Who will inspect roads? Inspection of cars while not inspecting roads makes no sense, as many roads are not roadworthy, and people pay for roads. What actions can br taken by citizens to take action against, not just roads that are not roadworthy, but roads construction that is substandard that can cause vehicles and people harm.

If this act won't address the issue of boda bodas riding on the wrong side of the road then it's useless. Only in Kenya where in a dual carriage one is forced to look both ways because of boda bodas

@@johnlobuin4212 It's so ridiculous. Even at an intersection when an officer has stopped traffic from your direction, bodabodas are allowed to pass as if they are not subject to the same traffic laws we are forced to follow.

The way traffic officers are corrupt then giving them more power? Why aren't they addressing the real issues. Bodabodas has been the greatest problem on our roads and they stay silent. What made them do this amendments and motorists have always been abiding to the traffic rules??

To reduce corruption, the cash bails most be zero shillings. They have your car make and number. They have the details of the driver. Do you understand what you are writing or you are just writing because you want to lay your blame on police? What happens is this. A)When you are arrested for any traffic offence/offences and taken to a police station, you pay a cash Bail B)The cash Bail will state the court and date to appear before it. C) In case you don't avail yourself in that court, the money you paid and got issued with the cash Bail will be forfeited to government and a warrant of arrest will be issued against you

Most are mundane charges like excess passengers, unroadworthy vehicles, worn out tyres, non functional lights etc etc. Don't take my word. Just attend any court. You spend an entire day in court. The magistrate will not even look at the vehicle as the vehicle is at the police station. The magistrate just reads a charge of unroadworthy vehicle and fines you ksh10000 or 3 months in jail. An archaic way of doing things. Go to any civilized country. Do any traffic offence that is not an accident and since your details are on the database, you receive mail with the amount of fine to pay. No wastage of time on a judicial process.
Committing a traffic offence in Kenya is like committing a huge crime. Why make it such an inconvenience to the motorists? It should just be a fine given.

In Kenya everything is criminal acts and that is why even if you ask the police a questions they instead accuse you of criminal act stroke robbery with violence.
A traffic offense can also cause death , or injury that might impact life. Maybe the best thingvto weed out careless drivers from driving for a period ,before being allowed back. But again its judges prerogative.
@@MagotsiLaw False. The police take bribes everyday while in their duty stations. This is because, they are cheap and quick. The courts are expensive and time wasting. Hence bribes are preferred over fines. All must go through a police officer.

Si the police is the judge, by police being alloowed to take action, ie drive the car, remive plate and linces means the ooluce is the judge to take law into his/her hand. Ut should be the police taking you to the court and the judge decides if the a traffic crime was indeed committed

Health issues are a broader topic. However, there are institutions that offer international driving licences that can be used here in Kenya and globally.
Uganda has better rules on traffic, you mess, you are given a charge sheet to pay at the bank while they detain your documents which you'll collect after paying at the bank. That charge sheet expires in two months time
There is no amendment of Section 36 of the Traffic Act (Production of Driving Licence) by The Statute Law (Miscellaneous Amendments) Act, 2024. It only amends Section 117 of the Traffic Act.

That one of the license was how it was before, then people complained that police were detaining drivers by confiscation of licenses then NTSA came with that solution. Now we have gone backwards 2 steps.
@@MagotsiLaw Before NTSA came up with the app you couldnt. The APP was a response to motorists complaints. Now have gone back to the bad manners of the police. This can be challenged as unconstitutional because there was no public participation and this amendment meets the threshold. This is a fundamental change affecting many people and a miscellaneous amendment bill can not be used to change it.

These amendments should be scrutinized as they seem to be punitive and biased. What amendments specifically touch on traffic police officer behaviors or the other road users like pedestrians crossing roads at non-designated areas or bodas flouting rules as they wish?

This is a very important query. in fact, a Petition can be filed in the High Court to challenge this section. What if the Officer does not have a valid licence, can he still drive my car?

Regarding the smart DLs; upon expiry, one renews online but still has to go to a Huduma Centre for biometry and then wait for nearly a month to get the new card. So one shouldn't drive during this one month of waiting?
@@HeraldOfTheChange exactly my concern! Just what is smart with this smart DL if every so often one has to go back physically to provide biometrics then wait endlessly to receive the card? Worse still, there is no way to track the progress of your renewal. The older licenses were smarter than this scam - you would do it online and print out the renewal slip at a cybercafe.

Do our Mpigs really read and debate this laws ? This laws are usually proposed by the police department and our MPs just rubber stamp them yet they are supposed to represent the interest of the people. This same laws will also affect them yet they had opportunity to reject them in parliament. Unfortunately all they are interested in is cutting deals or getting bribed. They have no time to do what they are paid to do by the taxpayers.

can you adress the issue of tint. where does it appear on the traffic act because when you get pulled over by the cops they tell you about it but actually never show you where it is in the law.

@@georgemugambi3263 I have been stopped by traffic police so many times. And recently I got tired and asked one cop where it is in the law. He smiled and said. " Unataka kuwa mjanja Kuliko polisi" and immediately he switched to tyres. And said my tyres were worn out. That statement he made has gotten me this far. So far most Cops have told me the issue is tinting the windscreen, the driver's window and the co-driver's window. I have been asking where it appears in the traffic act and the penalties charged but I can't find it.
@@leegathage9527 I think your issue is the commercial part. So even though it's a private van, these Cops don't want to hear any of it. Kwao it's a van and vans are commercial in Kenya. Toa tint if it's a work van. The stress won't be worth it. A private sedan or suv, you can tint all you want bro.
@@georgemugambi3263 Thankyou. Though I have tried checking where the traffic act regarding tinting of vehicles in Kenya but I haven't found yet. One officer told me that you can actually be issued with a permit by the government to tint a commercial vehicle but with reasons like theft, carrying high value goods etc. Hearses have psv insurance but are tinted. Could this be a case of ignorance by many drivers due to fear of the law? Many opt the easy way out but most don't know the traffic law and this makes the police take advantage.
