Update: This video captures a moment in time where I felt very frustrated and disappointed about the events that occurred in my employment at the time. I have now put this behind me and I have no resentment or grudges with any employer or company. However, I do think capturing this moment and sharing is important for anyone else who is going through similar situations. Here is a follow up video I made - ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-tHR-JcRPJb8.html

The company I worked for got bought out. Right away they brought in there own management team. They wanted me gone. I was highly skilled labor. One morning they asked me to a meeting and offered me 1 year of severance pay with health insurance if I signed a contract to not solicit any customers or current employees. All I said was FY and I'm going to put you out of business. I left. The following Monday I was on the plane. Over the course of 6 weeks i took 5 key members from the company and moved them all to a different state and a new company. It paralyzed my previous employer. In less than 6 months they were no longer in business. Revenge is sweet. I love the fools that make decisions that don't have a clue how to do the work themselves. Be careful with your skilled labor. Treat them like gold. Only you think they can be replaced. There the ones that actually make the company money. Management are a dime a dozen.

I'm an engineer, and I have been paid with 1099s many times. It's called "consulting/contracting." It doesn't require you to form a business, and there is nothing shady about it. It saves the company the overhead of paying you benefits, but it also pays quite a bit more per hour to make up for it. All you have to do is pay your own taxes. I don't know why you think they were trying to pull one over on you.
@langhamp8912
@langhamp8912 3 месяца назад
The contract worker costs companies substantially less than a W2 worker. Benefits are a form of compensation so the idea is that a contract worker gets that in cash on the front-end instead of medical, 401K, on the back-end. So basically they fired you and then rehired you for substantially less, correctly judging that with the current job market that you'll take a pay cut. I personally would take the pay cut while searching for a new job on the sly. You're just not going to win or convince them to convert you to W2 as you've already been a W2 at this company, but bills are bills and any salary is better than no salary whatsoever. The great thing about contract work, though, is that you can quit immediately upon finding your new job...no need for two weeks notice or such silliness.
@House_Husband_Romeo

Thaaaank youuuu! I did precisely this… and now a major investment firm wants to buy out my contract through the consultant firm I’m associated with. Not only will certain companies attempt to 1099 you but they will place more work on you that falls outside of your job description usually that is the bosses work. I took on that work and applied for an even higher position elsewhere not only was the talent scout pleased to buy out my contract he also wanted to give me an administrative position in IT which opens up a whole new world of opportunities for me in the IT sector. Now that the company I originally worked for know I’m contemplating leaving they are considering buying me out my contract for an even higher salary. Consultancy is the way to go.

@JimBobe
@JimBobe Месяц назад
You have a lot of maturing to do, and you'll understand more as you grow in your career and gain more experience. I know you didn't ask for anyone's input or opinion, but here's my two cents on your situation. You were let go because the company you worked for couldn't afford you. They offered you a contract position because while they can't afford you right now that doesn't mean they don't want you, it just means there's not enough work to keep you around. This contract position would benefit them and you, since you would get paid whenever work would be available. They were not trying to "scam" you as you put it. You asking to keep the laptop was a bit weird honestly, and it kind of sounded like you were expecting to keep it because of all your hard work. You don't normally get to keep company/work laptops after you get laid off or quit. They are normally given back to the company due to data/privacy reasons, and to give to another employee instead of having to continuously buy laptops. So when you asked if you can keep yours the owner was trying to be nice and im surprised he actually said yes, as long as you return it. This was smart on his end because that means he's giving you an opening to start a conversation when you return the laptop about your interest in the contract position again. I highly highly recommend you tell him you're interested! You mention that as you stayed in your position you had to always learn new things. Well, this is normal. Trust me. In fact this is a good thing. You having to maybe step out of your comfort zone and learning sql and other programming languages as well as contributing to projects that may be out of your scope are all good things. Why? Because you can put it on your resume and use it to hop to be a better job!! At your age you should be soaking in information and raising your hand to volunteer and learn as much as you can. Then you take all your knowledge and FLY AWAY! This is not the point in your career where you want to be complacent, save that for your 40s and 50s haha. Learn, grow and try to develop your leadership skills along with people skills if you can. This will all help you in advancing your career and finding your dream job! I wish you the best of luck,

I'm in the same boat, laid off Q1 of 2024 and it's been a month or so since I've been looking. I was at my previous employer for 2.5 years so it was a relatively long time in IT / CS. Right now the job market is brutal. It sounds like this employer was a red flag from the start if you were the only programmer there. The laptop deal, most companies want their equipment back - they really care more about the data than the equipment... I don't really know what else to say about this one. All I can say that it's rough out there right now and I really don't trust employers either at this point. You do have to work for a company until you can do something on your own but your employer is not your life unless you own the company. Good luck out there.

