The senior officer whose body camera this is has got some serious unaddressed anger management issues. Also something that I didn't notice before was the 2nd Lt. had his dog with him and mentioned his dog was choking on the OC he needlessly sprayed in his face multiple times. Adrenaline starts pumping when the chase starts, no matter how short the chase is its already started. So thats got him on edge, now he needs to get the suspect out of the vehicle so he uses an aggressive tone as expected after pursuit. Then the suspect has the audacity to use his veteran status to avoid the removal from the vehicle and arrest we would all be expecting after not pulling over when originally approached by police and he tries to use this excuse to a veteran of all people. I'm an officer in the Air Force who is white and these police officers never would have treated me this way. These small town cops racially profiled this Lieutenant, decided they wanted to arrest him as soon as they turned on their lights and it didn't matter what he did because they wanted to search his vehicle and prove he was a criminal. His vehicle had properly posted temporary plates in the window and he hadn't violated any traffic laws. He traveled less than a mile and just over a minute at low speeds looking for a safe place to pull over. They are just racist cops who wanted to jack up a young man of color. Fire them and charge them with assault.

When officers tell you to take off your seatbelt, they expect you to take your hands down slowly. If you do that, they have nothing to worry about. As for the door, open the door with the outside doorhandle since its a pretty common practice.

Nazario was calmly trying to de-escalate and said he was afraid to get out of the car, the senior officer literally said you should be. Cops like this need to be held accountable. Some People are saying Nazario should have listened, they should be saying the cops should have been trying to reassure Nazario of his safety if he got out. They should have been de-escalating instead of providing vague threats. They are the ones with the guns, with the power, so they are responsible for managing the situation and de-escalating.
Nazario's fear of getting out was clearly his fear of bringing his hands inside the vehicle, out of sight, to unbelt and exit the vehicle. Trevor Houff he was resisting arrest, fled police for a mile making this a felony traffic stop. Police protocol for felony traffic stops is to draw your weapon and call the occupant back. Exactly, from the moment the stop began all he had to do was get out of the car, take a knee, wear some bracelets and maybe clear up any confusion. It began as a simple traffic stop, the drivers initial refusal to comply and continued refusal escalated the situation. Up to the point the young officer put himself in harms way reaching into a suspects car attempting to help him comply but he still refused. I dont know if the officer asked if he was a specialist to see if the suspect knew the rank he was wearing or if he was making an assumption this mans rank must be by education and not by merit.

I've been pulled over multiple times on travels, even in 3rd world developing countries. None have been as terrifying as they are in the US. I will never understand why people defend this kind of behavior.

The argument would have merit only if the well-lit area is within site, which in this case, it clearly wasn't. Read the police report. The fact that the first cop wanted backup tells you this was no routine traffic stop. In addition, the Lt. refused multiple times to get out of the car. Guns were drawn after he disobeyed, not before. So the Lt. was apparently too afraid to get out of the car, but not afraid to elude police. So he wanted to be afraid when it was convenient for him, I guess. I will say, the senior officer could have kept his cool a little better and using mace in the face wasn't the best approach.

@@William14094 Police frequently recommend pulling into a well-lit parking lot for their safety as well as yours. Far too many officers are killed by passing cars who can't see them on the side of the road. Educate yourself. (It takes less than a minute to Google "where to pull over during a traffic stop" and find several sources that support this.)

It's an old execution strategy used to drive the person into a panic causing them to make irrational moves so they can have reason to execute you, hence all the yelling. Luckily this officer is in the military so he's probably used to being yelled at.
Your stupidity is amazing. When the cops tell you to do that, they mean: 1. keep your hands visible, out the window 2. leave the vehicle. Do one step at a time, and you confirm with them verbally asking if you can move your hands as you're going through each step. You obviously can't imagine being a cop. The senior officer got mad and frustrated after the LT tried to claim veteran means I am not beholden to laws as he repeatedly refused to comply with simple commands to ensure both his safety and that of the police. Now he has charges and his career is over. The LT that is. The officer did what was necessary and really, pepper spray was a deescalation. The LT also physically resisted like an idiot after he was sprayed and taken out of the car. Why make things harder? is the all around question he needed to contemplate. Cops are human and make mistakes, they are not evil though I’m sure some bad ones exist as they do everywhere but these ones are not. Was it perfect procedure, probably not but stress and adrenaline cuts out complex thought and motor skills. That’s a fact. However it was a successful procedure as no one was permanently harmed and the person breaking the law will probably not do it again considering the consequences.

