I have a 2019 NeXus RV Maybach 32M Class A, it has been a headache since day one! It was at the factory for 5 weeks, nothing was repaired correctly! As a result of scheduling and Covid my warranty expired. They don't stand behind their products! They won't warranty "design flaws"! They have settled with multiple people, but, they force those that they settle with to sign a "Do not Disclose" statement! They're crooks from the word go!

Need a class action to shut that non disclosure crap down. Those in itself, should be illegal, as it is bordering on bribery/extortion etc. In my opinion.

Ya they may need to eliminate the do not talk Claus. That is a way so so many people are getting away with bad behavior. Etc We'll just pay them off. And continue with out ways. What 10/20 years later they finally end up in court ??

I owned a 2018 Forest River 5th Wheel (Wildcat 375MC) on the federal sticker it actually said the unloaded weight included full fresh water tank, hot water heater tank and propane tanks. I assumed they all came this way. My new 5th wheel (GD Solitude 380) does not. On top of that they only put 7k# axles. I have ordered the new 8k axles to be installed this winter. These companies need to be regulated like the auto industries.

I agree with regulation. On the other hand, we as consumers keep green lighting these manufactures to make "CRAP" because we keep purchasing them. If we stopped purchasing them and insisted they make quality units instead of throwing them together, that may just turn the course of crappy constructed RV's.

Just putting heavier axles may not do anything. The frame, springs and shocks must also be sized for increased weight.

@@kckettridge it is just like time shares, "a new sucker is born every minute" -PT Barnum. When an industry discovers a way to make money off of ignorance (not a put down but not being educated on a complex subject), they will rake that money in as fast as they can. This is exactly the type of behavior the Consumer Product Safety Commission is supposed to prevent.

Great topic & I believe the manufacturers should have a weight included on the vehicles with all tanks full. Dry, black, fresh & any propane tanks included full. Also a spare tire with 1 lead acid battery as standard equipment. Eliminate confusion

Exactly. Makes sense. Also make sure axles and tires are over rated for full load ratings.

That really makes no sense. Large takes will never be installed as it would show a lower cargo. And there is no confusion "The UVW generally does not include passengers, cargo, fresh water, LP gas, or aftermarket accessories". With all this BS of including, and not including passengers or water or LP is where things get stupid. Should be simple, Fill the fuel tanks, take it to the scale, get out and there is your weight. Even when they took it to the scale, they were in it, the water takes were full and they even had the dog in it.

It seems crazy that they could sell a Rv that when you fill tanks, include filled propane, and battery would max out or go over cargo capacity, without people or personal items. For the cost of these things, they need to upgrade suspensions, tires, and at least floor/tow frame to be realistic and safe. Plus, how many designs inside and underneath, are weight balanced for towing? Add the equipment in underneath storage, how does that affect weight distribution? If more weight on one side, it will cause 'the tail wagging the dog" where camper starts weaving and yanks truck n trailer right over....

@@bindingcurve agreed it would limit the max tank sizes to below gvrw, but that would prevent the rig being transported with full tanks when that is over gvrw. It would really only crush the boon docking rigs with large tanks. More than likely, these are being towed with full potable tanks in reality anyway. Unless regulated by law, this will continue.

They could or should also throw in a suit for fraud since they misrepresented the weight rating from the beginning. Ford recently lost a suit for fraud against a single Navistar diesel f350 owner because they knew the engine was junk and kept selling it for years. I think he was awarded a million dollars.

Shame on Nexus for their deceptive practices, and threats. This seems like one of those David and Goliath cases nice to see the little guy getting some justice. 4 years is unbelievably long this could’ve been resolved so quickly and so easily if the manufacturer were stand up folks. I know one things for sure those class super C’s are extremely expensive why wouldn’t you take care of your customer? The best business is repeat business and good word of mouth but I guess not at Nexus.

I love this story. We need to hear more of these. People need to do exactly what these fine people did and that is to document. Everything you talk about follow it up with an email and print it out then place it in a folder. Keep everything. Have truth on your side and a good lawyer like the one they used. Cheers!!!

