This show is usually pretty good on procedural stuff, but a homicide prosecutor would never EVER be handling a low-level stalking case. It would have been stalking in the fourth degree, a class B misdemeanor which is the lowest level misdemeanor. With no prior record, anyone charged with it would have walked out with a fine. And it would have been handled by a new prosecutor and pled out at the arraignment. But I know they wanted to make it interesting.

This situation is sadly not uncommon. I work with Schizophrenia patients, many are very vibrant, intelligent, and coherent people when they are taking their medications. Eventually, they will stop taking the meds, or first, they try to cut down or forget a dose. In the end, they stop altogether and decompensate. Then they end up on the street muttering to themselves or worse, becoming violent. Then they are back in the hospital or jail. They end up in a psych ward back on meds and then they get let out. This guy was a psychopath. Even on meds he was determined to get around justice and likely do it again. Criminally insane.

Always cncerned me how the technical definition of legal insanity was "the inability to comprehend or appreciate the impact of one's actions". This is also basically the textbook definition of sociopathy-- the inability to feel attachment or remorse. What *legally* separates someone who is just living in a wild alternative universe from someone who is just a dead- sober cold blooded predator? Both conditions are technically mental illness.
@antmagor

@ayacachotinemi4974
@ayacachotinemi4974 3 месяца назад
It's not the same thing. A sociopath understands that what they're doing is viewed as wrong by society, they just don't care. A person who is legally insane (whether through schizophrenia or some other delusional illness) falsely believes that what they're doing is justified because the person they attack is some kind of threat to them or others. Or they're just completely incapable of understanding that they're harming someone.
@trout512
@trout512 3 месяца назад
There's a very fine line between "I can't care because I don't understand what I'm doing" and "I can't care because I don't care about others". You can't really make the argument that they're the same. It might seem like splitting hairs, but the devil's in the details. Someone in a psychotic episode isn't capable of following all the rules of society, they have other, often non-existent stuff they're dealing with. Violent sociopaths don't have that problem. They're fully capable of following the rules, they choose not to. It's also important to note that a lot of sociopaths lead completely normal, law abiding lives because it's more conductive to their own goals to avoid social rejection. Childhood trauma and other environmental factors have a lot more to do with how likely anyone is to act aggressively, regardless of diagnosis.
