Being Color Blind 

Ppl are saying it’s the plaintiffs fault, but she literally chose a sample and ordered, checked her order info on delivery and it was correct, name, inventory information exactly. she assumed it was her fault and allowed the installation meaning she was taking responsibility UNTIL she checked again, THAT wasn’t the Sample she was given. Pay the woman.

How dare the manufacturer not acknowledge their huge mistake in this, I really hope the defendant took the manufacturer to court...

Considering the plaintiff gave the defendant so much business, I think they could’ve done more to help her.

The contractor shouldn't be blamed for the mistake of the store as the store should be the ones that verify they received the correct product.

Absolutely not the plaintiff’s or the contractor’s fault. The contractor may have seen 20 different tiles in 2 weeks, he cannot remember everything. Also, the plaintiff would never had known that they switched the color on her until it was in place. Good win. 👏🏾👏🏾

The difference between the tiles were just too subtle, especially since the numbers matched the invoice, the contractor wasn't at fault and neither was the plaintiff. I'm surprised the defendant didn't just pay the install fee, because she would have eventually gotten it back from the manufacturer, crediting her 7% for every order.

The plaintiff and the defendant were very impressive in court as well. Don't talk unless the judge tells you to, don't make any faces, be respectful. This is how court is suppose to be done. Too many act as of they were animals.

All fault is on the manufacturers of the tile, the numbers not being correct!

So basically the tile company was going to recoup all their money from the manufacturer but quietly let their customer eat the expense. Glad she ruled in the plaintiff’s favor. Looks bad for the tile company.

I totally thought the plaintiff was going to lose. After hearing the evidence, I'm glad she won!

Always always always keep the sample you pick.

I'm a tile contractor and I see different combinations of tile colors that it's mind boggling. It's not my job to lay out the tiles to see if it looks good. There are so many shades of tile colors how is an installer supposed to know if it's the right shade? If the numbers jive with the invoices then I'm satisfied. Maybe the retailer should've picked up the tile and made sure it was the right color instead of blaming the installer. The defendant was going to be compensated for the labor with a 7% discount on future sales so they weren't going to be out any money. Pay the plaintiff.

The owner of the tile company can sue the manufacturer for the mislabeled products causing litigation.

This is crazy - happened to me too with shades of grey... paperwork matched, tiles didn't - lucky for me i took one tile home when i selected my tiles (i always take one from a box, or a box with me) and then i use that to match colours... Saved the day! Grandpa was a builder and he told me to do that always...

The case makes me feel like I'm watching the 80s Judge Wapner episodes. I'm sure there's Aqua Net in at least one of those hairdos. But on a serious note, defendant needs to take more accountability. I see both sides but you can't blame the contractor for something that happened on the backend.

I had a mislabling issue with haircolor. The sealed box read dark blonde, the tube inside was Ash ( green)extra dark brown. It was a good thing I wasn't super busy that day and looked at the tube before mixing! The whole case was mislabeled. Lots of blondes would've been really angry!

Im a tile installer for 25 years....15 to 20 times in my trade that situation happend to me...wrong tile or shade....but always...always I manage to catch the mistake ether from the tile vendor or manufacturers....chech your materials and always double check with home owners....10 to 20 minutes well spend...

Weird how some people are blaming the plaintiff for not double checking the tiles she received against her bathroom before installation. How about we blame the tile company for not double checking the tiles that came in against their own sample? If you're going to blame one for not double checking, you also need to blame the other for not double checking.

I can't see where the Plaintiff did anything wrong. It's between the tile store and the manufacturer to work it out. No need to be hard on the Plaintiff.

Maybe the Tile Shop had put the incorrect labels on and the Tile manufacturer had pointed this out. The Tile Shop may be just "blaming" everyone else, that is my conclusion watching this.

