DennisJ (The Last Methbender) The poor has been treated like utter shit through out the history of the world. It's...rather normal. I'm not saying it's right in any meaning of the word, but it's been going on longer than even Christianity or Catholicism. Though, to be honest, the poor is treated better -- barring individual cases mind you -- than they were a century or two ago. Hell, probably not even that long.

I googled Robert Durst (rich guy from the beginning) out of curiosity, and his trial just began YESTERDAY. This video's from 2015, and his murder trial just began yesterday.

You need to look further. He was previously tried in Galveston county, Texas for murder and found not guilty. This was after he jumped bail. After he was found not guilty for murder, he still had the bail jumping charge pending but was just a few days short of his time served being equal to the maximum jail time for bail jumping. The judge set his bail at $2 billion dollars. This was immediately appealed and reduced to a reasonable amount. However, he just stayed in jail a couple of days and reached that maximum then he was released.

+Mikurunrun The idea behind it is that some people aren't really dangerous to society, even if they have committed a crime. Because it costs money to lock somebody up, its easier (and cheaper) for society to just let them stay at home until the trial starts. The bail is just collateral, to keep someone from booking it. Your supposed to get it back after your trial if you show up. Kinda, like how a person might offer their car as collateral on a lone.

you wouldn't. Bounty hunters only show up once people get their court dates and don't show up. He makes it seem like one is in place of the other but that is not at all accurate. You get the people like debra remind you of your court dates. Bounty Hunter's show up when somebody ignores their court date and runs, evading their sentence.

meh forget it Depending on age it's may be likely that he is, a standard 401k (or any other retirement fund) for someone middle aged should be about that much depending on when they plan to retire and their standard of living/expenses. Being a millionaire isn't as big a deal as it used to be

Pleading guilty for a crime you didn't commit just to avoid time in jail because you can't afford the bail is LITERALLY one of the things the 8th Amendment was written to prevent. This is a violation of the spirit of the Bill of Rights.

@@comradesky5931 No, I'm saying the Justice system should not incentivize false confessions (false testimony, which under any other circumstance is considered perjury) with threats of greater jail time if you don't plead guilty. Nor should it offer bail (ie you get out sooner if you pay the court a bunch of money), as it is essentially a system of state-sanctioned bribery which creates a two-tiered justice system for the rich.

William Sonak Yes, but you would need someone with standing to bring that to the supreme court and challenge his bail on constitutional ground... So, that would not happens - it should happen, but it would not... Or, we need to loby congress, the senate, and everyone to change that.

Ketraar having your charges dismissed without an actual trial is not the same thing as you being right / innocent or them being wrong. It's more like a settlement sort of thing. Happens pretty much in every legal system around the world.

Chris O'Rourke Traffic fees in Wisconsin usually are over $250. I think of that court fee as a cost-saving discount... and to keep my insurance fees the same.... Still doesn't make it right, but makes it worth going to court.

Chris O'Rourke - You're not kidding! I disputed an $85.00 traffic ticket, and won. Judge dismissed the charges. Then I had to pay *$125.00* in Court Costs. It cost me $40.00 more, than if I'd just pleaded guilty to a crime I didn't commit. There is something very wrong with the system.

Protector of the Republic also, born and raised in the states, I've never seen this happen personally. But I also don't watch TV and avoid reality TV like the plague so a lot of us are unaware. I mean I knew there were bounty hunters, I didn't realize how stupid the entire system concerning them was until now... I though they had required training and certifications and worked with the police department more closely. This is insane though, I've pretty much got one foot in Canada at this point...

None of us really condone much of it and its getting changed at a relatively quick rate. There's also different types of issues in different areas and with how much money you have, so you can stand pretty safe at certain points.

The usa is just a more conservative nation (although that is sadly changing slowly) than most European countries, which I prefer. I find it amusing how so many non Americans consume various our products, culture, technology, use youtube to watch american programming and drop baseless inflammatory remarks. We must be doing something right since most Americans don't watch or care to know such about countries in Europe on a general scale. But good programming by John Oliver nonetheless.

