quickly to how to communicate and match the cadence and flow on the COM. Also what you don't see is that they're usually writing down complicated clearances such as departure clearances that involve more than just heading and altitude changes.

This ATC seems to be under the illusion that he can command pilots to ignore their own air craft readings to make him happy. To him it's just about doing a job, to the pilot it's about not exposing his passengers and crew to credible risk. Respect to the pilot.

The type of ATC is intimidating. This way of talking to pilots has proven to be a factor in aircraft crashes. IF THE PILOT SAYS I DON’T WANT TO GO INTO THE WEATHER CELL!!!! Mr ATC man, you have to accommodate his request, it’s his aircraft and his responsibility to keep it safe. Well done Mr Pilot.

@@valerierodger7700 2 different point of view. Pilot is responsible for his aircraft. ATC is responsible for every aircraft. Pilot decided, rightfully so to do what is necessary in his opinion. ATC is trying to get him back in order, but with the high volume of traffic and bad weather, it will take a while. Imagine a car turned to the street to avoid a cat, but now demands that he gets the right of way jumping back to the highway. No, you wait, there's heavy traffic in front of you.

The flight was to Dublin, it sounds like he was using the GREKI SIX standard instrument departure (SID), which is excerpted: TAKEOFF RUNWAYS 22L/R: Climb heading 224°, thence . . . . * GATEWAY CLIMB: Climbing right turn to intercept the JFK R-232 until 5 DME, then turn left heading 219°, thence . . . . . . . . via RADAR vectors to GREKI, maintain 5000. Expect clearance to filed altitude/flight level ten (10) minutes after departure Thus: (1) This departure is not a simple instrument departure with headings known on the ground, as a pilot you should expect to get heading information just after switching from Tower to Departure. RADAR is required for this departure, i.e., talking to ATC and getting vectors. (2) Flying the runway heading is what the pilot should expect to do, as per the SID and the tower's takeoff clearance. (A busy airport will sequence departures with different headings of 10-20 degrees difference.) (3) The pilot was trying to get to GREKI because that's a key waypoint to start the main climb. Everything prior to GREKI is ATC vectoring you around traffic and weather towards GREKI. FYI, GREKI is an "intersection" in Connecticut about 5 NE of Danbury, or more precisely Carmel (CMK) 057 radial at 17 NM. (4) Yes, lots of other departures out of JFK are using GREKI SIX (northern departure to Atlantic Ocean via Danbury CT), MERIT SIX (middle departure over Merit Parkway in CT), and HAPIE SIX (departure along Long Island South Shore), I've flown in this area, including in bad weather, with busy traffic around JFK. And I've flown in lots of crappy weather, including asking ATC for info from their weather radar in advance of our position. One time, it took 45 minutes - turning every direction of the compass - to corkscrew ourselves out of NY Approach. The pilot is Pilot In Command, responsible for all decisions and consequences. I've heard ATC become irritated when they wanted a pilot to do one thing, and the pilot says "unable", such as a pilot declining a a shorter parallel for a longer parallel runway (what ATC didn't know was the loading of the plane, the plane's particular requirements, and the pilot's own "minimums"). If a pilot says "unable", ATC needs to respect that and find other options, such as three turns in a hold before heading to GREKI. It seems plausible that the pilot, while on the ground, was unaware of the severity of the cell he was being turned into. While the pilot accepted the clearance, it would be normal to expect various heading changes within the New York area until he reached GREKI intersection and then he would expect to receive clearance to his filed flight plan. I think ATC could have been a bit more patient: the pilot is dealing with an imminent weather problem (which can become a safety problem) and the pilot is seeking to resolve this immediately. The pilot is NOT doing this to annoy ATC or give ATC a hard time. After the third turn in a hold (with GREKI just a short distance away, which would be less complicated from that point onward), it was reasonable for the pilot to ask ATC, in essence, how long do you expect us to hold here? ATC's response didn't need to have "attitude", ATC could have said "I have about a half dozen aircraft we're trying maneuver around the weather, so it's going to take me about 5-10 minutes (or whatever number) to get your aircraft into the sequence", which is the normal kinda back-and-forth between pilots and ATC during busy periods. Lastly, from a regulatory perspective, the pilot was within his right to refuse an instruction from ATC that the pilot could not perform safely: visual "see and avoid" takes priority over instrument clearances and ATC's instructions, even when in Instrument Meteorological Conditions (IMC).