Happened to us with carpets from a "Posh" UK shop. They fitted the wrong carpet, asking my wife to "keep out of the way". I get home and immediately I say that is NOT our carpet. Next day phoned up, given B.S. by the shop, then I remind them I have the samples that we paid for, reference numbers and a written copy of the order. They then say sorry, WE ordered the wrong carpet BUT we will give you 10% off if you accept it. I said NO! I said YOUR mistake and you have thrown away all this carpet, they say, we will sell the wrong carpet (now used) as remnants. I pointed out that was a criminal offence. They then ordered the correct carpet, which was fitted 8 weeks later, NO APOLOGY was given. The fitters the second time around, independent, told us that they were ordered NOT to leave a single piece of wasted carpet, so we were punished TWICE! Thank You John Lewis, High Wycombe, Bucks, UK.

Turns out husband was right. I am kind of torn with this one. Yes Manufacturer was in the wrong for color being in wrong box.. Store owner is not going to know color is in wrong box. When it is taken. What the plaintiff should have done when husband noticed it was wrong. Right there she should have gone back to store before installing the rest. That is how I feel about it. Really was not store owners fault. It was the manufacturers fault.

Not the contractors fault, and it’s a shame this woman is blaming their contractor when these people have come to her multiple times for tiles… This woman has a lot of respect for her loyal clients

I work in this industry and it is 100% the defendants fault, despite it being the manufacturers error, you have to accept the blame, explain the reasoning/situation and fix it. It is now her responsibility to fix it and make it right. Plus if she orders as much time as she says she does, 4gs is not going to break her bank. Once her client is taken care of she fights her battle with the manufacturer. It's tedious but it's the right way. Edit. Not a single company will lay out an entire job TWICE. just to check colour. That is double the labour and double the time. 🤦‍♀️

how on Earth can you install tiles all the way to the bathtub before you notice they're the wrong colour? How can you not see it before you lay the first one?

I don't know..... they all seemed to know something was wrong but they just continued to install tile. For the contractor I could see him just not wanting to be bothered because he has other jobs to do. I think the owner should have to eat part of that. 20% maybe..

The owner of a historic home related a funny story about a kitchen renovation. She had chosen a beautiful creamy off-white for the cabinets from a sample board in the cabinet makers office. Once done,she complained that the color was wrong . She went back & forth with the contractor,who was trying to appease her . The reno was in the high six figures & this was potentially an expensive screw up , but they had to make it right. They went back to the sample board & the order number was correct but the homeowner was adamant the color in her home was not the same. The sample board made it’s way to the house for comparison.Sure enough,the cabinet color was a much brighter white,in comparison to the sample. Then the 💡went off in the contractor’s head. The shop owner was a heavy smoker 🚬& the sample boards hung on a wall in his office. Nicotine had stained the off-white the perfect color for this historic home!! 🚬🚬🚬

I'm impressed that the woman has 4 bathrooms to renovate (cough.) I would not have a contractor working by himself while I was at work. If you can afford the work, you can afford to take (at least the first) day off so you can see that you're off to a good start.

Goodness I feel I am in the twilight zone here, what ever happened to taking responsibility for one’s actions. The defendant acknowledged and took ownership on the mistake by manufacturer and provided free titles but ultimately plaintiff failed to acknowledge her wrong doing, it was the plaintiff who knew and recognized the color was not as she pictured it or remembered seeing it at the store, she should have first laid it against the tile in the bathroom but to proceed to install it and expect to be compensated to undo installation she okayed to do ( I have no words). She should stop and go back to the store and the problem would have been taken care of from the beginning. In my opinion, defendant had a case against manufacturer as she lost money ( the free titles plaintiff received) but other than that nope it was plaintiff conscious decision to install titles.

I did not agree with that judgment on the tile.the customer had a chance to observe the tile and let it go.

I ordered drop earrings from Amazon, and what arrived were similar, but not the same. There was a cheap-looking small pink bead at the bottom of each. Even the customer service agent agreed that's not what the ad pictured.

