Breaking News: Nar Lawsuit Introduces New Rule For Home Buyers - Contracts Required Before Viewing!

The NAR lawsuit settlement introduces new rules for buying and selling real estate. These new nationwide rules require buyers to sign a " buyers agreement" prior to touring homes. YES...out with the old and in with the new as things are changing in the real estate purchasing process due to the NAR lawsuit. Home sellers can continue to pay broker commissions, however, they can no longer advertise the commission amounts in the multiple listing system. And buyers will need to sign a buyers agreement stating they will pay broker commissions if the seller refuses to cooperate. The agreement is also necessary for touring homes in this new settlement. It's expected that buyers agents will have to "CALL" the list agent in order to find out if the seller will cooperate. ( aka share the list agents negotiated commissions)

Good luck getting the title company to write your contract, negotiate the terms, hold the seller accountable for performance, hold any lender accountable for time frames, perform inspections and contingencies... and title companies will not show you homes. You can act on your own behalf and if you know real estate law, consumer finance law and of course your rights under the contract, ( including your performance) perhaps you could navigate a sale. Lisa, I think the "for sale by owner" segment of the R/E Market is going to expand. The contract signing requirement is going to discourage people searching for R/E. I also think the "All Cash" buyers will have better negotiating leverage in a R/E Market which has changing dynamics....The timing of this legal change could not have been worse for hard working Realtors like yourself. We would never pay a buyers agreement. Simply call and schedule with the listing agent. The For sale by owner business will really take off.

Except you may still need to pay the LA..the LA in that capacity will transition to a transaction agent and if the seller still doesn't want to pay them for being your agent then you may still have to pay them.

@@JoyDoesStuff As a seller, if you decide to do a For Sale by Owner (FSBO) you will not be paying an agent, and as a buyer, if you decide not to use an agent, you will not be paying an agent. YOU CAN conduct the entire transaction without an agent. And as per the NAR website itself, it clarifies that buyers are NOT always required to sign an agreement before being given access to a house for sale.

Thanks for the info. I've been a FL Realtor since 2003. This new system will make thousands of Realtors drop their licenses, they will stop paying $880 a year to Realtor Associations. Recession will put many Agents out of service too. HOA rising 40% plus, high txs and insurances going up 100% only the rich will keep their homes.

From the Buyer's position this will KILL a lot of 1st time Homebuyers who can BARELY come up with the DOWN-PAYMENT, CLOSING COSTS, TRANSFER TAXES and now THE REALTOR'S 3% COMMISSION!

@@KAZHE63 Spring of 2028 is when the real bargains will begin to be available. In 200+ years, since the land speculations of the early 1800s, it’s never been different. The cycles are 18-20 years. The up cycles average 12 years. Down cycles Peak to trough average is 4.6 years. Depending on whether you want to assess the timing from the nominal peak, the ‘real’ peak, use new home pricing, existing only, or the combo, you will get a different end point. But they all point in the same direction…down. And they all point to a time frame of 2027-2029. So take the midpoint and you get spring of 2028. It’s been memory holed. But the real estate market was in trouble in 2019. And if it hadn’t been for the repo crisis and a massive liquidity injection, followed by helicopter money the cycle would have played out as it always does. But all of that plus massive govt intervention and interference has delayed the inevitable.

You technically don't need realtor representation considering the contract the realtor prepares goes for attorney approval. Assuming the attorney is vested real estate attorney and has approved multiple contracts, you can simply rely on the attorneys find judgment and get the contracts approved or better yet go with a FSBO setup. thus creating a win win for the buyer and the seller.

I guess banks will have to change the way they do preapproval letters. I always looked first and then if I committed to buy, my bank would do the preapproval specified for that property. I have looked at a lot of properties online that looked great in the pictures, then when I saw it in person...it was sh*t. I think it's a lot of extra hassle for potential buyers. I've always bought with contracts that had the seller pay closing costs. I guess it does weed out non serious buyers, but to sign a contract just to look...I don't like that.

Well they can do this now, but buyer beware. Sellers may not be forthcoming with deferred maintenance or any issues that may materially affect the value of the home. When you use a list agent they require you to disclose everything.

@@TheRealLivingWithLisa I thought those issues were covered under state laws - even 'as is' laws. Realtor can only 'disclose' what they are aware of ... ... Seems a good inspection professional, title company and an attorney could safeguard the buyer. Maybe I'm wrong, but that's how I purchased a FSBO; I came in with property inspector, title research and my attorney wrote a contract (then I offered that $$ amount below what they were asking) and already had financing lined up (paid it off in 8 years btw).