1. The pilot is not going to clog up a class B airport on the ground because of some weather he can probably get vectored around. 2. Aircraft radar isn't turned on until on the runway, and it's not very accurate on the ground. 3. Asking for vectors for weather is the right thing to do if it looks bad.

Bunch of arm-chair professionals here. JFK, due to it's close proximity to to multiple other very busy major airports puts it in some of the most congested and complex airspace anywhere in the world. Working this kinda airspace, you have to plan ahead. When you have a plan to keep everything moving smoothly, and everyone is following it no problem till one pilot decides to deviate and through a monkey wrench into your whole system that isn't a problem for anyone else... It's infuriating! Now you're scrambling to get him outta the way and keep everyone else moving without loss of separation, while trying to plan out how you're now going to get him outta your airspace. When your already busy, it increases your workload 10 fold and your stress level 1000 fold. The traffic doesn't just stop so you can focus on 1 aircraft.

Theres a problem with certain types of mics that you may not understand...to keep background noise down they turn themselves off...the first new sound then activates the mic...at that point the first syllable or even entire word can be clipped off....blowing into the mic turns it on before speaking...

When I was first learning to fly, my instructor said to me, the hell with what the tower thinks you should do! They are not the ones up here flying and dealing with getting the plane on the ground. At the end of the day, the tower people walk outside and go home.

No doubt that the NY area controllers are overworked and underpaid, but I have to say, I found them to be the rudest controllers I have ever worked with. US, Mexico, Canada encompassed all my flying and I NEVER experienced anything like their airspace management anywhere else. For all the commenters wanting to defend the controller, please understand that the controller does NOT at ANY time control the aircraft. The Pilot in Command controls the aircraft. The controller can issue direction, but his directions can and will ALWAYS be overruled by the Pilot in Command if that PIC deems the controllers directions to be unsafe. If the PIC did not think it prudent to fly through that weather, then THAT is the final decision. The controller doesn't have to like it. In fact, as we see here, the controller was forced to do some serious shucking and jiving to make adjustments to accommodate this flight. Having said that, the controller has lots of other traffic to manage, especially in that insanely crowded and compact bit of airspace. Both controller and PIC are actually doing the right thing here. I would wager this kind of thing goes on regularly. The difference is the way the controller is chastising the pilot over the radio. For those wondering, that is also NOT his job.

True! Their role is to assist air traffic. Too many Hollywood movies glorify ATCs and no doubt their egos get a huge boost. I got shouted at by a controller once who said I had intruded into the controlled airspace. I had my VFR chart and was over a known landmark outside the CZ, so I knew I was right. But to avoid an argument with an asshole, I just had to say "sorry" and forget it. No doubt he was stressed, as many of them are, but he was wrong!

Because pilots operate in the following order: aviate, navigate, communicate. Number one priority is fly the plane. Number 2 is fly it in the right direction. Number 3 is talking to ground about what you're doing. And when it comes to instructions from ground, they respect them in that order to. The controller is a fat guy with a desk job. The pilot is a damn pilot.

It did sound that way but as a controller myself, I guarantee you it didn't sound that way because the controller had any concerns of what would happen to him...which is absolutely nothing in this situation. Controllers in general take no pleasure in delaying a flight of any kind and strive to provide the best service that they can. This controller was merely trying to help the pilot understand last second why this happened. This controller's delivery was terrible, however, the entire time.

