The plaintiff says her niece, the defendant, owes her for funeral costs after the plaintiff’s brother died. Her niece promised to repay her for months, but she’s out of patience. She’s suing for what she’s owed. The defendant says she’s hurt that a family member - her father’s own sister - would sue over a funeral.

THIS! I'm always so annoyed when Harvey asks people if they would sue family kver money and 95% of the time they say no "family is family", "blood is thicker than water" completely ignoring the fact that in proposed scenario it is family who screw you over in the fiest place.

@@kiahhh444 Nah, you're right. "Horrible" probably is a bit harsh. She's definitely suffering herself. I suppose I just hate to see families get ripped apart over something silly like $438 and whatever the change was; just pisses me off. And even though I was a little too much on this, I do hope that all of them are able to heal from this. Losing a loved one is not easy, I was the one being harsh.

When the judge said “I’m telling you that you’re wrong” you could tell by her reaction that she is in denial. She thinks she did the right thing and is very stubborn.

Thats what I was thinking she probably felt like she didn't need to pay her aunt back because they're family but realized her aunt was expecting to get her money back and wasn't going to go away I feel like that's why she was trying to block her aunt from going with her to get the death certificate translated because after that the next stop would have been the bank and the aunt would have been with her and the first thing the aunt would have expected is for her niece to put the money in her hands.

I'm kind of split down the middle about it. First of all, if I was the aunt that little $400 is nothing and I would just say forget it and never give her money again. If it was $4,000 or more then that's a different story. Also it's not uncommon at all for several family and friends to chip in for the cost of someone's funeral and not expect it to be paid back to them. Especially when it's immediate family putting in the money. But I also get the feeling that the niece probably did finally gain access to her father's account and spent all the money and now has nothing to show for it. Which is not uncommon at all after someone dies when family gets a hold to the deceased bank account.

Exactly! She's the one being petty. She lies about not being able to get time off work. She forced her lovely aunt into a corner where she had no other options, except losing the money which is obviously rightly & legally hers. The niece believes because she's young & her father was the aunts brother that the "grown ups" should take care of everything. It's time She grew up! 😊

Also, her age is absolutely no excuse. The brain function growth is not complete until approx 25 but a person's moral compass is generally fully formed. A liar at 20 is a liar for life. She will get better at deception as she matures.

Yes, a kid that is being burdened with things that shouldn't be. I lost my Dad at 20 and bc he was a responsible adult everything was taken care of. I know one thing for certain, if he didn't have everything set up the adults in my family wouldn't have looked to the kids. The adults would have pulled together and made it happen. Ppl don't do things like they once used to. We want to look at kids (which in her case sounds like she's had a tough start having irresponsible parents) and want them to grow up fast bc they had to or bc they haven't had decent parents. It's ridiculous. She's 20 and should be in college somewhere getting a good start. Not this shitty start she was handed. Over $438.00 smh.

She’s being a bad family member by putting all the responsibility on the other family member(s). Death regrettably occurs when we don’t expect it but that doesn’t mean you don’t take care of business to honour your father. My niece lost her mom when she was 8 and she’s even more mature than this 20 year old. And like the judge says, when people take others to court it’s always about the principle, not the money.

@@NiaMSnow depending on ur plan it can go towards your funeral and earthly expenses such as debt or bill cancelations etc. It's so ur family isn't trying to come up with all this money to pur you to rest. Many people buy their plots headstones and services so their family doesn't have to pay it and also get life insurance that is given to loved ones to help them out etc

Life insurance doesnt cover suicide, my grandfather died from a suicide attempt and he wasnt covered by life insurance

I don't believe she will learn. At age 20 we are not fully mature as far as our brain development is concerned, not until approx 25 but we do have a good grasp on which direction our moral compass is facing. If she's a proven liar at 20 then she's most certainly a liar for life.

Just because it ends up in small claims - doesn’t mean they don’t love you. It’s better to look at it as a third party ending a dispute that has no familial or friendly ties without it being a complete stranger.

$400 is ridiculously small. Especially when it comes to family-- you really want to put $400 between you and a relationship with a family member. It is so not worth it. Especially when that $400 is sitting in the bank account of your deceased relative and it will cost you nothing but time to go retrieve it.

I hope she grows to regret her actions, but she may stay young and entitled. One thing my parents taught me was no one owes you anything in life, not even them. If you depend on yourself and you don't feel entitled to things that belong to other people, when they actually gift you something, show gratitude. But you are never entitled to things.

I lost my dad all of a sudden just last year when I was age 22. If my family needed $400 to bury my dad, I would have hustled for it if I didn’t have it. If my aunt offered to put $400 up she might not have truly had, I would have busted my behind to get her that money back. Family means more than money. It’s hard enough to leave a dad, let alone a aunt as well.

In my opinion. This is about blocking the Aunt from knowing about the money. There is no reason to not get it translated and then the niece has access. That is the issue.

Didn't the defendant say her grandmother has his debit card? It's really likely the niece just used it & spent the money in the account & that's why she all of a sudden didn't want to go w the aunt to translate the death certificate. Because she found a way around it

This is so strange. As the sister I can’t imagine wanting to be reimbursed. As the daughter, be grateful that someone could step in and help since it seems the Dad didn’t have his affairs in order. “Something so small” we’ll pay her back.

I see where you’re coming from but we’re not really sure the aunt’s financial obligations that allowed her to assist. She put it on a credit card and not out of a savings account or anything of that sort. Another angle is the funds are available and sitting in an account. It’s not like she had to “work” to pay her aunt back. It’s the principle of the situation. I can tell you when my mother died my siblings and I had to make a lot of sacrifices to give her a proper burial. We were all struggling at that time and even had to go into our 401K to put in our contributions. It’s not as black and white as it always seems. Even if it were a $1 borrowed…keep your word! The “love” of money is the root…people act real funny when it’s time to pay back.

