Here's the thing though: he did not take into consideration that police and EMT's rather not have to scrape his brains off the windscreen or asphalt. That is a rather traumatic thing to have to do. So not wearing a seat belt when driving is a rather egocentric thing to do.

Seat-belts do more than protect the driver. By keeping them secured in their seat, seat-belts help keep drivers from losing control of the vehicle during certain conditions or situations. For example, if a minor collision causes a driver to slip from their seat, they may be unable to brake or steer the vehicle, resulting in real harm to other individuals. A driver may not care if their own headlights or windshield wipers don't work, but not having them endangers others. It's the same for not having the driver secured to the driver's seat.

you can also be thrown into a canal and drown because of the seatbelt or vehicle caught on fire and burn because of seatbelt and it has happened, I think this is an invasion of privacy by the gov. What's next are they going to send somebody to your house to see how much salt you put on your food ?

I agree with the first guy, it should be our decision whether or not to wear a seatbelt. The seatbelt law didn't come into play until the 80's if my memory serves me correctly? The reason for the passing of the seatbelt law wasn't to protect you or I, but for a way to accumulate money into the judicial system period!

I once was the passenger in a Hyundai Accent, (read: Accident"), which backed into a van at 40 KMPH. Thank God indeed I was wearing a sea-belt. I would have gone through the windshield. Fasten up everybody, Faten up!.

It seems that a lot of accidents in the news where someone died has the line "they were not wearing seatbelts." He has kids, grandkids and great-grandkids; why not buckle up for them?

Seatbelts should be a personal choice. The government acts like they care, but all they want is to control what we what we do. I've personally have witnessed my friend died while wear the government strap aka seatbelt. My friend burned to death because his seatbelt jammed on impact and we couldn't get it unhooked. My sister got third degree burns trying to save him.

That guy who has issues with seatbelts has issues with his attitude as well. Saying that he was flagged down because he is driving a mercedes is insinuating something negative. I hope he learns his lesson/s.

It's more to save money on deaths and stuff. So they force you to "protect yourself" so they can protect their pockets. But that also seems like a likely idea as well

I agree with the seat buckle argument. He's not hurting anybody else by not wearing it. If he gets hurt, then he should pay the medical bills. It's his decision if he wants to take a risk. Buses don't have seat belts, but nobody get a fine for that, and there a many more people who can get physically hurt. I ride a train to work. No seat belts. What happens if the train stops abruptly and people get thrown into each other? That has happened. Nobody seems to complain about that. It should be your decision if you want to take the risk. Please buckle up? It's not your decision if I want to risk hurting myself.

My logic is that putting your seatbelt also protects other people. Like if you are in a minor accident and you need to regain control of your vehicle after someone hit your car, for example, then you would probably be able to do that if you had the seatbelt. But if you didn't have it, even from a minor accident you might hit your head or something and lose control and hurt other drivers or pedestrians.

I live in rural TX. A couple weeks ago 4 members of a large family were driving to a small town for a child's sporting event. A car going the other direction lost and control and hit them and several more vehicles. Grandpa was driving. Mom was holding her 4 week old baby. A 2nd grader was also in the vehicle. No one was wearing a seat belt. Rest of the family was in a different vehicle not involved in the accident. Baby was killed. Mom suffered a very long list of injuries, requiring emergency surgery to remove spleen and stop internal bleeding. She required multiple surgeries in the following days. Both grandpa and the other daughter required surgery for their injuries. Due to the remoteness of the accident, airlife had to be called out to transport the family to the hospital. If that baby had been in a car seat, she would still be alive. The injuries probably would be as severe if everyone had been wearing their seatbelts. 4 children almost lost their mother, she remained in ICU for days. That family is from a very small town. Lots of folks were impacted by their decision to not buckle up. Not wearing a seatbelt doesn't just affect you. It can affect everyone who knows you.

Well, seat belt is not only safety for yourself but also having no seat belt can eject you from the vehicle during the crash and may lead to another irrelevant accident on the road.

Honestly, I agree with Mr. Summerville. Someone shouldn't be punished for putting themselves, and only themselves, in danger. Everyone should have the right to not wear a seatbelt so long as they are the only passenger in the car.

The first man not wearing his seat-belt should watch a few tow truck videos, and see some of the wrecks caused by other people, that the victim driver walked away from without injury because they wore their seat-belt especially when the victim is hit so hard the car jumps the guard-rail and rolls down an embankment, etc. I understand the man's logic however, it should have been explained to him that even in an accident, wearing a seat belt could help him maintain control of his vehicle. I'm glad the judge did explain to him that wearing a seat-belt could help save his life in an accident, and the judge should of added, possibly laying in the hospital for weeks in agony. ////// All in all I enjoy this judge, we should have more like him in our judicial system.