You must be joking. You heard the police say it is a felony traffic stop. Right from the start the lieutenant was not cooperating. He was not obeying lawful orders. When you do not cooperate and you disobey a lawful orders what do you expect. This man is a disgraced to the military uniform. He should be busted down in rank. The cops pull him over for a "traffic violation" but never once in this video explain what violation it is. On its own this is not illegal, although arguably morally unfound. The same goes for the order to leave the vehicle. The real problem is that from the start, these cops are the ones escalating the situation. From the time they exit their vehicle, their guns are drawn on the man, making reasonable interaction between them impossible. There was no justification for lethal force to be threatened. He complied with the order to show his hands but rightfully hesitated to exit the vehicle to two cops aiming their firearms at him for reasons he didn't know. 2. Beyond all of this, the stop escalating in the first place was unjustified. Although temporary license plates should always be placed on the outside of the car, preferably where the normal plate is supposed to be, it is visible in the bodycam footage at 2:17. This situation easily could have been handled by telling the man to just readjust his temporary license plate. And again, the man never knew what traffic violation he committed anyways, so the cops are in the wrong here for not letting him know. 3. The body cam officer directly threatened the man. "You should be [scared]" is a threat. Not much else to say there. 4. There was also no obstruction of justice. No threats toward the police were made nor was there a concerted effort to prevent them from performing their duties. Failing to cooperate and leave the vehicle does not count. Criticizing them does not count either. If he were to say something like "If you take me out of this car you'll regret it," that would count. But he didn't. Keep in mind this is everything wrong with the interaction _ignoring_ race. Can you seriously, with CONVICTION, tell me that any of this was justified?

The insignia on Army uniforms has been in the center of the chest since they first started using the Army Combat Uniform in 2004. The only branches who still display the rank insignia on their collars are the Marine Corps and the Navy depending on which uniform they're wearing. So it is very possible that the seat belt was blocking the rank insignia. Also, all of the branches stopped using the DoD base registration stickers, so that wouldn't have been a dead giveaway of an officer either.
By emphasizing rank, as if it would be different if the person was a lower or higher rank, you help participate in the same thing that is behind the damaged psychology of many police. A government issued badge that puts someone in a class higher than others who are not of that position affects that person psychologically as if he/she is more human than those below the rank. It doesn't matter that the man in the car is a military officer or a military enlistee. He is being abused by someone who thinks that his own societal rank of a policeman means he is more human than those who do not wear that same badge.

The only time I have ever been pulled over was in Windsor over a decade ago. I vowed to never even drive through the place again. It was the worst experience I've ever had with a police officer. I was horrified when watching this that this young man might end up dead. I was admittedly speeding when I was pulled but I was also screamed at and made to get out and lay down on the road by the officer who pulled me over and then cuffed and told to stay there while he went and ran my information. I remember retelling the story to other friends who were from other PDs and them being in disbelief that I would get that treatment over a speeding violation (I was going 11 mph over the limit...and I was, I didn't fight it at all and completely complied, I knew I was in the wrong for that part) He came back uncuffed me, told me to get in my vehicle and then did a lot of talking about the ticket he was giving me but I was too in shock to even pay attention and I signed it. I ended up not even going back there for my court date because I was honestly scared to...I just mailed them the fine and moved on. It's clear that there are serious problems in this department that need to be investigated and that they possibly need to clean house and do more training about how to deal with the public. the treatment this member of our military received was disgraceful. I hope these officers, especially the senior officer here are held accountable. What a horrible role model for the younger officer as well. The whole situation could have been avoided if they had approached with a little more common sense.

Specifically, I think the older cop is at fault for aggravating the scene. I think one of the most telling thing about this entire interaction is Daniels. I don't know anything about this case, but Daniels looks new. His behavior and even the way he holds his gun and follows after his superior, makes it appear that he's pretty new to this. This reason is RIGHT HERE is why police brutality is such an issue. The superior basically showed the rookie that they can get away with most things and get out just fine, despite that action being wrong. In fact, at 4:09 you can even see that Daniels sorta gets in front of his superior and tries to get Nazario out himself because he knows that it won't end well. He's basically telling Nazario, "Dude, this will not end well, just do what he says because you'll be the one to pay the price."
And yet he did nothing to help. He was the first one out of his car with his weapon drawn. Systemic issues that’ll never go away without a complete reform. This is pure trash.

If he pulled over in a darkly lit area they could’ve claimed he moved to fast and shot him. Even in a well lit area they could still make that excuse, hence why the veteran said he was scared to open the door. This is obviously an abuse of power, and even the younger officer doesn’t seem comfortable with what’s going on and is just following the older officers lead. It doesn’t matter what the veteran did, he was fucked no matter what and in the wrong according to the cops, who to some people should never be questioned no matter what, which is complete bullshit by the way. It’s as simple as, the older officer was bored that night, found a black man in a military uniform driving, and thought “hey, if I pull him over in this dark area I can shoot him and claimed he moved.” There are many cases of them being bored and doing stops like this, afterall, in this case they pulled guns on him supposedly because he had a malfunctioning light.

As a Brit I used to be critical but having your guns ready is necessary for them if they face such a threat or they are a sitting duck. Daniel is a Good Man. I worked with him on the Fire Department and he always did everything he could for victims or patients; no matter their race or gender. He's always wanted to help the community. The other officer in charge failed to de-escalate the situation. I will put fault on the LT too; he did right pulling into a well lit area but after that he didn't.

The gun came out after the first cop had called for backup because the driver wasn't getting out of the car after being asked many many times. But you didnt see that part because it was not on the bodycam.

