Actually, most lawsuits are based on factual information. But I understand your point. You are speaking of the legal maxim that truth is a complete defense in defamation actions. While this is generally true, in North Carolina and most states, defamation cases can be brought based on factual information under a narrow set of circumstances but a layman, not trained in the law of torts, would not be expected to know those limited common law exceptions.
