I'm going to give you some of the most popular lawsuits in real estate and some tips to prevent lawsuits.
One of the most common lawsuits has to do with someone stealing a deal, or someone trying to interfere with the real estate deal. If anyone tries to interfere with our contract, we will sue the seller and the person who interfered. This is sometimes necessary to prove a point.
The second most common is the repairs after a home is sold. A home inspection is done before the house is sold so all potential problems can be fixed. Sometimes, after living in the home for a few months, problems come up that no one could've seen. This is where a lawsuit could happen because we took all the steps to ensure their wouldn't be problems. The buyer could have also caused some of theses problems to arise. We will fix problems as long as they are within reason and a certain timeframe of moving in.
Now here are three tips for avoiding a lawsuit:
The first tip is to be honest and transparent. Always make sure to point out every single thing wrong with the house, because someone will buy it regardless.
The second tip is to make sure you're dialed in with your paperwork. This just means that everything that is wrong with the house should be in writing, and the buyer needs to sign off knowing about the problems.
The third tip is to try to find a solution before lawyers get involved. Once lawyers are involved it can become costly. Most of the time you're better off paying the cost than taking it to court, because the court fees will end up costing you more.