Congrats to The Smith’s for successfully defending their rights as consumers! Shame on Nexus! I just crossed them of my list of potential manufacturers due to how poorly they handled The Smith’s legitimate compliant. If more consumers had the fortitude to stand up to unscrupulous manufacturers, the RV industry would start cleaning up their act. Wishing both of you many happy years of RVing moving forward!

Unfortunately, I have a 2019 NeXus Maybach 32M Class A, they don't stand behind their products, even during the warranty! I've tried to trade it, but, once the people I'm trying to do business with find out that I want to trade a NeXus, I never hear from them again! Claude Donati and David Middleton are crooks in every sense of the word!

Good to know such a pretty looking rig isn't much more than a polished cow pie. If the CEO isn't willing to stand behind the product, the company word and warranty aren't worth squat. If they sell the coaches with the assumption that you can't travel with full tanks, that needs to be clearly spelled out on the rig, and in the owners manual, AND the ENTIIRE company, including sales, needs to know and be able to explain that. Most states have a three day cooling off period for any purchases that allow you to change your mind after sleeping on it. This is intended to protect consumers from high pressure sales tactics. If the CEO attempted to intimidate you after the purchase, I would have awarded at least triple compensation if I was on the jury.

@@FixItPleaseJ : The three-day "cooling off" period is typically only for door-to-door sales, not motor vehicle purchases. So be careful and do your research beforehand!

Great show. Kudos to them to step up and stare down the big boys and WIN!Persistence pays off. I worked with the Winnebago Factory to have some water leak issues repaired. The dealership would not work with me because the unit was 200 miles out of warranty. Winnebago went above and beyond in taking care of me. I am so sorry these fellow Wisconsinites, and fellow Viet Nam vet, had so much trouble with a custom RV. Just looking at the picture you can tell it needs a larger chassis, heavier springs and probably air shocks that are now available for gas engines. Here’s to a couple, and stand up attorney, who took on and beat the big boys.

This is EXACTLY what a "Wingman" is suppose to be! Help keep us flying in our lives, as we see this magnificent country of ours. Knowing who we can turn to is EVERYTHING. That is a wingman. Great Story - great people(Even if they are from Wisconsin) -= ¯\_(ツ)_/¯ (JUST KIDDING). 🤦‍♂️🤣🙋‍♂️ I think if I lived there, my fishing days would be my happy days. I'm no engineer, but IMO, an RV that big, with that much weight capacity in addition to the weight of itself, should've been designed and built with a double rear axle.

Yeah man I agree. Just looking that the photo of that thing. I wouldn't drive it. The rig would be high centering and scraping on rail roads or steep driveway humps I bet.

My 37" class a diesel pusher (bus style) has 1 front and 1 rear axle and weighs 26,000 lbs gross. Doesn't need a tag axle (second rear axle) at that weight.

Especially if you are driving on the highway at 65 mph and have a blowout in the rear , with a single axle, your asking for trouble.The manufacture of the chassis has a gross vehicle weight, which MEANS YOU CAN NOT GO OVER . The engineers of that motorhome company are idiots.A full tank of water,two adults,a dog and their rig was a 120 pounds over the G.V.W🤔🤔

The Smith's are right about being concerned about how much weight an RV can safely and legally carry. I have been looking at buying a small travel trailer to pull behind my truck, and have noticed that almost all sales associates will tell you the dry weight, ( not gross weight) even when you tell them the maximum towing weight of your vehicle. I have even been told that " Just buy your groceries when you get there." and " Just don't fill the water tank to full." When I figure the weight, I have to assume that the water and propane tanks will be full (especially if you are new to RVing) . I have learned that the weight of the trailer and the contents in the trailer, as well as the contents of the truck, make the max towing weight of the tow vehicle. You also have to watch the tongue weight of the tow vehicle. I admire the Smith's for taking such an active roll in the building process and questioning what didn't seem right.

You need to pay attention to the Payload stated on the sticker on the door post, the more options you have on the truck /TV the lower the payload, your payload is passengers, fuel, cargo, tongue weight. it can easily be exceeded. People always want to go by what that the manufacturer says the truck can tow a 10000 lb etc trailer.but that figure is for the lowest model and usually stripped. My truck if it was an XL with little to no options could tow the advertised weight, the payload would be over 3k lbs, my payload, because the wife wanted the Platinum model with every option is only 1900lbs, not much more than an F150.

