Yeah that’s insane they should have just outlawed it if they didn’t want it in South Dakota, though at that time Roe v. Wade was in effect so they couldn’t. Yes, and that’s why overturning Roe has had such a devastating effect on the country, because now there is no federal law that can protect women from forced-birthers enacting draconian laws like this, where a woman can’t even have surgery to remove a completely nonviable embryo from her uterus. Something that has zero chance of becoming a baby. Now she has to wait until she becomes septic and is about to die (“to save the life of the mother”) until a doctor can perform a D&C procedure aka an abortion. If it’s too late, and that woman dies anyway from sepsis and can’t take care of her other children who have already been born, or has such damage from septic shock that she is infertile, loses her limbs from infection, or myriad other horrific complications from letting an infection run rampant in a persons body, than that’s what has to happen. Laws like this don’t take into account all the nuances that can happen when a woman becomes pregnant. And doctors aren’t given the latitude because of the way the law is written to make the decisions that are needed on a minute by minute basis.

When this law was enacted, it would still be another five years before the Transcontinental Railroad was completed and somebody could take a train/s between the East & West Coasts. Back then people travelled by Stagecoaches and nowadays, we think nothing about flying across continents & oceans in hours. Heck, it would be another 18 years before Thomas Edison out open the Pearl Street Station, the first centralised, commercial Power Plant, in lower Manhattan.
If you want to get rid of ancient laws that no longer make any sense in today's world, how about at least modifying the Second Amendment? You know, the one that was passed in 1791, 233 years ago? 1791. When the best available firearm was a Musket. An un-rifled, smooth bored, barrel loading Musket with an effective range of only 50 yards and a rate of fire, in experienced hands, of just 3 rounds per minute. Not a Semi-automatic with an effective range of about 600 yards and a rate of fire of 45+ rounds per minute. Or even more if the Shooter can pull the trigger faster. Or a powerful handgun that can be concealed in a pocket or a belt loop. Just a thought. 🤔

We should require that gun owners be members of a well-trained militia available to protect their state and state government at need. Sort of like a volunteer guard that trains in case there’s some kind of emergency. Yeah, each state could have its own Guard. Since there’s already lots of cops, they should also be training to act as rescuers and first responders for non-shooting emergencies, like floods or earthquakes. Gun owners could each have a 6 chamber bolt action rifle and a similarly low capacity, lower speed handgun. They would have to spend a few months training full time so they can be evaluated for competence and character, and then spend 1 weekend a month training or volunteering in a relevant task.
There maybe bad laws passed in AZ in the 1800s , but this one banning the homicide of a child in the womb was not one of them. How evil is it that we now embrace murder of children, yet they had more sense on this one issue in 1864.

Not quite all but the branding is still actively used because people still raise and brand livestock and people still steal them. They might have been amended in potential imprisonment but not much. Also Murder laws came from way before then. New Mexico lucked out in that it's population centers were north of the Union/Confederate divide during the Civil War. AZ is pretty much Alabama but without the southern hospitality.
AZ was a territory and had quite different borders. The north half of the territory was Union and the south half was Confederate. And NM clinics aren’t “booming.” They’re overwhelmed.

In 1864 when this law was written, women and black people could not vote. The use and adoption of this law should be unconstitutional. How can a law be applied to all people even those who could not participate in the original enactment. This violates the 15th and 19th Amendments. For God's sake can someone with the power and means fight this.