NY ATC: if a pilot says he cannot turn towards a weather cell; well guess what.... he can't. He's not doing it to make your life difficult, he is making a safety decision based on information he is receiving in an ever fluid environment. Don't be a prat! We appreciate your airspace constraints, but: 1. We pilots are not "up here", because you're "down there". It's the other way around; get off your high horse and provide the service you're paid to provide! 2. English is not everyone's first language. Your non-standard ATC "lingo" (in many cases), combined with your accent and Mach 3 clearances can be difficult for non-native English speaking pilots to understand. Speak slower, stick to standard phraseology and exercise some patience when someone doesn't get it right, first time. You work at ONE airfield, ONE set of procedures. We, fly to MANY airfields on MANY continents, all with different procedures. Work with us, not against us!

Although the controller is right about accepting the departure clearence, weather is dynamic and risk can never be forecast. Safety is a point in time consideration for which the pilot is ultimately responsible and ATC must support. That considered, it is my conclusion the ATC acted unproffessionally.

Speaking as an aviation weather observer at an airport, we get ATCs occasionally calling us asking us to increase the visibility we are reporting. The answer from us, obviously, is no way! If we did that and reported a visibility than what it actually is and then there is an aircraft mishap, we would get the blame. Safety should always come before convenience when people's lives are at stake. The pilot made the right call in this case.

If the pilot says he can’t do it he can’t do it! They fly the aircraft and we fly the radar. Many airlines have different perimeters for weather avoidance. As a retired ATC I would suggest routes thru weather but never penalize aircraft for not accepting the route.

Reality is , it's human nature to want the best outcome to preserve one's life. In the aircraft when you are flying through and around the shit , you take the best course of action available to you via a process of decision making with the onboard equipment and crew. ATC on the ground have their own equipment but their lives are not directly in jeopardy. Your onboard equipment is what you trust. Not some annoyed ATC over the VHF. If that means you have to hold , then so be it. If there is doubt , there is no doubt.

The ATC's in NYTRACON are awesome!!! Try working NY Departure for JFK with weather. It's easy to pick on the controller from your arm chair. Like the ATC said if they were unable to fly the SID they shouldn't have excepted their takeoff clearance of off RWY 22R. Ever heard of en-trail spacing for weather that's why he had to put him in a hold.

s2v8377 putting him in a hold is not the issue here - he couldn't keep his cool and wasted valuable seconds of air time telling the pilot off. The pilot is in control, and if he says he's not doing something then it's the ATC'S responsibility to find a way to make it happen without any of the dramatics. Take a look at videos of London Control/Heathrow Director - they deal with similar traffic levels all day and manage not to lose their temper when they're inconvenienced!

They're just AM radios. Its the same reason phone calls sound terrible; its old technology that is straightforward to implement and standardized worldwide. It works well, and the chaos to try to change the standard worldwide isn't worth the benefit; we get along fine with it as it is.

Avianca 52 crashed because the pilots were intimidated by the new york controllers (one of the causes). They really need to adjust their attitude, if the pilot is worried about a cell, don't try to force them through it, just because other aircraft came through it unscathed, doesn't mean yours will

Delta 192 crashed at DFW after being told by ATC that weather was safe and other aircraft were landing OK, well it wasn't OK and 150+ people died.

Apricot Theory exactly, you’re not a pilot. I am. The pilots only job is to operate the airplane in a manner that he/she believes is safe. If they would have taken the vector into the storm and something would have happened. It would have been the pilots fault. Not the controller. It’s the pilots butt out there in the real world.

If I get into these situations I just say standby, and come back on after 10 seconds to tell ATC that I have just checked my license and it doesn’t say “Test Pilot” anywhere on it.

The pilot is facing a minute to minute changing environment " up there"..he had so many variables to factor in...the controller should understand that..at the same time the controller too is handling so many things all at once..and will take timely decisions on basis of what he feels is best..so both professionals should respect that..of each others job functions... thanks for sharing!!!

Ultimately the Pilot makes the call. ATC can't see what the Pilot sees. I appreciate the frustration on the controller's side here but the Pilot nailed it with the final statement.

It sounds like the controller was trying to intimidate (and punish) the pilot. This is against FAR 91.11 (no person shall interfere or intimidate a crew member during operation...). You know the saying, “When the pilot makes a mistake, the pilot (and passengers) dies, when the controller makes a mistake, the pilot (and passengers) dies”. The pilot sees what the controller can’t. Radar is not a substitute for the pilot’s eyes.