Towing any Vehicle with partially full tanks presents an increased risk of sloshing causing weight shifts and throwing the Vehicle out of ballance. Many vehicles have flipped because of part full tanks. They can make the tanks with baffles, divider plates with holes, to minimize sloshing, but not for black tanks. The info is not clear whether RVs used baffled tanks. It makes them heavier, so probably not.

BS when you say this is the exception. I've owned more than one RV. I gave that game up when, in fact, I had problems with everyone of them. I found that staying in a very good quality hotel at each junction I cared to visit was a much less stressful way to go. And it was much less expensive. The average RV depreciates so much once you take delivery that the loss is unacceptable. And if you search you will find all the other's who have had nightmare experiences with their RVs and have had to fight to get resolution or just live with issues that are both dangerous but unhealthy.

You're not comparing the correct thought process.... Being in a RV has MORE benefits then staying at a hotel. Staying at a hotel requires you to eat out. Staying in a RV you can cook your meals. Staying in a hotel requires you to only be in a single room. Staying in a RV means you can sit by a cozy fire and listen to sounds of the wild. So...... You can have fun in your hotel room. I will stay in my RV and enjoy life.

I would not buy a new RV. Much better to get one that has been used a few times. Make the dealer go through it’s systems before you take ownership.

Being in your own RV, once you’ve got the problems worked out of it, is nice because it is YOURS. YOUR bed, YOUR bathroom and shower, your own cooking, maybe even your pets. No one else’s germs or bugs. The benefit is in those cases where people want the comfort of sleeping in their own bed.

While I’m pleased that the Smiths have won their court case, I’m saddened for what they’ve lost. Money can’t replace the years they’ve wasted on this. They’ve suffered the loss of years of enjoyment of their RV, as well as the stress this must have caused. I live in Ontario, Canada, I’ve seen so many poorly loaded travel trailers and tow vehicles that are inadequate for what they are towing. We nearly fell into this category but luckily before picking up our first tt we realized that our vehicle was not designed for what we needed. Since then we’ve done a lot of research. Thank heaven for RU-vid. Thank you as well for your show. The information you provide is invaluable.

The federal government transportation Dept should have investigated this due to the incorrect info on the required federal vehicle sticker! Falsified documents by manufacturers are big trouble!

Thank you for this eye-opening interview. I am stunned the CEO would say "We have the best lawyers” after 3 days of owning his product. If I were told that I would consider it a call to action that all avenues of remediation are off the table. While listing to your interview I was searching for the reviews on this company for employees and most were roasting the company. Seems to me that a good product cannot be made by unhappy workers. The CEO was proven wrong that that they don’t have the best lawyers! Thankfully that you, Ronald Burdge, Gigi Stetler shine the light in this industry that seems to be filled with sharks.

Just saw this video, but on the exact month this video came out, we were in the process of buying one of these. We couldn't pull the trigger though, because we kept getting a bad feeling when we would get answers to our questions. To be safe, we decided to walk away. So glad we did...wow!

Good interview and warning for buyers. Document everything, have a checklist of what to check during your prewalk. Horrible to hear that they also had other problems as well. I had that brand in my short list of potential rvs.

So incredibly happy that the Smith's are getting what they deserve. They powered through a very rough four year process. Due to thier due diligence. Keeping every phone call, e-mail correspondence, personal experience on record in that four inch binder. Exactly what we would do from day one of the order to the PDI. Doing every bit of what they did is, yes a pain in the back end for some, but a necessary discipline if you want to be sure you're given your hard working money's worth!👍 We love hearing stories like this. It's all a part of the reality of RVing. Most people who haven't yet done thier research on purchasing an RV may come along this and other video's like it and learn from them. Unfortunately there are some out there that are blinded by the RVing process, passion that haven't taken these important steps into consideration that are necessary from a "Safety Standpoint" and wind up in very serious danger later on. Keep up the great work "Wingman" by staying on the lookout for our safety and wellbeing.