@Wilma Davilus we also don't know the daughter's financial obligations. That's now the daughter's problem to get her dad's affairs in order; maybe she needed it. Being that she's young she may not know how to translate that convo with her aunt, as the top comment said in the beginning, its strange, as a sister what u put in should be your portion I would not ask for it back from my niece who's now probably having to deal and pay way more for having to tie up all her dads loose ends. I recently lost my dad from covid, I few months ago 😢 and my family n I are STILL going through it n getting his affairs in order, I had to pay for so many things in the beginning of his funeral process that it left I huge financial hole in my savings, infact I have no more savings because it all. 💔

It always amazes me when someone like the defendant says 'I can't believe she would do this over something so petty', but that goes in both directions, she is being petty for not fulfilling her obligation. She's only 20 and she's already this nasty, she will only get worse as she gets older...

I think that the thing that’s being left unsaid is that the aunt doesn’t really NEED the money. So the niece feels like she’s making a big deal out of something when she doesn’t even need it. Unfortunately, she doesn’t have to need it in order for her to expect her niece to do what she said she would do.

What a beautiful aunt she has there who has been there for her especially at a time like this. At 20 it still shows her immature. She still has alot of growing up to do? I know she's hurt but she is blinding herself to her responsibilities. Better days are coming You have been through a lot. Soon it'll be time for you to shine. Never forget who helped you when you needed them And helped you before you even had to ask? Family is very important.. She seems like a wonderful Aunt.

Spelling, grammar and pronunciation has taken a big nosedive in the past couple of decades. To be fair though, English is probably not a Puerto Rican's first language. They certainly speak better English than I speak Spanish. I've noticed a trend for urban people to speak black ghetto "speak". Why is baby momma so prevalent? ('For example). And black ghetto use of "axes" instead of "asked"? Are people celebrating their ignorance and attitude? Why has this become so cool? Are we devolving? Bad education opportunities for poor people?

It’s sad, if she keeps behaving like that she has a hard life ahead of her. I know siblings right now who wouldn’t put a dollar towards a burial if there are heirs. Her aunt chipped in and went above and beyond. Such a nasty young woman, she has a lonely life ahead of her.

I lost my father to brain cancer two years ago at 24. I'm still grieving. My younger sister was 16 when he passed. Our whole family fell apart from grief and I have been estranged from them. I wasn't even invited to the scattering of his ashes so I have no closure. I miss my family and feel like an orphan. Despite my attempts, grief and pride get in the way of them accepting me as a daughter and sister.

That’s why it’s so important to have life insurance!! You can also add a POD(paid on death) person to your bank account should you die so that YOU can access the remaining funds. My mom had everything set up before she died. We fought over nothing!

This girl is only 20 years old. As someone who lost their dad at 25 I can say it was hard to come to terms with the loss. But to expect her to pay for her dad’s funeral is a little much. If she was my niece id never ask her to pay. 2 years ago this girl was considered a dependent child. If she was in college she would still be. I just don’t agree.

She’s not paying for her dad’s funeral. She’s giving back money that is sitting in his account to pay back what the aunt “borrowed” to her. It’s the principle and the sneakiness of it all that’s sad. The aunt put it on her credit card so obviously she didn’t have the funds readily available to herself and made a sacrifice as well. Show appreciation by paying the money back that is not really coming out of your own pocket.

The amounts matter and that's why the girl is morally right (although legally wrong). The 20 year old girl believes the aunt ( and aunt's 3 brothers) are more wealthy than she is and hence the siblings should pay off the remaining funeral costs (£438 which is approx £100 from each sibling) and not use her dad's money (he only had £800 left in his bank account) because that money the girl will eventually inherit and her dad would want that, right? The girl thinks she needs her dad's money more than the aunt does, which is true because she is young and that money would matter more to her.

The niece deep down knows that going into her father’s account to pay his own funeral expenses means he’s really gone. It’s an emotional thing and nothing to actually do with the aunt. It’s deep seated and I don’t think even SHE understands this is a protective mechanism to avoid facing that pain. Once that’s paid off and the his final affairs are over with, she has to face that he’s really actually gone.

If I was able to gift something without being needed to be repaid then sure. I’m also the type to not give if I don’t have anything to give and instead give whatever I can give.

None of us know what the money the niece borrowed was for, although it was not the cost of the funeral as others chipped in and paid for that. If she asked her aunt to pay her expenses and she said that she would pay it back then she needs to pay it back.

There is something in the will or whatever the 'Paper' is that needs to be translated, that the niece/daughter knows about, and she just does not want the aunt near it. I'm not going to expect my brother to pay when I'm gone that's my job b4 I'm gone or my husband's job. My parents on the other hand is mine as nd my siblings if they don't have funeral funds set up. Just my opinion but siblings are not usually expected to pay burial expenses

I just want to say, my husband is a funeral director and funeral home owner....he is very honest and works with families to keep costs down. A lot of families collect thousands if dollars through go fund me. Very rarely does the funeral director see any of that money.

If they needed a go fund me money was short for everybody involved. The plaintiff chipped in along with her brothers and still needed go GoFundMe. The plaintiff paid the balance due fro her own money with the stipulation that she be paid back from the deceased bank account. The niece was deceptive and wrong for not following through.

I can't imagine suing my 20 year old niece over $500 that I put towards funeral expenses of my brother after he died from trying to commit suicide. Even if I was strapped for money. If I gave it, I gave it with no expectation of repayment. That's why you don't give money that you NEED to salvage relationships. Everybody's in their feelings about it but like Harvey always says: everybody has a price. I guess the aunt's was $500
