I would disagree with your (and more critically the prosecutor) on your legal take of protected speech. This is NOT protected speech. Here's why: Threats to commit $exual violence are by definition the crime of $exual assault. When the $exual assault is combined with racial slurs, it combines to make it a federal hate crime. None of those things are protected by the First Ammendment. Thank God for that.

@@nw4042 Well, I'd say that the 1st Am is intentionally broad, because the Bill of Rights was drafted and ratified in that fashion, without fleshing-out language, on the presumption that the courts would deal with constitutional disputes. So there has been plenty of case law about speech. Did what was said endanger someone? If yes, were they harmed? And not just feelings. If not, would they have been safer or more comfortable or ?? had the harmful words not been spoken? If yes, how can that possibly be determined? I would have to take a look at case law in which a person has been convicted for "threatening sexual violence". Say "I will commit sexual violence against you!" shouted from a moving car or by a passing person. We can presume that the person who shouts that is a screwed-up individual. Maybe should be under enforced mental health treatment, even kept incarcerated as such in order to protect the innocent. The rest of us. But convicted of a crime? Maybe so. I'm just not sure about that.

It's called "shadowbanning." In all likelihood, nobody even reported you for anything. The youtube algorithm is triggered by certain words and phrases.