I would always ask the buyer to sign a Buyer Agreement and I can't tell you HOW MANY times the Buyer's would refuse and next thing I knew they went to another agent who made the commission. THIS is a GOOD thing for Realtors! No more wasting your time with the "tire kickers"

Well, maybe the realtor didn't gel with the client (personality) or just didn't listen to what was being asked for - as in the case of my son - asked for 3 bedroom 2 bath - really hard, right? Kept showing him 4 and 5 bedrooms or larger 3 bedrooms 1 bath with a 2nd added on as an afterthought. After 4 days of wasted time looking at these 'wrong' homes, he finally asked, point blank, why? She state they just didn't have any of what he was looking for in inventory! Talk about wasting time - he went to another realtor and she lined up 3 houses - one of which he purchased. We deduced first realtor was looking for bigger commission. Not a 'tire kicker' .... any recourse / contract for purchaser's time?

@@samsonabraha9536 that is not true. Realtors are your best source of values. If the list price too high and then the home just sits in the market? Double work for us too! The prices increased because of the inventory, lots of listings, the price goes down, few listings, the price goes up.

I got out of RE back in the late '90s when 'buyer agents' were just really becoming a thing; I only did commercial at the time. Glad I got out - commercial sell/lease was heck for me - my broker was who kept gypping my commission .... I didn't feel like getting my broker license so just got out. All is good, I purchased FSBO with my 'team' and an attny and it was a great experience; paid it off in 8 yrs. Hope this works out for all you folks.

To depend on the Seller's agent to set up an unbiased inspection, survey, comp review, to dig into the property taxes and be honest about the neighborhood, HOA and such when they are representing the SELLER and not me, the buyer, is NUTS. Especially if you're moving into an area 8 hours away from where you currently live and know nothing about the property history, condition and HOA. I'm looking at 20 acre properties in the western part of the state, some with dwellings and some raw land. I need a buyer's agent to do the leg work.

It's not a good rule in my opinion as it hurts buyers. Open houses is all you can view in this scenario,. And yes, you can have a lawyer draft your contract... just expect to pay for and and all revisions. Thank you for your comments.

It’s about time this finally changed. Why should a seller have to pay a 6% commission? If someone is selling a 500K home why should they have to shell out $30K? Buyers need to pay their own agents. Great news for sellers. 🎉

LOL, they buyer is going to offer you less now. Its not going to work. They buyer did not earn 300k in equity, you did. Think about that. It's hard enough selling a home today, making a buyer payer a fee was not smart and could potentially make it unaffordable. ill be looking for a home sold by owner and just need a lawyer.

You are dreaming. Shoppers who might have turned into buyers in the past just won’t bother. In the end, this means less traffic, less closed deals, and lower prices over time. The bottom will be brutal when it arrives in 2028 or 2029. What’s funny is that this settlement is exactly backwards. The sellers agents are mostly useless. It’s the buyers agents that do the real work and provide the most value.

@@Pelican5077 I may be dreaming but I’m still not paying for someone else’s realtor. A buyer can always try the next house in the list. I have my own problems to pay for. My price is firm and it will stay firm. Buyers have to sign a contract with their own agents now so that’s a step in the right direction. I’m not giving anything away. I’m not running a charity. @@BillyMartin68 Good morning. We live on our sailboat, so no dog in the fight. I don’t disagree with your position. If I owned a property, I wouldn’t be keen on paying for someone else’s realtor either. But you’re missing the point. Once these changes are in effect the ultimate harm will be to sellers. Less traffic. Less looks. Fewer offers. What does a sellers agent do. Fill out some forms. Take some pictures. Suggest a price. Maybe do an open house. And wait. They are not proactively looking for buyers. And, many of them are using this change to raise their prices. 3% is going to become 4%. Or more. You may think you have a ‘price’. And maybe you do, maybe you won’t sell unless you get that price. And that’s fine, as long as you have no reason to sell. But when the market turns, and it will, because it’s never been different, not in 230 years, and you find your equity melting away, you may be wishing that buyers agents were more plentiful and bringing traffic to your door. real estate agents just list house or show to prospective buyers. They CANNOT give legal advise, draft contracts. They only work as coach and help to get in contact with some people and coordinate with them in order to get their compensation. They work for the seller not your interest as a buyer. That’s the reason buyers beware in real estate transactions.

yeah and they take a huge sum just for nothing, thee seller pays out of the house they sold which fyi cripples some buyers especially now, I would be more than happy to give the discount to a buyer especially a first time buyer than some greedy realtor who just stands there looking stupid. why do we need them ..we dont they are all shady over paid over inflated egotistical idiots for the most part

at least in NY I can retain an attorney for the transaction As buyer’s agent and draft the contract, at least I feel like the person is going to conduct a due diligence. The first house I bought my attorney was very adamant of the whole deal, 🙄I told him, I want the house and close on it. 🙄It was a money pit with tenants from hell. 13 years later I got rid of the headache 🤕 The attorney was right.