An additional loss that can't be monetized is four years of their life. (Maybe that falls under the triple damages at the end) Maybe the judge will also add extra money for the cost of an RV today vs when they bought their rig. Wishing them many healthy years of travel ahead.

Well this is a real eye opener...that very coach is what I have been looking at purchasing. I am SHOCKED that this was the MANUFACTURER and not a dealer (which I would expect)...and just goes to show all the Smiles that Claud and Dave show on their videos is nothing but a smokescreen..they just lost a sale

What is even more interesting is this all took place before our current high demand for RV's. So if they were bad back then, they are bound to be even worse now. They would see potential buyers as just easy marks because of the high demand, low supply. If you look at most class c's that are built on a Mercedes sprinter chassis they are pretty much overweight with a normal camping load. Two people. clothes, food, full-on fuel, propane, a bbq and folding chairs etc. They just don't have the capacity to carry such a large structure.

WOW… Not an RV owner as of yet, we’re still considering options, nothing new as we just can’t afford it. But even if we could Nexus wouldn’t be in the list at all, and to have the CEO intimidate and belittle a customer… Needless to say Nexus should be shut down shortly after word gets around about their underhanded dealings with customers.

Exacly why I loved my school bus . Which I converted to a motor home . While packing and unpacking was slow and a lot of hard work . We could carry everything for a 7 room house . Appliances and all . The van on the tow bar provided sleeping an cooking in transit... If you start with a small truck you have a small truck. But if you start with a big truck you have more than enough capacity...

RV paint/bodyman for 30 years, born and raised in Elkhart,IN. I have painted for most of the major manufacturers Monaco/Holiday Rambler, Coachman, Forrest River, Thor, Jayco...etc Monaco Coach had the best engineered custom chasis. Not a Freightliner or Workhorse chasis with god knows what welded to it. That was before the 2008 collapse.

I dont believe the show stated the exact model but it looked like a Phantom 33SC. If that is the case, this unit for that year was built on an International Terrastar chassis (not a Durastar) which has a published GVWR of 19,500. The Nexus and most third parties have a published combined occupant and cargo weight of 760lbs. There has to be more to this story and I hope Nexus takes you up on the offer to tell the other dimension of the story.

Everyone missed the key point on this. GET IT IN WRITING. RVs, boats, cars, etc. does not matter one bit what the salesman says to you. What is written in the documents you sign is what the deal is. SALESMEN LIE TO MAKE THE SALE. That is just a fact of life. If something is important to you, make them put it in writing. If they won't put it in the contract, it is not true. Also check your state and the state where the deal is made. Many states do not cover RVs in their Lemon Laws. Be sure you have that protection or at least know for a fact that you do not.

I know, written RFP and SOW would have solved a lot of this. Just listening to this interview I had to do a doubletake to figure out if the requirement was 2000lbs CC dry or with full water (FYI it was dry, I think).

I met the Nexus RV people. Two guys own the place. Their statement, "I have more lawyers, " and their actions with these people indicate their guilt. They are crooks.

RV manufacturers have always erred on the overly optimistic side of carrying capacity. There are many instances of overloaded units including some Prevost conversions, Wanderlodges, even Newell along with many others. This is prevalent in the industry and will continue as long as federal guidelines and laws are so lenient to the manufacturers.

So you really can't tell a story without telling us what the cost of the rig was and how much they won. This was not a settlement out of court so there is no NDA in place for the couple. I'm not saying this because I may think the couple was over cominsated but when the CEO threatened them, I'd really like to know if he got his.

17:40 just from that statement about the lawyers from that company's CEO should make him no longer the CEO. Plus he represents the company so the company should be put out of business unless a new CEO can turn it around. That is appalling behavior, especially from a CEO. Unless this happens please don't use Nexus as your RV manufacturer.

This is another testimony of the unscrupulous sales staff we need to be aware of not only RVs but many big ticket purchases re cars, homes, building contractors. Encourage folks to DO THEIR HOMEWORK! RESEARCH, research, and then research a little more.

