Very true, but I've had at least two jury trials that nearly did not go forward simply because not everyone showed up to jury duty. My client spent thousands of dollars to have witnesses, experts, and days off work, and all of that was nearly wasted because of lack of jurors. However, if someone had a legit emergency that morning that prevented them from attending, then no they shouldn't be punished.

This so called court system in America is a joke. I am an Angel of the Lord. And I only take my orders from the High Command. And NO ONE ELSE. This is why they hate me so much. Because I will NEVER BOW DOWN TO THEM. I am forever. And torment in Hell forever is what's coming for all of them. As it is Gods will. Even Satan will be destroyed by me in the pit. Haha! We TRIED to do zoom jury trials, but then we had jurors driving, watching RU-vid, and even asking for a break - mid-testimony - to tend to a dog. I'm not saying it's impossible, but some adjustments would need to be made. Thank you for your service on the Heard/Depp case. lol 😆

I have social anxiety and panic attacks when I'm in a room full of people so I was able to get excuse with a doctor note so if anybody have panic attacks you might can get a excuse by telling the judge and lawyers you have social anxiety and panic attacks I'm pretty sure they don't want you in there freaking out on them during the case

As a lawyer, I'll tell you how to get excused LEGALLY. Obey the jury summons and then tell the court "I believe in jury nullification. I won't agree to follow the court's instructions because I believe that the jury is entitled to determine both law and facts." You'll be excused immediately. The judges and most attorneys don't want you to know that jurors can't be punished for disobeying the court's instructions. This precedent was established 300 years ago in the Bushel case. Look it up on Wikipedia!

The case involved William Penn and other Quakers who were preaching doctrines contrary to the Church of England. The judge basically tried to direct a guilty verdict, but the jury defied him and voted "Not Guilty." The court tried to hold the jury foreman in contempt for violating court instructions. A higher English court reversed in a famous opinion, which was well known by the Founders of the US.

I told the judge I go by what I think the law should be rather than what it actually is. This worked, but I had the judge trying to convince me otherwise for the duration.

Well, at the beginning of Voir Dire all of the prospective jurors take an oath to answer all of the questions truthfully. If you refuse to take the oath, then you will likely be stricken from the panel and won't have to answer any questions.

I’m supposed to call via Zoom in about five minutes. It’s inconvenient but I got the point. Shirking your responsibility isn’t freedom. Someone has to do it. It’s part of the price we pay for freedom. Freedom isn’t free. Some gave years of their lives. Some gave, or had taken from them, parts of their bodies or minds. Some gave, or had taken from them, their lives. We don’t have the King anymore. They want me to watch a trial if I’m chosen and deal with the inconvenience and help decide if someone broke the law or not. I guess I’ll do it. It’s a small price to pay. Gotta go. I’m back. We got everyone’s devices squared away. Went to the virtual courtroom, all rules apply as if we were there in person. We got sworn in and they gave us a general idea of the case. It’s a civil case so the verdict is based on a preponderance of evidence rather than proven beyond a reasonable doubt and the verdict can be decided by 10 out of the 12 jurors rather than by unanimous decision like in a criminal case. Out of the group of 35 prospective jurors there will be 13 chosen, one of which one will be randomly chosen to be the alternate. The judge divided us into two groups. The first group, prospective jurors 1-18 stayed. I’m in the second group, 19-35. We are to return to the Zoom about 90 minutes from now. I assume the lawyers and the Judge will be asking us questions to determine if we will be selected. I kinda hope that I will be dismissed and my obligation will be fulfilled. I have a monstrous headache. I work nights so I should be sleeping now and I’d rather not have to deal with this anymore. Later

I've seen jury nullification backdoor-argued a few times when it came to marijuana possession. The Judge nearly LOST IT! Just about resulted in mistrials.

@@arroyobaby38 Does New York have an exemption if you've served recently? In Texas, to be qualified, you must "not have served as a juror for six days during the preceding three months in the county court or during the preceding six months in the district court."

All I know is that I served in 2007 ( 3 LONG ASS WEEKS!!!)) , 2013 ( 2 DAMN WEEKS) and I was supposed to serve in 2021 but I needed to be excused for a WHOLE 6 months ( BIG WHOOP! 😡) for medical reasons. They’re going to call me again in May 2022 to serve. For this reason I HATE JURY DUTY! Pick on somebody else for a change.

That's the spirit! It's refreshing to see someone who has no need for a jury and trusts the Judge to handle any potential case in the future. It is awe inspiring that you would trust the Judge (who is probably a former prosecutor) to decide your fate since you most likely wouldn't expect anyone else to have to appear for jury duty to determine guilt or innocence.

