Two officers did disgusting unlawful things to me and my non verbal autistic 8yr old son at the time, 4 years ago. A grown woman in her late 30’s hit him on the sly. I saw and got angry. The store called the police on me and hid cctv evidence, said there was none in the store. But told me it was blurry, when I went next day to complain about our treatment. They teamed up with the police, told lies, got me arrested, then everyone turned on me, they was glad they covered up a grown woman hitting my child. I won the court case and they told the biggest lies. My son had to go with emergency carers, because I was in the cells because I wasn’t happy a lady hit my son. The police attacked me and my son when they turned up, grabbing our hand shaking it and laughing, my necklace broke and I was telling them to stop, because my son will run in the road. They laughed and said “so what, I don’t care, I’ll arrest you”. So much to it that I can’t write it all. I’m not surprised by their behaviour at all anymore since then. They definitely don’t care about the public and vulnerable children. Evil evil bullies, can’t stand them 😒

Section 4a includes using 'insulting' language, which means that you could literally say 'hello' to a person and they could have you arrested for committing a section 4a public order offence. The problem is whether something is insulting is subjective rather than objective. Therefore, hello may be subjectively fine with one person, but subjectively insulting with another (e.g., say that person came from a culture where it is insulting to say hello before saying your name... for arguments sake)., Now, onto the specific offence in this video: I regard muppet as subjectively complimentary, as the Muppet show was one of my favourite shows as a child. It portrayed various characters in a positive esteem who entertained and gave joy to countless people. Therefore, to me Muppet is a compliment. However, to some people Muppet is subjectively insulting, as they regard Muppet as an insulting word - maybe they could not afford a telly so never watched the Muppet Show. It's a grey area of the law which needs updating.

When they mention alarm, harassment and distress. All 3 have to occur! 1 encounter is not harassment. A loud bang could alarm someone. So that is subjective. Distress, you could be late for work and that can cause distress. Again this is subjective. The victim needs to demonstrate lasting damage from your interaction. Otherwise it's not more than a hurt ego or hurt feeling 😉

And uses threatening, abusive or insulting words or behaviour, or disorderly behaviour. Calling someone a muppet is not insulting, nor a threat, not abusive.

This is almost entirely incorrect. I’m a huge fan of auditing generally, but not the spreading of misinformation in the comments sections of the videos! All three don’t have to occur at all. That’s why it’s written as harassment, alarm OR distress. The offence of intentional harassment under the Public Order Act is different to the offence of harassment. The Public Order Act offence refers to a single incident where you have intentionally caused distress or alarm to another person. It’s also not the case that the incident has to provoke lasting damage, only that it has a “significant effect” on the victim. Nonetheless, the CPS wouldn’t have brought a charge as it wouldn’t have been in the public interest (due to its nature). I’m not being insolent, but please don’t advise where you’re uncertain. The purpose of auditing is to ensure that the Police only act within the remit of the law, not what you think should constitute it. All the best.

As everybody has stated your arrest was purely an exercise in getting your details and to put a marker on you, there was no serious intent to charge you. What is more concerning is the need for cuffs especially in the holding cell. The Home Office has put out new handcuff guidelines and they state their use has to be necessary and proportionate. You peacefully went inside with 4 constables and once inside there was even less grounds for the use of cuffs. It was purely retaliatory.

i must confess. i wish i could go out to do audits but i am totally blind. i watch/listen to these videos that you do often and other auditors. i have a laptop software screenreader. i have commented often on your vids kev. obviously i can't tell facial stuff etc but it often does make me think when stuff like this happenes. them police officers were a real law unto themselves. no need at all for how they approached and spoke to you. and the public order act? doesn't there need to be a croud of people for making that an offense?
@MelbourneAlan
@MelbourneAlan Год назад
1st how do you watch you tube videos if your blind. does it read out whats happening along side the audio 2nd. a blind person doing an audit would be cool. i would like to see how they react . you would have a medical reason to film and would be discriminatory to stop you in certain situations.
@emmagrundy17
@emmagrundy17 Год назад
@@MelbourneAlan hi. thanks for your comment. yeah i could imagine how cool that might be. to answer your question, i have a screenreader software which helps me locate things on webpages but there isn't anything extra on the videos that explains anything that is happening visuall, but lets face it you don't really need to see to know what is going on from the dialogue on the video. its cool your curious though as i think i might be the same if i wasn't blind and saw a comment like mine.

The reason that the public order offences that ‘cause alarm, harassment or distress’ are so open to abuse is because it is an offence that appears to be enacted on consequence rather than any cause. A person only has to say that they or somebody else feels alarmed, harassed or distressed and that appears to generate the offence, no matter how harmless or inoffensive the actual cause, as would be acknowledged by most reasonable people.