I had a similar experience but I chalked it up to my experience. I bought a custom ATC Toyhauler and it took me six months to finalize the the custom work. There really wasn’t very much custom to it, I just wanted to make sure I had the blue paint I wanted on the cabinets, the cabinets place to where I wanted. Each time I talk to them I said I’m gonna pull this with a Nissan Frontier and they said yes there will be no problem. Well, it was a Hugh problem ! I had to buy a different pull vehicle. I had that ability and it was my best option. I thought it was a total of 20 ft long, that was for the trailer box, not the total length of the trailer. 25 feet. Acceptable but longer than I actually wanted. The long and short of it is … I think when we talk to these manufacturers they hear it in their language not the consumer language. ATC is a very good company and I would buy from them again. But next time I will go in person to the manufacturing site and walk through weights, length, heights, stairs, water pumps, how the electricity functions, plumbing and any other thing I can think of. Take friends with me etc. This works until the next year model is being produced.

People need to start sending a message to the manufacturers who are putting safety to the side for profit, and stop buying shoddy workmanship. At least until the manufacturer's take the message that we're not that desperate.

Same here Jim! I have a 2019 Maybach 32M Class A, they never fixed anything to last when they had it for 5 weeks, now with Covid and their scheduling, it's out of warranty and they won't attempt to correct the 3 pages of issues unless I pay for it. I can't even trade it, no one wants it!

If the CEO is not the full owner of the company. Then the share holders and or the owner of the company needs to act fast and dump him. I know of a President of a company told the owner you can’t fire me and this was after working for him for years. Well on a Saturday morning the email came out from the company lawyer as of that morning he no longer worked for the company. He was locked out of all the companies systems. I guess you can be fired…….

It sounds like it went to a jury award as part of a court judgment, rather than a settlement between the parties. Which is great, because then it's normally a matter of public record, unlike most settlements where the corporation paying you off won't do so without a non-disclosure agreement, a non-disparagement agreement, etc.

One of the court docs read like they lost one of their claims, but they clearly must have won others. Just curious as to what finally happened, as Paul Harvey said, "The rest of the story" and it is kind of missing.

Congratulations on your lawsuit. My question to you is, could you get your sticker valuated for 2000 lb with water. With all that storage space in your basement you won't be able to haul hardly anything correct unless the sticker weight or gross vehicle weight is changed to a higher number.

Had someone here in FL get lemon Jayco special ordered. Ended up being full of leaks and other issue and got/getting run around getting fixed. Sad these companies rip people off

Yes, I loved the story, and would like to see more. Balance this with stories of good people in the rv industry. I bought Norhtstar camper manufactured by CEO Rex Willett. They have a reputation for taking care of their customers. Never had any problems. Rex did major repairs on a camper that the owner had bought used. He cares, and makes an excellent product at a fair price. You should interview RVers that have those kind of experiences also. Do not make it a commercial for the manufacturer, but told from the consumers point of view of industry people that own up to their mistakes or just want to see their product live up to their expectations.

It’s still unbelievable to me that there is poor government oversight over an industry that sells products that generally weigh and cost much more than the average consumer vehicle, yet is known for its poor quality control and flouting of safety requirements. And the fact that a large segment of their costumer base consists of older folks makes it obvious that this industry is comfortable with taking advantage of vulnerable populations. I want to be fair: not all of the folks in this industry are bad actors, but the ones who are unfortunately seem to be the rule rather than the exception. Kudos to the Smiths in this story for standing up for what’s right even when confronted by the brash, overconfident CEO who is obviously one of the industry’s bad actors. Those of us who want to continue safely enjoying the RV life need to push harder for better regulation of this industry.

ALL factory built RV’s, bumper pulls, fifth wheels, and motor homes, are all built like garbage. Roofs that require sealing every 3 months but are so week that you have to use a board to spread the weight out because the roof can’t be walked on, toothpicks or tiny aluminum tubes for “structure”, rear caps glued to cardboard, and the list goes on. We discovered this during our research for our retirement rig. We’re building a custom Class A on a 40’ diesel pusher bus chassis with 31,800 GVWR and air brakes. Thank god we found out before buying a piece of junk. Clarification: we are building the Class A ourselves on a steel exterior bus.