@@MatthewHarrisLawPLLC I understand your point, I really do, but would you rather have that judge - who presumably is a rational and intelligent person - determine your fate or a randomly chosen severely depressed autistic with ADHD who knows nothing about the law (this is me) determine your fate? I can barely even get to the courthouse because driving in cities is horrifying to me. I haven't made a phone call in 2 years. Like most people on the spectrum my values do not match those of mainstream society. I am not currently seeing a psychiatrist so I wouldn't be exempted for medical reasons. You want someone like me to make the call on if you go to jail or not? There should be a professional pool of jurors made up of people who are screened, and they should be compensated fairly for their time and efforts. Even people who are drafted for military service get paid a fair wage.

Well I received a jury call up letter for the second time in 2 years . The first time I called the ministry of justice in my country and told them thanks but no thanks and if you want me to do legal work then my rates are as per what any other lawyer charges per hour . I also told them if I wanted to be involved in the legal system then I would have gone to law school . Next I told them that I didn’t appreciate the threats of fines and or imprisonment in their letter and if it continues I will start legal proceedings against them for threatening and harassment .Next I told them I have no intention of providing them in their paper work of my contact number or email as they are private information along with other numerous information they wanted like bank account details to pay some miserable amount of money to me . I never herd from them again for over two years and now I have just received another request I’ll tell them again and this time ask them what part did they not understand the first time around .

Well, don't be too hard on the Court Clerk answering the phone. They weren't the ones who decided to put your name on that list. Have you considered applying for an exemption? We have a separate video on disqualifications and exemptions that you might find helpful. There may be support for a list of people who refuse to perform jury service to prevent these notices from going out.

I've been called on jury duty four times in a row this one will make my fifth it's giving me a headache a big fat headache everytime I turn around I wind up doing jury duty every 4 years I come from a family of 10 none of my brother's and sisters never went to jury duty it's just me and my farther all the time you never know what's going to happen when I'm 69 they may call me again I hope I pass away real soon at least this way I have an excuse my father died three years ago and they gave him a summons it's ridiculous

Other aspects of jury duty aside since other commenters have raised those points, I think people would be a bit more receptive if the state weren't so antagonistic and demanding in the way they communicate. What I mean is, this is 2024 and the people we deal with and the communications we see don't use the language and demeanor you'd see in a professional business environment or even the language and demeanor they use toward each other. From end to end, they talk to you like you're in the military as a low ranking enlisted man. Except you're not in the military. And the people ordering you around are not in the military either, and since they're not in the military they don't understand that yes, you give orders in the military but there's an element of mutual respect behind those orders too. The employees at these courthouses are often rude as hell. In fact the only case I was a juror on was a case where someone assaulted one of those employees, and my initial thoughts going in were, "Good. He probably deserved it" I'm not saying there aren't other things I can complain about regarding jury duty, but to me that lack of respect makes people far more resentful than they might have been ordinarily. It certainly doesn't help.

What happens if you just ignore the jury summons? I’m in California and have many friends who say they just throw it away and nothing has ever happened to them. I have never heard of someone being charged for contempt of court for ignoring jury service.

Pursuant to California Code of Civil Procedure Section 209, any prospective juror who has been summoned for service, and who fails to respond as directed and be excused from attendance, may be found in contempt of court, punishable by fine ($1,500), incarceration (5 days) or both. I have a lot of friends who drive over the speed limit, but they haven't yet been caught or prosecuted. Could I get away with it too? Sure, but that doesn't mean it isn't illegal. 😁

And if they don't even have the money to send a summons through certified mail what are the odds they have the resources to come after me, let alone prove that I recieved anything saying I needed to be there in the first place? Has to be the only part of the legal system that's rigged in my favor lol

@@Steve-eq8iz That's a real good point. If they prosecute, then they have to prove actual notice of the summons. However, I once had a jury trial where dozens of jurors didn't show up, and nearly had to declare a mistrial. The Judge directed the Bailiff to go issue $100 fines to every juror that no-showed.

@@Steve-eq8iz well, not exactly. We only picked 12 jurors out of the 70 that were called (and out of the 40 that showed up). Those that weren't picked were out of there in a few hours. If they made more than $33.33 per hour, then perhaps.

Exactly my situation. These self-righteous attorneys always frame everyone who doesn’t have weeks of their life to waste in jury duty as un-American. I’m self-employed and cannot provide the slew of documents from an employer as proof of economic hardship. So instead, I’m risking losing over $5k in missed wages next month. I hope you found a much more helpful resource and avoided jury duty in order to continue providing for your family.