Florida jails, Seminole County, charged inmates a daily fee, and an arrest/booking fee. And you can get re-arrested at the time of your release if you don’t pay as soon as you’re released. Justice.

Forrest Weintraub Hey man, they're technically breaking the 7th amendment too: In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law. (This law was initially meant for cases involving corruption but isn't often cited and can technically be used here.) $20 in 1789 is approximately $530 dollars today (www.officialdata.org/1789-dollars-in-2017?amount=20). If a case exceeds that amount the case immediately goes to the Supreme Court. As shown in Municipal violations: most people pay close to $1000 to get out of parking tickets if they couldn't pay at the time. This means theoretically EVERY SINGLE ONE OF THOSE CASES must be handled by the Supreme Court. Now is that going to happen, most likely not because that means most of these cases will be dismissed, but it'll probably end a lot of this scummy behavior.

Medha They also break the law of wrongful imprisonment when they don't immediately release you from jail when the Judge releases you. If you are in jail, go in front of a judge, then get released, you then have to still go back to jail and go through an entire process to get you items back, sign documents and then be released. It can take up to a whole day. Especially since you have to wait in a holding cell until all the other prisoners see a judge so you can all take the prison bus back to jail. I was in jail on $30k bail then the judge RORed me (gave me a bail set at $0). I didn't officially walk outside free for another 8 hours. Had to go back to a holding cell in handcuffs, wait to get on the jail bus (in handcuffs) to bring me back to jail, go through an entire process to receive my items, then be transported to a different area of the jail to officially walk out the door. All while my parents were in the court room and I could of easily of just walked out of the court into their car.

This is exactly what happened to me with a DUI case. I was sleeping in my car, no sobriety test was given not even mentioned. My Girlfriend at the time told the police I was high the night before when I drove. Couldn't make bail, the public pretender told me you can await a 90 day trial or you can plead guilty and you will likely be out tomorrow. Needless to say I plead guilty.

Here's what I still don't understand: A) why the f*** are people being held in jail before being found guilty of a crime??? Sure they were arrested but nothing has been proven!! Doesn't that completely go against the "innocent until proven guilty" thing??? Why don't we see people complaining about that more often? Getting rid of this would also eliminate the problem of people getting fired for pleading innocent etc. Could someone explain why this isn't a big problem in society? Because it seems like a much bigger problem than most of the stuff people talk about. That brings me to my next point... B) "the right to a speedy trial" is guaranteed in the constitution. If you're gonna hold potentially innocent people in jail, you MUST grant them a quick trial. Two high profile trials here in MA just lated for multiple YEARS: Tsarnaev and Hernandez. How can you take away two years from a person's life without even knowing if they're guilty or not!?? Once again, seems like a blatant violation of the Constitution that no one talks about. This wouldn't be such a big problem if we didn't hold innocent (aka awaiting trial; not proven guilty) people in jail, but if that is what we are going to do we cant let it run on for years at a time. How the f*** is two years considered a speedy trial??? I think that if you can't find the evidence to prove someone guilty in TWO YEARS, that person should just be let out of jail. You can't have them just sit there while you wait for some evidence to come up against them. Why are these issues not talked about more??? They seem like basic simple violations of fundamental principles of liberty and justice. Ridiculous.

Stephen Malacaria Well, the reason for bail is to prevent people from leaving the jurisdiction when they may present a safety risk to the public, or who risk trying to leave the jurisdiction prior to trial (aka a "flight risk"). The problem is when we start using high bail to keep incarcerated people who've committed non-violent crimes. People with a history of missing trials or violent crime? Sure. But people who drive with a bad license? Come on!

