I'm going to give you some of the most popular lawsuits in real estate and some tips to prevent lawsuits.
One of the most common lawsuits has to do with someone stealing a deal, or someone trying to interfere with the real estate deal. If anyone tries to interfere with our contract, we will sue the seller and the person who interfered. This is sometimes necessary to prove a point.
The second most common is the repairs after a home is sold. A home inspection is done before the house is sold so all potential problems can be fixed. Sometimes, after living in the home for a few months, problems come up that no one could've seen. This is where a lawsuit could happen because we took all the steps to ensure their wouldn't be problems. The buyer could have also caused some of theses problems to arise. We will fix problems as long as they are within reason and a certain timeframe of moving in.
Now here are three tips for avoiding a lawsuit:
The first tip is to be honest and transparent. Always make sure to point out every single thing wrong with the house, because someone will buy it regardless.
The second tip is to make sure you're dialed in with your paperwork. This just means that everything that is wrong with the house should be in writing, and the buyer needs to sign off knowing about the problems.
The third tip is to try to find a solution before lawyers get involved. Once lawyers are involved it can become costly. Most of the time you're better off paying the cost than taking it to court, because the court fees will end up costing you more.

I was actually sued by tenants I evicted 8 months after the eviction. It wound up going nowhere. Keep good insurance and a good attorney on your side!

I put a clause in my contract that if you back out you have to pay me $7k. Lady paid me & resold the home to someone else. I don't flip homes tho. Buy & hold only.

Love your commentary....One quick point...When someone interferes with a deal, you need to sue them them NOT ONLY for the sake of your employees that worked hard for the deal but also for the rest of the investor community. If you allow bad actors to continue to defraud deals then you are turning a blind eye and that hurts the rest of the investor community. Anyone who turns a blind eye to this is complicit in the scheme...it might be worth it for you to take the easy way out but this person will attempt to same thing on the next person until their stopped. Always do the right the thing and bring those that try to circumvent contract law to justice. Keep up the good fight!

Awesome Video Ryan! Have you ever heard of these guys that Sue everyone to avoid banks from foreclosing on their homes.. and living rent free for years in them??? There's a seller that has done this... he sued the bank to stop foreclosure, then filed a thing for COVID, and now might Sue the Dual Agency Brokerage that was helping him sell his house months before going to auction because a Buyer backed out of escrow probably due to the bad home conditions and inspections...

I bought a home from a flipper. Seller put on the seller disclosure that that all toilets and bathroom vanities replaced. I was lied to. I hadn't noticed it until after moving in after 2 months. They replaced all, but 1 toilet. They changed 1 vanity out of 4. They changed the vanity tops, faucets, and sinks, not the vanity. Now they say that it's my fault for not doing my due diligence. It looked new, but it wasn't. Lawyer will cost more and like you said it's a headache.

I've been in a lawsuit and it was bogus and got dropped but was stressful. I had a tenant sue me and made up a bunch of stuff. During the deposition the people on the tenant's side ended up testifying for me as the landlord and the case was dropped. I think my mistake on that one was poor tenant screening. I rented to a professional tenant that sues people. You sound like you and your company make every effort to do what's right.

Real estate agent had inspector in without notice and now buyer cancelled without explanation. Very upset at real estate agent as we were in the middle of multiple repairs and were not ready nor were we notified of inspector appointment. Place was for sale "as is" and we were told buyer didn't want an inspection. Now we are screwed. Not upset at buyer or inspector (not their fault) but our real estate agent did not inform or warn us or get any permission to enter. Escrow cancelled with no explanation.

We had to sue our insurance company after a fire destroyed our construction site-- they tried to underpay for our damages by hundreds of thousands of dollars, and it took almost 4 years to resolve. If we had fewer resources it would have been extremely difficult for us to continue doing business after a loss like that, and we would have had a hard time pursuing the court case, as they dragged it out as long as possible. They wound up having to pay our legal fees but it took a ton of time away from our profit generating projects. Lawsuits can be a real drag, watch your asses.

My mother wanted to sell her house and this real state agent came by and promised my mother 600,000, but he found a buyer who wanted to buy it for 500,000 and my mother refused and now the real state agent wants to sue. Idk care who you are you can’t force someone to sell their house especially if it is not the deal that was Discussed.

This was a really helpful video. Had several contracts fall through due to others going around our back and not being very ethical. Unfortunately, it was off market and it was actually a realtor who caused the deal to blow up with the seller. Thank you for sharing

Hi . I need your advice please the realtor said to us he is a exclusive realtor meaning ( he represent the seller and the buyer) he never did anything for us keep telling us everything is parfait , I saw 👀 a video on RU-vid about walkthrough we call 📞 him we need a walkthrough 3 days before closing okay Monday at 11:00 we supposed to close at 12 pm . Never said anything the first floor no light 💡 and our Brocker said everything fine it’s good deal,at the closing our lawyer give us paper to sign, I asked my brother how long it is going to take to read them he said the lawyer knows everything and our lawyer said he read this paper more than millions times. Now 3 days after closing everything went wrong after the rain . We desire to sue them

This is not a professional. Professionals don't get sued, because professionals know that time is money. If you don't want to take the time to do it RIGHT, then don't do it at ALL. These punk kids got everything backward and knowingly defraud people because the only way to make a QUICK buck is to cut corners and CHEAT. Investment returns take YEARS. This turd runs around slapping on luxury lipstick, forgoing critical maintenance due, and marks it up for 40, 50, 60, 200 YEARS worth of equity in only 2 months time. The homes are typically worth LESS after they tear out original wood and craftmanship. So, buncha punk fraudsters. Nobody in my family got their butts sued for the last 100 years, because they all did fantastic work, spent a decade or more on their project, thus got top dollar from exceptionally excited and content buyers. This kid is a duche.