Hogwash. You can make that argument about anything to justify controlling every aspect of people's lives. The government is not responsible for protecting people from themselves. If you give the government that power, then the government will tell you how long to sleep, what to eat and drink, what to wear, how to live.

We pay taxes for the roads we pay taxes for the ambulance we pay taxes for emergency care and now we have to pay insurance to drive and the cars belong to us and our bodies belong to us. Yet we are ordered to wear a seatbelt in order to drive on our own roads. This is really a violation of our rights

The first man's argument is valid and really compelling. The idea of forcing people to protect themselves against their will is a real challenge to deal with. The main thing the judge should have focused on is not just the injury or death risk being taken away from the individual. He should have focused on the cost to the community and others if the injured cannot or does not pay for medical care once injured.

Wearing your seat belt is the law for obvious reasons. However, you cannot be pulled over for not having your seat belt on, alone. In most states, if not all states, you can only be charged with the seat belt violation as part of another offense.

Inspector Quinn was not in favor of that first guy getting off without paying court costs. I think I agree because a law abiding person, as he said he was, should have shown up in court when he was notified. But the judge thought otherwise, okay. As for wearing a seat belt, I don't think I would know how to drive without being buckled up. It's not only the law but also very wise. The young Falcons fan was brave to come into court dressed that way but he had good sense of humor and took the abuse in a humble way. That was fun.

I love watching these shows. We learn alot!! Go Pats!! I used to live in MA for 12 yrs. My favorite place except for the winters. I'm Syracuse born and bread. Have severe arthritis I don't miss that snow!

The government should learn to butt out and stop trying to run everyone's life. Judge Caprio has a point in that he administers the law but does not make the law, and I like that he seemed willing to listen and understand the defendant's point, even if he does not agree with it.

Seat belts .. for not make ambulances, hospital rooms and accidents department busy .. There are many patients who need help and hospital rooms and an ambulances .. Put on the seat belt in order to provide to whos needy these services greeting from saudi arabia

Summerville should have paid the $35 too. Refusing to wear a seatbelt, not showing to court, he thinks he is doig nothing wrong and no respect infront of the Judge. I would have fined him more than $75.

Being thrown through the windscreen of your car doesn't stop there. Someone has to pick up the pieces; take you to hospital (or the morgue); and then work hard to help you get better from your own stupidity. So, it's not a simple case of 'if I want to hurt myself, I should be able to' as others will have to deal with the aftermath.

The thing is, if the seat belt guy was to be thrown from the car in an accident, it does affect other people. He could fly into oncoming traffic and cause another accident. Paramedics would need to scoop him up from wherever he lands and try to save his life. He could land over a cliff or off an overpass where they are at risk trying to rescue him. Not to mention the heartache he'd cause his family and all that normal stuff.

I don't know if the judge reads the comments, but in regard to reasons for the seatbelt law, there are times when an operator not wearing his seatbelt in an accident may be knocked out of position where if he was belted in, could maintain enough control to keep from hitting another vehicle or pedestrian, so the seatbelt does save other people from serious injury.Not to mention the additional cost to first responders to deal with more serious injuries of the bozo who wasn't belted in responders. Unfortunately, due to the Dunning - Kruger effect, these selfish daredevils are incapable of seeing these issues past their righteous indignation.

I hope the judge sees this, 24 years of not wearing a seatbelt. I’ve been in 3 major accidents. Never been hurt, I’ve seen many ppl wearing the seatbelt get hurt, we have airbags that replace the seatbelt

Your Honor, I agree with you about the seat belt law. However, I know of one situation where a person I know would have DIED, if she had her seat belt on. She hit a guard rail which peeled the roof off of her car like a giant can opener. If she'd had her seat belt on, she would have been decapitated.

Seabelt law makes sense in a country where healthcare is free as if you injury yourself because of lack of seabelt then you'll cost lot of money to get threated. However in US healthcare is NOT for free hence if I injury myself in a car accident because I didnt wear seabelt, well it's my business

Did I hear that right??? $50 for 16mph over??? Wow... that's a $250 ticket where I am. I'm constantly shocked by how cheap the ticket prices are down there! And seatbelt violations are $115 here!

But, I can assure you sir that you didn't get that ticket because you were driving a Mercedes. I got the same ticket while driving a Kia. Moreover I lived in Liberia for five years. If I got into a taxi that had a seatbelt, then be assured that I would put it on!