Agreed and what ticks me off in Washington state is that in one county where my family lives being self employed and running your own small business automatically exempts you from jury duty which is what it should be. I wasted Friday being forced to watch two propaganda videos and have to go back today when I can not afford to miss work since I am one of only three employees at my business and do the accounting so there is no one to do my work when my time is being wasted in court but these overpaid nasty judges do not care about or respect the livelihood or physical health of the citizens and instead threaten them if they do not show up which is insane.

My neighbor told me to postpone it online until the day after Christmas to New Years Day. He said they won’t call you. So I did and I never heard back from the court.

(Illinois) I am SHOCKED. I just called to be excused for one simple reason: IMO, 90% of anybody accused who is going to trial is GUILTY. Realizing I am not GOD, I could be wrong at any time, so I called the number to plead my case. She says, "No! You will be a GREAT juror!" "You can't POSSIBLY tell me that I would be a good juror if I think people are guilty!!" "Yes, the prosecution would love you! How old are you?" "70." I said. That got me off. On the Bible, that just happened and it is a true story. My Law education started with L.A. Law, and every David E. Kelly TV show that ever aired!❤

You self-righteous attorneys always assume everyone who doesn’t have weeks of their life to waste in jury duty is un-American and not empathetic to the defendant. There are legitimate reasons to want to avoid jury duty that aren’t “justified reasons” to not be selected. I’m self-employed, for example, and cannot provide the slew of required documents from an employer as proof of economic hardship. So instead, I have no way out of jury duty and am about to lose over $5k in missed wages. But thank God I have a holier-than-thou attorney to talk shit on me and frame me out to be a horrible person! What a wholesome video.

My supervisor takes his summons and toss them in the trash. Unless it comes certified mail they have no way of knowing if you received it or even live at the address. He’s never been held contempt of court or paid a fine. I guess he has a point lol

Well, there is a "presumption of receipt” associated with the “mailbox rule.” If a letter or document is properly addressed and delivered to the post office or postman via a mailbox, it is presumed to have been received by the person whom it was addressed.

serious question. can people with adhd do jury duty? i ask because as a person with adhd i miss important facts or bits of information all the time in conversations, documents, videos, etc. i personally would not want a person like me on jury duty because i could miss an important piece of information very easily.

Great question! Having ADHD isn't alone a disqualifying factor. Everyone misses a detail or two, which is why the jury has 12 members. However, I usually conclude my voir dire by asking if there is anything that I didn't ask that anyone thinks I should know which might prevent them from serving. That might be where you volunteer that information and then let the attorneys decide whether you should be disqualified. You never know. The case could have an ADHD component and you could be the only person in the jury room that understood that evidence and can explain it to the other members. Thank you for the question! I'm sure you aren't the only one who has wondered that.

Where I live , the Jury Summons are sent regular mail. (i.e. no signature acknowledging receipt). Therefore, I ignore them and toss them in garbage, because there is no proof I received the notice. Haven't had a problem yet.

I once had a digest-style magazine (basically a paper back book) arrive torn in half and then mangled, and then delivered in a plastic bag with a "so sorry we ruined this thing you've been looking forward to reading and paid money for."

It just seems wrong that people have to miss days work just to go sit in a court room and lose wages they need for rent, food and other stuff. When there is really no point if the judge disagrees they will just over rule the jury. Its just a punishment for the innocent. As someone who is frequently pick for this garbage it irks me to have someone insinuate that it is in anyway just... Basically its pointless and it can only have a negative affect on the people "serving". I mean they don't even care about the opinion of the jurors hence, they will send you home or even find you in contempt of court for mentioning jury nullification. If I didn't have life issues that I know they would not excuse but I take seriously then I'd have no issue being a part of a jury. They treat us as if we don't do it we are in trouble and force it on us. Maybe that is why I would vote against anyone government like prosecution or judge or cop if I am forced to do something that takes away from my family and caused me or my family duress. Plus the fact potential jury's are basically threatened makes us not wanna do it more.

That's fair to feel that way. Unfortunately, the government has limited means to encourage citizens to do anything and they often use the stick instead of the carrot. Here's a question though, what if you were called to jury duty, but the government, prosecution, or police weren't involved? Most of my jury trials have been child custody cases. Would that be a jury that you'd feel comfortable serving on?

Yes, I saw that! It was during the Juan David Ortiz trial where the juror fainted when explicit pictures were shown. Although, you shouldn't let the possibility of seeing explicit pictures keep you away from jury duty. Most jury trials don't include such images. In fact, zero of the jury trials that I've ever been involved in included such pictures. If the trial is about a child custody issue, or a breach of contract, do you think you could handle jury duty for that?

Great question. I actually go to great effort to refer to jurors by their names because it helps to personalize the case and put a human element on it. However, sometimes in high profile cases it is necessary to protect the anonymity of the jurors from the public, so the Judge may institute a gag-order to prevent their disclosure.