In my case the seller is An elderly lady trying to back out and their attorney is claiming that she was not competent to sign or enter the contract Saying she doesn’t understand what she’s getting into. And even my attorney somehow called me and persuaded to settle things as the Judge might favour the old lady as she is in wheelchair and there is no way to prove she was competent/ok at the time of contact formation. this is so messed! up any advice in this case?

Good morning Ryan, Hope you are doing well. Got a scenario: We just bought through VA (“They do inspection”) and we hire our own inspector. And not even a month in the house and we started noticing issues with the HVAC system the piping things here and there. So the HVAC was not installed up to code. So we contacted the code enforcement and he noticed that the HVAC is not up to code so he said call the office for permits well the only permits for the house after huracán were the fence and the roof no other permits were pull for water heating which is also installed wrong. What would you do in this case? Any thoughts or suggestions?

Hello, I was under contract for a home that already had a signed contract by seller. There was a lien on the property and I was unable to close. The agent told me that she KNEW about the situation and that the seller told her that she signed something. She still allowed me to go under contract. Can I sue this agent and brokerage? I have evidence up and down including recorded conversations, and what can I get for damages? The equity on the home has raised to almost $200,000 in Brooklyn.

Definitely seller's real property disclosures area big issue when it comes to legal issues. A lot of unethical house flippers discover a ton of issues when flipping a property but just mark off being "unaware of all issues" due to them "never occupying the property"...

Hi, I have an issue with my purchase. As per MLS listing, the house is 2000 sq ft, source public record. County tax record also shows the same. But the appraisal report shows 1600, when we measure the house it is 1600. I have removed the inspection and appraisal contingency. I have given 2 percent earnest amount. My realtor says if we terminate the contract, i will not get back my earnest amount. What should I do in this case.

Do you include a Home Warranty for a year when you sell? It is an expense, but it gives the buyer a year of most major systems covered.

A lot of times yes. Especially if there is something old that they’re unsure about, we’ll compromise and give them a warranty instead to cover it if/when it reaches its lifespan.

When you are rich you have a lot of acquaintances, but few true friends. Everyone loves you because of what you can give them and everyone tries to take what you have. It's hard not to be objectified or feel objectified even by your own family. Relish in the fact that you the ability to provide for them rather than lement the inauthentic appearance of your relationships. Never lend a dollar to anyone that you care about that you actually want repaid. Go into every personal loan with the expectation that your money will help them and that you'll never get it back. Use discipline to use your money for things that will bring you health rather than vices that will weaken you in the long run. Don't assume because you are rich you are always right. Because sometimes smarter people than you who give you advice are also poorer. Stay humble, Stay grateful, if you want more keep doing the same things that made you rich.

I bought the house in NC which was misrepresented to me pretty much in every question mark in the disclosure. The seller who lived in that house for 13 years and agent knew about major construction problems which very costly $ and yet they decided to lie to me and in the disclosure taking advantage that I am from Ukraine and don’t have much support and on budget. The house had major safety issues and poor condition. They staged and out on Zillow hiding all the problems. I was out of state. I asked broker to get with me in video call to show the property. She just took pictures and video ti show me no problems but hide all the major problems which cost up $100K in construction repairs. Now, acre I contacted attorney they sad I can loose the trial because it’s be aware state and it’s my responsibility was ti come and inspect and check that out. My question what is point to have legal document like disclosure ? If the company lied 95% why should I be responsible for my list just because I didn’t fly ti see the house before I bought ? This is why we have corruption and this us how rich become richer by stealing from hard working people

I'm from florida, but i'm like 99.9% sure they committed fraud. I think if you have sufficient evidence that proves they both knew about the construction problems, but decided to not disclose that information to you, you can try and fight back. *It is illegal to not disclose unobservable facts to a prospective buyer.* EXAMPLE: If a real estate agent knew there's a leak in the roof, but refused to tell you, the buyer. That is illegal. Regardless if you didn't go and check in, the real estate agent is legally required to disclose unobservable facts about the house

I was or attempted to be sued by my scammer tenants. I didn’t realize they were scammers until previous LL and their newly acquired LL came to me and said they’re doing the same thing to me that happen to you... aka plumbing magically broke and they smell black mold... I previously went sleepless for 3 months cause I felt I was a bad landlord. After their new landlord showed up saying he has a similar lawyer letter without the lawyers header requesting more money I felt guilt free and pure rage for screwing my family. Lawyer respond to still pay the small $$$ figure in order for them not to comeback at a later time with larger $$$$$$ which my father agreed. Father congrats on being a successful landlord. Scammers currently going through bankruptcy and loosing their house. Karma is a bitch.