I agree with this. Also, I want to add, 1099 is not shady at all in my opinion. It provides more flexibility to both the employer and the worker/contractor, and can be a good option in many situations. A lot of people don't like it because they have to pay SS tax and healthcare themselves and don't get paid holidays & PTO, but that's just the nature of being in business for yourself. You can always keep looking for a full-time gig while working on 1099 (with a bump in nominal hourly pay to make up for the drawbacks). Who knows, you might land more clients and turn it into a "real" business. 😺

What I learned is that its better to have any job so that you at least have some money coming in (even if its below your skill level) that way you dont have large gaps in your resume and dont lose years of your life where you werent making any money. You could always apply to engineer jobs while working a less skilled job.

Speaking of being a software engineer and I saw a couple of videos by youtubers honestduane (video title=May 2024: The tech layoffs have oversaturated the USA tech job market) and MillionaireMorningShow (video title=Show Me the Money, Not Layoffs..." Big Tech Using Perks To Lure Workers Don't Work Anymore). The former speaks to the problem of oversaturation being so bad that even level 7 Principal or level 6 even having to take a step down to Sr Devs just to earn so it's really bad for inexperienced and mid & jr level people looking. The latter video talks about developing an even stronger mindset to support yourself to survive as Big Tech may no longer the dream so have other bags to chase. I hear ya...not everyone is even making 100K even in high cost of living areas. Stand firm with integrity and a healthy internal locust of control, prioritizing your time/energy and faith with hierarchy needs while bag chasin'.

There is nothing wrong with 1099. Well, it's not the same as W2 employee. It's basically a contracting job. You still get paid. There is nothing shady about it like what you said. One advantage over W2 is that you get paid by the hour. Unlike 1099, a W2 employee is mostly exempt meaning your pay is a fixed amount. There is no overtime. You don't get paid extra if you work more than 40 hours a week. Since 1099 does not have benefits like paid vacation, 401k, medical, etc., you will need to set your 1099 hourly rate to cover those benefits. Normally, a 1099 hourly rate should be at least twice the hourly as W2. Another advantage of 1099 is you can treat it as a business. Unlike W2, with 1099, you can deduct expenses from your taxes. The disadvantage of 1099 is that the hours are not regular, meaning your income stream is not guaranteed. Again, you will need to set your 1099 hourly rate to cover to cover that uncertainty. With 1099, like any business, you can negotiate your hours and schedule. Unlike W2, with 1099, your employer which is now a client and he cannot force you to work for you exclusively. This means you can have multiple 1099 jobs. It's not really that bad. Some people actually prefer 1099 than W2.

Sometimes 40hr work just isn't there, so be flexible. If you're around you're that much ahead of the people on the outside still looking. Good luck, and btw you're in tech and you have to add to your skills, its a fundamental career activity.

Good luck with any VW at that age. I went through a phase when I just had to have my 2001 Corvette until its repair bills ate away at my savings. Toyotas/Lexus, Mazdas, and Hondas are typically so much more reliable than US and German vehicles, although BMW's collaboration with Toyota has resulted in a steadily-increasing reliability reputation. But getting back to your employment situation....I've gone through similar layoffs over the years and have learned to avoid very small companies, as they are more likely to fail. Mid-size companies are best. Keep looking, even outside of your geographical location. I moved cross-country and never looked back. One last thing: Always be learning something new if it is likely to be valuable to many companies that have openings in your field. Your day will come.

I wish I had seen this video earlier. I know that what they wanted to offer is not what you wanted but, I have advice from an old man. Never leave money on the table. Learn how to negotiate a good contract. Factor in your personal cost to continue as a contractor, and compare it to the cost associated with the previous position. As their only technology specialist, you get to control your work/life balance based on the contract that you commit to fulfilling. Life is a long journey and there are many peaks and valleys. Make every bad situation benefit you in some way, if you can. the experience you gain as an independent contractor is still of value when applying for positions in the future. Now is not the time to worry about new rims for your car. It is time to focus and plan for the brighter, newer, more lucrative, and more fulfilling, future ahead. Never leave money on the table. Never doubt your skills.

Hi there, Many people have mentioned Ridesharing in my previous videos. What they do not know is that I've worked with Uber before, so much that I have actually gotten a ticket for parking on red to deliver a food item. That was a bit long ago however and with the current gas prices and my monthly bills, these options are not a good choice for me. It would make more sense for me to network, brush up on my resume and find a corporate job with more consistent pay. However, if I did have a Prius or electric vehicle and I lived in a smaller city, you bet I would be driving out there for some extra cash.