New England, sales are down, but median home prices have reached all time highs. i’m glad you lived through the 2008 recession. I lost about 40% dumping a 2nd property in 2014, that I bought in 2006 but values never recovered in location Hey, survived too. hope to cash in to Florida for property, but that’s another roller coaster. 😂

I sold my condo in April and am riding this out in a rental for a while. Not necessarily cheaper but no worries with taxes, maintenance and insurance. Will reevaluate in a year

Whaa whaaa. The NAR settlement is a good thing as it actually restores "true" fiduciary agency......something that present day "Realtors" rarely, if ever, employ. The "transaction broker" monster created by NAR in the early 90's never served either sellers or buyers yet still remains the Realtor relationship of choice to this day. It is and always was a bad idea that lowered the standards of a so-called real estate professional. Embrace the new old concept of Agency.

I will just use the listing agent, as I always have, I have found that the buyers agents are not what they claim they are. They don't care about you, just the money.

Hmmm. I'll look into this one of my son is in the market for a house in Laconia New Hampshire where he lives he just got pre-approved from a mortgage company that gives them the paperwork to go to any open house where he can even make an offer. He's the last one in my house that needs to buy a house and we'll take any advice we can get. Seems like my whole family is moving out of crazy Massachusetts because we're spending 50 million a month on illegal immigrants in our taxes are going crazy.

he doesnt need to use a buying realtor the realtors are manipulating information by playing on buyers now and telling them oh its awful but...tell your son to go to the house hes legally allowed to represent himself sans buying realtor and any seller will welcome him and also be happier to give him the discount instead of being forced to give it to some buying realtor . buying realtors are crooks its hard enough to pay the commission to s selling realtor never mind a buyers realtor on top of it

So there is no set commission rate for this Buyers Contract, correct??? No more set rates, that was what the law suit was about. As for purchasing all the information is now on the internet, a savvy buyer can look up the properties history as well as what has sold. Scary now for agents...sorry this happened as sellers always paid...

Any agent who is a member of any MLS has to comply.. so the list agent will be required to have you sign it. You can sign it and ask the agent to negotiate with the seller to pay it.

yes thats the whole point of this lawsuit. buying realtors where getting a huge payout from the sellers and they complained and sellers actually won the court case. you dont need a buyer realtor you never did all you need is a title agent which by the way you still needed even with a buying realtor as the buying realtor cant do much more than show you home and fill out a buyers offer form its smoke and mirrors and was a big game for realtors to make more money but the games up. seller will be happier to give the buyer a discount than these greedy realtors

There will be an additional form for you to sign when selling.. just saying if you’re willing to share the commission with buyers agents.. and you should. Because buyers really can’t afford this and you”re not giving an agent a reason to show the house if not.. we will just have to call ahead to find out if your willing share compensation. Which comes from the buyer anyway.. they are the reason you’re making profit.

it will save you half the commission and doesnt affect you at all, if you hire a realtor to sell your house then the buyer now has the choice always had actually ..to come see it without a buying realtor make an offer and go forth from there. so dont let any realtor tell you different. this lawsuit was won by sellers that where being extorted for commissions from listing and buyers agents in order to sell and they put a stop to it. its called unfair trading and it was getting out of hand as they where making sellers give extra to a buying agent to lure a buyer to buy a house just so buying agent could get commissions and 10s of thousdands extra..its corrupt and its now been dealth with

This will save Sellers and Buyers thousands per year. Realtors finally have to do their job if they want to get paid. Sellers should reduce their asking price and buyers should only pay their realtor by the hour. Don’t be deterred by “greedy” realtors needing to work to get paid. CHANGE IS GOOD!

The seller should always pay there own realtor commission. If your In a good position to sell and the buyer is usually stressed to make the monthly mortgage payment. I agree the seller should pay.... the number one question is.... where does the seller get his profit? THE BUYER. ( without a buyer no profit) ..... so, will buyers choose homes where the seller pays the fee. Realtors will call the list agent to find out and provide this information to the buyer and the buyer will choose which homes they want to see.... I'm interested to see what buyers do with this change. I think buyers will have a bigger influence on which homes sell.

There will be an additional form for you to sign stating whether or not you are willing to share compensation with the buyers real estate agent. Buyers are the reason you would make any profit on your home.. agents will call ahead to find out if you’re willing to compensate before they make an appointment with you to see the house. Obviously they’ll tell their buyer if you’re willing to compensate this could have an effect on whether the house is shown.. the buyer may pass if they know they have to pay. Basically you can’t publicly advertise the broker compensation.