They will literally get lost without super vision and my issues are this bad and they want me to go when I'm mentally unable to show up. Should I tell the person on the phone that I can only go if I can get a ride there somehow due to how bad my learning disability is? If they want people like me with mental disabilities that bad than they should be offering us a ride to the courthouse. I can't get up by other transportation by myself. I will literally get lost too easily. They don't understand what is like to have severe mental disabilities.

When I was in highschool, I took a 'government and law' class, and a few times during the semester we went to the local court house to sit and watch the trials going on that day. I found it incredibly interesting, (and at times just plain entertaining!) I think that's why I'd volunteer if I could. We never saw any 'big' cases, but watching how each 'player' within the courtroom interacted with each other was fascinating to me. It's ironic that my uncle works for the attorney general in Ohio, I'm so interested in all this, yet he's the only relative I don't have a relationship with, haha! So if a juror was randomly grabbed off the street, and they were (for example) on their way to an doctors appointment, would that let them be dismissed? (I'm not sure of the legitimate reasons to be dismissed, it's just the first thing that comes to mind) because they'd of had no prior notice to be able to provide proof?

It definitely helps to remove some of the mystique around our court system and hopefully helps us to find the next generation of lawyers. You should call your uncle, tell him you're interested, and see if you two can have lunch. I'm sure he'd love to hear from you. If they grabbed someone off the street, they'd still have to go through voir dire, which would uncover any conflicts (like Dr. Appt) that would prevent them from serving. Another great question!

If somebody had a mother die almost 3 years ago who was a co-owner of the house/& upon mothers death the state government through the superior court placed a hefty lien on the property last year along with restrictions of not being allowed to rent any portion of the house to supplement income or get a mortgage till said lien was paid off, & attending jury duty would be a financial hardship....would the court take that unique circumstance into consideration & grant an excusal? Not to mention this somebody is self employed with a small business & zero workers.

Those would certainly be issues for consideration. You might not be able to be exempted to avoid showing up, but if you disclose that to the attorneys during voir dire, and express that you may have difficulty focusing on the evidence while dealing with the gravity of your personal issues, then it is very likely that they would agree for you to be excused.

In Texas, if you get a conviction for misdemeanor theft, or a felony, then you won't receive a jury summons anymore. Also, if you are over the age of 70, you can be permanently exempted from service if you file the exemption with the voter registrar. Or, if you are not a citizen of the United States, then you can be placed on the list of disqualified persons. You are partially correct. In Texas, the list is compiled from the voter registration as well as the DPS driver's licenses and Identification Cards.

Maybe tell them you are a Christian and if you are chosen for a jury you will have to follow the words of your lord and saviour Jesus Christ, when he was asked how many times should you forgive someone: "I do not say to you seven times, but seventy times seven."

I've had this come up a few times during jury selection, but on civil cases, you aren't asked to "judge" anyone. You're only asked to determine if certain facts have evidentiary support. Like "Did Sally and Susy agree to be bound by a contract?" Yes or No?

Well, that's one way. Do you mean on your driver's license? Driver's license data and voter registration is typically where jury duty notices are pulled from.

This is far from the Steelman argument because there is not only one solution to this. For example I think we should have a paid job where people go to school to be jurors. It is their job to make a fair decision. And if they are found of bribery they will not only lose that job, but be thrown in jail. These people will not only be taught the law. But also more importantly how people manipulate emotions to deceive you. As well as stuff like ballistic analysis, and blood spill analysis To say that we don't want one possibly corrupt King to make these decisions so we're going to get morons off the street that know nothing about what they are talking about making these decisions instead is not the only answer. And then just to make sure that only absolute morons are the only ones left we will let the professional Liars who get paid based on how good they are at lying, decide who will be on that jury.

I'd just walk in and hear about the case and if they ask "What do you think", simply say "Well if the defendant is black, he did it.". Simple as that. Good thing about that is they won't come knocking on your door again 😂

I have a summons for April 4th 2022. I am a Christian so for me to be honest I will tell them God says we are all sinners so how can I judge another person for their sin(s) when I am guilty of sin myself. God is the judge of all mankind so even the courthouse judge is as guilty as the one on trial.

As a Christian Attorney, I have faced this as well. If you have never served on a jury, then you might be surprised to learn that it usually doesn't involve "passing judgment." Here is the difference. Most cases only require you to determine whether certain facts are true. For example, in a civil case, you might be asked "Did the parties agree to be bound by the terms of this contract? Yes or No" In my opinion, that is not "passing judgment." What do you think?

100% positive. If you ignore your summons for jury duty, you run the risk of fine or jail time. If you want to know how to get dismissed from jury duty, go watch our How to Get ON a Jury video, and just do everything opposite of what we say. 😁