When I got laid off or got the threat of getting laid off, it was always a come to Jesus moment for me. It's quite ironic folks would misuse this name in daily conversations or when talking to themselves but when the proverbial hits the fan, they're faced with the option to either seek divine help or figure it out all on their own. Don't mistake me, I believe you got to work some things out on you're own, but when it comes to things totally outside one's control, you got nothing to lose if you call upon the name of the Lord and admit you're defeated without His help alone. Unfortunately for folks in Asia, they seek their idols and false gods, but for all you western anglosaxon folks out there, Jesus is asian, not european or african.

Hi Thomas, one advantage of 1099 is that you control your own schedule and can tell the company yes/no on availability. Another advantage is you can typically make 50% more on your hourly fee compared to what you were making full time as the work is not guaranteed and is usually an urgent need. The company is willing to pay extra. It has some upsides you may not have considered -- good luck!!

Gen Xer here. From 1990 I worked for six large organizations, got laid off at four of them, fired at one. Mergers, acquisitions, and despising a couple of my bosses and those related roles were the reasons. Hang in there, today is tough and with AI wiping out many jobs, it's going to get worse before it gets better. But it's always been tough, it was never easy. You and most of us will get through it. Just don't get addicted to drugs or booze, I've seen that take quite a few off the board. Good luck!

You made a mistake. Nothing wrong or shady with the 1099. You could have negotiated a high hourly rate and just work 3 to 4 days a week and work more on your projects. The job market is absolutely brutal. If you are in tech, it can take more than a year to find a job.

Now I have another car to pay off 😂

It's difficult to find a salaried position for your skillset unless it's govt or a massive company. You can have great success leaning into the 1099 route. I did something similar, and decided to market myself to multiple companies. Now I make a lot more then when I was a salaried employee, set my own hours, and feel more secure not relying on one source of income.

Hang in there. It's hard to digest knowing that employers can treat people like they are disposable just so they can save however much they can. One thing to remember is that when one door closes, another one opens and it's just a matter of time before that 2nd door is in front of you.

Not to long ago I read something about AI computing. How it works is you put in all the work while the AI is learning from you then the AI will improve daily tries to be more efficient. Once that happens the employment will start letting people go. I've heard hundreds are laid off due to AI. It sucks...

they may have been trying to save on offering benefits but working as a contractor is not like working salary. You will still negotiate a hourly wage. Infact you would need to negotiate a hourly wage more than what you were making before because you will be having to furnish your own benefits and health insurance. Instead of as a employee they paying a large amount on your insurance them selves and then you cover your part, as a contractor they wouldn't supply insurance and you would have to handle all of it not to mention the other stuff like short and long term disability. You would also be able to deduct from the income many things to lower your taxable income. The only thing is how many hours they would offer you a week. interesting proposal. If it worked for you then you could maybe offer your services to other companies.

Keep the laptop dude they don't owe you a free laptop especially if they paid you. It's your responsibility to buy your own laptop. Take accountability and learn you are a disposable asset like the rest..what you knew 2 years ago let alone 5 years ago is obsolete in IT. I ha have no loyalty to any firm my first loyalty is to myself and my family. You saw red flags and didn't act. That would be my cue to update my CV and start job hunting.

As a former independent contractor, I also had a full time job. Stay at the company. Get paid, get more experience. Learn what you can and keep looking for a permanent job. Asking for the laptop as you're quitting is not a good look. They owe you nothing like that. Greed is taking something that doesn't belong to you and want anyway. This company can't afford to give away anything, not even a crappy laptop. It's probably not performance but more likely immaturity.

You currently have no understanding of contract work. They would’ve been paying you for anytime you worked, we’re not just gonna be in the office not getting paid. Kind of stupid to turn down at least some work while you look for another job. That’s OK. The other people that are working will just pay your unemployment

Look into FIRE. One way to set yourself up so that you are not at the mercy of some crappy employer is to get yourself into a position where you have enough to support yourself without a job. It’s fun to do, believe it or not, and completely liberates you from wage slavery. If you think layoffs are rough now, rest assured they are much harder as you get older. Just something to think about.

I guess it is the tech sectors or tech jobs that would have cyclical lay off and endless competition and evolving technologies. My two kids got in tech sectors (One just graduated and got a job the other to graduate in two years). I have always worried about them. I did not agree with my second kid to take on the same career path. But he did anyway. Nowadays, job security is not a thing anymore. It would be average peoples forever concern. Sorry for your experience.

Here's advice you didn't ask for. Don't turn down work just renegotiate your terms. If they want 1099 then ask for 1099 money. They can also keep you on retainer for a certain amount a week. Being an employee doesn't shield you from anything.
