Personally I think to myself how would I brief this in to an illustrator in a way to not break any copyright issues, should a lawyer look at the brief.... so for example, I wouldn't ever write 'in the style of FAMOUS ARTIST' or 'using FAMOUS CHARACTER' as I think that's when you can get into the main issues.

No it doesn't. So you need to be careful with prompts, and use common sense with checking your work. So for example I wouldn't say 'disney mickey mouse drawing', because it'd use those keywords to go and find things on the internet which are copyrighted.

You can copyright a book you’ve made but there’s pretty much zero point unless you’re expecting to sell tens of thousands of copies. If people are going to plagiarise you, it being copyrighted won’t stop them, and it’s probably not be worth the legal fees to follow up. So… yes if you’re a large publisher.

I use creative fabrica but haven't used their AI tool yet, I'll give it a go and do a video on it :)

Not as a free user, no unfortunately not (I understood from midjourney T&Cs that you can only use them on paid plans).

Hmm from my researchi'd disagree... with a paid subscritpion to Midjourney you are given the rights to utilse the content as you see fit. I've not seen anything to show that you can't use midjourney images in books... obviously it's a fluid situation, but again, I'd not be worried due to the T&Cs on MidJourney.

@@selfpublishingempire I agree, you can use Midjourney images in books. I didn't say you can't. What I'm saying is that you don't have a copyright. Nobody does, including Midjourney. Not in the USA at least. For anyone outside of the USA, your mileage may vary. However here in the US the government organization that issues copyright has established that only a human can have a copyright, and Midjourney is not a human. And since Midjourney doesn;t have a copyright in the first place, they have no right to grant it to you. Any image created using AI is immediately public use. Anyone can use it for anything, because nobody can hold a copyright to it. The reason they mention it in their paid license agreement is because the company behind it made an assumption about their rights, and then they very recently found out they were wrong. I don't want to link to another person's video in your comments as that feels rude. But for anyone interested LegalEagle made a very good video about it recently.

@@bcxanth7 thank you for clarifying Ken. I will make sure that I don't say outright that you get copyright of the AI imagery moving forward, but whilst MJ's T&Cs stay as they are I do think we have some form of loose 'ownership' (even if maybe not legally copyrighted)... I know in the UK there have been sucessful copyright claims of AI imagery as an example. Thank you for the info and I'll watch Legal's video :)