Kenneth McKlinski every time a police officer pulls over a person it could be his last stop. They all know this. Cops want to get home safely too. When people don't follow orders it takes the control out of the cops hands and that's not something they ever want to occur.

When your job is dealing with assholes that lie and steal and cheat and break laws day in and day out and you have to scrape bodies off highways and fill out reports over and over again from domestic disputes at the same home or apartment. Then you come tell me how well you handle difficult situations when people give you shit about getting out of the car when you told them to based on the needs of your job to conduct your procedures.

This guy was acting like he was under active threat, gunshots bouncing off his car or something, not pulling over a vehicle because he couldn't see a plate. This was not what should be expected of a trained PO.
Looks like he did not stop and they had to follow him with their sirens on for a while and then he refused to get out of the car. All this makes the police have to handle it this way. Again people bring this stuff on themselves!

I have a friend who just had felony resisting and assault of an officer charges dropped because none of the half dozen officers had their body cameras turned on during the encounter. This guy is actually lucky he parked in a well lit area and cameras recorded the encounter. Just a few years ago he’d probably have been shot dead without a question asked.

It's perfectly reasonable to avoid taking any action that could potentially look like you might draw a gun when having guns pointed at you. When the officer is getting out of his car he states it's a felony traffic stop? From what I understand they stopped him because they said he was driving a car without a license plate...but they say you can see it taped in the back window.
He lead them into a pursuit. Wtf do you think happens automatically when you fail to stop for the police. FELONY STOP! The cops have no choice but to conduct a felony stop. It's standard operating procedure. Cut the shit. This is ridiculous!

This is because there have been so many incidents of criminals posing as police, as well as the many incidents of police raping and/or murdering suspects on lonely, darkened roads. It took this guy less than 2 minutes driving at the speed limit to pull into the gas station. Hardly the actions of someone committing grand theft auto.

What about the safety of the officers? Most pursuits, high or low speed, are initiated by the suspect to create an opportunity to get rid of evidence (drugs, alcohol, guns etc. ) cops have to assume the worst case scenario or they end up in the mourge. The senior officer needs to be fired - not suspended. The rookie was probably afraid to say anything to contradict the senior officer. If the city is smart - they will pay this man and then charge the senior officer and have him arrested immediately

Couldn’t see the tags tapped inside the tinted window. Technically improper display of vehicle tags. Took him over a minute and a half to pull over which is why the felony stop was performed.
He was pulled over for driving a vehicle popular with people of color. Let's not fucking pretend there was any other reason, because there certainly was not.
Not getting out of the car after being told to for 3 minutes straight is a universal sign of non compliance. The other circumstances don't matter one bit. He was repeatedly given orders to exit the vehicle, doesn't matter if his hands were up outside of the window, doesn't matter if he was talking calmly. Not following orders is resisting arrest and obstruction of justice. Criminals regularly pull this type of non compliance behavior. If you think the cops are wrong, it's not for you to sort out in the moment, it's for you to sort out afterward with a lawyer. They only let this guy go because they were doing him a favor, because if that arrest ended up on his military record, he would be punished for it by the military. They were trying to save his career in the military by not charging him, and he turned around on them and tried to feign wrong doing. Non compliance with their orders justifies everything they did. This wouldn't even be a story had the man gotten out of the car when he was asked to the first time. And this is why nothing will happen. The ultimate result is this driver probably gets tried by the military and gets dishonorably discharged and loses his pension / benefits, all because he thought he could game the system to get a pay day.

@@dropthexd3277 Put your hands up and get out of the car doesn't mean you need 4 arms. When a cop tells you to get out of the car, that means they're expecting you to make movements with your hands. If he was worried and wanted to be safer, all he would need to do is say, "OK, I'm getting out, but I need to reach down to open the door". Simple as that. As a military officer, he should have known how to behave like that better than a regular citizen even. But no, he was REFUSING to get out of the car, creating a situation where he could feign he was the victim, and a situation that caused officers to become even more stressed, because then they're wondering why he isn't complying, and if that means he's building up the courage to make a move, like quickly turn to grab a gun from inside the car. The longer he doesn't comply, the more he's convincing the police that he intends to do something crazy. You ever consider that criminals act a certain way to create doubts about their arrest? Police deal with all the crazies, they've heard and seen every excuse, every attempt to not comply. And when a cop see's a guy in a soldiers uniform breaking the law, then they have even more reason to be on edge, because breaking laws like that has serious consequences in the military, and more capability/training than a normal citizen. So as a cop, you'd have to wonder if there's a reason why that guy just changed lanes in the middle of an intersection and blew a red light. That's about the most dangerous way you can cross an intersection. Then you have to wonder why this guy claiming he is a military officer, is stalling and isn't complying with commands.

Pretty sure that's not standard procedure for a 'traffic violation'. These cops should be held accountable for treating people like that and the overbearing one throwing the tantrum needs some anger management classes. I'm thinking policing is not something they should be involved with.