Did I understand correctly that the manufacturer replaced all the tile for free, and also said that they would discount future orders by 7% until the entire $4,000+ was reimbursed? And then the defendant was just going to keep those savings and not give the money to the plaintiff? That makes defendant look really really bad.

Beauty is in the eye of the beholder and the plaintiff deserves to get what she paid for. To me the darker one was even better.

Judge million is such a fraud. With "certain people" she woulda said: you admit to seeing the difference early in the job and had a chance to correct it. You admitted to that. I rule in favor of the defendant! I seen her do just about that. She biased

The defendant should have paid right away for the mistake ! The manufacture was at fault, they were going to compensate the defendant. The defendant took the cheap way out by just paying for the tiles and not the work to put them in. I would never go back to that store again. She kept trying to blame the plaintiff and contractor!

So the defendant orders "a lot" from that manufacturer and this is how they treat her? 7% for every 1,000. That would take years. Whereas giving the store $4000 would make them a better business. Shame on them.

I think the wrong colour looks nicer. She didn't notice it immediately. She could go to one of the other 3 bathrooms. I'd take a gift certificate to my favorite restaurant and be done with it. That's just my opinion. 😜😧🤪

I get the legality of the verdict, but I do feel sorry for the defendant. The plaintiff saw the difference early and didn't hit the brakes on the install (tiny bit of fault). The installer didn't lay out the tile before installing (tiny bit of fault). The tile company had the samples mislabeled and sent the wrong product (MAJOR fault). The only person who didn't really do ANYTHING wrong was the defendant, and they seemed to try pretty hard to make things right by being the middle man between the customer and the tile company. Again, doesn't change the legality of the ruling, but I do feel sorry that the only people who did nothing wrong had to eat a four thousand dollar bill.

From all the lawsuits I've seen with contractors, I would never be at work with a contractor working on my place. If you can't afford to take a day off, you can't afford to buy it.

first of all i work in supply chain so i deal with this kind of stuff everyday….i 100% believe that the tile store messed up their display name…however, the mfg should pay if it’s truly their mistake…they truly don’t have a leg to stand on when the wrong item/ material is purchased. that’s how it goes.

Plaintiff had no contract with the manufacturer. That’s the defendants issue. The customer did everything right, store is responsible for the merchandise they offer. The store needs to pay, the store can then sue the manufacturer. But in no world is the plaintiff responsible. The judge says she follows the law, but really she follows her mood.

How could you blame the plantiff in this situation the origin of the mistake lies in who fucked up first, she never wouldve fucked up if the manufacturer never fucked up

You can put whatever you like in a Contract but it doesn't make it binding. Had this discussion with Toyota when my Car was supposed to take 6 months but going to be 12 months and that new technology will be introduced before mine is being built, although it is being built 6 months after it was supposed to be built

"the contractor should inspect the tile" - Let's assume that's a fair statement. But what is the contractor inspecting the tile for? It's the right package, the right tile, the right PO. He can't be expected to remember what the sample looked like. And it most certainly isn't his job to tell the client that her choice is ugly.

Am I the only one that thinks the plaintiff and defendant should have gotten on the same page and went after the manufacturer together instead of each other?? It seems like they would have had a stronger case if they aligned and both could have gotten reimbursed/compensation.. just seems like it would have been more productive.

Not sure how people think the customer is at fault for not catching the manufacturers ridiculous mistake. Is that how it works, customers are liable for manufacturing mistakes?

Usually the norm in the society is for the seller of the tiles , they will only refund or replace the tiles . If it was a contractor that did the whole job, then the refund would include the labor . That’s what is normally done in America. That being said, the plaintiff is fortunate that the judge ruled in her favor to get reimbursed for the labor which was done by a seperate contractor.

I just KNEW JM would tell her she has to go after the manufacturer.

Either tile color is horrible! It’s like a mausoleum. What “style” is her house? Early American tomb-chic?
