There are no debtor's prisons in the United States. If a creditor or collection agent tells you otherwise, they are misleading you and probably violating federal law.
This does not mean you should ignore aggressive bill collectors. If you owe money you can't pay, you are at risk for getting sued, and eventually facing wage garnishment, bank account seizure and liens on your property.

Yes it is, but you need to play their game to open new doors. Places like Rent a center is a scam in it self. You pay 3 times the price just because of interest. Mine as well use a credit card and go to the actual source for the product. That way you only pay interest on the credit card. Credit cards shows your track record. Every one will say yes to you if you're responsible. Avoid all Rent a center clones and just pay at an actual store. My wife bought a dog. The original price was only $300 dollars. Why she didn't pay it straight up I don't know. She paid way more because she had no idea interest was building up. If you got the cash just straight up pay for it. Yes credit cards are scam but Rent A Center clones are worse. Use a credit card and pay interest on one thing.

I was a judgement victim in 2002, former MBNA came after me for not paying a credit card debt. I was so glad to see that joint go when it was sold to Bank Of America in 2006; also a bunch of assholes

Can you be thrown in jail for not paying a credit card lender? The answer is "no" with a few very limited exceptions.

I need your help I just got a letter in the mail saying I owe td bank over 2 thousand dollars. Somebody did a credit card scam with my card and now I owe the bank money I did not take out and I am being told that I could face time in jail. I don't know what to do and I certainly don't want to get arrested for something I didn't do. Can you or anyone please help me

I will say this. You can go to jail as a secondary consequence of not paying a debt. Be mindful if you get sued show up for court. If you don't a bench warrant can and is issued for you in some states.

What if you moved out of state since 2008 & never received a summons but out of the blue you get a phone call threatening you about going to jail for fraud purchases, want a certain amount of money to pay off in payments? You tell them because the economy crashed finally found a job at $9.00 an hour, & still say that you ignore a summons when never received anything & we have lived in Illinois for 8 years, the county that is coming from in Wisconsin is 15 miles away. So he he got scared & made arrangements.

They have to prove you were served. However, that is done at you hearing after bench warrant is issued. The only people that can garner your wages with out going to court are federal student loans, IRS, and in some states debt that was created from a USDA mortgage program. The last I have only heard of. Pretty much companies deliver summons via you local police. They in some states do not have to hand deliver, but cab leave on your door.

Yeah but what about tbe income you put as more to what you had to boost income to get better odds at getting approved for a credit card? My family did that a lot in the past telling all of us it helps to get approved for credit cards. Now that they are in hard times and years and years paying on time for the cards they had to default them all. Now near 6 to 8 years later they are getting calls from collectors saying to prevent then from filing the lawsuit they better pay up 700 down and monthly payments or a settlement in cash lower than principle owed or they will file a lawsuit for two counts of credit card fraud and prison time for lying about income. How does that work?

+BLUExEYEDxSLICKT - fraud can be either civil (money damages) or criminal. If you misrepresented your income in order to obtain credit you could have a fraud problem. I would suggest that you speak with a criminal defense lawyer to discuss this risk. In a bankruptcy context, I have seen lenders file objections to discharge and/or the dischargeability of a specific debt on the basis of fraud. I also think that a bill collector who is using the threat of criminal prosecution to collect a debt may be in violation of the FDCPA, but that is a different issue. This video was about the consequences of not paying your debt. You can't be thrown in jail for not paying a credit card debt but that assumes that there is no fraud in the application. Again, I would not assume anything until you discuss your specific situation with a criminal defense lawyer. Generally credit card companies are much more interested in money than in prosecuting anyone, so you should be able to work something out. For future reference, however, use accurate numbers on credit applications. Good luck.

Jonathan Ginsberg, I was taken to jail for failure to pay a bill by Sears more than 10 years ago. I have been paying $25 a month all this time. I think I still owe $1,000. The original bill I think was around $2,500. I'm telling u this 2 let u know that u can go 2 jail.

no jail, more than 100 k debt and judgement was made against me then i move to another states with my wife.I am like a free bird now.My suggestion is just dont pay this crook ...thing u need to do is just change the cell num and move to new states then u will be all set .