Stephen Malacaria simple, i commit a crime then get arrested. there is 99% chance of i'm going to be found guilty and the consequences wont be good at all, what should do? well if i'm free to go before my trial then making a run for it does seem like a viable option ol. bail the system was set to make sure people actually show up for their trial. if you can't afford it, odds are you don't have much to lose so they think that you could make a run for it. while if you can afford that 200,000 dollars, odds are you are going to show up to court. there is some major flaws in that logic but that's pretty much the gist of it.

Stephen Malacaria because thank god most Americans still care about the victims more than the felons. Most people arrested ARE guilty and most ARE repeat customers. Most normal people don't get arrested unless its for something like DUI which has a low bail. 90% of people arrested have been arrested before and just cant keep their hands out of the cookie jar.

raven1234566 Except that they are not felons until they have been proven guilty in a court of law. Also, why even use the money system in the first place? Take a look at other countries, which does not have a bail system, but does sometimes hold people before they have been judged. For example: Denmark. In Denmark, you can be detained for up to 30 days before you must have had a court hearing, and only if the police can procure enough evidence to suggest that your crime is heinous enough and that you are a flight risk to get a judge to sign off on it. The decision is NOT based on whether you have the money necessary to get out.

samramdebest It's because they plead guilty in the form of a "plea bargain", in which the prosecutor and the accused agree on a punishment without putting the case to trial, which is usually something less significant like a fine or a shorter jail sentence. But if the accused pleads innocent, then they have to stay in jail until their trial is over, which can take months, sometimes years. Then if they are eventually found guilty, they must then serve jail time as punishment in addition to the time they spent waiting for their trial.

ImmaterialDigression The answer to your question is the entire point of staging an ambush. However, I can think of a few other points: 1. It seems likely that most people who own firearms do not carry them within their homes. 2. It seems likely that most people do not sit at home with their backs in corners and clear views of all points of ingress. 3. Even if someone managed to shoot one of these vigilantes, bearing in mind that such a person would be within their rights, said vigilantes would take that as a justification to use lethal force. 4. Significant training is required to shoot more than one attacker in such a scenario (consider the El Presidente Drill).

Not every where. I spent 30 days in Wayne County on a first time non violent offense because I couldn't pay my bail. I lost my kids, car and was evicted. I'm still picking up the pieces.

I live in PA but I had a traffic ticket in NJ and there was a guy being held in jail and had his hearing via video and the judge would not let him out unless he could come up with $600. NO arrangements no nothing. I was paranoid as hell. I wanted to make an arrangement but said F**k it Ima pay the whole thing. I felt bad for dude. young black kid sitting in jail for traffic ticket. SMH

Why are people even getting locked up if they are not guilty? This seems to me, as a non American citizen, like the police is going through a neighborhood just picking off people. " Nah he is good... he also... oh, there is a poor guy, let's arrest him for no reason and if he can't pay the bail he is fucked."

If there is reasonable cause to arrest someone, they can be arrested. They go to jail, which is temporary, unless their convicted of a crime severe enough to send them to prison, which is much more permanent. Reform is necessary, but you seem to have a very poor understanding of the system in the first place. Also, "any gun you want" is entirely wrong. Just because Americans can own guns, doesn't mean they can own any gun.

They are arrested for actual crime but the bail in most states then fucks them.

Even if you get out on your own recognizance (i.e. no bail required), there is usually a charge just for being arrested if you are taken to jail and booked. Some jails will refund that charge if you are found not guilty, but you are responsible for asking for the refund and for keeping the paperwork that shows that you paid the booking fee.

Guilt is determined by a jury of your peers (or by a judge if you ask for a bench trial). Police arrest on reasonable cause. Reasonable cause does not equal guilty.

It's worked SO well for NYC. I guess California hates the "Commiefornia" label so much they'd rather be known as "Crimeofornia." Let's see: They don't want you able to defend yourselves but they DO want to keep the criminals roaming the land. DON'T BE PROUD OF THAT!