The pilot didn't "see" jack shit. He was looking at his onboard radar and shitting his pants over nothing, basically being that doddering old asshole doing 46mph and drifting between lanes on the highway while people have to dodge for their lives.. The fact is Aer Lingus had a cell on their radar that their SOP required them to avoid. I have no doubt this was inconvenient for the controller but it turned out to be a lot more inconvenient for the aircraft. There is no way the crew would've declined a vector if they didn't need to. They will have been keen to get turned around and pick up their oceanic route so it is not as if maintaining their orginal heading for another 15 miles was something they would have wanted. The manner in which the controller behaved was childish. Those who say the crew should not have accepted the clearance before take-off are wrong. There can be a very long time between receiving the route clearance on the ground and actually getting airborne but the weather wasn't standing still. Furthermore these departures involve vectoring so the exact flight path between intial climb-out and GREKI is unknown and it is impossible to know ahead of time if there will be a build up along the way.

The ATC complied to the pilots request who than started bitching about having to hold his position, watch the video again there is at no moment a reason where ATC is at wrong! The only mistake that was done was by the pilot when he didn’t check the weather briefing prior to takeoff and when he was bitching to the ATC on an open traffic channel (which is hella forbidden).

Of course ATC was not correct. He mentioned he has to go by the equipment he has in HIS aircraft. He is ultimately responsible for the safe conduct of that flight. Pilots are NOT there for ATC, ATC is there for pilots. This controller seems to have forgotten that. Starts arguing like an imbecile instead of keeping his cool and getting the guys out.

NYCEE57' Not this time. The captain was working with the data that his own instruments were feeding him, and by his judgment as pilot in command of the aircraft, deemed it unsafe to make that turn. He communicated this to the air traffic controller who then got pissed at him because he acted in the safe interest of his plane, crew and passengers. By that logic, pilot-in-command makes the final call on what is and isn’t safe on his aircraft. ATC is there for clearance and information, acting as a support system for air traffic. It’s not ATC’s job to determine on behalf of the pilot what is and isn’t safe. Only he crew is aware of their flight capabilities and safety minimums.

According to the ATC, everybody else was turning left into the weather, and 104H was requesting to go straight for 15 miles then turn left. It sounds like he would've been in even less conflict with other aircraft. Plus, this is a 3D space, so I don't know why he couldn't have been directed to a different flight level than the other traffic.

I find this most extraordinary. Flights into, out of and over LHR follow graceful flight paths that vary to spread the out noise evenly. I remember seeing this kind of pattern over SVO Sheremetyevo a few times and could only wonder that was going on.

In the words of one of my instructors early on in my jet career " we haven't lost a controller yet". If that pilot would have accepted that turn and someone would have got hurt that crew would have been raked over the coals. NY ATC has some of the rudest controls that talk way to fast, think they know everything, use lingo instead of standard phraseology, and get so mad if you don't get it on the first call or question them. I departed Teterboro Airport and a ground controller reamed out somebody so bad for asking for confirmation instructions that everybody else on the radio frequency was afraid to ask any questions. Not a good situation when you're dealing with human lives and millions of dollars and equipment.

That's why pilot experience is so important on commercial jets. He made a judgement and didn't put his aircraft into a questionable situation just because atc was putting pressure on him.

4:22 Note for the departure controller, there is usually a minimum of 60 minutes between the time that you ''accepted' or copied a departure clearance and the time that you take off. Weather changes quickly, even in NY.

I had no trouble understanding them, there were subtitles, and other than their specific lingo about calling an Irish airliner Shamrock all the rest of it was just Direction headings like telling someone to turn 180 degrees or make a 360° Circle that's the same thing he was telling the plane over and over again.

Yehiel I am having a tough time understanding the question here. Did the EI pilot understand the weather conditions ahead of him and sound an alarm over a storm cell in a wrong place? Was there a prospect of a Delta collision? What exactly did the ATC try to do by spinning EI into a circle.