So u are telling me if i all of a sudden i max out my 38 cards with $200,000 credit line and don't pay (i have about 7 grand to my name) and i am on SSDI on about $800 a month....they will not throw me in jail?!?!

No, there is no debtor's prison in the US. Now if you intentionally max out your cards when you know that you have no hope of repayment that could edge into civil or criminal fraud territory and, if criminal fraud, you could face incarceration.

Process is pretty simple really. If you owe one company a lot of money, say $2k and up, you quit paying. They will probably sue you after about 18 months or so of ignoring them. You will get served with court papers, usually a cop. Letting you know you are being sued. After this you got maybe a month or two to come up with the total payment. I wouldn't recommend going to trial, as you will always lose and trial means extra court fees. If you got a car that is worth anything, they will take it. If you got absolutely nothing and you don't work, they could put you in jail. If you got nothing but do work, it's wage garnishments, at a percentage till you pay off the debt. If your debt is like under $1000, they will probably just write it off. You will keep getting settlement offers, like pay it off for $150, and you are clear. But then you get IRS to tax you on that as if it is income. So if they write off 850 as a loss, you have to report it to IRS as income

***** They can jail you and there are workarounds. And credit card companies are using them. You will get a summon to go to court and answer questions about your financials. Refuse or lie= jail term. If they find out you had the money to pay the debt, but refused to do it, = jail time. If you lied on your credit card application about your income = jail time.

+Y10Q - A couple of corrections. Lawsuits are served by sheriff's deputies, not cops. Second, you can't be put in jail for not paying a debt. Third, unless your car is worth a lot of money, the creditor is not likely to go after it. Wage garnishment, bank account levy and real property liens remain the biggest problems associated with unpaid lawsuit judgments.

jimmy roberson - At best, that would be (civil) fraud - incurring debt with no intent to pay it back. At worst, it could cross over into bankruptcy fraud territory, which is criminal in nature. Either way you could not discharge such debt in bankruptcy.

I am going to a hearing for a $7,000 credit card debt with Bank of America next week. I own a 18 year old car my question is will they take it after the hearing or at any time. I live in Florida.

@Steve Burton Well I guess 7,000 wasn't worth the lawyer showing in person. He did call in and I guess that was allowed. He was very nice and I mentioned that it was actually $5,000 not $7,000. The Judge asked if he had papers showing the amount that he could fax over and he did not. So she put everything on hold until December 12th when we will return. He was to send me papers showing the owed amount. Judge claimed if I had to have a judgment put on me better yet if it was not 7,000 but 5,000. The attorney did indeed send papers showing what I owed but it is dated January of 2018. This was in 2016-17. I would like to see original debt in correct amount in the right year. So I will ask for that again at court. What else could I do. Im also considering claiming not guilty as I did ask BOA to debt the account once the money was but in it and they never did. This was in January of 2017. I also was with them and had their credit card for years. Was never late and PAID IN FULL most months !! Instead they closed my account and sent me my money in a cashiers check. I called numerous times asking why and no one knew why. I have had bank account since the 1970's and never had a problem with a bank or a bank not wanting my business. Whole thing is just strange. Well i'll no more this week.

Let me give you guys a little story. I had 50k USD in credit, bought 50k worth of goods to start my business overseas(New Zealand) I shipped the goods, started my business and return to the USA every year and still buy goods, but now I use cash and credit that I now have built up in New Zealand. Debt does not trasnfer from USA to NZ. This happened 10 years ago. Nothing happened and nothing will ever happen. I sent an email to the CC company immediatly after I shipped goods and moved and told them I can no longer pay the debt and never sent them another email again. Its simple and I will do it again. In the USA there is no such thing as Debtors prisons and also CC debt is not linked to immigration or coming in and out of the country. The CC companies can kiss my ass and anyone telling me its not right can kiss my ass too. I now have over 100K in credit with mastercard and visa in NZ and that is proof that Countries do not share credit reports. PS. Thanks for the 50k free loan USA CC companies.
