There is no legal argument Haminwa has presented. He has just narated history and pleading with judges to throw away the appeal. It does not work like that, unless the appalate judges also fall into a trap of wanting to settlie scores with the president .
The constitution is Unammendable(articles 255,256 and 257). To me that is strong argument that trashed the BBI and the appeal. Get your fact. Wisdom is a gift.
The history however, may inform the Judgment to some extent, just as it did the High Court Judgment; and there would be nothing wrong with that. The Judges needn't ignore Kenya's history in their application of law to the facts.

It does not disapprove only of illegal acts but will deny relief for bad conduct that, as a matter of public policy, ought to be discouraged. A court will ask whether the bad conduct was intentional. This rule is not meant to punish carelessness or a mistake.
@@edmond2014 Well, that is relief one of Counsel was asking (that woman politician lawyer). At the same time they are saying BBI shouldn't be given chance to participate in the process. You need a proper contradictor to seek declaratory relief.
Haminwa forgets that not only the president has appealed to this matter.. His arguement is personal. You cannot throw away the whole appeal because the president did something. That will be a battle of retaliation.

It is quite unfortunate at his age and who ought to be regarded as an elder has turned to a youthful swag of working against the executive.I have severally watched and heated in the social media where the current president is bluntantly being abused and nobody is arrested; but are quick to judge him(Uhuru) harshly especially when the judiciary and self appointing activists accuse him of not appointing corrupt judges.The likes of John kaminwa will not speak out when corrupt cases are not concluded as expected but argue energetically on political cases favouring their sides!
