This was very confusing, I think some visuals would help for the future. Also, seems silly Canva would have logo designs if people can’t actually use them. What’s the point? Canva marketing commercials and ads even shows businesses easily designing their own logo with Canva.

Thank you so much for this valuable information! I have a bachelors degree in art, and this just reaffirms that I should use my own creative artwork!

This was incredibly helpful. Thank you. I knew something was fishy when I watched videos of people using Canva templates, changing the color, and fonts and then uploading them to Etsy. You answered all of my questions.

Yes template designers know clearly that you must ALWAYS start from a blank page if you are selling Canva templates.

Nice presentation of Canva legal issues. Custom design is always better. So create your own design using Affinity or Photoshop or some other graphics program then upload to Canva. Then use your personal design to create a unique item to sell. I think this is better then using Canva's graphics and you don't have to worry about someone outright stealing your concept as easily which is a huge problem with Etsy. Now that Etsy has gone full AI, people can now steal your design with the greatest of ease. You need to integrate more in your design or get a Trade Mark which is expensive because copyright isn't going to do it in my opinion.

I am trying to get into the business of KDP and related books items. Basically, pint on demand at this point. So, my heavy concern has been what elements can I use on Canva? Seems the more 100% original, the better, only using Canva for putting the exterior and interior together. However, it does seem that we can use some of the fonts and related elements to give color and look to our production. But then again, how much can I use of their letterings, shapes, and colorings? If you don’t mind, would appreciate a short thoughtful answer. Thanks very much and thanks for the video…

If i use different fonts, images, elements and/or color, all put together to create a design, is that design allowed to be used commercialy then, as in can I sell it on a tshirt?
@Aperfumeaddict

So essentially, as long as I’m using their elements to create something new by changing the colors, adding fonts, or incorporating other elements to make something completely different it’s ok to sell with the pro account?

from the canva website: Print-on-demand (POD) scenarios Scenario 1: Jon wants to create t-shirt and mug designs and sell them using a print-on-demand (POD) service. Jon uses a mixture of graphics and fonts to create his original designs. This is allowed.

I cannot find anything about the use of free Canva elements by the US Government. I make pamphlets, printouts, etc. for a leader development course that I teach as a federal government employee to other government employees. I am not selling it, but it is something that the government plans to use internally on training materials (and not sell). Is this allowed? It is so hard to figure out and because I work for the government and we need to make sure we're following the law to the letter!

So... if I understand correctly, I have the Pro account... I can't have an element in my logo, but can I sell a notebook with that element on it? Can I use an element to create a sticker? And then sell it? There is no change made to that element except for the colours maybe and the outline/shade to make a border... that would be illegal right? Thank you!
@thelegalpaige
@thelegalpaige 2 месяца назад
1. You can have an element in your logo from Canva, but you wouldn't own that logo or be able to trademark it since its not a unique, original mark. 2. If you merely use an element from Canva to create a sticker and sell it, that would likely violate Canva's T&Cs.

I’ve bought some PLR templates recently to try and get the cogs turning in my mind with creating journals and planners, and yeah, some of them have had premium elements from Canva included, giving me the option of buying the rights to the element, signing up for premium, or download a watermarked copy. As I only want them for inspo, it’s no big deal, because I’m an artist and designer and want to design these things from the ground up myself, but I do wonder how the legalities work in terms of people using it for PLR and MMR designs using Canva templates and elements… Do you have any thoughts in specific to this?

How to create a design in canva so I can resell it. Or how designs allow canva to resell.

I’m sorry but this was really confusing. First of all, what do you mean with templates. What’s the difference between templates and design? SO I can’t use a template to create a workbook and sell the workbook to my customer or use it on my retreats? Isn’t the whole purpose of a workbook to be use commercially direct or indirect? Why do they have workbook templates and why am i paying for pro if I can’t sell the products I’m making with Canva? Without using their templates Canva is useless.

Templates are pre-made, already designed and available to you in canva. Design is something you make in canva from scratch. On your own.

In a nutshell, you’re not allowed to use any templates if you want to sell the end products unless you’re using the free elements … that’s what Canva customer service told me.
@thelegalpaige
@thelegalpaige 2 месяца назад
Let me clear up any confusion. 'Templates' are the pre-made templates under a Canva pro account when you click on the 'Design' tab. These are done-for-you graphic templates made by Canva for you to use for your own business. You cannot use these templates, tweak them, and then sell those templates to others. If you want to SELL an ebook template, social media graphic template, presentation template, etc. then you need to start those from a blank page in Canva. In your situation, you can absolutely use a workbook template for your retreats, because you aren't selling that template to them (you're printing it out with your own business information on it for them to use at the retreat).

This is an issue currently before the US Copyright Office regarding how much of the totality of the final work of art needs to be created by you versus AI for it to be considered an actual copyrighted work owned by you. My legal take: when using AI in any capacity on Canva you run the risk of not fully owning that work.

Hope someone can answer this, I'm just confused. What if I'm commissioned to make an invitation for an occasion and I use a Canva template to make invitations is it illegal?

What about low content books selling on amazon? Is it possible to use the outline design elements as coloring book items?
@RoseannLowe-n6c
@RoseannLowe-n6c 2 месяца назад
Seems that I’m not the only one confused. So, here’s a very common scenario; let’s say a person purchases a template design from a website like Creative Market THAT IS EDITABLE in Canva and comes with a commercial license. The seller of the template provides a link to the template which opens up in Canva. The template text, images, and content is changed within the template using either free Canva elements or third party properly licensed elements. Can that new / altered version of the template be resold leagally? If this isn’t legal then I think the entire digital download business model will end once the Canva lawyers start to prosecute. Thank you.
@thelegalpaige
@thelegalpaige 2 месяца назад
You can totally use that template design you bought on Creative Market that opens up in Canva for your OWN business. But, you wouldn't be able to resell that template to others. That would actually violate the seller on Creative Market's copyright ownership over that template.Canva wouldn't be involved there because it's not their copyright ownership at issue.

@@thelegalpaigeBut Creative Market and many other sites sell Canva templates with licenses to be used commercially and re-sell? As the original poster said this makes no sense.

Here's an example! Say you want to create 3 social media template graphics to sell to your audience. You CANNOT go into Canva -> Design -> Templates and take one of those templates and very slighty tweak it with different colors and fonts and then go sell them to others. You CAN start from a blank square and use various elements, colors, and fonts to create a totally original social media design and sell those templates to your audience! Hope that helps!

easier said then done though (unless I'm totally wrong). I want to use Canva elements to create educational worksheets. For example, if I used the elements of a cat, hat, mat, and rat with the related words next to them, I can't just create my own dog, cat, rat, and hat from scratch as I'm not artistic. That is why I need the pictures that Canva or other webisites have. Am I missing something?

If I pay for that design, I do what I want with it! If it is illegal to sell them, then @Canva should not offer premium subscription!

1000%. I linked Canva Support in the description. Written confirmation on whether you can or cannot sell something you made on their platform is the best option.