I don’t think there should be a monetary price to pay for not wearing a seatbelt, instead there should be a mandatory 1-2 hour class where they talk and give examples of seatbelts saving a life. At least for first time offenders. This in my opinion would teach people why it’s important to wear them, instead of seeming like the parents that justify everything by saying “because I said so” and facing punishment for not obeying.

Seatbelt law is to give the cop a reason to search your car and frame you plus to give money to the government for nothing. I have been in three car accidents. The first two were before this law and I didn't wear my seatbelt. I didn't get a scratch. The third one I was wearing my seatbelt and I went to the hospital with a broken collarbone plus many other problems.

the issue is if you get hurt form not wearing a seat belt that is is your fault, but you are hurting others because who has to pay to deal with your injuries or worse your funeral? well? the insurance/your family/tax payers

As a fire fighter in Australia I have been to a lot of car accidents. Seat belts do save lives in some cases. There have been many accidents I have been too were of the driver wasn’t wearing one they actually would have survived. One thing people also tell you is yes it may save you life but in a lot of them the damage the seat belt does is extreme in cases. Thing to take out of this though is drive responsibly and safely

Summerville is smart - seatbelts are good IDEA but terrible LAW. As a surgical nurse, having seen the injuries inflicted and lives destroyed by seatbelts. There's actually a diagnosis for seatbelt injuries - SBIS or Seat Belt Injury Syndrome - crushed pelvis, shredded internal organs, multiple surgeries, INTENSIVE rehab, infections, MILLION $$ medical bills, and all the fun of ostomies and bags. But yes you are alive - the final injury of SBIS. NOT FOR me - I just take each ticket (I think it's 68 now - haven't had one in a while - but I've had one in 38 states now) as a badge of honor and a cost of personal freedom. There is no diagnosis (as a group) for injuries caused by not wearing a seatbelt. BTW - 46 years driving - never a seatbelt - never an at fault collision - never an injury.

Initially the first guy's argument sounds ridiculous but when you actually think about it it's a tricky one. Yes it is the law to wear your seatbelt while driving the argument that it should be a personal choice is a somewhat valid one. I personally always wear my seatbelt as it makes me feel safer while driving but if an individual feels like they don't want to wear one should they be punished for making that choice? It's hard to say but hey it is the actual law already so we can't change that.

In the first court case the the gentleman said he wasn’t hurting anyone by not wearing a seatbelt. One of the reasons it’s important to wear one is to prevent passengers from being injected from there seat or even there car, in the case of an accident. If that were to happen it can make a situation worse then what it actually needed to be.

seat belt is a choice (free will) should not be a code by States to punish people for making their own choice. Codes or Laws should not infringe on personal choice. I wear mine, but that is my choice. What if the code or law was changed to wearing a seatbelt was in violation of code or said law. No man/women has the right to tell another man/women what to do with their own life. Seatbelt law (code) is nothing but a way to bring in revenue under the blanket of "We Care For Your Safety". It's BS

The first guy is annoying me. Is it sooo hard to just put the seatbelt on? It’s like a 1 second job... and it’s not all about you. If you get thrown out the window when you hit me, I’ll might be injured because of your negligence...

Yes sure if he thinks that its better not to wear the sseatbelt he shouldn't be given treatment if he's hurt when involved in an accident and its proven he wasn't wearing a seatbelt!

The seatbelt law is good but I don't believe the punishment for that law should be a fine. The best way to scare someone whose not wearing a seatbelt is to make them watch a video of accidents where the participants are not wearing their seatbelts. Watching the bodies fly out of the car would scare anyone! I ALWAYS buckle up automatically before I even start driving, even if I'm only going a few blocks down the street. Seatbelts take a second to click into place and have SAVED my life in an accident when I was t-boned at 50 mph. Everything that wasn't secured down in the car went flying in all different directions. I shudder to think that could've been me, had I not worn my seatbelt!

Won't work on some people. I personally know people that have been in bad accidents and they still refuse to wear their seatbelt. Some have had their lives saved due to a seatbelt, but won't wear one unless they are driving. I don't get it.

Still if you would not have a seatbelt, and someone crashes their car into you, and you fly out of the window and u get injured or even dies, then the person who drove into you will suffer from more since you would probably have survived or got less harmed by the crash.

What the judge didn't mention is the effect of poor driver judgment on insurance rates. Before the seat belt laws, it was common for insurance companies to arbitrarily raise insurance rates for any individual with a record of harm caused by not wearing seat belts. When national statistics were eventually gathered and published on this subject, showing that most people didn't use seat belts, insurance companies were given the magic green light to raise rates. But, along came seat belt laws and premiums fell.
